Subject: Constituent Comments: Homeless initiative and Citizen Police Academy
Dear City Council:
I am disappointed that the vote to utilize the five million in funding towards the homeless initiative fell short with just two votes. Please make this a priority and vote for it.
Also, please see if you can resume the Citizen Police Academy at Concord PD. I believe it's a rather good way for individuals to learn more about policing and thereby be informed on what officers go through on a daily basis.

The second phase of the Project, considered in this report, will involve the sewer and storm drain replacement, and pavement rehabilitation.
The Project combined two projects into one for the purposes of bidding and has been designed and competitively bid and is at the point of construction contract award. If award is approved by Council, Project construction in the field is expected to begin in July 2024 and be completed by September 2024, weather permitting.
Construction management, inspection, and materials testing services for the Project are needed to ensure work during construction by the contractor is performed and completed in a manner satisfactory to the Project contract documents and the City of Concord (City).

Background
On June 28, 2022, Council adopted the 2-Year CIP Budget for FY 2022/2023 and FY 2023/2024, which included the Pavement Maintenance – Zone 3N (Project No. 2623).
On June 6, 2023, Council adopted the mid-cycle adjustments to the CIP Budget for FY 2023/2024, which included the initial funding for the Aspen Drive Sewer Replacement (Project No. 2703).
On September 13, 2023, the City presented the bicycle signage additions included in Pavement Maintenance – Zone 3N (Project No. 2623) to the City’s Bicycle and Pedestrian Advisory Committee (BPAC. BPAC was supportive of the design.
On October 11, 2023, after combining the two projects into one for the purposes of designing, bidding and constructing, staff held an in-person open house community meeting on the combined Project. The meeting informed the residents within the neighborhood about the proposed pavement treatments and bicycle signage additions.
Approximately 1,700 residential units were notified and approximately five residents attended the meeting. Residents were mostly concerned about the schedule and logistics during construction but did not have any issues with the proposed improvements.
City staff (Staff) has planned to complete the combined Project in two phases, concrete construction and sewer and pavement rehabilitation. This was done to allow specialized contractors to bid on the project, minimizing construction costs and helping to address residents’ concerns with schedule. This sewer and pavement construction contract award is what is before Council tonight. The construction management contract,
City Council Agenda Report

however, will cover both phases of the Project. The construction management contract is also before Council tonight in this report.
On May 14, 2024, Council awarded the concrete construction phase to Villalobos & Associates, Inc. The concrete construction is proposed to begin in June 2024 and be completed by July 2024, ahead of the pavement construction phase.
If awarded tonight, the sewer and pavement construction is anticipated to begin in July of 2024 and be complete in September 2024, weather permitting.
Analysis/Procurement Process
Construction Contract
The Project was advertised for construction bids as required by state law and City policy. The Engineer’s Estimate for the Total Bid is $1,489,500.55. Bids were opened on May 2, 2024, and two (2) bids were received. The basis of award for the Project is the Total Bid. The lowest bid was received from Radius Earthwork Inc. of Campbell, CA. A summary of the two (2) lowest bids is as follows:
BID SCHEDULE Engineer’s
Estimate
Radius
Earthwork Inc.
Carone and
Company Inc.
Bid Schedule A $1,181,261.30 $1,196,549.54 $1,533,853.00 Bid Schedule B $184,170.00 $149,300.48 $190,700.00
Bid Schedule C $124,069.25 $107,088.80 $64,390.00
Total Bid $1,489,500.55 $1,452,938.82 $1,788,943.00
Radius Earthwork Inc. was the lowest bidder and submitted a responsive and responsible bid. Radius Earthwork Inc. has an appropriate and valid contractor’s license and has previously completed a CIP project, Pavement Maintenance Zone 5J (Project No. 2526).
Staff completed analysis of Radius Earthwork Inc.’s bid, determining that this contractor along with its subcontractors possess appropriate and valid licenses, are not on any debarred lists, and agreed to be bound by the Citywide Project Stabilization Agreement.
Radius Earthwork Inc. is registered with the Department of Industrial Relations as required by SB 854.
The City reserved the right to include any combination of the bid schedules to the project at its own discretion. Staff has determined there are sufficient funds to award the Total Bid.
City Council Agenda Report
Agenda Item No. 3.a

