General:

Referenced in Schedule:
[C] Withdrawal application and refund of fee:
[D] Fixed fees include a maximum of two completeness reviews and two public meetings. Additional completeness reviews will be charged, based upon the adopted hourly rate. [E] Fee exempt from Technology Fee.
[F] City subsidized fee.
3) If no written request for withdrawal is submitted by the time specified in 1) or 2) above, no part of the filing fee shall be refundable. (12-28-92) For services rendered by City staff which have no fee listed in this section of the fee schedule, the City Manager or the City Manager's designee shall determine the appropriate fee based on the established hourly rates for the applicable City staff as provided in Table 1. Additionally, the City will pass-through to the applicant any discrete costs incurred from the use of external service providers if required to process the specific application, including an administrative fee of 20% to cover the associated Citywide overhead costs.

Overpayment Information Any permit overpayment made by check of $15 or more will be processed for refund by check. Such refunds may take up to three weeks. Any permit overpayment made by check less than $15 will be forfeited by the applicant, as the cost to the City of processing such refunds exceeds the refund amount. Overpayments made by credit card follow the same guidelines unless the charge can be voided and correctly processed. 1) If written request to withdraw an application is submitted within three (3) workdays of filing an application, the full filing fee shall be refundable. (12-28-92) 2) If written request to withdraw an application is submitted after three (3) and within seven (7) workdays of filing an application, forty precent (40%) of the filing fee shall be refundable. (12-28-92) [A] Security Deposits (also called Refundable Security Deposits) are required in an amount equal to the expected cost of restoring City property, public infrastructure or right-of-way to its original condition. Security deposits are refundable when the deposit condition has been satisfied, but may at that time be applied by the City to any unpaid fees, hourly charges, or other costs associated with the project, after construction or other pledged purposes have been met. Applicants must request refunds of security deposits within 30 days of acceptance by the City or 30 days of permit finalization (unless otherwise stated in the Fee Schedule.) Any deposits unclaimed after four years from the date of the deposit will be forfeited. [B] Trust Account Deposit Required. Fees billed on an hourly basis require an upfront deposit of estimated fees (see "Trust Account Information" below); the totals provided on this line item represent the required minimum deposit. The Chief Building Official, City Engineer, Planning Manager or Economic Development Manager may adjust the required minimum deposit based on the project parameters and any additional information they may have. Additionally, all outside consultant costs required for the project are billed at actual cost plus 20% administrative costs to cover the City's costs of administering the requisite contract; a deposit to a trust account is required prior to any work commencing, and will be calculated based upon the consultant's estimate (including any contingency amount) plus 20%. Funds will be drawn down from the applicant's trust account as needed to pay the actual invoices and associated 20% admin fee on amounts paid.

Additional Trust Account Information Refunds of unused trust account balances will be provided upon request. Any amounts remaining in an inactive trust account will be forfeited by the depositor and/or applicant; if the remaining balance is $15 or less, account will be considered inactive after one year from date of last transaction, and in all other instances, the account will be considered inactive after four years from date of last transaction. 18

USER FEES AND CHARGES RECOVERY

1. PURPOSE
To establish policy guidelines for setting and updating User Fees and Charges; establish cost recovery goals; and ensure compliance with State law.

2. GENERAL
California Constitution Articles XIIIC and XIIID [Prop 218], Article XIIIC §1(e) [Prop 26] and Article XIIIA [Proposition 13] have placed both substantive and procedural limits on cities’ ability to impose fees and charges. This policy establishes a process for Concord’s User Fees and Charges to be reviewed and updated on an ongoing basis to ensure that fees do not exceed the City’s costs of providing services; keep pace with changes in the costs of providing the services; and keep pace with changes in methods of levels of service delivery.

