SUBJECT: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COMPTON ADOPTING MITIGATED NEGATIVE DECLARATION 951

AND MITIGATION MONITORING PROGRAM AND APPROVING
CHANGE OF ZONE CASE NO. 2021-003 REMOVING THE PARKING
(P) ZONING CLASSIFICATION AND ZONING THE SITE 100% LIMITED COMMERCIAL (CL) FOR THE PROPERTY LOCATED AT 930 WEST

COMPTON BOULEVARD

SUMMARY
The City Council will consider a request to approve Change of Zone application Case No. 2021- 003, a request to remove the existing Parking (P) zoning leaving the site as 100% Limited Commercial on a 2.45 acres Successor Agency owned lot located at 930 W. Compton Blvd.

BACKGROUND
On May 11, 2022, the Planning Commission held a public hearing on the above-listed request. After due consideration, the Planning Commission voted to not recommend approval to the City Council of Mitigated Negative Declaration (MND) No. 951, the Mitigation Monitoring and Reporting Program (MMRP) and Change of Zone Case No. 2021-003. The project also is requesting approval of a General Plan Amendment, Conditional Use Permit and Tentative Tract Map.

PROJECT DESCRIPTION
The City Ventures Company is requesting approval of Change of Zone Case No. 2021-003, a request to remove the existing Parking (P) zoning leaving the site as 100% Limited Commercial to develop a gated 60-unit three-story condominium community. The site is a vacant 2.45-acre successor agency owned property located at 930 W. Compton Blvd. (southeast corner of Compton Blvd. and Kemp Avenue).

STATEMENT OF THE ISSUE
The project is requesting a zone change to remove the existing Parking overlay zoning (P) on the southern half of the site resulting in a site with only Limited Commercial zoning (100%). The proposed zone change will give the site a single Limited Commercial (CL) zoning that permits high density residential development (29 units per acre) with a Conditional Use Permit.

A Mitigated Negative Declaration was prepared for the project. The Initial Study/Mitigated Negative Declaration No. 951 was posted with the Los Angeles County Clerk’s office in Norwalk, circulated for a 20-day public review period from November 16, 2021 to December 5, 202. The proposed project will not cause any negative impacts.

2.2. Staff Report – City Council Change of Zone Case No. 2021-003 and MND No. 951 July 5, 2022

Mitigated Negative Declaration:

1. That in accordance with the California Environmental Quality Act (CEQA) (Public Resources Code, Division 13 §21000 et seq.) an Initial Study for the project was prepared that identifies and evaluates the environmental impacts of the project.

3. That the notice of intent along with the Initial Study/Mitigated Negative Declaration No. 951 was posted with the Los Angeles County Clerk’s office in Norwalk, circulated for a 20-day public review period, mailed to abutting property owners and posted on the City’s website.

4. That all environmental documents have been processed in accordance with the California Environmental Quality Act (CEQA) guidelines.

5. That the approval and subsequent implementation of the proposed project will not have the potential to degrade the quality of the environment with the implementation of the conditions of approval.

6. That the approval and subsequent implementation of the proposed project will not have the potential to achieve short-term goals to the disadvantage of long-term environmental goals with the implementation of the conditions of approval.

7. That the approval and subsequent implementation of the proposed project will not have impacts that are individually limited, but cumulatively considerable, when considering the proposed development in the immediate vicinity with the implementation of the conditions of approval.

8. That the approval and subsequent implementation of the proposed project will not have environmental effects that will adversely affect humans, either directly or indirectly with the implementation of the conditions of approval.

Change of Zone

1. That the removal of the Parking (P) zone resulting in a 100% Limited Commercial (CL) zone will be in conformance with the existing Limited Commercial zoning on the site and the new general plan land use designation of General Commercial. The GPA will achieve a higher level of consistency between the General Plan and Zoning map and have one zone on the lot.

2. That the change of zone removing the Parking (P) zone and leaving the site as Limited Commercial (CL) is more suitable for the subject site in that the zoning will be consistent with the project and existing land use patterns of development in that higher density residential use proposed will be consistent with the Limited Commercial zone.

3. That the change of zone removing the Parking (P) resulting in a 100% Limited Commercial (CL) will not be detrimental to the surrounding area in that the site is already intended for medium density residential development. The proposed zone change will allow for a slightly higher density and will serve as a transition development from the heavily trafficked Compton Blvd., eliminate blight, develop a vacant successor owned site and provide additional affordable housing opportunities, result in a single zone for the lot and help encourage additional redevelopment in the area.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMPTON RESOLVES:

Section 1. The City Council adopted Mitigated Negative Declaration No. 951, made appropriate environmental findings, and adopted a Mitigation Monitoring and Reporting Program for the Project. The documents and other material that constitute the record on which this decision is based are located in Department of Community Development the and are in the custody of the Department of Community Development .

Section 2. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, the remainder of this Ordinance shall remain in full force and effect.

Section 3. That this ordinance removing the Parking (P) zoning classification, leaving the site as 100% Limited Commercial for the property located at 930 W. Compton Blvd. is hereby adopted and shall be in full force thirty (30) days after the date of its final passage and adoption by the City Council.

Section 4.That a copy of this Ordinance shall be filed in the offices of the City Clerk, Building & Safety and Community Development Department (Planning).