Construction Management
Staff issued a Request for Proposal (RFP) to select a consultant to provide construction management, inspection, and materials testing services on March 7, 2024. The RFP was advertised in the local newspaper and on the City’s Procurement Website. Four (4) proposals were received, which were reviewed and ranked by Staff.
Based on the analysis of the proposals, interviews, and references, Zoon Engineering of Emeryville, CA (Zoon) was selected as the most qualified firm to provide construction management, inspection, and materials testing services for the Project. Staff and Zoon negotiated the scope of work and cost for the services and agreed upon a base amount of $249,888.20 as a fair and reasonable compensation for the services needed to complete the construction phase of the overall project. Staff has included a 10% contingency of $24,988.82, bringing the total potential contract amount to $274,877.02, should the full contingency be necessary. This total contract amount will cover both the Curb Ramps construction phase and Pavement construction phase of the overall Project.
Project Stabilization Agreement
On September 13, 2016, the City Council approved a Citywide Project Stabilization Agreement with the Contra Costa Building & Trades Council for City projects with a construction contract valued at over $750,000. Project No. 2623 will be subject to the requirements of the Project Stabilization Agreement as the estimated construction costs exceed $750,000. The prospective bidders for this project were made aware of this requirement as part of the construction contract. Radius Earthwork Inc. and their subcontractors have submitted the required agreement to be bound forms for the Citywide Project Stabilization Agreement. Zoon and Ninyo & Moore, Zoon’s material testing sub-consultant, have both agreed to be bound to the Citywide Project Stabilization Agreement for material testing during construction.
Financial Impact
The current total budget for Pavement Maintenance - Zone 3N (Project No. 2623) is $1,980,000 and is funded by Measure J Local Funds (Fund 485) and Capital Projects General Fund (Fund 400). Additionally, the current total budget for Aspen Drive Sewer Replacement (Project No. 2703) is $650,000 and is funded by Sewer Operating Funds (Fund 710). There are sufficient funds to award the Pavement phase of the Pavement Maintenance - Zone 3N and Aspen Drive Sewer Replacement construction contracts.
There are also sufficient funds to award the construction management, inspection and materials testing services, Staff oversight, and an approximate construction contingency of 10 percent for the Pavement Maintenance – Zone 3N and Aspen Drive Sewer Replacement projects.

CITY may terminate the Agreement upon five (5) days written notice if CONSULTANT breaches this Agreement. In the event of any termination, CONSULTANT shall promptly deliver to the CITY any and all finished and unfinished reports or other written, recorded, photographic, or visual materials, documents, data, and other deliverables (“Work Materials”) prepared for the CITY prior to the effective date of such termination, all of which shall become CITY’s sole property. A. CONSULTANT covenants and represents that neither it, nor any officer or principal of its firm, has, or shall acquire any interest, directly or indirectly, which would conflict in any manner with the interests of CITY or which would in any way hinder CONSULTANT’s performance of services under this Agreement. CONSULTANT further covenants that in the performance of the Agreement, no person having any such interest shall be employed by it as an officer, official, agent, employee, or subcontractor without the express written consent of the CITY. CONSULTANT agrees to at all times avoid conflicts of interest, or the appearance of any conflicts of interest, with the interests of the CITY in the performance of this Agreement.

