BACKGROUND
The City of Compton’s Recreation Department provides resources which meet the needs of the community through highly accessible, enjoyable and varied opportunities for learning and recreation. More specifically, the parks within the City of Compton offer a source of recreation for the community. Lueders Park, located within the City of Compton, has a playground. The playground equipment has significant damage and requires replacement. In order to replace the equipment, the City of Compton must contract with a professional provider. The City has partnered with Innovative Playgrounds Company Inc, a Sourcewell company.

Innovative Playgrounds Company brings over 40 years of combined commercial playground sales and construction experience in the park, recreation, school, and childcare industry. They are well established and are a professional representative firm serving California for some of the most prestigious manufacturers like BCI Burke Company LLC, who is a Sourcewell member, as well as the parent company of Innovative Playgrounds Co., Inc.

11.1 Default by Contractor.

Without limitation to any of City’s other rights or remedies at law or in equity, City shall have the right to terminate this Agreement in the event that Contractor fails or refuses to perform any of the obligations set forth in this Agreement or the other Contract Documents, and fails to cure such default in the manner required hereafter.

11.1.2 Opportunity to Cure Default. Contractor shall cure any default in performance of its obligations under the Contract Documents within two (2) business days after receipt of written notice of such default from City; provided, however, that if the breach cannot reasonably be cured within such time then Contractor will commence to cure the breach within two (2) days and will diligently and continuously prosecute such cure to completion within a reasonable time, which shall in no event be later than ten (10) calendar days after receipt of such written notice.

11.2.2 Rights Cumulative. All of City’s rights and remedies under this Agreement are cumulative, and shall be in addition to those rights and remedies available in law or in equity. City shall determine whether there has been noncompliance with the Contract Documents so as to warrant exercise by City of its rights and remedies for default. Without limitation to the foregoing, Contractor acknowledges that issuance of a suspension order by City due to circumstances relating to City’s compliance with the California Environmental Quality Act is foreseeable and that such suspension order, regardless of its duration, shall not be considered a breach by City of this Agreement. Upon receipt of a suspension order, Contractor shall, at City’s expense, comply with its terms and take all reasonable steps to minimize costs allocable to the Work covered by the suspension order during the period of work stoppage. Within the period of the above noted aggregate time, or such extension to that period as is agreed upon by Contractor and City, City shall either cancel the suspension order or it shall have the right, without incurring a liability to Contractor for lost profits or consequential damages, to delete the Work covered by such suspension order by issuing a Change Order.

11.3.1 Resumption. If a suspension order is canceled or expires, Contractor shall resume and continue with the Work. A Change Order will be issued adjusting the Contract Price and/or the Contract Time for additional costs of work and delay necessarily caused by such suspension.

11.4.3 Trade Contractors. Contractor shall include provisions in all of its subcontracts, purchase orders and other contracts with its Trade Contractors permitting termination for convenience by Contractor on terms that are consistent with this Agreement and that afford no greater rights of recovery against Contractor for termination than are afforded to Contractor.

11.5.1 Contractor's Remedies. Contractor may terminate this Agreement for cause only upon the occurrence of one of the following:

AUTHORIZING THE CITY MANAGER TO AMEND THE GRANTS
MANAGEMENT DEPARTMENTS’ 2024-2025 FISCAL YEAR BUDGET
AND APPROPRIATE FUNDS WITHIN THE FY2020 COMMUNITY

DEVELOPMENT BLOCK GRANT (CDBG) FUND AND ISSUE A

PURCHASE ORDER TO CREATIVE BUS SALES IN THE AMOUNT OF
($272,304.96) FOR THE PURCHASE OF TWO (2) GAS FUELED BUSES

FOR THE DIAL-A-RIDE PROGRAM

SUMMARY
Adoption of the attached resolution will authorize the City Manager to amend the Grants Management Department Fiscal Year 2024-2025 budget to appropriate Two Hundred Seventy-Two Thousand Three Hundred Four Dollars and Ninety-Six Cents ($272,304.96) in funds within the FY 2020 CDBG Fund and issue a purchase order to Creative Bus Sales in the amount for the purchase of two (2) gas fueled buses for the Dial-A-Ride Program

BACKGROUND
The City of Compton operates a Dial-A-Ride Program that provides public transportation services for the residents and riders who reside or visit the City.

Dial-A-Ride Program
The Dial-A-Ride Program is designed for seniors 55 years and older and persons with disabilities who reside within the City. This program is designed to offer curb-to-curb transportation services to seniors and disabled persons anywhere within the City boundaries and to satellite points outside of the City, including Kaiser Bellflower, Downey and Harbor General, Martin Luther King, Jr., and St. Francis Hospitals.

The City currently operates two (2) Dial-A-Ride buses. Based on the current rideshare activity, the City’s existing fleet is inadequate to meet the demands of the transportation services being requested. Therefore, staff is requesting to purchase 2 additional buses to add to the fleet.

4. Staff Report – Resolution Amending FY 2024-25 Budget Issue Purchase Order to Creative Bus Sales
Purchase 2 Buses for Dial – A-Ride Program
March 25, 2025, page 2

STATEMENT OF ISSUE
In February 2025, City staff received proposals from Creative Bus Sales to obtain two (2) Starcraft Bus – Class C (GM 45000) ADA buses for 16-passengers + 2 wheelchair passengers at a total cost of $272,304.96 (see the attached proposals provided by Creative Bus Sales). Staff anticipates delivery of the vehicles within 45 days after receipt of the order from the City.

Creative Bus Sales was awarded a contract through the California Association for Coordinated Transportation (CalACT)/Morongo Basin Transit Authority (MBTA). The City is a member agency of the CalACT/MBTA, which is a statewide association of small, rural, and specialized transportation providers.

As a component of promoting collaboration and exchange among smaller transit agencies, CalACT provides opportunities for small agencies to “piggyback” off of existing procurement contracts to purchase vehicles and equipment.

Under this existing purchase contract, the City is able to select the appropriate vehicles for its operation, customize them as desired, and purchase them utilizing a price that has been previously bid consistent with governmental purchasing guidelines. As these contracts are bid on a larger scale, this would enable the City to obtain competitive pricing that might not otherwise have been available.

FISCAL IMPACT
The total cost for Fiscal Year 2024-2025 is $272,304.96. A budget amendment is being requested for the funds for these expenditures to be made available in the Grants Department’s 2024-2025 fiscal year budget. Specifically, the following budget amendment is being requested:

Increase in revenue appropriations in:

Account Code Account Name Amount
2800-540-J93-3583 CDBG, FY20 Grant year $272,304.96
HUD Revenue account
And, Increase in expenditure appropriations in:

Account Code Account Name Amount

Capital outlay account
Staff Report – Resolution Amending FY 2024-25 Budget
Issue Purchase Order to Creative Bus Sales
Purchase 2 Buses for Dial – A-Ride Program
March 25, 2025, page 3
If approved, then funds will be available in the CDBG account number 2800-540-J93- 4300. As a CDBG qualifying project, the City of Compton will be reimbursed, for the expenses related to purchasing two (2) senior buses from Creative Bus Sales, as claims are filed with HUD.

ALTERNATIVE
No alternative proposed.

RECOMMENDATION
Staff recommends that the City Council adopt the attached Resolution.
