3.122 The City Council may meet in closed session during this period.

3.123 The City Council shall not reconvene the open session of the meeting until at least one hour following the disruption, or until telephonic or internet service is restored, whichever is earlier.

3.124 Upon reconvening the open session, if telephonic or internet service has not been restored, the City Council shall adopt a finding by rollcall vote that good faith efforts to restore the telephonic or internet service have been made in accordance with this policy and that the public interest in continuing the meeting outweighs the public interest in remote public access.

3.13 Exceptions to Remote Public Access. Remote participation will not be provided for any City Council meeting held to do any of the following:

3.131 Attend a judicial or administrative proceeding to which the City is a party.

3.132 Inspect real or personal property provided that the topic of the meeting is limited to items directly related to the real or personal property.

3.133 Meet with elected or appointed officials of the United States or the State of California, solely to discuss a legislative or regulatory issue affecting the City and over which the federal or state officials have jurisdiction.

3.134 Meet in or nearby a facility owned by the City, provided that the topic of the meeting is limited to items directly related to the facility.

3.135 Meet in an emergency situation pursuant to Government Code Section 54956.5.

3.2 Special Meetings. The presiding officer or a majority of the City Council may call a special meeting at any time in accordance with Government Code Section 54956.

3.3 Study Sessions. Study sessions may be conducted as part of a regular or special meeting. Study sessions may be scheduled as deemed necessary or desirable for exchanging information and providing direction to City staff prior to final action by the City Council.

3.4 Closed Sessions. The City Council may, from time to time, meet in closed session, not open to the public or the news media, to discuss litigation, real estate negotiations, personnel matters, labor relations, and other matters authorized by the Brown Act. The City Attorney shall prepare the agenda description for each closed session item.

3.5 Emergency Meetings. Emergency meetings may be called without complying with the 24-hour notice requirement in accordance with Government Code Section 54956.5.

4. MEETING CONDUCT
At the time scheduled for each regular or special meeting, the members of the City Council, the City Manager, the City Clerk, the City Attorney, and such Department Heads or others as have been requested to be present, shall meet in the Council Chamber or other meeting location as designated in the posted agenda. The business of the City Council shall be conducted in substantially the manner herein provided. In situations not expressly governed either by State law or these procedural rules, the City Council may proceed in accordance with the parliamentary rules set forth in the revised version of Rosenberg’s Rules attached hereto. Failure to follow these procedural rules or the revised version of Rosenberg’s Rules shall not invalidate a City Council action.

4.1 Quorum and Voting. Three members of the City Council shall constitute a quorum for the transaction of business. When there is no quorum, the Mayor shall adjourn the meeting, or if no member of the City Council is or will be present, the City Clerk shall adjourn the meeting. Notice of adjournment shall be posted as required by Government Code Section 54955. For the purpose of considering any item subject to vote of the City Council, when any member of the City Council is disqualified due to a conflict of interest, hia/her their presence shall not be considered in determining the existence of a quorum. Consideration of such items shall be deferred until a quorum of disinterested Councilmembers is present to discuss and vote on the items unless otherwise authorized by the Political Reform Act (Government Code Section 87100 et seq.) and the Fair Political Practices Commission Regulations. Except as otherwise provided by law, a majority of the Councilmembers present and voting shall be sufficient to approve an action, provided, however, that at least three votes are required for the passage of any ordinance, resolution, or orders for the payment of money pursuant to Government Code Section 36936.

4.2 Rules of Debate. A motion must be seconded before it can be discussed. A second merely implies that the seconder agrees that the motion should come before the City Council and not that the seconder is in favor of the motion. A second may be withdrawn for any reason before the motion is voted on.

4.21 Recognition. Every member of the City Council desiring to speak shall address the Mayor and, upon recognition by the Mayor, shall confine him/herself to the question under debate.

4.22 Rights of Mayor. The Mayor may move, second, and debate any item before the City Council subject only to such limitations of debate as are imposed by these rules on all members of the City Council and shall not be deprived of any of the rights or privileges of a member of the City Council, including the right to vote on all motions and other actions of the City Council.

4.23 Interruptions. No member of the City Council, once recognized, shall be interrupted when speaking unless it is to call him/her to order or as otherwise provided herein. If a member of the City Council is called to order while speaking, s/he they shall cease speaking until the question of order is determined and, if in order, shall be permitted to proceed.

4.24 Motion to Reconsider. A motion to reconsider any action taken by the City Council may be made only by a member of the Council who was on the prevailing side of the vote, but may be seconded by any member of the City Council and requires a majority vote of the City Council for approval.

No matter shall be reconsidered more than once. Any action of the Council which cannot be reversed cannot be reconsidered.

4.241 Timing of Motion. A motion to reconsider may be made at any time during the meeting at which the action was taken, but not at any adjournment or continuance of that meeting.

4.242 Effect of Approval. Upon approval of a motion to reconsider, the prior action shall be set aside in its entirety; and the underlying matter shall be scheduled for consideration at the earliest feasible City Council meeting and shall be re-noticed pursuant to Concord Municipal Code Sections 2.05.050 or 2.05.050 or other applicable laws.

4.243 Rescission, Repeal or Amendment. The reconsideration rules contained in this Policy & Procedure shall not limit the City Council's inherent authority to rescind, repeal, or amend its prior actions in situations where it is not precluded from doing so under applicable laws.