20. ENFORCEABILITY; INTERPRETATION. In the event that any of the provisions or portions of application of any of the provisions of the Agreement are held to be illegal or invalid by a court of competent jurisdiction, CITY and CONSULTANT shall negotiate an equitable adjustment in the provisions of the Agreement with a view toward affecting the purpose of the Agreement. Report in Brief
On June 14, 2022, the City Council (Council) approved four separate Agreements for Professional Services for Plan Check and Building Inspection Services (Agreements).
The related Staff Report and Agreements can be found here: June 14, 2022, City Council Meeting. In the staff report and Agreements, the payment limit was set not-to- exceed $500,000 for the entire 5-year term of the Agreements when it was intended to have been set at $500,000 per fiscal year. The agreements are not guarantees of work, but rather they establish a contract relationship with pre-qualified firms for specialized

work, to be accomplished as assigned by the City’s Chief Building Official, with a not-to- exceed amount per fiscal year.
The four proposed First Amendments to the Agreements (see Attachments 2-5) correctly identify and set the not to exceed limits to $500,000 per fiscal year.
Recommended Action
Approve First Amendments to the Professional Service Agreements with 4LEAF, West Coast Code Consultants, TRB and Associates, and SHUMS Coda Association for Plan Check and Building Inspection Services, in the not-to-exceed amount of $500,000 per fiscal year for the term of each agreement; and authorize the City Manager to execute the Amendments in a form acceptable to the City Attorney.
Background
The current fiscal year and next fiscal year each include $515,000 for the use of specialized consulting services for the Building Division. Retaining multiple consultants under contract concurrently provides the City of Concord (City) with flexibility to utilize different consultants based on their subject expertise and availability. One consulting firm may have inspectors available but not plan checkers, while another may have plan checkers and not inspectors. Some may have staff available to cover positions in the office, while others may only be available to perform remote work. Historically, the City has maintained contracts with multiple building consultants and utilized more than one at a time for these very reasons. This has been an effective practice to deliver the best possible service to our customers. Setting the not-to-exceed amount for each of the contracts near the annual budgeted amount for consultant services provides the Building Division with full flexibility to distribute workload between consultants, as needed under various circumstances. None of the contracts guarantee any amount of work for the firm, rather they allow the City to pre-qualify firms and establish a contractual relationship, so that each firm can proceed with work as needed by the City and assigned by the Chief Building Official.
Analysis
The current Agreements limit the total compensation to each consultant to $500,000 for the entire 5-year term of the Agreement. The intention was to allow the use of these firms either individually or in combination for up to $500,000 for each year of the contractual arrangements. Approving the First Amendments to their agreements will allow this to occur.
Financial Impact
None. The cost of these professional services is charged directly to building permit and inspection customers and fully reimbursed to the City. All allowable compensation associated with these Amendments is fully funded by revenue from Building Permit Plan Review and Inspection fees and is limited and controlled by the Council approved two year 2023-24/2024-25 budget.

Environmental Determination
Pursuant to Public Resources Code Section 21065, CEQA Guidelines Sections 15060(c), 15061(b)(3), and/or 15378, this activity/award of this contract for design professional services is not subject to environmental review under the California Environmental Quality Act (CEQA) of 1970, as amended, as it does not constitute a “project,” does not constitute discretionary approval of a specific project, and will not result in a direct or reasonably foreseeable indirect physical change in the environment, and in the alternative is exempt from CEQA as it falls within the “common sense” exemption set forth in CEQA Guidelines Section 15061(b)(3), excluding projects where “it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.” No unusual circumstances exist and none of the exceptions under CEQA Guidelines Section 15300.2 apply. This determination reflects the City’s independent judgment and analysis. Individual projects will undergo CEQA analysis as necessary.

Subject: Considering approval of 27 Master Services Agreements (MSAs) for various consultant services for the Community Development Department; and authorizing the City Manager to execute the Agreements in a form acceptable to the City Attorney.
CEQA: Not a “project” under CEQA Guidelines 15060(c)(2) and 15378; in the alternative, exempt pursuant to Section 15061(b)(3).
Report in Brief
The Engineering Services Division (Engineering) within the Community Development Department (CDD) is responsible for the design and construction of projects identified in the Capital Improvement Program (CIP). In addition, both the Transportation Division of Public Works and the Planning Division of CDD, as well as the Current Development section of Engineering, are responsible for Development Review services. These respective divisions fulfill their responsibilities by relying on both internal staff and professional consultant resources.
The Master Services Agreement (MSA) process simplifies and accelerates the design delivery of small to medium-sized projects that require professional consultant support.

