Subject: Rescission of Award and Award of Construction Contract to VVD Dear City of Commerce,
Energy Smart Group hereby rescinds the construction award previously made to Energy Smart Group and recommends that the City of Commerce award the EV charging station construction and installation contract directly to Video Voice Data Communications (VVD).
VVD is the designated installer and supplier of the ChargePoint EV charging stations for the City of Commerce project. To help ensure the equipment is properly installed, commissioned, and eligible for applicable manufacturer warranty coverage, the City should work directly with VVD, a certified installer that has completed the required training and is familiar with the ChargePoint equipment being provided.
Additionally, the City’s approximately $119,000 Communities in Charge rebate was submitted utilizing VVD’s contractor license, EVITP certification, and other applicable contractor qualifications and certifications associated with the project.
Energy Smart Group acted as the City’s EV charging and rebate consultant during 2025 and assisted in developing the project and securing available incentive funding. ESG’s scope of work is now 100% complete, and there are no outstanding payments. Going forward, the City of Commerce will work directly with VVD for all construction, installation, commissioning, and charger activation activities.
