2023-2024 FISCAL YEAR BUDGET AND AUTHORIZING THE CITY
MANAGER TO ENTER INTO A SECOND AMENDMENT OF
AGREEMENT NO. R0919 WITH AND ESTABLISH A PURCHASE
ORDER FOR ALAMEDA CORRIDOR TRANSPORTATION AUTHORITY
(ACTA) IN AN AMOUNT NOT-TO-EXCEED TWO HUNDRED TWENTYSIX THOUSAND DOLLARS ($226,000.00)
SUMMARY
Adoption of this Resolution will amend the Public Works Engineering Department’s 2023- 2024 Fiscal Year budget. It will also authorize the City Manager to enter into a second amendment to Agreement No. R0919 (Agreement) with and establish a purchase order for Alameda Corridor Transportation Authority (ACTA) in an amount not-to-exceed Two Hundred Twenty-Six Thousand Dollars ($226,000.00).
BACKGROUND
The City of Compton is replacing a section of the Artesia Boulevard Bridge (State Bridge No.53C1744, Los Angeles County Bridge No. 2446), located approximately 600 feet west of Santa Fe Avenue within City limits. Specifically, the Project is located over Alameda Street and the Union Pacific Railroad and Alameda Corridor’s Right-of-Ways, which is operated by ACTA.
The Project is currently underway and involves replacing the existing fire-damaged at Spans 9 & 10 portion of the bridge. This replacement is necessary due to the severe fire damage sustained to the bridge’s steel girders and supporting connections. The replacement will be an in-kind concept, using a steel superstructure with rolled steel girders. The bridge installation will be facilitated by a crane, staged adjacent to the bridge and railroad tracks. The City requires ACTA’s assistance to perform flagging services that are needed to facilitate the construction process of the Project.
On September 26, 2023, pursuant to Resolution No. 25,909, City Council authorized the City Manager to enter into an Agreement with ACTA to provide construction related services along the ACTA Right-of-Way in an amount not to exceed Twenty-Five Thousand Eight Hundred Seventy-Five Dollars ($25,875.00).
19. Staff Report- Second Amendment to Agreement No. R0919 May 7, 2024
On January 2, 2024, construction commenced to replace damaged portions of the Artesia Boulevard Bridge, which requires the use of flagging services before any construction can occur where tracks could potentially be fouled. Flaggers are deployed to ensure safety by managing train traffic within ACTA’s Right-of-Way and facilitating communication between train operators and construction crews.
On January 8, 2024, the City and ACTA initiated the first amendment, which expanded the initial Agreement to include additional services related to the construction phase of the Project. These services now encompass Construction Coordination Support and Flagging services specifically for work situated on or near the Alameda Corridor Right-ofWay. Although, the scope was broadened to include flagging services, there was no corresponding increase in the cost outlined in the first amendment of the Agreement.
STATEMENT OF ISSUE
In response to ongoing construction activities, the City has determined that there is a need to amend its Agreement with ACTA for the second time to increase the level of flagging services that are currently being provided by ACTA, as the City has exhausted all funds previously allocated towards services with ACTA, which amounted to $25,874.00.
Given the City's utilization of flagging services for 14 days during the initial construction phases of the Project, and the projected need for additional flagging services (estimated at 127 days) for the remaining duration of the Project, it is imperative to amend the existing Agreement to reflect additional flagging days to ensure the Projects stays on schedule.
Therefore, in order to amend the Public Works Engineering Department’s 2023-2024 fiscal year budget and authorize the City Manager to initiate a second amendment to Agreement No. R0919 with and establish a purchase order for Alameda Corridor Transportation Authority (ACTA) in an amount not-to-exceed Two Hundred Twenty-Six Thousand Dollars ($226,000.00), City Council’s authorization is necessary.
ALTERNATIVE
There are no alternatives that are being recommended at this time. The progression and completion of the Project requires flagging services to be performed by ACTA and be reimbursed by the City.
FISCAL IMPACT
The Public Works Engineering Department’s 2023-2024 Fiscal Year budget will be amended as follows:
Staff Report- Second Amendment to Agreement No. R0919
May 7, 2024
Increase Revenue:
Account No. Description Amount
2789-710-041-3569 State Grants $226,000.00
Increase Expenditures:
Account No. Description Amount
2789-710-041-4300 State Grants/Capital Outlay $226,000.00 The maximum amount payable under the Agreement shall be Two Hundred Twenty-Six Thousand Dollars ($226,000.00). Therefore, funds in the amount of $226,000.00 will be available in the Public Work’s Engineering Department’s 2023-2024 Fiscal Year budget in Account No. 2789-710-041-4300.
On a monthly basis, ACTA shall submit invoices and supporting documentation of ACTA’s work completed during the prior month, along with its subcontractor invoices received during that prior month to the City for reimbursement. The invoices and supporting documentation shall contain sufficient detail and clarity to indicate the portions of ACTA’s work that was completed during the invoicing period.
ACTA shall submit a final reconciled invoice to the City of Compton within 180 days after the completion of ACTA’s work. The final billing shall be in the form of an itemized statement of the total costs for ACTA’s work. Within 45 days after receipt of the final reconciled invoice, The City shall pay ACTA all amounts evidenced by such invoice in full.
RECOMMENDATION
Staff recommends the City Council adopt the attached Resolution.
