PUBLIC COMMENTS ON AGENDA ITEMS AND NON-AGENDA MATTERS:

Aisha Woods is a community volunteer at Lincoln Memorial Park Cemetery and expressed concern about an incident Monday at Woodland Memorial Park Cemetery.

Tomas Carlos informed there is an issue with our Hispanic community not having adequate translation of the meetings. He's asking the community to do better in that area. He was critical of the process to get translation services and indicated it should always be available.

Karen Lewis spoke about requesting repair, for the past ten years, the danger of a very deep hole in the sidewalk in front of her house, which is right across the street from an elementary school, and whether she could have it repaired herself.

Bob Adams, a businessman with ASNE District Housing Authority 36, represents the management group here, the union, and with him is the president, Desmond Fletcher, and the secretary, Rosalyn Rambo are present to discuss a contract that is stuck in transit to the City Council. The contract has been expired since 2019. The last raise given was 2018, at 3 percent in 2018.

There was an attempt to negotiate with various City managers and the previous City managers but did not reach a tentative agreement back in November. The Agreement was ratified back in January, which is two months ago but not being brought to the City Council because it's in process with the controller's office. They would like the City Council to look into the process and feel this is of high priority to move these contracts forward.

Elizabeth Hicks had a request to be completed within 90 days to give the City ample time for the City to correct ADA deficiencies. Title II of the ADA requires state and local government to make the programs and services accessible to persons with disabilities.

Jacqueline Venters inquired about potential activities for children for Easter, the street repair and Long Beach Boulevard and said the City Attorney needs to enforce these rules. Ms. Venters also spoke about summer coming with our youth with the swimming pools, summer jobs and other things for our kids here in the City. Inquired about jobs for the youth for summer.

On Thursday at 3:00 o'clock at, um, 300 Spring Street downtown, there will be a press conference, and there will be a demand that the attorney general open up an investigation concerning the cemetery. She felt the City and Community should support the efforts of Celestina being that her family members are buried there and the tragedy which she has lived with.

Anthony Lewis agreed with Ms. Venters and said he was sharing with the treasurer the damage that was done. It was ridiculous how they backed the truck into her gate and now it can't be secured. He spoke about a gentleman who came up here and posted $25,000 reward and took the $25,000. He commented that the same gentleman was there yesterday and has a video of when the gate was damaged. He spoke of supporting cleanup efforts.

Lynn Boone said she requested for an interpreter because there's people in the audience that don't speak English. Suggested subtitles be put on the screen for the people speaking, and the mayor, when speaking, isn't clear because she's mumbling and stutters. She spoke about the City Clerk and the minutes being up to date. Ms. Boone expressed displeasure with the City Clerk and Mayor Sharif and some Council Members.

Missy Barbara informed City Manager Hopkins that the bridge on Willowbrook and Rosecrans needs to be removed because it was in disrepair. She also spoke about the cleanup efforts Pocket Park on Wilmington across the street from the airport and updates on street signs throughout the city. She inquired about the audit report. The water and sewer fund and the money that's owed.

She received something in reference to a 700 form and why it would be necessary for her to fill out the form. She also inquired about the minutes and the seal to the city.

Kinsey Jones spoke about his dislike of Temple to Greenleaf being a straightaway and a crosswalk right at Pauline and Caldwell. The prostitutes cross right there at the same time the kids are out there, wearing scant clothing.

He also spoke about the condition of the streets near the manhole covers and a big gap in the street.

He expressed concerns about it being a possible danger to the children. He indicated for the last 16 years, he's petitioned to get two streetlights up on the corner of Pauline and Caldwell because of the lack of lighting and as a result, the numerous accidents that occur at that intersection.

Mr. Jones inquired about a plan to get the prostitutes off the street, and tree trimming that ceased at Temple and went all the way to Greenleaf. He spoke about a security camera in the area that doesn't work and had it worked when a guy got killed at the car wash, there would have been a video.

