6.4 Deductible. Any deductible or self-insured retention must be approved in writing by the City and shall protect the indemnified parties in the same manner and to the same extent as they would have been protected had the policy or policies not contained a deductible or self-insured retention.
6.5 Evidence of Insurance.The Contractor, concurrently with the execution of the Contract, and as a condition precedent to the effectiveness thereof, shall deliver certified copies of the required policies to the City. The certificates and endorsements for each insurance policy shall be signed by a person authorized by that insurer to bind Services Agreement – Innovative Playgrounds Company, Inc Playground Construction Project at Fig & Oleander Park, Resolution No. XX,XXX

Nothing contained in this Agreement will create any contractual relationship between any subcontractor of Contractor and City. Contractor will be responsible for payment of subcontractors. Contractor will bind every subcontractor and every subcontractor of a subcontractor by the terms of this Agreement applicable to Contractor's work unless specifically noted to the contrary in the subcontract and approved in writing by City.

SUMMARY
Adoption of this resolution will authorize the City Manager to utilize Community Development Block Grant-Coronavirus (CDBG-CV) funds in the amount of $214,976.91 to contract with End Point Wireless Inc. for the installation of new security camera systems at Wilson Park, Kelly Park, Gonzales Park, Lueders Park and Tucker Park.
BACKGROUND
The City of Compton receives CDBG-CV funds from the U.S. Department of Housing and Urban Development (HUD) to prevent, prepare for, and respond to the coronavirus. Eligible activities include public facility improvements that enhance health, safety, and the use of outdoor spaces during and after the pandemic.
The need for improved security at City parks has increased due to repeated vandalism, after-hours activity and public-safety concerns that emerged during and after the pandemic. To address these issues, the Grants Department working with Community Improvement Department initiated outreach to obtain competitive pricing for security camera.
The City received three written quotes form qualified vendors. After review, End Point Wireless, Inc. submitted the lowest most responsive proposal that met all HUD procurement and eligibility requirements including equipment specifications and installation standard. Their proposal includes equipment, installation, cloud- based storage integration and warranty.
STATEMENT OF THE ISSUE
The City must obligate and expend its remaining CDBG-CV funding to comply with HUD timeliness requirements. Allocating $214,976.91 to install security

SERVICE PROVIDER will bind every sub-SERVICE PROVIDER by the terms of this Agreement applicable to Consultant's work unless specifically noted to the contrary in the subcontract and approved in writing by City.
9. Other Consultants.The City reserves the right to employ other consultants in connection with the services.
10. Indemnification.SERVICE PROVIDER shall indemnify and save harmless the City, its officials, officers, employees, agents and volunteers (collectively hereinafter the Professional Services Agreement – End-Point Wireless Inc Grant Administrative Services

This indemnification and hold harmless obligation does not extend to claims arising out of the negligence or willful misconduct of the City.
11. Insurance.Without limiting the Consultant’s indemnification of the City, SERVICE PROVIDER shall obtain and maintain, at its cost and expense, for the duration of the Agreement and any and all amendments hereto, insurance against claims for injuries to persons or damage to property which may arise out of or in connection with performance of the services by SERVICE PROVIDER or Consultant’s agents, representatives, employees or sub-consultants. The insurance will be obtained from an insurance carrier admitted and authorized to do business in the State of California. Such evidence shall specifically identify this Agreement and shall contain express conditions that the City is to be given written notice at least thirty (30) days in advance of any termination or implementation of a reduction of limits or material change of insurance coverage as specified herein. Failure on the part of the SERVICE PROVIDER to procure or maintain insurance shall constitute a material breach upon which the City may immediately terminate this Agreement. All insurance required hereunder shall be primary with respect to any insurance maintained by the City.
Coverages and Limits. SERVICE PROVIDER will maintain the types of coverages and minimum limits indicated below, unless the Risk Manager or City Manager, in consultation with the City Attorney approves a lower amount. These minimum amounts of coverage will not constitute any limitations or cap on Consultant's indemnification obligations under this Agreement. City, its officers, agents, volunteers and employees make no representation that the limits of the insurance specified to be carried by SERVICE PROVIDER pursuant to this Agreement are adequate to protect Consultant.
The coverage will contain no special limitations on the scope of its protection to the below- indicated insureds except for Workers Compensation and errors and omissions insurance. SERVICE PROVIDER will obtain occurrence coverage, excluding Professional Liability, which will be written as claims-made coverage. If SERVICE PROVIDER believes that any required insurance coverage is inadequate, SERVICE PROVIDER will obtain such additional insurance coverage, as SERVICE PROVIDER deems adequate, at Consultant's sole expense.
11.1 Commercial General Liability Insurance. $1,000,000 combined single-limit per occurrence for bodily injury, personal injury and property damage. If the Professional Services Agreement – End-Point Wireless Inc Grant Administrative Services

