SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COMPTON AUTHORIZING THE CITY MANAGER TO PREPARE
A BUDGET AMENDMENT TRANSFERRING FUNDS BETWEEN
ACCOUNTS AND TO ISSUE A PURCHASE ORDER TO
VERMEER EQUIPMENT CORPORATION FOR THE PURCHASE
OF A TREE STUMP GRINDER MACHINE FOR THE CITYWIDE
TREE MAINTENANCE PROGRAM IN AN AMOUNT NOT TO
EXCEED ONE HUNDRED FIVE THOUSAND SIX HUNDRED
SEVENTY-THREE DOLLARS AND SIXTEEN CENTS
($105,673.16).
SUMMARY
Adoption of this resolution will authorize the City Manager to amend the 2022- 2023 Fiscal Year Budget and transfer funds between accounts, and to issue a purchase order to Vermeer Equipment Corporation for the purchase of a tree stump grinder machine for the Citywide Tree Maintenance Program in an amount not to exceed One Hundred Five Thousand Six Hundred Seventy-three Dollars and Sixteen Cents ($105,673.16).
BACKGROUND
The City of Compton’s Urban Forest Program is committed to managing and enhancing the trees in the City and to ensure that all the residences of Compton enjoy the optimum benefits that can be obtained from this precious resource known as the urban forest.
The Citywide Tree Maintenance Program oversees more than 20,000 trees and is responsible for administering proper tree care; planting new trees; removing dead and hazardous trees; conducting reforestation projects in the parks, municipal grounds, open spaces, medians and streets, and maintaining a street database with maintenance information about trees throughout the City.
Whenever there is a determination to remove a tree, the tree stump remains.
The tree stump removal task is assigned to City staff because this allows the Department to better manage the City’s tree contractor (United Pacific) to perform more pertinent tree services such as trimming the large trees on our main thoroughfares, trimming residential trees, remove hazardous or dead trees and planting new trees.
4. Staff Report – Purchase of Tree Stump Grinder 2022-2023 March 7, 2023, page 2 of 3
STATEMENT OF THE ISSUE
The removal of tree stumps is an important task because if left untouched, a tree stump and its roots will start to rot and over time can become home to pests, fungi and other organisms. Also, the roots can continue to grow leading to regrowth of the tree. The continued growth of tree roots can also disrupt landscapes and sidewalks.
The City had owned a tree stump grinder in the past that has since been red tagged and put out of operation.
The City will utilize Sourcewell for the purchase of the tree stump grinder.
Sourcewell is national cooperative purchasing site. Cooperative purchasing is “Procurement conducted by, or on behalf, one or more Public Procurement Units”, as defined by the American Bar Association Model Procurement Code for State and Local Governments. Sourcewell follows the competitive contracting process to solicit, evaluate, and award cooperative purchasing contracts for goods and services. The City has been a part of the Sourcewell program since 2007, and this has been an approved method of procurement.
The Vermeer Equipment Corporation is a heavy-duty equipment vendor with the Sourcewell Program, and provided the Department with the following quote for a tree stump grinder:
1. New 2023 Vermeer SC70TX tree stump grinder $105,673.16 In order to provide the Public Works Street Maintenance staff with the equipment necessary to remove tree stumps, City Council authorization is needed for the City Manager to issue a purchase order to Vermeer Equipment Corporation in an amount not to exceed One Hundred Five Thousand Six Hundred and SeventyThree Dollars and Sixteen Cents ($105,673.16).
FISCAL IMPACT
City Council shall authorize the City Manager to amend the 2022-2023 fiscal year budget transferring funds between account as follows:
Account Number Description Amount
From: 1004-610-000-4269 Other Contract Services $105,673.16 To: 1004-610-000-4334 Machinery/ Equipment $105,673.16

SUMMARY
Adoption of this resolution will approve a budget amendment to the 2022-2023 fiscal year budget, transferring funds between accounts, and authorizing the City Manager to issue a purchase order to the Sherwin Williams Company for the purchase of paint for the Citywide Anti-Graffiti Program in an amount not to exceed Fifty Thousand Dollars ($50,000).
