As part of the American Rescue Plan, the City of Compton was provided with a one-time allocation of HOME-ARP funding in the amount of $1,988,847. STATEMENT OF THE ISSUE
The City has accumulated vehicles and equipment which have exceeded their useful life cycle and can no longer be safely used or operated by City staff. The items listed on “Exhibit A” are old, damaged and excessively costly to continue to operate or no longer have value to the City’s operations.

Financial Settlement Services (FSS)
It is understood the Client elects GovDeals to collect all proceeds due the Client from the winning bidder and remit the proceeds to the Client less the GovDeals fee GovDeals will charge the winning bidder a “Buyer’s Premium”, therefore, the Client is not allowed to charge the winning bidder an additional “Buyer’s Premium”.
GovDeals will collect all proceeds from the winning bidder, including the “Buyer’s Premium” through PayPal, credit card or wire transfer. This is the only means of payment by the bidder.
The Client will not release an asset to the winning bidder until the Client has received verification from GovDeals that payment has been received from the winning bidder. Prior to an item being released to the winning bidder, the Client will ensure the winning bidder or his/her agent has signed a “Bill of Sale” containing the following notation: “Asset is sold as is, where is and without warranty. Once the asset is removed from the seller's premises there is no refund of monies previously paid”. The Bill of Sale must be printed from the Seller Asset Management (SAM). Any other “Bill of Sale” used by the Client must be submitted to GovDeals for approval.
No proceeds will be remitted to the Client for any asset sold without verification of payment from GovDeals and verification from the Client the item has been picked up by the winning bidder. Approved payment from the winning bidder through PayPal, credit card or wire transfer will be noted in SAM. It is the Client’s responsibility to notify GovDeals when an item has been picked up, which is accomplished by the Client accessing SAM and selecting the “Picked Up” option from the “Paid, not picked up” report.
GovDeals will remit all proceeds collected, less the “Buyer’s Premium” and the GovDeals fee to the Client on a weekly basis for all assets marked in SAM as ‘Picked Up’. All proceeds will be remitted electronically by Automatic Clearing House (ACH). A detailed backup will be submitted to the Client to support the amount remitted.
Under no circumstance will the Client collect any proceeds directly from the winning bidder and if requested to do so, the Client should refer the winning bidder directly to GovDeals for payment instructions.
GovDeals will absorb all costs of Charge Backs by PayPal or a credit card company where an item is released to the winning bidder after the Client receives proper payment notification from GovDeals, GovDeals receives proper pickup notification from the Client and the Client obtained and retained a signed “Bill of Sale” from the winning bidder.
GovDeals will refund proceeds collected to the winning bidder in those rare occasions where the winning bidder pays for an asset but never picks it up and subsequently convinces PayPal or the credit card company to withdraw the amount from GovDeals’ bank account. It is the Client’s responsibility to request a credit on the asset paid for but not picked up as soon as the allowable pick up time passes. By taking the credit, it insures GovDeals will not charge the Client a fee and will allow the Client to resell the asset. If the asset is mistakenly placed in ‘picked up’ status by the Client and GovDeals has remitted payment, the Client agrees to refund this amount back to GovDeals.
A GovDeals’ Client Services Representative or a GovDeals Help Desk Representative will train the Client on how to effectively use the Financial Settlement Services feature and provide ongoing support as needed.
There are no additional costs to the Client for training and support.
GovDeals is covered by a Crime Insurance Policy with a limit of $5,000,000, which will protect the Client against any loss of funds.

FROM: CITY MANAGER
SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON
AUTHORIZING THE CITY MANAGER TO ENTER INTO A
REIMBURSEMENT AGREEMENT WITH AND ESTABLISH A
PURCHASE ORDER FOR UNION PACIFIC RAILROAD COMPANY FOR
PRELIMINARY ENGINEERING SERVICES FOR THE COMPTON
BOULEVARD CORRIDOR IMPROVEMENT PROJECT, CIP# 18-03 IN
THE AMOUNT OF TWENTY-FIVE THOUSAND DOLLARS ($25,000.00).
SUMMARY
Adoption of this Resolution will authorize the City Manager to enter into a Reimbursement Agreement with and establish a purchase order for Union Pacific Railroad Company (Railroad) for Preliminary Engineering Services for the Compton Boulevard Corridor Improvement Project (Project) CIP# 18-03, in the amount of Twenty-Five Thousand Dollars ($25,000.00).
BACKGROUND
The City of Compton maintains approximately 173 centerline miles of pavement within City limits. In July 2015, the City secured a Highway Safety Improvement Program (HSIP) Cycle 7 grant in the amount of $1,691,098.00 to reconstruct Compton Boulevard within City boundaries. This grant will focus on the installation of raised medians and Class II bicycle lanes along Compton Boulevard from Willowbrook Avenue to the eastern City limits.
In August 2016, the City was awarded the HSIP Cycle 8 grant in the amount of $1,168,200.00. This grant will address systemic issues along the Compton Boulevard Corridor by installing bike lanes and lighting along Compton Boulevard from Willowbrook Avenue to Central Avenue as well as enhancing pedestrian crossings at 15 intersections.
The HSIP is a core federal-aid program with the purpose of achieving a significant reduction in traffic fatalities and serious injuries on all public roads. Overall, the Project’s proposed improvements will focus primarily on improving safety through roadway paving, which is in poor condition, as well as improving raised medians islands, adding Class II bicycle lanes, enhancing pedestrian crossings, improving parkways, sidewalks and curb ramps which do not meet ADA standards.
On September 18, 2018, pursuant to Resolution No. 24,862, City Council authorized the City Manager to enter into a professional services agreement with JMD to provide design

services for the Project. Subsequently, on March 1, 2022, pursuant to Resolution No. 25,620, City Council authorized an amendment of the aforementioned agreement to provide additional street design services for the Project.
STATEMENT OF ISSUE
The Project’s description proposes to improve the roadway pavement structure at the existing at-grade crossing on Compton Boulevard. The Project’s location will affect the Railroad’s track and right-a-way on Compton Boulevard, and the Railroad agreed to collaborate with the City on the conceptualization and development of the Project in accordance with the terms and conditions of the attached Agreement (Exhibit A).
The Railroad will be performing the following scope of services for the Project:
Field diagnostic(s) and inspections;
Plan, specification and construction review;
Project design;
Preparation of Project estimate for force account or other work performed by the Railroad; and
Meeting and travel.
The Railroad and the City desire to execute this Agreement providing the terms and conditions pursuant to which the Railroad and/or its representatives, at the time City’s sole cost and expense, agrees to perform (or shall cause a third-party) consultant to perform on Railroad’s behalf) the preliminary engineering services work described on Exhibit B attached hereto (Preliminary Engineering Work-PE Work).
The Agreement stipulates that the City acknowledges and agrees to the following:
Railroad’s review of any Project designs, plans, and/or specifications, as a part of the PE Work is limited exclusively to potential impacts on existing and future Railroad facilities and operations; and
Railroad makes no representations or warranties as to the validity, accuracy, legal compliance or completeness of the PE Work; and
City’s reliance on the PE work is at the City’s own risk.
Accordingly, in order to authorize the City Manager to enter into an Agreement between Union Pacific Railroad Company and the City of Compton for preliminary engineering services within the Railroad’s area, City Council’s authorization is necessary.
ALTERNATIVE
There are no other alternatives being recommended at this time.
