RESOLUTION 2026-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA DECLARING CERTAIN REAL PROPERTY OWNED BY THE CITY AS “SURPLUS LAND” PURSUANT TO TE SURPLUS LAND ACT AND DIRECTING STAFF TO TAKE NECESSARY RELATED ACTIONS.

WHEREAS, the Surplus Land Act (“SLA”) codified under Government Code Sections 54220 et seq. applies when a local agency disposes of “surplus land,” as that term is defined in Government Code Section 54221; and WHEREAS, Government Code Section 54221 requires the City of Commerce, prior to the disposal of land, to declare the land either “exempt surplus land” or “surplus land” by resolution at a regular public meeting; and WHEREAS, the City of Commerce (“City”) is the owner in fee simple of those certain real Properties in the City of Commerce located at 5440 Telegraph Rd., Commerce, CA 90040 (APNs: 6336-023-910, 6336-023-911, 6336-023-912, 6336-023-915, 6336-023-916, 6336-023-920, 6336-023-921, and 6336-023-922), composed of eight (8) parcels at one site, and described in Exhibit A, attached hereto, and made a part of hereof (“Properties”); and WHEREAS, under the Surplus Land Act, Government Code §§ 54220-54233 (“Act”), surplus land is land owned in fee simple by the City for which the City Council takes formal action in a regular public meeting declaring the land is surplus and not necessary for the City’s use. The land must be declared either exempt surplus land or non-exempt surplus land; and WHEREAS, under the Act, land is necessary for the City’s use if the land is being used, or is planned to be used pursuant to a written plan adopted by the City Council for City work or operations; and WHEREAS, the Properties are not otherwise being used by the City; and WHEREAS, City staff has evaluated the Properties for their potential to be used for City work or operations, has determined that the Properties are not suitable for the City’s use, and that the Properties are non-exempt surplus land; and WHEREAS, the City Council desires to declare that the Properties are surplus land and not necessary for the City’s use and are non-exempt under the Act; and WHEREAS, the Act requires that before the City Council disposes of the Properties or engages in negotiations to dispose of the Properties, the City shall proceed to dispose of the Properties pursuant to the Act; and WHEREAS, the City Council finds that declaring the Properties as surplus and proceeding under the Act is in the best interest of the City and its residents.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMMERCE DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:

SECTION 1. The City Council of the City of Commerce hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution.

SECTION 2. The City Council finds and determines that the above referenced Properties are not necessary for the City’s use and are hereby declared to be “Surplus Land” pursuant to Government Code Section 54221(b). The City Manager, or his designee, is directed to proceed with the notification and negotiation requirements set forth under the SLA to facilitate the possible disposition of the Properties.

SECTION 3. The City Council authorizes the City staff to prepare and transmit a written Notice of Availability for the Properties in compliance with Government Code Section 54222.

SECTION 4. The City Council finds and determines that approval of this Resolution declaring the Properties as Surplus Land, is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15061(b)(3) (the “Common Sense Exemption”), in that it can be seen with certainty that there is no possibility the approval will have a significant effect on the environment. The action also does not constitute a project under CEQA Guidelines Section 15378(a), and none of the exceptions to categorical exemptions set forth in CEQA Guidelines Section 15300.2 apply. Additionally, the declaration of surplus land is a purely administrative and legislative action that does not authorize any development, demolition, or construction. Accordingly, the action is further exempt under CEQA Guidelines Section 15378(b)(5), which provides that organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment are not considered projects.

SECTION 5. The City Clerk shall attest and certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. This Resolution shall be effective immediately upon adoption.

PASSED, APPROVED AND ADOPTED this 28th day of July 2026. _____________________________________
