April 29, 2025
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: CITY MANAGER’S OFFICE
SUBJECT: A RESOLUTION OF CITY COUNCIL OF THE CITY OF COMPTON RESCINDING RESOLUTION 26,231 TO ADDRESS PROCEDURAL OVERSIGHT IN
COMPLIANCE WITH THE BROWN ACT
SUMMARY
On April 22, 2025, the City Council adopted Resolution No. 26,231, appointing Aleshire and & Wynder, LLP to serve as the City’s legal counsel. However, it has come to staff's attention that the item was not properly noticed in accordance with the requirements of the Brown Act. The Brown Act mandates transparency and public participation in local government decision-making. Failure to comply with its requirements undermines public trust and could expose the City to legal challenges.
BACKGROUND
On April 22, 2025 a presentation given by Aleshire & Wynder, LLP during Closed Session was not properly noticed. Upon the completion of Closed Session, City Council approved Resolution No. 26,231, and the legislative body was provided a statement to read out during the Regular Council Meeting. During the regular council meeting an Aleshire and Wynder representative gave an un-agendized presentation that was not under General Public Comment.
STATEMENT OF THE ISSUE
The procedural oversight in this case constitutes a violation of the Brown Act. To rectify this, staff recommends rescinding Resolution No. 26,231. This action demonstrates the City Council’s commitment to transparency and accountability.
Rescinding Resolution No. 26,231 will not have a substantive impact on legal services as Council has the right to reconsider the item following proper notice.
FINANCIAL IMPACT
There is no direct fiscal impact associated with rescinding Resolution No. 26,231.
1. RECOMMENDATION
To uphold the principles of transparency and public trust, staff recommends that the City Council rescind Resolution 26,231.
