2 6. PUBLIC HEARINGS
Buttonwood Village Subdivision (PL23017 – TM, UP, DR, RT) – Considering adoption of Resolution No. 23-08 PC approving a Tentative Map, Density Bonus with one concession and reductions of development standards, Planned Development Use Permit, Design and Site Review, and Tree Removal Permit for a small lot development with 14 single-family detached homes, with one affordable unit, on a 1.67-acre site at 1836 Clayton Way. The General Plan designation is Low Density Residential, Zoning classification is RS-10 (Single-Family Residential; 10,000 square foot minimum lot size); APN 114-220-019. Project Planner: Michael Hart @ (925) 603-5821 or [email protected]. CEQA: Categorically exempt pursuant to CEQA Guidelines Section 15332 (In-fill Development Projects).
Michael Hart, Associate Planner, gave a presentation and answered questions from the Planning Commission.
Commissioner Barbour asked if the Design Review Board had any further discussions pertaining to the houses on Clayton Way being reversed so the driveway, and not the backyard, faces Clayton Way. He also asked if there is any difference in how deep the anchor cement has to be for a seven-foot solid fence or a six-foot fence with a foot of lattice.
Commissioner Mizutani asked who will be maintaining Buttonwood Lane now that the project has changed from the six-lot proposal and further asked if sidewalks would be required.
Vice Chair Corio asked for clarification on who is responsible for the cost of undergrounding utilities, existing or future residents, and what happens when a project is approved which causes displacement.
Chair Laub asked if the affordable unit would share the cost of undergrounding utilities equally or would it be adjusted.
Commissioner Kaushal asked for clarification on why the project was denied when it was previously brought before the Planning Commission.
Public Comment Period
Bob Nichols, of JP Morris and Company, commented on the project and thanked staff for their work on the project.
Commissioner Barbour asked what type of vegetation is allowed in bioswales, and if water runoff could be determined on both post development and predevelopment.
Mike Milani of Milani and Associates, answered questions from the Planning Commission and addressed the earlier undergrounding of utilities questions.
Planning Commission Draft Minutes July 5, 2023
3 Emma Castro, Brian Fiddes, Roy Branda, Sue Dittmann, Alex Gillen, Brigido Rodriguez, Ravi Nadesan, Allen Ables, Rachel Sisson, Jamidi Daiess, and Gabriel Daiess expressed their concerns on the number of lots, size of the proposed homes, construction noise, removal of heritage trees, loss of privacy, additional traffic, lack of parking and sidewalks, and safety.
Commissioner Discussion
Commissioner Barbour commented that he hoped the incoming neighbors and the existing neighbors would be able to be neighborly to each other and mentioned there are funding sources to assist with undergrounding of utilities. He also stated he was not happy about the size of the open space and felt there should be more, and asked the developer to consider seven-foot fences with Simpson brackets when constructing the fences. He further mentioned he was not overly happy with the project but would be supporting it.
Vice Chair Corio encouraged neighbors to contact Senator Atkins to express their feelings about Senate Bill 330 as it has restricted the Commission’s purview on housing projects. She further stated she was conflicted on her decision, did not particularly like the project, understood the neighbor’s concerns, and she would be contacting Senator Atkins about her concerns on Senate Bill 300 and its impacts on communities.
Commissioner Mizutani mentioned he is conflicted on his decision and reiterated that the Commissioner’s hands are tied due to Senate Bill 330 and stated he inquired with the City’s legal department and found out most cases, with similar concerns, brought against SB 330 have been upheld. He also stated he likes the design of the homes but was still conflicted with the lack of sidewalks for the project. He further mentioned that curb heights, fence heights, the visibility triangle, and hammerhead turnarounds were all created for safety though the word “safety” is not written as to why these are needed in the Municipal Code and is therefore being used as a loophole. He stated he was still conflicted but was leaning toward voting to approve the resolution.
Commissioner Kaushal stated he liked the design of the project and felt there was a need for housing and would therefore be supporting the project.
Chair Laub stated in his eight years as a commissioner there had been a handful of projects he didn’t feel right about approving and this was one of them. He did like the fact that additional homes were being proposed but the issues with the parking and design were too much for the site and reiterated the Commission’s hands were tied by SB 330.
He indicated he would be reluctantly supporting the project.
Commissioner Mizutani asked for clarification on the five--public meetings rule on a single item.
Commissioner Kaushal stated the commission heard the concerns of the neighbors but that the Commission’s hands are tied and felt the project needed to move forward.