submitted policies contain aggregate limits, general aggregate limits will apply separately to the work under this Agreement or the general aggregate will be twice the required per occurrence limit.
11.2 Workers' Compensation and Employer's Liability. Workers' Compensation limits as required by the California Labor Code and Employer's Liability limits of $1,000,000 per accident for bodily injury. Workers' Compensation and Employer's Liability insurance will not be required if SERVICE PROVIDER has no employees and provides, to City's satisfaction, a declaration stating this.
11.3 Professional Liability. Errors and omissions liability appropriate to Consultant’s profession with limits of not less than $1,000,000 per claim. The coverage shall also provide an extended two (2) year reporting period commencing upon termination or cancellation of this Agreement.
Endorsements. For Commercial General Liability Insurance, SERVICE PROVIDER will ensure that the policies are endorsed to name the City of Compton and its respective elected and appointed officers, officials, employees, agents and volunteers as “additional insureds” with respect to liability arising out of the activities of the Consultant. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the City. Prior to City's execution of this Agreement, SERVICE PROVIDER will furnish certificates of insurance and endorsements to City.
Waiver of Subrogation. The policies shall contain a waiver of subrogation for the benefit of City.
12. Permits and Licenses.Consultant, at its own expense, during the term of this Agreement, shall obtain and maintain all appropriate business and professional permits, licenses and certificates that may be required in connection with the performance of services by the Consultant. Upon execution of this Agreement, the SERVICE PROVIDER shall show evidence of a business license permit in conformance with Section 9-1.2 of the Compton Municipal Code.
13. Maintenance of Records. SERVICE PROVIDER will maintain complete and accurate records with respect to costs incurred under this Agreement. All records will be clearly identifiable. SERVICE PROVIDER will allow a representative of City during normal business hours to examine, audit, and make transcripts or copies of records and any other documents created pursuant to this Agreement. SERVICE PROVIDER will allow inspection of all work, data, documents, proceedings, and activities related to the Agreement for a period of three (3) years, or longer if required by law, from the date of final payment under this Agreement.

In the event the SERVICE PROVIDER encounters any conflict between such laws and ordinances, SERVICE PROVIDER shall notify the City in writing and the Parties agree to work cooperatively to resolve the conflict.
16. Termination.In the event of the Consultant's failure to prosecute, deliver, or perform the services, after giving written notice of default and two (2) days to correct the same, then, in addition to any other remedies, City may terminate this Agreement for nonperformance by notifying SERVICE PROVIDER in writing. SERVICE PROVIDER has five (5) business days to deliver any documents owned by City and all work in progress to City address contained in this Agreement. City will make a determination of fact based upon the work product delivered to City and of the percentage of work that SERVICE PROVIDER has performed which is usable and of worth to City in having the Agreement completed. Based upon that finding City will determine the final payment of the Agreement. In the event City elects to terminate, City will have the right to immediate possession of all Work Product and work in progress prepared by Consultant, whether located at Consultant's place of business, or at the offices of a sub-consultant.
The City’s obligation is payable only from funds appropriated for the purpose of this Agreement. All funds for payments after the end of the current fiscal year are subject to the City’s legislative appropriation for this purpose. In the event this Agreement extends into succeeding fiscal year periods and the City Council does not allocate sufficient funds for the next succeeding fiscal year payments, this Agreement shall terminate immediately upon written notice from the City.
Either Party, upon tendering ten (10) calendar days written notice to the other Party, may terminate this Agreement for convenience. In this event and upon request of City, SERVICE PROVIDER will assemble the work product without charge, put it in order for proper filing and closing, and deliver it to City. SERVICE PROVIDER will be paid for work performed to the termination date; however, the total shall not exceed the maximum amount payable as specified in Section 3, above. City will make the final determination as to the portions of tasks completed and the compensation to be made.

SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON
AUTHORIZING THE CITY MANAGER TO AMEND THE PROFESSIONAL
SERVICES AGREEMENT AND ESTABLISH A PURCHASE ORDER
WITH JMC2 ENGINEERING + SURVEYING TO PROVIDE ADDITIONAL
ENGINEERING DESIGN AND CONSTRUCTION SUPPORT SERVICES
FOR THE ALAMEDA–STATE ROUTE 91 URBAN GREENING AND
WATER RECLAMATION PROJECT ($173,431)
SUMMARY
This item seeks authorization for the City Manager to amend the existing professional services agreement and establish a purchase order in the amount of $173,431 with JMC2 Engineering + Surveying to provide additional engineering design and construction support services for the Alameda-State Route 91 Urban Greening and Water Reclamation Project (Urban Greening Project).
BACKGROUND
In 2018, the City of Compton was awarded the Urban Greening and Water Reclamation Grant from the California Natural Resources Agency (CNRA) under Agreement No.
U29107-0. The total grant award was $1,207,921.
The project, titled “Alameda–SR-91 Urban Greening and Water Reclamation Project,” aims to transform approximately 8.34 acres of blighted land around the State Route 91 and Alameda Street/Santa Fe Avenue interchange into a sustainable green corridor.
Improvements include:
Installation of over 100 drought-tolerant trees and 200 shrubs; Construction of bioswales, permeable surfaces, and stormwater infiltration systems;
Addition of interpretive signage, park seating, solar lighting, and 1,811 linear feet of fencing.
On January 16, 2019, Public Works solicited proposals for professional engineering and design services to support project implementation and grant compliance. Following review, JMC2 Engineering + Surveying was selected and, on May 21, 2019, City Council approved Resolution No. 25,027, authorizing a contract in an amount not to exceed $381,270.40. JMC2’s scope of work included:
18.18.18.18. Staff Report – Resolution Authorizing Amendment to the Professional Services Agreement with JMC2 Engineering + Surveying
December 23, 2025, Page 2 of 3
Research and utility coordination;
Survey and base mapping;
Preliminary and final design (PS&E preparation);
Meetings and public presentations; and
Bidding and construction support services.
In October 2019, work was paused due to funding limitations. In June 2021, additional funds were identified, but the prior agreement had expired. City Council subsequently approved Resolution No. 25,680 (June 14, 2022), authorizing a First Amendment in the amount of $91,481.80 to update the design documents and resume work.
STATEMENT OF ISSUE
Because the project is located within Caltrans right-of-way, additional coordination, permitting, and reporting requirements arose that were not included in JMC2’s prior scope.
These include preparation and submittal of:
Caltrans Encroachment Permit Application;
Revised cost estimates and design plans (including traffic control and erosion control plans);
Grant maintenance and California Environmental Quality Act (CEQA) documentation;
Aerially Deposited Lead (ADL) Site Investigation Survey; and Annual reporting to the State Water Resources Control Board (SWRCB) via the Storm Water Multiple Application and Report Tracking System (SMARTS).
To complete these tasks and provide construction-phase support, City staff requested a proposal from JMC2. On November 3, 2025, JMC2 submitted a proposal for additional services as summarized below:
1.Permit Processing
Preparation and coordination of permit submittals, plan check responses, and meetings with Caltrans and regulatory agencies.
2.Construction Phase Services
Participation in pre-construction meetings; review and response to Requests for Information (RFIs) and submittals; distribution of updated plan documents; and periodic field observation.
3.Stormwater Pollution Prevention Plan (SWPPP) – Qualified SWPPP Practitioner (QSP) Services
Weekly site inspections, reporting, and annual compliance filing with the SWRCB SMARTS portal during construction.
4.Record Drawings
Preparation of final record drawings using contractor as-built data.
Staff Report – Resolution Authorizing Amendment to the Professional Services Agreement with JMC2 Engineering + Surveying
December 23, 2025, Page 3 of 3
5.Punchlist Preparation
Final inspection and preparation of punchlist to verify construction completion per approved plans and specifications.
JMC2, a Los Angeles-based engineering and surveying firm, provides project management, civil and structural engineering, land surveying, permit processing, and construction support for public agencies throughout Southern California.
ALTERNATIVE
No alternatives are recommended. Proceeding with JMC2 is necessary to maintain project continuity and comply with grant requirements.
FISCAL IMPACT
Funds in the amount of $173,431 are available in the Public Works Engineering Department FY 2025–2026 Budget, Account No. 1077-710-000-4262 (Urban Greening Grant).
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution authorizing the City Manager to:
1. Amend the professional services agreement with JMC2 Engineering + Surveying; and
2. Establish a purchase order in the amount of $173,431 for additional engineering design and construction support services associated with the project.

