A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA, APPROVING AGREEMENTS WITH 19 QUALIFIED CONTRACTORS FOR ON-CALL MAINTENANCE, REPAIR, AND CONSTRUCTION SERVICES IN AN AMOUNT NOT TO EXCEED $100,000 PER CONTRACTOR PER FISCAL YEAR AND RATIFYING THE PREVIOUSLY EXECUTED AGREEMENT WITH SIEMENS INDUSTRY, INC. FOR HEATING, VENTILATION, AND AIR CONDITIONING MAINTENANCE SERVICES IN THE AMOUNT OF $120,375 FOR THE INITIAL ONE-YEAR TERM WHEREAS, the City of Commerce ("City") is responsible for maintaining its public streets, sidewalks, pavement markings, landscaping, irrigation systems, municipal buildings, and related infrastructure; and WHEREAS, these responsibilities frequently require specialized contractors with the appropriate licenses, equipment, personnel, and availability to respond to routine, urgent, and emergency maintenance needs; and WHEREAS, the City issued separate Requests for Proposals through PlanetBids for pothole repair, asphalt patching and paving; concrete and sidewalk repair and replacement; electrical maintenance, repair and installation; heating, ventilation and air conditioning ("HVAC") maintenance; landscape and irrigation maintenance; pavement striping, roadway markings and curb painting; and plumbing maintenance, repair and installation; and WHEREAS, the City received interest from contractors specializing in the respective service categories, and staff evaluated the contractors based on qualifications, experience, personnel, technical capabilities, responsiveness, pricing, and the ability to perform public works subject to applicable prevailing-wage requirements; and WHEREAS, staff recommends approving agreements with the 19 qualified on-call contractors identified in Exhibit A, attached hereto and incorporated by this reference, in an amount not to exceed $100,000 per contractor per fiscal year; and WHEREAS, should an approved on-call contractor is unavailable or unable to perform the requested services, staff may assign the work to another approved on-call contractor, even if its annual contract amount exceeds $100,000, provided that total expenditures remain within the department’s approved budget; and WHEREAS, the on-call agreements do not guarantee any contractor a minimum amount of work or compensation, and services will be authorized only through individual written work orders supported by available funding; and WHEREAS, the City's HVAC equipment requires continuous preventive maintenance and timely repair services to support the safe and reliable operation of City facilities; and WHEREAS, while the broader on-call maintenance agreements were being finalized for City Council consideration, the City required Siemens Industry, Inc. ("Siemens") to continue providing essential HVAC maintenance services, making immediate execution of the Siemens agreement necessary to prevent a lapse in maintenance coverage and reduce the risk of service disruptions, equipment deterioration, and increased repair costs; and WHEREAS, staff recommends ratification of the previously executed Siemens agreement in the amount of $120,375 for the initial one-year term, with four optional one-year extensions, for a maximum of five years, subject to applicable Consumer Price Index adjustments during each extension year; and WHEREAS, no additional appropriation is required at this time because costs incurred under the agreements will be funded through available appropriations in the City's adopted operating budget.
