TO WAXIE ENTERPRISES, INC. DBA WAXIE SANITARY SUPPLY FOR

THE PROCUREMENT OF EQUIPMENT AND SUPPLIES ON AN AS-

NEEDED BASIS FOR THE GENERAL SERVICES DEPARTMENT
($50,000.00)

SUMMARY
This resolution will authorize the City Manager to issue a purchase order to Waxie Enterprises, Inc. DBA Waxie Sanitary Supply (Waxie) for the procurement of equipment and supplies on an as-needed basis for the General Services Department not to exceed $50,000.00.

BACKGROUND
The General Services Department (Department) is responsible for the maintenance and general upkeep of the City of Compton’s thirty-one (31) facilities that encompass administrative buildings, park facilities, fire stations, service yards, and leased properties.

Due to the high daily usage of City facilities, staff utilizes various supplies and materials in large quantities to keep and maintain all of the facilities in an orderly fashion. The ability to efficiently order materials and maintain supplies is paramount to the Department’s operation. Waxie equipment (paper towels, soap, and tissue dispensers, etc.) and products (toilet tissue, paper towels, air fresheners, etc.) have been installed and utilized in all City facilities to provide uniformity in appearance, quality, and to uphold cleaning standards. In doing so, the dispensers and supporting equipment for these products only fit Waxie products and this purchase order will allow staff to ensure all facilities are property stocked with sufficient supplies at all times.

STATEMENT OF THE ISSUE
The Department is requesting an exemption to the City’s standard purchasing procedures and authorizing this request as a sole source procurement as Waxie’s equipment is designed to only operate within their product lines. The City currently has Waxie’s equipment installed throughout its facilities. Consequently, Waxie is the only qualified vendor that can provide these products.

1.1.1. Due to the City’s daily demands, staff is requesting the ability to efficiently manage multiple procurement requests by combining the requests for equipment and supplies on a single resolution in an amount not to exceed $50,000.00.

FINANCIAL IMPACT
Funds for Fiscal Year 2022-2023 in the amount of $50,000.00 are available in the General Services Department’s 2022-2023 Fiscal Year budget in the following Account Number:

UPDATE AND HYDRAULIC MODEL CALIBRATION ($35,094)

SUMMARY
Adoption of the attached resolution will approve an amendment to the Water Department’s Fiscal Year 2022-2023 Budget, transferring funds from Fiscal Year 2021- 2022 Budget, and authorize the City Manager to issue a purchase order in the amount of Thirty-Five Thousand Ninety-Four Dollars ($35,094.00) for AKM Consulting Engineers Inc. (“AKM”) for engineering services in preparation of the Water System Master Plan Update and Hydraulic Model Calibration.

BACKGROUND
The Compton Municipal Water Department (“Department”) is an Urban Retail Water Supplier providing water services to approximately 80% of the incorporated City limits.

The water system consists of approximately 156 miles of water mains, 1,000 fire hydrants, 1,000 valves, 8 water wells, 2 water storage tank locations with 5 storage tanks total and 1 booster pump station.

AKM Consulting Engineers, Inc is a multi-disciplinary professional organization that specializes in providing exceptional quality engineering and related services to public agencies. The City retained the services of AKM to prepare the Water System Master Plan Update and Hydraulic Model Calibration. On September 14, 2021, the City Council adopted Resolution No. 25,551, and the professional services agreement between the City and AKM was ratified and a purchase order was authorized in the amount of $35,094.00 from funds appropriated in the Department’s Fiscal Year 2021-2022 Budget.

Although, the agreement was executed by the parties, it was discovered that inadvertently a purchase requisition was not completed in Fiscal Year 2021-2022, thus funds were not encumbered for this expenditure.

3.3. Staff Report – Water Master Plan, AKM Consulting
December 20, 2022, Page 2

STATEMENT OF ISSUE
The engineering services consists of preparing the Water System Master Plan and providing two (2) pressure data loggers for tracking reservoir levels, Meter Masters for tracking water use at 8 wells, retrieving and processing the data, and using it in calibrating the hydraulic model.

Staff seeks Council authorization to amend the Department’s Fiscal Year 2022-2023 Budget, in Account No. 5000-900-000-4262 in the amount of $35,094.00 to issue a purchase order for this completed project.