TO: MAYOR AND CITY COUNCIL MEMBERS
FROM: MUNICIPAL WATER DEPARTMENT
SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMPTON AMENDING THE WATER DEPARTMENT’S 2025-2026 FISCAL YEAR
BUDGET TO RE-APPROPRIATE FIFTY-EIGHT THOUSAND THREE
HUNDRED FORTY-TWO DOLLARS AND ZERO CENTS ($58,342.00)
FOR CALRECYCLE GRANT – ROUND 3 (OWR-3)
SUMMARY
The City Council will consider a resolution to re-appropriate Fifty-Eight Thousand Three Hundred Forty-Two Dollars and Zero Cents ($58,342.00) from the CalRecycle Grant – Round 3. Grant funds were accepted and deposited on March 19, 2024, pursuant to Resolution No. 25,994, and were based on the City’s population of approximately 93,000.
Staff deposited funds in the SB1383 Organic Waste Recycling 3 Account No. 2789-850- WR3-3569 during the 2024-2025 Fiscal Year. The City intends to continue using the remaining funds to continue implementing Compton’s Integrated Waste Management Plan (IWMP) in compliance with Senate Bill 1383 (SB 1383) and all applicable CalRecycle rules and regulations.
BACKGROUND
The Municipal Water Department is entrusted with the implementation of State Mandate SB1383. These regulations require jurisdictions to conduct comprehensive education and outreach programs related to organic waste recycling for residents, businesses (including entities generating edible food for donation), haulers, solid waste facilities, local food banks, and other food recovery organizations.
Jurisdictions, including cities, counties, or special districts that provide solid waste collection services, must maintain all applicable SB 1383 Implementation Records in accordance with Title 14, California Code of Regulations (CCR), Section 18995.2.
Pursuant to the SB 1383 Model Ordinance, the City of Compton has elected to implement a performance-based, source-separated organic waste collection system, as defined in Title 14, CCR, Article 17.
To ensure ongoing compliance with SB 1383 requirements, jurisdictions are required to conduct performance-based source separation and organic waste collection audits and document the results using the Performance-Based Model Implementation Record Tool.
19.19.19.19. Staff Report – CalRecycle Grant – Round 3
December 23, 2025
STATEMENT OF THE ISSUE
The City of Compton Water Department applied for and was awarded One Hundred Twenty-Nine Thousand Two Hundred and Twelve Dollars ($129,212.00) through the CalRecycle Grant – Round 3. The grant payment was received on June 15, 2023, and funds were accepted, deposited, and appropriated on March 19, 2024, pursuant to Resolution No. 25,994.
To date, $70,870.00 of the grant funds have been expended. The remaining balance of $58,342.00 requires appropriation. The City intends to use the remaining funds to continue engaging the sole-source consulting firm, Mariposa Eco Consulting, Inc., to support the City’s ongoing compliance efforts related to SB 1383. These mandates require specialized technical knowledge, established compliance systems, and program implementation continuity. The consulting firm currently supports the City and is familiar with our operations, data system, hauler processes, and regulatory reporting needs.
Staff respectfully requests Council approval to authorize continued engagement of the consulting firm under a sole-source justification to maintain compliance with SB 1383 requirements.
ALTERNATIVES
Staff does not recommend any alternatives.