City Council Agenda Report
Agenda Item No. 3.c
June 4, 2024
It does this by pre-qualifying and establishing contractual relationships with specialized firms, prior to work being needed, allowing them to perform work associated with specific projects defined by a future Task Order (TO).
It is estimated that the use of MSAs will save the City of Concord (City) over $100,000 this year alone in the staff time that would otherwise be spent requesting and evaluating multiple proposals and issuing and processing contracts for each small project or need.
The MSA process has been used successfully for many years within the City.
With the City Council’s (Council) approval and the City Manager’s execution of the MSAs, the City Engineer will be authorized to issue TOs up to $200,000. TOs greater than $200,000 will be brought to Council for consideration. The proposed MSAs would all expire on June 30, 2026, with the option for a mutually agreed upon one-year extension.
Funding for each TO must be identified and available prior to issuance and each TO, regardless of amount. Additionally, each TO requires review and approval by the City Attorney and the Finance Director for conformance with the City’s regulations and existing Agreements. Under the proposed MSAs, the total not-to-exceed cost of services is$1,000,000 per fiscal year per consultant firm. However, an MSA does not commit the City to any expenditure of funds nor guarantee any amount of work to the contracted company; rather, as stated above, expenditures are made through the issuance of TOs on a project-by-project basis to a pre-qualified firm.
Recommended Action
Approve 27 Master Services Agreements (MSAs) for various consultant services for the Community Development Department (Attachment 2); and authorize the City Manager to execute the Agreements in a form acceptable to the City Attorney, and make the CEQA determinations as provided in this staff report.
Background
Through the adopted CIP, and Capital Budget which funds and authorizes the implementation of individual projects, the Council allocates funds for improvement projects. Engineering is responsible for managing the design and construction of those capital improvement projects. In addition, Transportation and Planning, as well as Current Development, are responsible for Development Review services. These respective divisions fulfill their responsibilities by relying on both internal staff and professional consultant resources.
The MSA process supplements the traditional Request for Proposal (RFP) process, which will continue to be used for both large and special projects. The MSA process is a more efficient means to authorize work for smaller expenditures, while there are still many projects in the CIP that will require the use of the traditional RFP process.
City Council Agenda Report
Agenda Item No. 3.c
June 4, 2024
The purpose of the MSA process is to simplify and accelerate the delivery of small to medium-sized projects by authorizing staff to issue project-specific TOs to pre-selected consultants. The use of these consultant firms is needed by the City as they provide specialized expertise and/or professional experience that is needed for certain projects but is not within the skill set or workload capacity of City staff (Staff). The MSA process accelerates project schedules by at least six weeks, which is the time it would take to bring a professional services contract to Council for approval.
Council’s approval of the MSAs authorizes Staff to assign projects to selected consultants under the Agreements and authorizes Staff to issue TOs for each project, within the limits set in the MSAs. For each project, Staff will select a consultant based on their qualifications, availability, and the specific needs of the project. Staff and the consultant negotiate a contract including the proposed scope of work, schedule, and compensation. The contract will be executed through a TO and after approval of the TO by the City, the consultant will proceed with the requested work.
Under the proposed MSAs, the City Engineer is authorized to approve up to $200,000 for an individual TO. TOs with compensation of more than $200,000 will continue to be considered by Council. The proposed MSAs will all expire on June 30, 2026, with the option for a one-year extension upon mutual agreement. Each TO requires review and approval by the City Attorney and the Finance Director for conformance with City Policy and existing agreements. Under the MSAs, the total not-to-exceed cost of services is $1,000,000 per fiscal year per consultant firm. It is clear to all of the proposed firms that entering into an MSA is not a guarantee of future work with the City.
A notice for a Request for Qualification (RFQ) was advertised in the Contra Costa Times on July 26, July 28, August 2, and August 8, 2023. The RFQ was published on Public Purchase on July 25, 2023, and responses were requested by September 14, 2023. A notice for RFQ was re-advertised in the Contra Costa Times on January 25 and February 4, 2024, for four disciplines (Mechanical Design Services, Right-of-Way Services, Interior Design Services, and Pavement Management Inspection) due to a low number of applicants in these disciplines. The RFQ for those disciplines was published on Public Purchase on January 25, 2024, and responses were requested by February 29, 2024.
Staff received one hundred and twenty-one (121) Statements of Qualifications (SOQs).
The firms were separated into eighteen (18) disciplines (or areas of expertise) for evaluation: CCTV Pipeline Services, Architecture Design Services, Civil Design Services, Electrical Design Services, Interior Design Services, Landscaping Design Services, Mechanical Design Services, Structural Design Services, Traffic Design Services, Development Plan Review, Environmental Services, Geotechnical Services, Materials Testing Services, Pavement Management Inspection, Project Coordination/Construction Management, Right of Way Services, Survey Services, and Utility Location Services. Development and Public Works (Transportation, Parks, and Recreation divisions) reviewed the SOQs based on discipline. The committee selected the firms best suited and most qualified to provide services for the City’s projects and anticipated needs.
Analysis
The recipients of an MSA fully understand that such an agreement is not a guarantee of work. This selection process and award of an Agreement provides a pool of pre- qualified and pre-contracted “go-to” firms when specialty work is required on projects, which allows Staff to expedite the contracting process. Multiple firms are chosen in each discipline to allow Staff the ability to select a firm based on schedule and/or availability depending on project needs and qualifications.
The proposed MSAs with twenty-seven consultants (Attachment 2) include consulting firms selected to provide professional and specialized services. Staff reviewed each firm’s past experience, performance, and availability in considering the best choices, to provide the needed services for projects slated for implementation in FY 2024-25 through FY 2025-26. The name of each firm is listed in Attachment 1 with the fields they have been “pre-qualified” shown on the side, and if the firm is new to the MSA process (NEW) is listed in bold.
The disciplines for the MSAs proposed for award in this report are firms that have qualified for Design Services for Civil Engineering and Project Coordination/ Construction Management Services. With the passage of Measure V, the City has undertaken an increased amount of roadway, sewer, fiber, traffic signal, and facilities construction. Costs for design engineering and construction management are generally larger therefore the total not-to-exceed cost of $1,000,000 ensures that there are adequate qualified consultants available under the MSAs for the upcoming CIP projects.
If consultant firms have submitted qualifications for multiple disciplines and have been deemed qualified by Staff, those additional disciplines will also be included under their MSA.
The MSAs for consultants that only focus on disciplines such as CCTV Pipeline Services, Architecture Design Services, Electrical Design Services, Interior Design Services, Landscaping Design Services, Mechanical Design Services, Structural Design Services, Traffic Design Services, Development Plan Review, Environmental Services, Geotechnical Services, Materials Testing Services, Pavement Management Inspection, Right of Way Services, Survey Services, and Utility Location Services, will be brought to the council at a later date with a reduced not-to-exceed limit.
Financial Impact
Funding for the CIP projects, including all project consultant costs, is included in the adopted Two-Year Capital Budget. It is estimated that the use of MSAs will save the City over $100,000 this year alone in Staff time.

Environmental Determination
Council action on this item is exempt from California Environmental Quality Act (CEQA) review as the approval of a project listing and budget amendment are not activities that constitute a "project" within the meaning of Public Resources Section 21065, CEQA Guidelines Sections 15060(c)(2) and/or 15378), do not commit the City to a definite course of action, and do not constitute discretionary approval of a specific project; if this was determined to be a “project” for CEQA analysis, this activity falls within the "Common Sense" CEQA exemption outlined in CEQA Guidelines Section 15061(b)(3).
This determination reflects the City’s independent judgment and analysis. Individual projects will undergo CEQA analysis as necessary.