Vanessa Cain expressed a desire to assist Mr. Jones in the removal of the prostitutes. She said she was instrumental in the removal of prostitutes in front of a business and didn't wait on the city.

She expressed the thought that the residents would have to get involved for change to come. She also expressed a need for up-to-date meeting minutes. Vanessa expressed criticism toward the Madam City Clerk McDaniel and City Attorney Perrodin. Vanessa further expressed concern for the lack of planning for the upcoming Olympics and the impact on the city.

Maria Villareal spoke of needing help. Even though it is a small, charter City with all these issues, everyone can do something to help clean up the community. She expressed concern about the translation and how it is important for the Spanish-speaking community to understand what's going on here or up there by disseminating the right information in Spanish and English.

She gave a history from 2004 that the same issues existed. She said Spanish-speaking residents were given six minutes, and we translated Spanish from English. Ms. Villareal commented that there seems to be an issue with the translation because, two weeks ago, she spoke Spanish, and she was highly criticized. She was told that it was disrespectful to some groups. She expressed a desire to understand the issue and said that translating Spanish from English and English from Spanish was necessary. In closing, she said we came here from different parts of the world. We have to respect each other.

Craig Henry thanked Council Member Duhart for the beautiful tea she had and for honoring his mother. It was very special to him. He also apologized to the City Manager. He said that if he were the City Manager, based on what's going on with the citizens, he would resign, but he expressed his desire for the City Manager Hopkins to continue. He admonished the City Council Members to listen to the Citizens' grievances and respond to those grievances aside from personal feelings.

He also expressed the need for the community to come together to address the real issues within the City of Compton.

SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

AUTHORIZING THE CITY MANAGER TO ESTABLISH A PURCHASE

ORDER WITH HAAKER EQUIPMENT COMPANY FOR PAYMENT OF
OUTSTANDING INVOICES FOR SEWER TRUCK REPAIRS ($6,418.96)

SUMMARY
The adoption of this resolution will authorize the establishment of a purchase order with Haaker Equipment Company for payment of outstanding invoices in the amount of Six Thousand Four Hundred Eighteen Dollars and Ninety-Six Cents ($6,418.96) for sewer truck repairs.

BACKGROUND
The City of Compton’s sewer collection and delivery system is comprised of approximately 147 miles of piping, ranging in size from 4 to 24 inches. The piping is connected via 2,899, 4ft-diameter manholes. The City’s sewer flows by gravity. As part of the City’s Sewer System Management Plan, the Public Works Street Maintenance Department (Department) has developed an ongoing condition assessment program as well as routine preventive operation and maintenance activities for scheduling regular maintenance and cleaning of the sanitary sewer system.

An essential component of maintaining the sanitary sewer system is the use of industrial sewer vacuum trucks. The vacuum trucks use a combination of high-pressure jet spray and suction to create an unobstructed path in sewer lines. The high-powered spray and specialized equipment are valuable in unblocking pipes, which helps keep the City’s pipes flowing without interruption, making planned maintenance more manageable and sanitary.

STATEMENT OF THE ISSUE
The Public Works Street Maintenance Department (Department) is responsible for maintaining the City’s sewer infrastructure. The City owns and operates Vactor 2110 Sewer Cleaning Trucks to maintain and clean the sanitary sewer system, one of which needed repairs.

Haaker Equipment Company assessed the damages of the sewer cleaning truck, replaced parts and satisfactorily repaired the vehicle. It is necessary to pay Haaker

SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON RESCINDING RESOLUTION NO. 26,071 AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A FIVE (5) YEAR LEASE AGREEMENT

WITH ANGELS FOR SIGHT FOR THE LEASE OF CITY-OWNED
PROPERTY LOCATED AT 920 NORTH ALAMEDA STREET

SUMMARY
Staff requests to rescind Resolution No. 26,071 which was approved on June 25, 2024, and seeks authorization for the City Manager to enter into a five (5) year (i.e. July 1, 2024, through June 30, 2029) agreement for the lease of approximately 1,224 square feet of indoor space and 2,216 square feet of outdoor space at the City-owned property, located at 920 North Alameda Street, Compton, California 90221 by the Angels for Sight organization.