3. REVIEW AND UPDATE
A comprehensive analysis of City costs and fees should be conducted at least every five years. In the interim, fees will be adjusted by annual changes in labor costs as approved by the City Council with the exception of Special Events Fees, which shall be adjusted by 3% per annum. Fees may also be changed based on supplemental analysis whenever there have been significant changes in the method, level or cost of service delivery.

4. POLICY
It is the policy of the City of Concord to set User Fees and Charges based on cost recovery levels in lieu of fully subsidizing fee-related activities with General Fund dollars. The cost recovery levels are reflective of the following policy statements.

4.1 Community-wide vs. Private Benefit: The level of user fee cost recovery should consider the community-wide versus private-benefit nature of the program or activity. The use of general- purpose revenues is appropriate for community-wide services, while user fees are appropriate for services that are of special benefit to easily identified individuals or groups.

4.2 Service Recipient vs. Service Driver: The concept of the service recipient versus service driver is particularly important for regulated activities such as development review and police-issued permits. It could be argued that the applicant is not the beneficiary of the City's development review efforts and that the community is the primary beneficiary. However, the applicant is the driver of development review costs, and as such, cost recovery from the applicant is appropriate.

4.3 Consistency with City Goals and Policies: City policies and Council goals related to the community’s quality of life may also be factors in setting cost recovery levels. For example, fees can promote city-wide goals, facilitate environmental stewardship, encourage compliance

Attachment 2

Page 2 of 3 ends

with City regulations (e.g. water heater permits, minor but important permits to ensure safety) or discourage certain actions (e.g. false alarms, which negatively impact law enforcement).

4.4 Elasticity of Demand for Services: The level of cost recovery and related pricing of services can significantly affect the demand and subsequent level of services provided. At full cost recovery, this has the specific advantage of ensuring that the City is providing services for which there is genuinely a market that is not overly-stimulated by low fees.

Conversely, high levels of cost recovery will negatively impact the delivery of services to lower income groups. This negative feature is especially pronounced, and works against public policy, if the services are specifically targeted to low income groups.

4.5 Availability of Services from the Private Sector: High cost recovery levels are generally sought in situations where the service is available from other sources in order to preserve taxpayer funds for core City services. Conversely, services that are not available from other sources and are typically delivered when residents experience an emergency typically have low or zero cost recovery levels (e.g. response to a 911 call).

It should be noted, that the current Master Fee Schedule for recreational services includes a lower rate for Concord residents than residents living outside of Concord.

4.6 Feasibility of Collection and Recovery: Although it may be determined that a high level of cost recovery may be appropriate for specific services, it may be impractical or too costly to estab- lish a system to identify and charge the user. Accordingly, the feasibility of assessing and col- lecting charges should also be considered in developing user fees, especially if significant pro- gram costs are intended to be financed from that source.

Target Cost Recovery Levels

Based on these policy statements, the following table overlays certain cost recovery levels grouped in low (0- 40%), medium (40.1% to 80%), and high (80.1% to 100%) cost recovery ranges. It is important to note that these groupings provide policy guidance and are not absolute. Some policy statements may weigh more heavily than others, which may result in a different cost recovery level grouping for particular fees. For example, fees for recre- ational activities are expected to be set in general at the medium cost recovery level. However, fees for recreational activities for which there is high demand may have a high cost recovery level due to high enrollment levels per class. It is important to note that User Fees and Charges will be reviewed at least biennially by the City Council as part of approval of the Master Fee Schedule.

SUBJ
ECT: Final Report - Review of MDRR Refuse Rate Index Rate Adjustment Request Dear
Mr. Blythe:

R3 Consulting Group, Inc., was engaged by the City of Concord (City) to assist with a review of Mount Diablo Resource Recovery’s (MDRR) Refuse Rate Index (RRI) rate adjustment request for fiscal year (FY) 2024-2025. R3 was also engaged by the City to review the mathematical accuracy and reasonableness of MDDR’s request.

MDDR is requesting an 5.53% indexed increase, plus 4.61% for the 5-year Base Year Rate Adjustment, coming to a total increase of 10.14%. R3 concurs with the calculated rate increase and does not recommend any changes.