FINANCIAL IMPACT
Funds for this expenditure in the amount of Thirty-Five Thousand Ninety-Four Dollars ($35,094.00) was allocated in the Department’s Fiscal Year 2021-2022 Budget in Account No. 5000-900-000-4262. However, at June 30, 2022, funds lapsed and fell to fund balance. Therefore, staff is requesting that an appropriation from fund balance be made and an amendment to the Department’s Fiscal Year 2022-2023 Budget be made to Account No. 5000-900-000-4262 for $35,094.00, which is required for this expenditure.

Currently the fund balance for the Water Enterprise fund is approximately, $15 million, and therefore there is sufficient funds to appropriate the needed $35,094.00 for this expenditure. Additionally staff is asking for a purchase order to be authorized for the amount of $35,094.00 to AKM Consulting Engineers Inc in order to move forward with the project.

RECOMMENDATION
Staff recommends that the City Council adopt the attached Resolution.

December 20, 2022
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: MUNICIPAL WATER DEPARTMENT
SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON AMENDING THE MUNICIPAL WATER DEPARTMENT’S 2022-2023

BUDGET FOR SEVEN MILLION NINE HUNDRED EIGHTY-EIGHT
THOUSAND DOLLARS ($7,988,000.00) OF AMERICAN RESCUE PLAN

ACT FUNDS

SUMMARY
The City Council will consider a Resolution amending the Municipal Water Department’s 2022-2023 Fiscal Year Budget for Seven Million Nine Hundred Eighty-Eight Thousand Dollars ($7,988,000.00) of American Rescue Plan Act Funds.

BACKGROUND
On March 11, 2021, the President of the United States signed into law the American Rescue Plan Act (ARPA) of 2021. The legislation provides $1.9 trillion in funding to address the economic impacts of the Coronavirus (COVID-19) pandemic, which included $350 billion in federal fiscal recovery aid to state and local governments. The City of Compton received approximately $34 million in aid as a result of the ARPA.

The U.S. Department of the Treasury has adopted guidance regarding the use of ARPA funds. According to the guidance, recipients may use ARPA funds to invest in necessary improvements to their water infrastructure, including areas that address the impacts of climate change. Recipients may also use this funding to invest in an array of drinking water infrastructure projects, such as building, repairing or upgrading facilities and transmission, distributing and storage systems. Recipients retain flexibility to identify those water infrastructure investments that are of the highest priority for their own communities.

On May 10, 2022 City Council approved Resolution No. 25,662, which authorized the City Manager to amend the Department’s 2021-2022 budget to appropriate $7,988,000.00 of ARPA funds to the Department’s operating budget. The appropriation was intended to fund various capital improvement projects that will upgrade the Department’s aging infrastructure. The Department is currently seeking to move forward with the capital improvement projects; however, the previously approved ARPA funds in the amount of $7,998,000.00 need to be reappropriated from the Department’s 2021-2022 budget to the Department’s 2022-2023 operating budget, in order to begin the process.

4.4. Budget Amendment ARPA Funds – Municipal Water Department December 20, 2022
Page Two

STATEMENT OF THE ISSUE
The Department will dedicate these funds to improving the water system's infrastructure, which services approximately eighty percent (80%) of the land within city limits and maintains a total of eight (8) active wells for extracting groundwater, 156 miles of water distribution lines, and two (2) reservoir locations (including booster stations) with four (4) 3 million gallon elevated storage tanks.

The Department has nearly 14,000 water service connections providing water to approximately 80,000 residents and businesses within the City of Compton. The water system’s infrastructure requires updated software, routine maintenance, repairs, and rehabilitation to ensure a sufficient level of pressure for fire protection, optimal water quality, and an overall adequate potable water supply for our customers.

The following is the Department’s ARPA expenditure recommendation:

Administration:
$925,000.00
Supervisory Control and Data Acquisition (SCADA). The SCADA system is a control center of information for water facilities including reservoirs, pump stations and well sites. SCADA also includes alarms for intrusions, malfunctions and unusual system operations.

Remove and replace asphalt to prevent microbiological contamination from entering the distribution system
Install mixers in each reservoir to improve water quality Total $650,000.00
Total amount: $7,988,000.00
Lastly, the proposed use of ARPA funds is consistent with the Department of Treasury’s funding objectives, and the Department will utilize the funds for ongoing projects throughout the current and subsequent fiscal years through December 31, 2026, which is consistent with the language contained within the Department of the Treasury Coronavirus State and Local Fiscal Recovery Funds Rules and Regulations (Rules and Regulations).

