City Council Agenda Report
Agenda Item No. 4.a
December 9, 2025
Recommended Action
Approve a Construction Contract in the not-to-exceed amount of $190,637.08 to PlayCore Wisconsin, Inc. dba GameTime, $173,306.08 base amount and an additional 10% of $17,331 as project contingency for contract change orders, to replace playground at Concord Community Park; authorize the City Manager to execute the contract in a form acceptable to the City Attorney; and make the CEQA determinations as provided in this staff report (Funded by PJ 2387).

Background
The City maintains 20 playgrounds at various locations throughout the City. The lifespan of playgrounds varies based on the manufacturer, material, location, exposure, use, vandalism, and other factors. A typical City replacement schedule is every 15 years, or so. The factors above can either speed up or delay the replacement timeline, as can financial resources available. The Public Works Department replaces one to two playgrounds every two years as part of the Capital Improvement Program, but our replacement plan had been delayed over the past four years due to the City’s emphasis on roadway repairs throughout the City.

As part of playground maintenance, staff conduct high frequency inspections on a monthly basis and staff that are Certified Playground Safety Inspectors conduct annual safety inspections. These inspections help to inform and guide staff recommendations on playground replacement schedules. The playground at Concord Community Park Playground is over 10 years old and is subjected to above average use due to increased foot traffic and events that take place at the park Keeping this playground usable has become maintenance intensive because of this use and parts are beginning to fail with higher frequency. Some of these parts have become irreplaceable and need to be manufactured at an increased cost for the City in order to keep the play structure usable.

On November 4, 2025, City Council voted to accept and allocate a grant from the California Parks and Recreation Society (CPRS) as part of the 2025 CPRS Statewide Training and Funding Initiative for a playground replacement that met specific criteria as a National Demonstration Site (NDS) and purchase playground equipment to replace the playground at Concord Community Park.

Analysis
This playground was scheduled for replacement based on the standard replacement cycle, regular maintenance demand, availability of replacement parts, frequency and demand of use, and other factors. As a result, staff brought the recommendation to move forward with proposed replacement of the playground at Concord Community Park to the Parks, Recreation, and Open Space Commission (PROSC) on March 12, 2025. A presentation was given to the Commission. Staff received a recommendation from PROSC to move forward with a playground replacement at this location.

Report in Brief
The Capital Improvement Program project titled “On-Call Citywide Sidewalk Replacement Phase 4 (Project No. 2341)” is intended to provide City staff with access to an on-call concrete contractor to perform as-needed repairs to sidewalks, driveways, and curb and gutter. The project is specified as a one-year “on-call” services contract with a renewable option for up to two additional years upon mutual agreement of the contractor and City of Concord (City). This on-call service would provide an opportunity for residents to utilize the City’s contractor to repair damaged sidewalks, curbs, gutters,

and driveways in front of their properties for projects that are either emergencies of have a cost under $75,000.

Seven bids were received and opened on Thursday, October 23, 2025. Frontline General Engineering Construction Inc. of Tracy, CA (Frontline) was considered the apparent low bidder after the several bidders were deemed non-responsive.

Recommended Action
Award an on-call construction contract for Citywide On-Call Citywide Sidewalk Replacement Phase 4 (Project No. 2341) to Frontline General Engineering Construction Inc. for one year (with two one-year extensions possible) and a not to exceed amount of $500,000 annually, and authorize the City Manager to execute the contract in a form acceptable to the City Attorney.

Background
The bid package for this project was structured as an “on-call” service contract for the replacement of sidewalk, driveways, curbs, and gutters. In order to provide prospective bidders with a biddable estimate of “on-call” services for the year, staff provided an “estimated quantities” of various items of work needed over the year to establish “per unit” costs for each work item. For example, the prospective bidder was asked to provide a per-unit cost for the removal and replacement of sidewalk on a square foot basis.

Determination of the lowest responsive and responsible bidder was based on the total bid for the estimated quantities. Actual work will be outlined on work orders issued to the contractor, as needed, with a limited window for repair. An individual project will be limited to emergencies and/or situations where the total cost of the project is less than $75,000. The contractor would then be paid as each work order is completed based on the unit prices. The On-Call Citywide Sidewalk Replacement Phase 4 is specified as a one-year “on-call” services contract with a renewable option for up to two additional years upon mutual agreement of the contractor and the City. The City had an existing on-call sidewalk replacement service, awarded in December 2022, which concludes at the beginning of December 2025. Kerex Engineering Inc. is the on-call contractor for the previous contract.

Procurement Process
The project was advertised for construction bids as required by state law and City policy. Bids were opened on October 23, 2025. Seven (7) bids were received in the amount ranging from $363,750 to $486,850 as shown in the Bid Summary (Attachment 1). The lowest responsive bid was received from Frontline. The Engineer’s Estimate for the Total Bid was $400,000. A summary of the responsive bids is as follows:

Total Bid $400,000 $453,710.04 $481,000 $486,850
The basis of award for this project is the Total Bid and there are no additive bids. There were four bidders with lower bid totals than Frontline but they did not submit a responsive bid. The City received written and verbal confirmation that these four contractors acknowledging they would be deemed a non-responsive bidder. Frontline was the next lowest bidder and submitted a responsive and responsible bid. Frontline has an appropriate and valid contractor’s license and satisfactory work references.

The on-call contract will be limited to a not-to-exceed amount of $500,000 per year to perform work as assigned by Public Works on a work order basis. This not-to-exceed amount is not a guarantee of work. The awarded on-call contract will lock in Frontline’s unit prices for the one-year contract and for the two possible additional years of the contract.

