become inconsistent with the General Plan and or Zoning, as a result of the City approving the specific plan. The proposed specific plan land use district overlay will prevent this and permit the property owner to have the option to use the base general plan land use designation and zoning or choose to utilize the provisions of the TOD-SP overlay designation.
The proposed Specific Plan overlay is limited to City initiated specific plans. Individual projects proposing immediate development like the KBK project will be required to amend the General Plan and Zoning map to immediately apply the SP land use designation and zoning directly to their property as a base land use and zoning designation.
To create the overlay district designation, the current General Plan Specific Plan land use goal #3 will be amended as follows:
Specific Plan Land Use Goal (Existing)
3. Specific Plans within a quarter mile of either the Compton or Artesia stations shall facilitate transit-oriented developments including residential, commercial, hotel, and recreational uses that bring people to the Downtown and or serve as a Downtown as destination points for the region and catalyst for the further revitalization of and investment in the area.
Specific Plan Land Use Goal (Amended)
3. Specific Plans within a up to a half mile of either the Compton or Artesia stations shall facilitate transit-oriented developments including residential, commercial, hotel, and recreational uses that bring people to the Downtown and or serve as a Downtown as destination points for the region and catalyst for the further revitalization of and investment in the area.
The Specific Plan land use designation in lieu of being applied as a base land use designation can also be applied as an “Overlay District” designation. This overlay district specific plan designation shall only apply to area wide specific plans that do not propose a specific project. Presently, it is envisioned that this overlay designation will only apply to the Compton Station TOD-specific plan area, but could be applied in other areas. Figure A shows the limits of the Compton TOD-SP overlay district.
Environmental Review:
In accordance with the California Environmental Quality Act (“CEQA”), California Public Resources Code, Division 13 §21000 et seq., The City of Compton in its capacity as Lead Agency, has determined that the proposed general plan amendment is exempt form the provisions of CEQA in accordance with section 15061.
FISCAL IMPACT
There is no direct fiscal impact to the General Fund that will result from the adoption of the attached resolution. The proposed general plan amendment establishes the TOD specific plan overlay district only and does not propose any development or use of City funds.

October 18, 2022
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: CITY MANAGER AND CITY CONTROLLER
SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON AUTHORIZING THE CITY MANAGER TO AMEND THE 2022-2023
FISCAL YEAR BUDGET AND APPROPRIATE FUNDS IN THE AMOUNT
OF FIVE HUNDRED THOUSAND DOLLARS ($500,000) TO FACILITATE
USE OF PROFESSIONAL CONSULTANT SERVICES TO FACILITATE
HIGH-RISK AUDIT REPORT CORRECTIVE ACTION PLAN
SUMMARY
The purpose of this item is to act on a Resolution to appropriate funds and amend the Fiscal Year 2022-2023 Budget to utilize funds from the American Rescue Plan Act (ARPA) to address priorities recommended by the State Auditor of the State of California through utilization of professional consultant services in the fields of legal, financial, software, and human resource services. This item will authorize funding to be appropriated, but selection of contractors will forward to Council at a later date as needed.
BACKGROUND
After authorization by the Joint Legislative Audit Committee (JLAC) in 2021, the California State Auditor’s Department issued an Audit Report to the City of Compton on October 13, 2022, which includes audit findings and a Corrective Action Plan required to be completed over the next two years. The findings and recommended actions are serious in nature and pose significant financial and legal risks if not properly and efficiently addressed. The State Auditor Report took months of investigation, including numerous hours of investigation by the State Auditor staff across a large set of City departments and City officials. The Corrective Action Plan recommendations have been diligently prepared by the State Auditor and should be regarded with the utmost seriousness.
STATEMENT OF THE ISSUE
It is imperative that the City address the concerns in the report in a timely fashion and avoid negative progress reports by the State Auditor that may be reported to the State Legislature. In order to take these actions, the City needs to hire a number of consultants with expertise in these matters to help implement these directives. Staff is proposing a budget amendment to spend ARPA funds to immediately address the corrective action plan items required to be implemented this fiscal year. Staff will return with future funding requests in future fiscal years to address the remaining items and timelines identified in the report. Failure to take immediate action will jeopardize the City’s ability to address the Corrective Action Plan and the stated due dates and will risk further involvement of the State legislative.
7.7. Staff Report – Resolution Approve Appropriation of Funds and FY 23 Budget Amendment October 18, 2022, page 2 of 3
The use of ARPA funds includes a category of usage to pay for ongoing City services that the City revenue would have ordinarily paid for and had the funds for if the pandemic had not occurred. In the allowable category of “Lost Revenue Due to the Pandemic,” the City has calculated that it has lost approximately $13M. The calculation followed the formula which was prescribed by the ARPA legislation in Federal Register / Vol. 87, No. 18 / Thursday, January 27, 2022 / Rules and Regulations 4401.