FISCAL IMPACT
The Department was previously allocated $7,988,000.00 of ARPA funds to assist with restoring the City of Compton’s aging water infrastructure, from the ARPA funds the City received in June of 2021. The Department’s 2021-2022 fiscal year budget was amended to appropriate those funds, the funds were unencumbered and lapsed and fell to fund balance as of June 30, 2022. The money has not been spent and is awaiting encumbrance in order to move the project forward.

As previously mentioned, these funds will be used for ongoing water infrastructure improvement projects throughout the current fiscal year, and subsequent fiscal years through December 31, 2026; which is consistent with the language contained within the Rules and Regulations. The funding objectives state that ARPA funds must be obligated by December 31, 2024 and all funds must be spent by December 31, 2026.

CITY CLERK OF THE CITY OF COMPTON
December 20, 2022
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: COMPTON MUNICIPAL WATER DEPARTMENT
SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON AUTHORIZING THE CITY MANAGER TO ENTER INTO A THREE (3)

YEAR AGREEMENT WITH AND ISSUE A PURCHASE ORDER TO THE

CITY OF LAKEWOOD CALIFORNIA FOR THE LEASE OF CENTRAL
BASIN GROUNDWATER PUMPING RIGHTS FOR FISCAL YEARS 2022- 2023, 2023-2024 AND 2024-2025 ($247,500)

SUMMARY
Adoption of this resolution will authorize the City Manager to enter into a three (3) year Groundwater Pumping Water Rights Lease Agreement with the City of Lakewood California to lease up to 1,500 acre-feet of water rights for Fiscal Years 2022-2023, 2023- 2024 and 2024-2025 to offset the amount of imported water the City would need to purchase from other sources, and issue a purchase order in the amount of Two Hundred Forty-Seven Thousand Five Hundred Dollars ($247,500.00), upon approval for the lease of water rights for Fiscal Year 2022-2023.

BACKGROUND
The Compton Municipal Water Department (Department) produces ground water, which can be augmented by purchasing treated water supplied by the Metropolitan Water District of Southern California (MWD). The City of Compton (City) has 5,780 acre-feet of “Allowed Pumping Allocation” annually. The City supplies approximately 7,200 acre-feet of water annually to meet its customers’ demands. There is approximately 1,420 acre- feet of difference in supply and demand is either made up by purchasing water from the MWD or by leasing pumping rights from other agencies. The production cost associated with ground water pumping has been historically more cost effective than purchasing imported water from other sources.

Water rights are required to pump groundwater from the Central Basin. These rights are valuable and there is a sizable surcharge for pumping more than the rights holder’s allocated amount of water. Each year holders of groundwater rights solicit request for proposals to lease their water rights. This is the amount of water they are not able to carry over into the next fiscal year. This creates an opportunity for other parties to leverage, thereby reducing their supply cost because pumping groundwater is less expensive than purchasing imported water from the MWD.

5.5.5. Staff Report – Water Lease Agreement, City of Lakewood California December 20, 2022, page 2

STATEMENT OF THE ISSUE
The City of Lakewood, California is willing to lease up to 1,500 acre-feet of their allowable pumping allocation of ground water to the City for Fiscal Years 2022-2023, 2023-2024 and 2024-2025 at the unit cost of $165.00 per acre-foot of water totalling $247,500 per fiscal year. The City can utilize this leased allocation to offset the required amount of imported water through MWD connections.

FISCAL IMPACT
Payment to the Licensor will be made in two (2) increments of One Hundred Twenty- Three Thousand Seven Hundred Fifty Dollars ($123,750.00) per fiscal year according to the following:

Fiscal Year 2022-2023 due dates are January 31, 2023 and June 15, 2023 Fiscal Year 2023-2024 due dates are December 15, 2023 and June 15, 2024 Fiscal Year 2024-2025 due dates are December 15, 2024 and June 15, 2025 Funds for this expenditure in the amount of Two Hundred Forty-Seven Thousand Five Hundred Dollars ($247,500.00) for the cost of leased pumping rights during Fiscal Year 2022-2023 are allocated in the Department’s Fiscal Year 2022-2023 Budget in Account No. 5000-850-000-4251.