MDRR’s initial rate adjustment request was submitted to the City on January 29, 2024. The Rate Setting Process and Methodology Manual states that if MDRR fails to submit the financial information in the required format by January 31
st it is agreed that MDRR shall be deemed to have waived the RRI for that year.

R3 reviewed Mt. Diablo Resource Recovery’s rate application and confirmed that:

The correct indices were used;
It is mathematically accurate;
It is consistent with applicable terms and conditions of the City’s Franchise Agreement and the Rate S
etting Manual; and
The magnitude of the request is reasonable.

This final report presents the results of our review.

We appreciate the opportunity to be of service to the City. Should you have any questions regarding this report or need any additional information, please don’t hesitate to reach out directly.

Sincerely,
Maryann Hulsman | Consultant Alex Soulard | Sr. Consultant R3 Consulting Group, Inc. R3 Consulting Group, Inc.

FINDINGS
City of Concord | Review of MDRR Refuse Rate Index Rate Adjustment Request Page 1 of 2 Background
Mount Diablo Resource Recovery (MDRR) has an exclusive franchise agreement (Agreement) with the City of Concord for the collection of solid waste, recyclables, and organics. Commercial rates are adjusted as negotiated between MDRR and the commercial customers; however, maximum permissible residential rates are approved by the City Council pursuant to the requirements of the franchise agreement. The franchise agreement with MDRR contains a Rate Setting Manual, which describes the methodology for annual refuse rate adjustments and special extraordinary increases. The rate adjustment request is due from MDRR on January 31st of each year and is required to contain the following components:
》 Financial information, which is used to determine relative item weightings for each of the RRI components; and
》 Calculation of the appropriate percentage change in each of the indexed categories.

Thes
e two main components are multiplied for each indexed category, resulting in a weighted percentage change, which are then summed to produce a total percentage change applied to each residential rate.

The C
ity of Concord and MDRR previously agreed to rate increases as part of the Base Year Rate Application in 2021, which resulted in a 21.55% rate increase that was spread over 5 years as follows:
》 9.76% increase in 2022
》 RRI plus 4.61% in 2023
》 RRI plus 4.61% in 2024
》 RRI plus 6.26% in 2025
》 RRI plus 6.26% in 2026
The
requested 2024 RRI increase would thus be in addition to the scheduled increase of 4.61% in 2024 that represents year three of the Council-approved five-year implementation of the 2021 Base Rate Application. This scheduled increase was agreed to in 2022 to spread the MDRR’s 2022 special extraordinary request for rate adjustment over a five-year period.

Rate Adjustment Requests & Recommendations
MDRR’s initial request, made on January 29, 2024, calculated a rate adjustment of 5.53%, as shown in Table 1. MDRR used the 2022 actual costs by category as per the rate adjustment methodology detailed in the Rate Setting Process and Methodology Manual for Residential Solid Waste Fees (Updated Manual, March 2019, or “Rate Setting Manual”). Using the various categories and indices, MDRR calculated a weighted percent change of 5.53%. Table 1, below, shows MDRR’s initial rate application request.

City of Concord | Review of MDRR Refuse Rate Index Rate Adjustment Request Page 2 of 2 R3 re
viewed the indices and the calculation methodology used in the MDRR application. The data and calculations for the Compressed Natural Gas (CNG) index were missing from the original application, so a revised application was requested by R3.

MDR
R submitted the revised request on February 15, 2024, with data and calculations explaining the CNG index change. The revised submittal did not result in any changes to the RRI request shown in Table 1.

R3 c
ompared the 2022 expenses by category to those from 2021 and noted that the differences were minor, leading to only minor variations in the Item Weightings.

The 5.
53% rate increase, which R3 concurs with, would be in addition to the 2024 rate increase “spread” described above, resulting in a total rate increase of 10.14%.