BACKGROUND
The City of Compton owns certain real property located at 920 North Alameda Street, Compton, California 90221. Pursuant to guidance of the City Council, in November 2012, the City Manager implemented a City-wide leasing policy which mandates that City- owned facilities and/or property shall not be leased without first obtaining proper authorization from the City Council (i.e. an adopted resolution) and execution of a written lease agreement [City of Compton Standard Operating Manual, Policy 4.17(A)]. In addition to other matters, the Policy specifies that lease rates shall be based on the square footage of the area(s) subject to the exclusive use/occupation of the Lessee and that the standard leasing rate in a City-owned facility shall be at least One Dollar ($1.00) per square foot for indoor space and Fifty Cents ($0.50) per square foot for outdoor space or vacant property.

In addition to this required minimum base rental rate, the leasing policy addresses recovery of the costs incurred by the City for the provision of the following services:
utilities (e.g. gas, electricity, water, trash, etc.), maintenance and repairs, custodial services and City security. However, the leasing policy does provide that a Tenant that will have exclusive use/occupation of the entire City facility and/or property shall be solely responsible for all utilities, janitorial, security, and minor, routine interior and exterior maintenance of the facility or property, with the City responsible for structural and major repairs and maintenance.

STATEMENT OF ISSUE
On June 25, 2024, City Council Meeting, the Mayor and City Council authorized the City Manager to enter into a five (5) year lease agreement with Angels for Sight. Staff is requesting to rescind Resolution No. 26,071, as the amount to be charged to the lessee was not clearly determined during the meeting.

The proposed lease agreement will provide Angels with exclusive use of the following space at 920 North Alameda Street:

Exclusive Indoor Square Footage 1,224 square feet
Exclusive Outdoor Square Footage 2,216 square feet
Total Exclusive Square Footage 3,440 square feet
Angels seek City Council approval to enter into a five (5) year lease agreement with the City, beginning July 1, 2024, through June 30, 2029, for exclusive occupation of the entire property. Angels is interested in leasing the subject property for the purpose of administrative offices and support services for their organization.

On May 28, 2024, Angels met with the City Manager and Director of General Services to discuss the lease agreement. The organization wishes to provide approximately One Hundred Fifty Thousand Dollars and Zero cents ($150,000.00) in tenant improvements and requests a reduction in the lease rental rate. Management does not oppose this proposal, provided tenant improvements are concluded within the first six (6) months of the agreement.

Angels request that the Council authorize leasing rental rate provisions different than required by the City’s Leasing Policy; more specifically, a lesser rental amount of One Dollar ($1.00) per year for the term of the lease agreement. Angels will be responsible for utilities, routine maintenance, minor repairs, custodial, and security. SOM Policy

4.17(A)(1) provides that “…only the City Council shall have the authority to reduce or waive the standard leasing rates and/or other costs required by the policy and the proposed lease agreement.” Thus, City Council approval is required for the reduction in and/or waiver of the standard leasing rates.

FINANCIAL IMPACT
Unless the Council decides to waive the minimum lease rental rate requirements of Policy

4.17(A)(1) of the City Leasing Policy, the estimated fiscal impact of this proposed action will be a net gain to the General Fund of a base monthly lease rental rate of Two Thousand Three Hundred Thirty-Two Dollars ($2,332.00) per month for the term of the lease for an annual amount of Twenty-Seven Thousand Nine Hundred Eighty-Four Dollars and Zero Cents ($27,984.00).