BACKGROUND
The City of Compton values the quality of life for our community and recognizes the spread of graffiti as a challenge to that goal. The Public Works Street Maintenance Department (“Department”) removes graffiti from public property as quickly as possible in order to improve the City’s appearance and discourage future incidences of graffiti. Residents of the City make hundreds of service requests to remove graffiti from buildings and other surfaces each year. The Department has found that the best practice is to remove graffiti within 24 hours of reporting.
The Sherwin Williams Company supplies paint products that are compatible with the City’s paint sprayers. Other companies that the Department has used (Dunn Edwards, Home Depot, and Lowes) clogged the paint sprayers causing costly repairs and delays in graffiti removal services.
STATEMENT OF THE ISSUE
Therefore, in order to provide graffiti removal services citywide, it is necessary to amend the 2022-2023 fiscal year budget to increase the Measure P Maintenance and Repair Account and authorizing the City Manager to issue a purchase order to the Sherwin Williams Company for the purchase of paint in an amount not to Staff Report – Resolution Authorizing Budget Amendment and P.O. FISCAL IMPACT
Funds are available in the Measure P Fund Balance and the Fiscal Year 2022- 2023 budget will need to be amended as follows to appropriate funds from fund balance:
Increase Expenditure Account Description Amount
1004-720-000-4236 Maintenance/Repair $50,000

FISCAL YEAR BUDGET AND AUTHORIZING THE ISSUANCE OF A
PURCHASE ORDER TO ELK GROVE AUTO GROUP FOR THE
PROCUREMENT OF FLEET VEHICLES ($2,800,136)
SUMMARY
Adoption of the attached resolution will rescind Resolution No. 25,531, adopted by the City Council on July 27th, 2021, amend the 2022-2023 Fiscal Year budget of the Public Works – Street Maintenance Department to transfer funds to increase expenditures in the amount of Two Million Eight-Hundred Thousand One-Hundred and Thirty-Six Dollars. ($2,800,136) and authorize the City Manager to issue a purchase order in the amount of Two Million Eight-Hundred Thousand One-Hundred and Thirty-Six Dollars ($2,800,136) to Elk Grove Auto Group for the purchase of seventy-two (72) Dodge Ram 1500 Classic Tradesman Trucks for use by the Public Works - Street Maintenance Departments (Public Works and Parks Maintenance Divisions) and General Services Departments.
BACKGROUND
The City of Compton’s fleet is aging with the majority of the vehicles having been in service over fifteen (15) years. In addition to age, the vehicles have been determined to be inadequate to meet the current needs of the Public Works – Street Maintenance Departments (Public Works and Parks Divisions) and General Services Departments.
The Code Enforcement Officers in the Community Improvement Services Department are currently utilizing Dodge Chargers for their daily duties. In addition to citations and inspections, personal property seizures have become an increasing aspect of their job, and include seizing large items such as illegal street vendor carts which cannot be placed inside of a sedan, like a Dodge Charger. As a result of this, officers must coordinate the use of a pickup truck with the Public Works - Street Maintenance Department to impound such items, which creates inefficiencies for both departments.
After reviewing the current duties with management, a more appropriate vehicle for this job description is a pickup truck. Staff recommends purchasing Dodge Ram pickup trucks from Elk Grove Auto Group to address the needs of this Division, thereby allowing Code Enforcement Officers to confiscate items themselves and Public Works staff to remain focused on their assigned duties.
7. Staff Report –Rescinding Resolution 25,531 and Amending 2022-23 FY Budget Authorizing P.O.s to Elk Grove Auto Group
for Fleet Vehicle Purchase
March 21, 2023, Page 2 of 3
The Public Works – Street Maintenance Department and General Services Department encompasses Street Maintenance, Fleet and the Parks Divisions under its operations.