Financial Impact
The award of the on-call construction contract does not directly appropriate or expend funds. Funding for each work order would need to be in place prior to issuance a notice to proceed and will be provided from existing capital or operating budget allocations or via reimbursement from individual property owners. The on-call construction contract award limits the maximum annual cumulative value of work performed through all assigned work orders up to $500,000 per year.

Environmental Determination
Pursuant to the California Environmental Quality Act (CEQA) of 1970, Public Resources Code Section 21000, et. Seq., as amended and implementing State CEQA Guidelines, Title 14, Chapter 3 of the California Code of Regulations (collectively “CEQA”), awarding this contract does not constitute a “project” within the meaning of Public Resources Code Section 21065, 14 Cal Code Regs. Sections 15060(c), 15273, 15378, as it has no potential for resulting in a direct or reasonably foreseeable indirect physical change in the environment and/or the activities consist of creation of government funding mechanisms or other government fiscal activities which do not constitute a “project”. Even if approval of the purchase did constitute a project under CEQA, the approval of this purchase falls within the “common sense” exemption set forth in 14 Cal.

Code Regs. Section 15061(b)(3), excluding projects where “it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.”

City Council Agenda Report
Agenda Item No. 4.b
December 9, 2025
Approval of the contract is exempt under CEQA Guidelines Sections 15301 – Existing Facilities, 15302 – Replacement and Reconstruction, 15303 – New Construction or Conversion of Small Structures, and/or 15304 – Minor Alterations to Land, as it involves de minimus construction and reconstruction sidewalks. No unusual circumstances exist and none of the exceptions under CEQA Guidelines Section 15300.2 applies.

Accordingly, further environmental review is not warranted. This determination reflects the City’s independent judgement and analysis. The Notice of Exemption will be filed with the County Clerk’s Office following Council approval of the on-call contract.

CEQA: Not a project/exempt pursuant to Public Resources Code Section 21065, CEQA Guidelines Sections 15060(c),

Report in Brief
The City of Concord’s Police Department utilizes police car Mobile Data Computers (MDC’s) and various other in-vehicle technologies to aid in law enforcement duties. The existing MDC units are seven years old, at end-of-life, and require replacement. The systems also do not meet the technical specifications to upgrade to the new Windows 11 operating system that is required by Microsoft to receive security patches and updates.

The total cost to purchase 68 Mobile Data Computers (MDC’s), with installation services, from CDCE Inc. is $539,909.04 (Attachment 1). After adding in a 5% contingency, the total not-to-exceed amount requested is $566,905. All requested

funding has been previously identified and approved in CIP #2218, Citywide Technology Hardware and Software Replacement.

Recommended Action
Authorize the City Manager to approve the purchase of 68 police Mobile Data Computers (MDC’s) and installation services from CDCE Inc. in an amount not-to- exceed $566,905, including a 5% contingency, in accordance with the City’s technology replacement schedule; authorize the City Manager to execute an agreement in a form acceptable to the City Attorney; and make the CEQA determinations as provided in this staff report.

Background
The City maintains a replacement schedule and fund for IT equipment to ensure reliability, security and optimal performance. The current Police Mobile Data Computers were purchased in 2018, and in accordance with the City’s replacement schedule, are due for replacement.

Police in-vehicle Mobile Data Computers provide:
• Dispatch communications
• Automatic vehicle location (AVL)
• CLETS communications
• Police report writing
• Support for In-Car and Body Camera functionality
• Access to Evidence SYNC/Evidence.com
Analysis
To maintain the City’s MDC’s, IT staff must perform periodic updates for maintenance, security, and functional enhancements. On October 14, 2025, Microsoft ended support for Windows 10, the operating system loaded on the current MDC’s. Microsoft does not support upgrading the current MDC’s to Windows 11 and will no longer provide security patches and updates for Window 10. With this lack of support, and the fact the current MDC’s are at end-of-life and require replacement.

The total cost to purchase 68 Mobile Data Computers (MDC’s) and installation services from CDCE Inc. is $539,909.04 (Attachment 1). After adding in a 5% contingency, the total not to exceed amount requested is $566,905. All requested funding has been previously identified and approved in CIP #2218, Citywide Technology Hardware and Software Replacement.

Procurement Process
Pursuant to Municipal Code-Title 3 Revenue and Finance-Chapter 3.10 Purchasing, the City may participate in a cooperative purchase or “piggyback” off an existing contract and join with other public jurisdictions in cooperative purchasing plans or programs when determined to be in the City’s best interest. NASPO is aggressive in searching for the best prices by issuing nationwide RFP’s and inviting top manufactures to submit proposals for the various government needs. After the bid opening occurs, NASPO and the partnering government entity enters a contract with the best vendor. This is an example of the waiver of bidding regulations, as stated in the Municipal Code section

3.10.080.

Environmental Determination
This activity does not constitute a “project” and/or is exempt from environmental review pursuant to Public Resources Code Section 21065, California Environmental Quality Act (CEQA )Guidelines Sections 15060(c)(2), and/or 15378 because there is no potential that it will result in a direct or reasonably foreseeable indirect physical change in the environment. Even if the activity does comprise a project for CEQA analysis, it falls within the “common sense” CEQA exemption set forth in CEQA Guidelines Section 15061(b)(3), excluding projects where “it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.” Financial Impact
There is no additional fiscal impact associated with this action as all necessary funding has been previously budgeted and approved in the Citywide Technology Hardware and Software Replacement CIP project #2218.