Subject: Question Regarding Council Public Hearing Item 7.a: Buttonwood Subdivision Appeal This e-mail is being shared with all Councilmembers
Mayor Hoffmeister,
You recently inquired about the earlier smaller subdivision application at the Buttonwood Subdivision location. Our Planning Manager, Mindy Gentry, has provided the requested information below. This information will be put into the public record for this item and published as a benched correspondence prior to the Council meeting next Tuesday.

Subject: RE: buttonwood question
Hi Valerie,
In March 2021, the applicant submitted an application for a six-lot subdivision, which included requests for variances and minor exceptions for lot depth and setbacks; however, the lots met the minimum 10,000 square foot minimum lot size as required by the RS-10 zoning district.
More specifically, variances were requested for lot depth for lots 2, 4, and 5 to allow for a 75- foot depth (85 feet is required) and for lot 3 to reduce the front setback to 14 feet (20 feet is required) and rear setback to 18 feet (25 feet is required). Minor Exceptions were also requested for lots 2, 4, and 5 to reduce the front setback to 15 feet (20 feet is required) and the rear setback to 20.5 feet (25 feet is required).
Each lot was proposed to have a large two-story home.
Agenda Item No. 7.a
Benched Correspondence
October 24, 2023
Neighbors voiced concerns throughout the project review on the following topics:
• the project was too dense,
• the homes were too large for the neighborhood (which generally consists of single-story homes),
• loss of privacy,
• safety concerns on Clayton Way, and
• noise.
The Design Review Board reviewed the project at three separate meetings, ultimately voting to recommend approval to the Planning Commission with a vote of 3-2 (Ayes: Shelby, Moore, Wells; Noes: Alaksa, Laub).
The Planning Commission considered the project at its March 16, 2022, meeting, and voted deny the project at its May 18, 2022 meeting with a vote of 5-0. The primary reason the Commission provided for the denial was a lack of justification for the requested variances and minor exceptions. The possibility of the project being redesigned with additional density under the small lot subdivision provisions with SB 330 protections (limiting the City’s ability to be able to deny the project) was articulated to the neighbors and the Planning Commission and was discussed during the meeting.
Following the Planning Commission denial, the applicant redesigned and resubmitted the subject project.
Thanks,
Mindy Gentry

Subject: buttonwood question
I see that the project time line in the staff report starts with ---February 20, 2023, the Applicant submitted a formal application for a Tentative Map, Density Bonus with one concession and reductions of several development standards, Planned Development Use Permit, Design and Site Review, and Tree Removal Permit for the 14-lot subdivision
I thought there was an earlier application for less units that was possibly withdrawn – then resubmitted later as this project of Feb 2023
Can someone clarify and if there was an earlier application I would like to know when submitted, for how much units, withdrawn date??
Thanks
Mayor Laura

PC Approval
• On July 5, 2023, the Planning Commission adopted Resolution 23-08PC by a vote of 4-1, approving the Buttonwood
Subdivision project.
• 11 neighbors attended the meeting, voicing concerns regarding lack of emergency vehicle access, lack of parking, loss of privacy, excessive density, and loss of trees.

29
Appeal
• On July 17, 2023, Ivan Gomez filed an appeal of the
Planning Commission's approval of the project.
• “We believe this project is a hazard to our neighborhood and disrupts the enjoyment of our property (e.g. private nuisance). We also seek more info on our rights.”
30
Response to Appeal
• SB 330 limits the City’s review of housing projects to applicable, objective general plan, zoning, and
development and design standards.
• City may not deny the Project unless specific written findings are made that the Project would result in a
“specific adverse impact” on public health and safety.
31
Response to Appeal
• The project meets the applicable objective development and design standards.
• No evidence has been submitted that the project would cause any “specific, adverse impact” on public health and safety.
32
Response to Appeal
• Project exceeds the minimum parking requirement
through a mixture of garage and driveway parking (48
spaces provided, 35 spaces required).
• Contra Costa County Fire Protection District has reviewed the project, concluding that it provides sufficient
emergency access.
33
Staff Recommendations
• Adopt Resolution denying the appeal of the Planning
Commission’s adoption of Resolution No. 23-08PC and
approving a Tentative Map, a Density Bonus with one