The divisions employ vehicles of various sizes to carry out daily functions (street repairs, illegal dumping, traffic and sign maintenance, park maintenance, facility maintenance, etc.) and these vehicles were purchased in 2008 and have exceeded their useful life becoming cost prohibitive to maintain. Any current cars and vans will be changed to trucks to meet the current and future needs of the Public Works and General Services Department. A total of seventy-two (72) Dodge Ram 1500 Classic Tradesman Trucks will be purchased to address the needs of the Public Works-Street Maintenance Department (Public Works and Parks Maintenance Divisions) and General Services Department at a cost of Two Million Eight-Hundred Thousand One-Hundred and Thirty-Six Dollars ($2,800,136).
These vehicles will need to be outfitted with various aftermarket upgrades (ladder racks, service bodies, lift gates, etc.) to meet the needs of the respective divisions. Staff requests an additional allocation of Four Hundred Thousand Dollars ($400,000.00) to cover the modifications.
STATEMENT OF THE ISSUE
The vehicle purchases are being made through the State of California’s “Statewide Contract” agreements for Fleet Vehicles issued by the Department of General Services Procurement Division. The State conducted a formal Request for Proposals (“RFP”) process that identified a number of vendors to provide vehicles of various types (Trucks, SUVs, Vans and Cars) to meet the needs of their departments. Subsection B “Local Government Agencies” of Section 2. “Contract Usage/Rules” of each agreement contains language that allows local government agencies to also utilize their agreements for vehicle acquisitions. Review of the State’s procurement process satisfies the City’s procurement requirements; thus, utilizing the State’s agreements allow the City to capitalize on pricing that would not be available if staff conducted a separate Request for Quotes process for the vehicle purchases.
Staff inquired about the status of the order of new Chevrolet trucks, authorized under Resolution No. 25,531 last July 2021, and was informed production issues have delayed delivery for the foreseeable future. The representative also represents a Dodge retailer (Elk Grove Auto Group) and said they have inventory on hand that would meet the City’s order once modified (service bodies, light bars, tow hitches, etc.) to meet the City’s needs.
In light of the fact that the authorized purchase of seventy-two (72) 2022 Chevrolet Silverado and Chevrolet Colorado Trucks, one (1) Paramedic Unit and two (2) Tow Trucks to Winner Chevrolet can’t be fulfilled, it is necessary to rescind Resolution 25,531 and authorize a purchase order for Elk Grove Auto Group in the amount of Two Million EightHundred Thousand One-Hundred And Thirty-Six Dollars ($2,800,136) for the purchase of seventy-two (72) Dodge Ram 1500 Classic Tradesman trucks.

for Fleet Vehicle Purchase
March 21, 2023, Page 3 of 3
This purchase will provide the City with a uniform fleet as all service trucks will be Dodge trucks. These vehicles will also be outfitted with the appropriate equipment (light bars, tow hitches, City Logo and Department decals, etc.) to allow staff to use the vehicles in their daily duties as soon as they are delivered, which is expected two to three months after the orders are placed by the City.
FISCAL IMPACT
Funds are available in the Equipment Rental Fund Balance for the Fiscal Year 2022-2023 budget and will need to be amended as follows:
Increase
Expenditure
Account Description Amount
6000-720-000-4333 Equipment Rental – Automotive Equipment $2,800,136
The purchase orders will be allocated to the respective dealerships in “amounts not to exceed” as follows:

SUMMARY
Staff is requesting that the City Council authorize the City Manager to execute an agreement with Revenue & Cost Specialists (RCS) for the preparation of a City-wide Fiscal Sustainability Plan and to authorize a purchase order in an amount not to exceed Twenty-Eight Thousand Eighty Dollars ($28,080). Staff is also requesting that City Council approve a budget amendment in the amount of Twenty-Eight Thousand Eighty Dollars ($28,080).
BACKGROUND
The State of California State Auditor’s Department issued an Audit report to the City in October of 2022. This report had findings and recommendations for various areas of improvement needed for the City. One of the recommendations included in this report was (on page 4 of the report) the following,
“To Ensure accountability for Compton’s fiscal recovery process, the City should develop and the city Council should approve a fiscal sustainability plan by July 2023 that contains specific measures for increasing revenues, decreasing expenditures, and eliminating fund deficits. This plan should identify the individuals responsible for implementing these measures and those responsible for monitoring the City’s progress in implementing each action, should include estimated dates of completion, and should describe the estimated fiscal impact of each measure. City management should also inform the City Council every quarter of its progress in implementing the plan.”
8. Staff Report – Resolution Amending 2022-23 FY Budget Authorizing Contract Execution and P.O. to Revenue & Cost Specialists LLC.
Prior to this, in March of 2022, the Finance Committee brought forth fiscal sustainability elements which were adopted by City Council with Resolution Number 25,629 on March 15, 2022. At that time, the Finance Committee identified the need to adopt a framework to help address the State Controller’s audit findings from the 2018 State Controller’s Office’s audit findings and help the City move forward with general implementation.
Further, the framework allowed the City to communicate to the public its goals for achieving future fiscal sustainability. The audit finding from the State Controller’s Report which was combined with the City’s external auditor (Eadie & Payne LLC)’s audit finding was stated in the Fiscal Year 2018-2019 Single Audit report as follows:
2019-025 – Negative Fund Balances (MW)
Criteria: The City should operate to maintain adequate fund balances in all of its funds to mitigate current and future risks, such as revenue shortfalls and unanticipated expenditures.
Condition: There are negative fund balances for various funds including the general fund, grant funds, nonmajor governmental funds, and internal service funds.
Cause: Lack of policies and procedures over cash management and budgetary restrictions. Weakness in internal control over operational spending and lack of consideration of long-term financial planning.
Effect or Potential Effect: The deficits could have a significant effect on operations on a go-forward basis. City programs and services involved with the fund may be curtailed.
Repeat of a Prior-Year Finding: 2018-037, 2014-049A
Recommendation: We recommend that management review the negative fund balances and the affected operations to make provisions to eliminate the deficit balances going forward.
A fiscal sustainability plan is a plan that City Councilmembers and City staff can follow, so that the City’s long term and short-term fiscal health can be considered when making decisions for on-going City operations and for new endeavors. Upon Staff review there is currently no Fiscal Sustainability Plan documented or in place.
STATEMENT OF ISSUE
In order to remain in compliance with the State of California Auditor’s October 2022 recommendations for the deliverable of a fiscal sustainability plan, City staff has issued a request for proposal on 01/09/23. The request for proposal (RFP) was published in the Compton Bulletin and on the California Society of Municipal Finance Officer (CSMFO)’s Staff Report – Resolution Amending 2022-23 FY Budget
Authorizing Contract Execution and P.O. to Revenue & Cost Specialists LLC.
RFP website, which is a website frequently reviewed by vendors who provide financial services to municipalities and local governments within California.
The RFP yielded only one response, which was from RCS. After City staff interviewed the firm and checked their references, staff decided to recommend RCS as the front-runner of the RFP process for these services.
FISCAL IMPACT
The cost for these services is not to exceed Twenty-Eight Thousand Eighty Dollars ($28,080), per the proposal from RCS. A budget amendment to the FY2022-2023 City Budget is being requested for the following:
Increase in Revenue appropriations:
Account Code Account Name Amount
2810-000-000-3565 American Rescue Plan Fund $28,080.00
Other Federal Grant Revenue
Increase in Expenditure appropriations:
Account Code Account Name Amount
2810-650-000-4262 American Rescue Plan Fund $28,080.00
Other Professional Services
A purchase order for Twenty-Eight Thousand Eighty Dollars ($28,080.00) is also being requested to be authorized to be issued out of the following account:
Account Code Account Name Amount
2810-650-000-4262 Other Professional Services $28,080.00 Once the Fiscal Sustainability Plan is completed and adopted by Council, it will establish goals and directives to ensure the City’s future fiscal health. Further it will communicate to stakeholders of the City that the City is committed to the improvement and success of the City’s fiscal health. The plan will provide guidance for cost savings and revenue enhancements that will ultimately improve the City’s financial position, while simultaneously addressing related auditor findings and recommendations. It is also important to know that policies may need to change to keep up with current environment or any unforeseen circumstances.
ALTERNATIVE
The City would continue to remain in a position without a fiscal sustainability plan for which staff could start implementing into day-to-day operations, and these audit findings would likely continue to be repeated until such a policy is adopted and implemented.