ALTERNATIVE
The Council has discretion to choose among a number of options:

1.Authorize the City Manager to enter into a lease agreement with Angels for Sight for the five (5) year term requested (or offer a lesser term) as follows:
a. The Lessee will pay One Dollar and Zero Cents ($1.00) per year for a period of three (3) years, starting on July 1, 2024, and ending on June 30, 2027. This reduced rent is in exchange for tenant improvements to the facility, valued at One Hundred Fifty Thousand Dollars and Zero Cents ($150,000.00). Starting on July 1, 2027, recurring monthly lease payments will begin, with the amount set at Two Thousand Three Hundred Thirty-Two Dollars ($2,332.00) per month. b. For the minimally recommended City policy rates (i.e. $1.00 per square foot for indoor space and $0.50 for outdoor space) of $2,332.00 per month.

2.Deny the request to enter into a lease agreement for this location by Angels for Sight.

RECOMMENDATION
Staff recommends a reduction in rate for three (3) years of the agreement and adherence to the current Standard Operating Manual, Policy 4.17(A), for the remaining two (2) years of the agreement.

However, the decision to increase lease rental amounts and/or waive other requirements of the City’s Leasing Policy is at the discretion of the City Council.

8 Section 12. Damage or Destruction.
a. Termination of Lease. If the entire Premises or any material portion thereof are damaged or destroyed by earthquake or other violent action of the elements, or by fire or other casualty such that it is difficult or impossible for Lessee to continue operating its business thereon, then either Owner or Lessee may cancel this Lease as of the date of damage or destruction by delivering written notice to the other within thirty (30) days following the damage or destruction. If the Lease is cancelled, Lessee shall surrender the Premises and shall not be obligated for any further rental payment and Owner shall refund any unearned rent paid in advance by Lessee, calculated at a daily rate based on the regular monthly rental.

Repair of Premises. In the event of any lesser damage by casualty (other than that caused by or do the actions/inactions of the Lessee), Owner shall, at Owner's cost and expense, promptly repair the same to the extent Owner's insurance proceeds are made available to Owner therefor and provided that (a) such repairs, in Owner's reasonable good faith opinion, can be commenced within thirty (30) days of the event which necessitated the repair and restoration, unless it is not reasonably possible to commence repair and restoration within thirty (30) days from the date of such damage or destruction (without payment of overtime or other premiums) and (b) the cost of such repairs, in Owner's reasonable good faith opinion, will not exceed 50% of the then replacement cost of the Site. If Owner is not required to repair such damage or destruction, then Owner shall, within 30 days from the date of such damage or destruction, either (i) notify Lessee in writing of Owner's election to repair such damage or destruction, in which event Owner shall promptly repair the same, or (ii) notify Lessee in writing of Owner's election to immediately terminate this Lease, in which event this Lease is terminated effective as of the date of such damage or destruction. Lessee may terminate this Lease effective as of the date of any such damage or destruction if Lessee reasonably determines in its good faith opinion that such damage or destruction substantially impairs the satisfactory operation of the Lessee's operations by notifying Owner in writing of Lessee's election to terminate not later than 30 days after the date of such damage or destruction.

Loss Caused by Lessee. If the Premises are wholly or partially damaged or destroyed as a result of the gross negligence or willful misconduct or omission of Lessee, Lessee shall forthwith diligently undertake to repair or restore all such damage destruction at Lessee's sole cost and expense. This Lease shall continue in full force and effect without any abatement or reduction in rent or other payments owed by Lessee, and this obligation of Lessee to repair or restore the Premises shall survive the cancellation of this Lease.

Exclusive Remedy. This Section 12 shall be Lessee's sole and exclusive remedy in the event of damage or destruction of the Premises, and Lessee waives and releases Lessee's rights under California Civil Code Section 1932 and 1933(4).

SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON APPROVING A BUDGET AMENDMENT TO THE FISCAL YEAR 2024-
2025 BUDGET AND AUTHORIZING THE CITY MANAGER TO
ESTABLISH A PURCHASE ORDER WITH ALAN’S LAWN & GARDEN
CENTER, INC. IN THE AMOUNT OF NINETY-ONE THOUSAND SEVEN

HUNDRED FIFTEEN DOLLARS AND NINETY-EIGHT CENTS
($91,715.98) FOR THE PURCHASE OF TWO (2) ELECTRIC LAWN
MOWERS

SUMMARY
The adoption of this resolution will approve a budget amendment to the Fiscal Year 2024- 2025 Budget and authorize the City Manager to establish a purchase order with Alan’s Lawn & Garden Center, Inc. in the amount of Ninety-One Thousand Seven Hundred Fifteen Dollars and Ninety-Eight Cents ($91,715.98) for the purchase of two (2) electric lawn mowers.

BACKGROUND
The South Coast AQMD (SCAQMD) has established a Commercial Electric Lawn and Garden Equipment Incentive & Exchange Program. The goal of the program is to improve air quality by exchanging older, polluting gasoline or diesel-powered commercial lawn and garden equipment with new zero-emission battery-operated commercial grade equipment.

The Commercial Electric Lawn and Garden Equipment Incentive & Exchange program is open to local governments, school districts, colleges and non-profit organizations that work within the SCAQMD’s four-county jurisdiction. The program provides participants with incentive funding that will significantly reduce the purchase price of the commercial grade battery-operated lawn and garden equipment, up to the funding caps listed below:

Commercial Lawn & Garden Equipment Funding Cap (Up to) Amount Chainsaws/Trimmers/Edgers/Brushcutters $700
Leaf blowers/Vacuums $1,400
Walk Behind Lawn Mowers $1,500
Ride-on or Stand/Sit Lawn Mowers $15,000

6.6.6.6. Staff Report – Resolution Authorizing Budget Amendment and P.O.

Alan’s Lawn & Garden Center, Inc.– Purchase Electric Lawn Mowers July 9, 2024, page 2
The equipment available through this program includes handheld trimmers, chainsaws, pruners, backpack and handheld blowers and ride-on, stand-on, walk-behind and robotic lawn mowers. One equivalent operable gasoline or diesel-powered piece of lawn and garden equipment must be scrapped to qualify for funding incentives toward battery- operated replacement equipment.

The program is voucher-based, and is available on a first-come, first-served basis until the funding is exhausted. Eligible participants will contact a participating retailer to select new commercial grade lawn and garden equipment. The participating retailers will apply for vouchers, which will be applied as a point-of-sale discount towards the purchase price of the new lawn and garden equipment. The participating retailer ensures that the old equipment is properly dismantled and permanently destroyed by a licensed dismantler.

STATEMENT OF THE ISSUE
The Public Works Street Maintenance Department (Department) desires to participate in the Commercial Electric Lawn and Garden Equipment Incentive & Exchange Program to support SCAQMD’s goal of achieving cleaner air quality for all.

The Department will utilize the program to purchase two (2) battery-operated zero- emission ride-on lawn mowers. Staff has completed the required application process to participate in the program and has obtained quotes for the lawn mowers from Alan’s Lawn & Garden Center, Inc., a participating retailer. The program will provide a total of Thirty Thousand Dollars ($30,000) of incentive funding towards the purchase of the lawn mowers.

Transitioning to battery-operated zero-emission ride-on lawn mowers, allows the Department to not only reduce carbon emissions and air pollution but also promotes a quieter and more sustainable approach to park maintenance. These mowers can efficiently tackle the upkeep of city parks and infrastructure without the noise and fumes associated with traditional gas-powered models. This investment reflects a commitment to both environmental stewardship and effective resource management, ultimately contributing to a cleaner and healthier urban environment for the community.

FISCAL IMPACT
An amendment to the Department’s Fiscal Year 2024-2025 Budget is required for this expenditure. The Department’s Fiscal Year 2024-2025 Budget will be amended as follows:
