TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: CITY MANAGER
SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON ADOPTING THE FIVE (5) YEAR CAPITAL IMPROVEMENT PLAN FOR THE CITY OF COMPTON.

SUMMARY
The five (5) year Capital Improvement Plan (CIP) outlines the City’s Capital Infrastructure Needs and Plans to address those needs over the next five (5) years. The projects listed address major infrastructure issues from street repair needs, park rehabilitation, and the restoration and repair of fire stations and our own City Hall and Council Chambers. The Public Works, General Services, Recreation and Water Departments all worked in concert with the City Manager’s office to develop this plan.

Based on this collaboration, the City Council will consider the adoption of the enclosed Capital Improvement Plan. This will provide the Mayor, Council and the residents with information of the City’s long-range vision by outlining both the short and long-range fiscal and capital development improvement needs.

BACKGROUND
The City of Compton had its last Capital Improvement Plan presented and approved in 2014 which provided details for projects through 2017. In the State Audit from October 2022 the following was stated: “…the city should develop and the city council should approve an updated capital improvement plan. The city should then immediately begin implementing its updated capital improvement plan for needed infrastructure projects.

The plan should set priorities for all projects, with an emphasis on those related to repairing and updating its streets, water system, and sewer system.” The projects in the Capital Improvement Plan (CIP) are listed by department and all highlight elements outlined in the Priority 1 Requirement. One of the priority elements of the City of Compton’s infrastructure is the need to repair the streets. The State Audit outlined the priority and gave details pertaining to the percentage of streets that were in poor condition and those that were not. Within the CIP, Council and residents will find a full breakdown of all of the grind and overlay rehabilitation plans for streets in all four (4) districts. Along with the road repairs there are other projects outlined in the Public Works Engineering section that will increase the methods of safe transportation for our residents.

1.1.1. Staff Report – CAPITAL IMPROVEMENT PLAN FY 23-28 November 28, 2023, page 2
Another listed area of concern is the aging water infrastructure in the City. The CIP’s Water Department section addresses the plan for improving the access to one of the City’s most valuable resources. Rehabilitation of several wells throughout the City are outlined in the plan and will be an ongoing undertaking. The City’s Water Department has also outlined the replacement of vehicles for the production, distribution and meter reading sections to ensure the safety of its employees.

The General Services Department has undergone an internal reorganization of duties and has assumed the management of all maintenance for City buildings. This undertaking has resulted in more streamlining of repairs and renovations to stand alone city buildings and those city facilities within the parks. In the General Services section of the CIP are plans for the renovation of park facilities, fire station interior and exteriors, and City Hall and Council Chambers. These renovations will improve the structural aesthetic of the locations while simultaneously improving two facilities that support the operations of the City, and the City Council, and the quality of life for the residents of Compton.

STATEMENT OF THE ISSUE
From the Audit: “Compton’s deteriorating infrastructure – which has presented health and safety risks to the public – is emblematic of its struggles. Half of Compton’s streets are in poor condition, its water wells and related infrastructure are decaying. One reason for Compton’s infrastructure disrepair is that it has not updated its citywide capital improvement plan – which should prioritize the city’s infrastructure projec5ts and identify their funding sources…”
As expressed above in the excerpt from the state audit, the adoption of the Capital Improvement Plan by Council will fulfill one of the Priority 1 Recommendations made by the State Auditor in 2022. The outlined projects provide a transparent framework and keeps the community informed of current and future projects addressing many of the immediate infrastructure needs of the city.

RECOMMENDATION
Staff recommends that the City Council adopt the attached Capital Improvement Plan for years 2023 through 2028.

FISCAL IMPACT
The City of Compton’s General Fund will fund $4,000,000 of the capital projects scheduled to begin in 2023 and be completed in 2024 while the remaining funding will come from a number of alternative funding sources (i.e., MTA Bond, prop funding, measure funding, SB funding, etc.) All funding sources and amounts are fully listed and broken down by fiscal year within the CIP document.

SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON

DECLARING SCRAP METAL AS SURPLUS CITY PROPERTY AND

AUTHORIZING THE CITY MANAGER TO SELL, DONATE OR DISPOSE

OF SUCH PROPERTY AND APPROVING LU MAR INDUSTRIAL
METALS COMPANY, LTD. FOR THE COLLECTION AND SALE OF

SCRAP METAL ON AN AS-NEEDED BASIS

SUMMARY
The adoption of this resolution will declare scrap metal as surplus city property and will authorize the City Manager to sell, donate or dispose of such property and approve Lu Mar Industrial Metals Company, Ltd. for the collection and sale of scrap metal on an as- needed basis.

BACKGROUND
The City has accumulated a large amount of scrap metal that can no longer be utilized by City staff and has little or no value in its current condition as shown on “Exhibit A”.

Staff has determined that it is in the best interest of the City to have the stored scrap metal removed.

The Public Works Street Maintenance Department regularly has the need to manage scrap metal storage, thus it has become necessary to develop a recycling program by which these items may be handled in an effective manner. Approval of this resolution will allow staff to more efficiently manage the storage of scrap metal and will ensure that City property containing metals are recycled. Therefore, it is recommended that the stored scrap metal be designated as surplus City property and sold, donated or disposed of on an as-needed basis utilizing Lu Mar Industrial Metals Company, Ltd.

Lu Mar Industrial Metals Company, Ltd. is a fully registered California company with over 30 years of metal recycling experience, is insured and compliant with state regulations and located within the City of Compton. This company provides the most local and affordable services available to the City.

2.2.2. Staff Report – Resolution Declaring Scrap Metal as Surplus Property and Sold, Donate or Disposed Lu Mar Industrial Metals Company, Ltd.

November 28, 2023, Page 2

STATEMENT OF THE ISSUE
Multiple departments within the City generate valuable scrap materials from their operations that can be conveyed to recycling companies. Types of scrap metals collected by these departments includes tubing, wire, fittings, valves, street, traffic and other signs, copper, aluminum, brass and cast iron. These materials have become unfit for use for municipal purposes and can no longer be utilized by City staff. It has become necessary to develop a sustainable recycling program to allow staff to more efficiently manage stored recyclable metal. Therefore, staff recommends that the stored scrap metal be designated as surplus City property and sold, donated or disposed of in a manner most advantageous to the City.

The Compton Municipal Code, Section 4-11.10., Sale of City Personal Property, provides the sale, donation, or disposal of materials, supplies, equipment or other personal property which has become unfit for municipal purposes as stated in the following:

CMC 4-11.10. Sale of City Personal Property.

Whenever the City has any materials, supplies, equipment or other personal property which it no longer needs for municipal purposes, or which has become unfit for use for municipal purposes, the City Manager shall provide for the sale, donation or destruction of such materials, supplies, equipment or other personal property by such means as he or she shall find most advantageous to the City. In the event such materials, supplies, equipment or other personal property has a sale value of more than $500, the City Manager shall obtain the consent and approval of the City Council before authorizing the sale, donation or disposal thereof.

Staff recommends that the City utilize the services of Lu Mar Industrial Metals Company, Ltd., a Compton based company that has years of recycling experience and is dedicated to processing recyclable materials in the most efficient and environmentally friendly manner. Lu Mar Industrial Metals Company, Ltd. will render its recycling services at no cost to the City. The company will partner with the City to create a scrap metal processing program customized to the City’s needs, including providing containers, timely pickups and transportation of recyclable materials to the processing facility in Compton.

Developing a sustainable scrap metal recycling program will ensure that the collection and sale of scrap materials are adequate to safeguard City assets, and disposal is being conducted efficiently and effectively in accordance with City policies governing the disposal of surplus property.

ALTERNATIVE
There are no proposed alternatives at this time.

November 28, 2023, Page 3

FISCAL IMPACT
The services will be provided free of charge to the City. Proceeds from the sale of recyclable metals will be used to augment the City’s General Fund.

BACKGROUND
The Wilmington Avenue Safe Streets Pedestrian/Bicycle Improvements Project is a pedestrian and bicycle safety improvement project aimed to improve pedestrian and bicycle safety for communities that are adjacent to the Wilmington Avenue transportation corridor. The project will develop safer pedestrian crossings and intersections, in addition to installing bicycle lanes to improve bicycle visibility and safety, which aims to reduce traffic collisions.

The proposed pedestrian and bicycle safety improvements include the following street segments:
 Rosecrans Avenue at Wilmington Avenue
 Spruce Street at Wilmington Avenue
 Poplar Street at Wilmington Avenue
 Stockwell Street at Wilmington Avenue
 Arbutus Street at Wilmington Avenue
 Palmer Street at Wilmington Avenue

Staff Report – Union Pacific Railroad (Wilmington Avenue) Authorization for Crossing Improvements Agreement
November 28, 2023 Page 3
Phase I and Phase II of the design are scheduled to be completed by December 31, 2023.

STATEMENT OF ISSUE
During the Project’s Design Phase, it was determined that a portion of the Project was located within the Union Pacific Railroad’s right-a-way (Crossing Area). As a result, Staff contacted representatives of the Railroad to coordinate the requirements that the City has to adhere to in order to complete construction within the Railroad’s right-a-way.

Subsequently, City staff was informed that a construction contract would need to be entered into with the Railroad.

According to the Agreement, it is the City’s responsibility to reimburse the Railroad for any costs incurred by the Railroad in connection with the Railroad completing the following scope of services: (1) Removing existing 94’ asphalt crossing surface; (2) Installing new 104’ precast concrete crossing surface; (3) Fielding weld rail; (4) Relaying track at crossing with 136 lb. transition rail; (5) Renewing ties; and (6) Surfacing the track with new ballast.

While the Railroad completes their scope of work, the City will be responsible for the following: (1) Providing traffic control and road closure with detour plan during construction; (2) Installing new signage and striping; (3) Using a sawcut and removing the pavement; and (4) Installing pavement up to the crossing surface upon completion of crossing surface installation.

The Railroad has an estimated cost to complete the aforementioned work in the Crossing Area in the amount of $270,635.00. However, that figure is an estimate and is subject to fluctuation depending on an increase or decrease in the cost or amount of material or labor that is required. Therefore, the Department is requesting a 10% contingency fee to cover any fluctuations in cost in the amount of $27,063.50.

Accordingly, in order to authorize the City Manager to enter into an Agreement between Union Pacific Railroad Company and the City of Compton for installation and maintenance services within the Crossing Area, City Council’s authorization is necessary.

ALTERNATIVE
There are no other alternatives being recommended at this time.

FISCAL IMPACT
The reimbursement method is as follows, the City agrees to reimburse the Railroad for 50% of actual costs incurred by the Railroad in connection with the Railroad work. During the performance of the Railroad work, Railroad will provide progressive billing to the City based on Railroad’s actual costs. Within one hundred twenty (120) days after completion of the Project, the Railroad will submit a final billing to the City for any balance owed to the Railroad in connection with the Railroad’s work. The City will then have thirty (30) Staff Report – Union Pacific Railroad (Wilmington Avenue) Authorization for Crossing Improvements Agreement
November 28, 2023 Page 4
days after its receipt of any progressive and finals bills submitted by the Railroad for payment.

Funds for this expenditure in the amount of Two Hundred Ninety-Seven Thousand Six Hundred Ninety-Eight Dollars and Fifty Cents ($297,698.50) are available in the Public Works 2023-2024 Fiscal Year budget in Account No. 1900-710-000-4269.

RECOMMENDATION
Staff recommends the City Council adopt the attached Resolution, which will authorize the City Manager to enter into an Authorization for Crossing Improvements Agreement with and establish a purchase order for Union Pacific Railroad Company (Railroad) for installation and maintenance services within the Right-A-Way (Crossing Area) for the Wilmington Avenue Safe Streets Pedestrian/Bicycle Improvement Project (Project) in the amount of Two Hundred Ninety-Seven Thousand Six Hundred Ninety-Eight Dollars and Fifty Cents ($297,698.50).

The adoption of this resolution will authorize the issuance of a purchase order to Quinn Company for payment of outstanding invoices from July 2023 to August 2023 for maintenance and repair services in the amount of Twenty-Eight Thousand Nine Hundred Sixty-Seven Dollars ($28,967).

BACKGROUND
The Public Works Street Maintenance Department (Department) is responsible for maintenance of public facilities, roadways, sewers and streetscapes. In June 2019, the Department determined that there was a need to purchase heavy duty equipment to be used in maintaining the City’s infrastructure and subsequently, purchased a Caterpillar 908M Wheel Loader and Caterpillar 926M Wheel Loader from Quinn Company.

Caterpillar Wheel loaders are utilized for loading quantities of materials (grit, asphalt, rubble, concrete) for street repairs, tree removal (tree branches and trunks) and for other public maintenance tasks. The Caterpillar 908M and 926M are high performance loaders designed for efficient loading and material handling tasks including, building and paving roads, preparing job sites, digging, landscaping, carrying large heavy loads, handling large amounts of refuse and moving other heavy materials.

The Public Works staff utilizes both the 908M and 926M as their primary equipment to load and unload heavy materials. The capacity of the 926M Wheel Loader offers a larger dump clearance and larger bucket capacity making it more suitable for city-wide projects including the removal of large asphalt loads, concrete loads, and large tree branches and trunks.

STATEMENT OF THE ISSUE
The Department engaged Quinn Company to render maintenance and repair services for the wheel loaders. Quinn provided well trained, highly skilled technicians to perform

The Quinn technology is built to help the Department better manage heavy equipment, lower operating costs and is vital to keeping the City’s equipment running in peak operating conditions.

It is essential to the services of the Department to maintain the heavy equipment through a program of consistent repair and preventative maintenance, which will result in fleet optimization, minimizing downtime, maximizing production and improving reliability.

The Department seeks the Councils approval to issue a purchase order to the Quinn Company for the completed repair and maintenance services.