4.3 Addressing the Council. Each person wishing to address the City Council is requested (but not required) to fill out and return to the City Clerk a speaker card containing the speaker’s name, address and item on which he/she is interested in addressing the Council, and the speaker’s position on the item to be addressed. All information on the speaker card is a public record and may be subject to disclosure under the California Public Records Act. The Mayor shall use the speaker’s card to determine whether a time limit is necessary for the item to be discussed, to arrange the order of presentation of testimony before the City Council and to recognize speakers. The Mayor shall recognize anyone Page 7 of 17 POLICY & PROCEDURE NO. 2
desiring to address the City Council even if a speaker card has not been filled out. After having received permission from the Mayor to address the City Council, each person shall come to the microphone and may give his/her their name for the record before speaking. The Mayor will also endeavor to call for additional speakers before closing comment on an item. All remarks shall be addressed to the City Council as a body. No person other than a member of the City Council and the person having the floor shall enter into any discussion without permission of the Mayor. Any person following this procedure shall have the right to be heard during the public comment period or at the time the City Council considers any items of business listed on the agenda.

4.31 Spokesperson for a Group of Persons. Whenever any group of persons wishes to address the City Council on the same subject matter, it shall be appropriate for the Mayor to request that a spokesperson be chosen by the group to address the Council, to specify a time limit, and in case additional matters are to be presented at that time by any other member of the group, to limit the number of speakers to avoid repetition.

4.4 Decorum

4.41 Council. Members of the City Council must preserve order and decorum and shall not, by conversation or otherwise, delay or interrupt the proceedings or peace of the City Council in any way, or disturb any other member of the City Council while speaking, or refuse to obey the orders of the City Council or the Mayor, except as otherwise herein provided.

4.42 All Persons. No person speaking may make any unduly repetitive, irrelevant, personal, impertinent, slanderous, profane, loud, threatening, or abusive remark to any member of the City Council, City staff, or the general public, which actually disrupts, disturbs, or otherwise impedes the orderly conduct of the meeting. No person may bring into the Council Chamber, or employ outside the Council Chamber, any device, sign, sound, or object that may cause disruption of the meeting, or obstruct others attending the meeting from participating in, hearing, or seeing the meeting proceedings. Any person who makes such remarks, or who engages in any other disorderly conduct which actually disrupts, disturbs, or otherwise impedes the orderly conduct of any City Council meeting may, at the discretion of the Mayor or the City Council majority, be barred from further comments during that meeting, and/or subjected to enforcement actions pursuant to Section

4.43. 4.43 Enforcement. The Chief of Police, or his/her their authorized representative, shall be the ex-officio Sergeant-at-Arms of the Council. S/he They shall carry out all orders and instructions of the Mayor for the purpose of maintaining order and decorum in the City Council meeting room. Upon instructions of the Mayor, any person who engages in conduct prohibited pursuant to Section 4.42 at a City Council meeting it shall be the duty of any police officer may be present to removed from the City Council meeting room any person in the audience who engages in conduct prohibited pursuant to Section 4.42 at a City Council meeting , and/or to be placed under arrest any person who is if violating the law as determined by the Chief of Police or their designee. With respect to those offering remote public comment, the City Clerk shall have the authority to determine whether any such person has engaged in conduct prohibited pursuant to Section 4.42, and may terminate their remote public access.

4.5 Duties of Mayor. The Mayor shall assume his/her their place and duties immediately following hi/sher their election by the City Council.

4.51 Call to Order. At the hour appointed for the meeting, the Mayor shall call the City Council to order. The Mayor shall serve as the presiding officer for all City Council meetings. In the Mayor’s absence, the Vice Mayor shall serve as the presiding officer. In the absence of both the Mayor and Vice Mayor, the most senior Councilmember (in consecutive years served on the City Council) shall serve as the presiding officer; if there is a seniority tie, the Councilmember who received more votes during their latest elections shall serve as the presiding officer. Mayor, the Vice Mayor shall relinquish the chair at the conclusion of the business item then before the City Council; upon the arrival of the Mayor or the Vice Mayor, the presiding officer shall relinquish the chair at the conclusion of the business item then before the City Council.

4.52 Changes to the Order of Business. The Mayor may change the order of business as shown on the meeting agenda at any time during the meeting as deemed necessary or convenient.

4.53 Additional Duties.
a. The Mayor shall preserve strict order and decorum at all meetings, have the power to limit the time of any speaker from the floor, state questions coming before the City Council, and announce the City Council's decision on all subjects.
b. The Mayor shall have the authority to rule on procedural matters relating to the conduct of City Council meetings. Any procedural rulings or other actions of the Mayor may be overruled by a majority vote of the City Council.
c. The Mayor shall sign all ordinances, contracts and other documents approved by the City Council, except if a conflict of interest exists or authority to execute documents has been delegated to the City Manager or another representative of the City. d. The Mayor may, from time to time, announce appointments to ad hoc advisory committees composed solely of less than a majority of the members of the City Council; the announcement of such appointments shall appear on the posted agenda, but shall not require City Council approval. The Mayor may also propose appointments to standing committees and regional bodies, subject to confirmation by a majority of the City Council. e. The Mayor may make declarations of special dates and recognition awards on behalf of the City, such declarations to be detailed in the subsequent correspondence and reports to Council.
f. The Mayor may declare a meeting adjourned if the end of the agenda has been reached or there is no further business.

4.6 Roll Call. Before proceeding with the business of the City Council, the City Clerk shall call the roll of the members of the City Council, and the names of those present shall be entered in the minutes.

4.7 Public Comment Period.

4.71 Public Comment on Non-Agenda Items. The agenda for every regular City Council meeting shall include a public comment period. Members of the public may address the City Council during this period on any subject that is within the jurisdiction of the City Council and not listed on the agenda.

Individual public comments shall be limited to three minutes, and the total duration of the public comment period shall not exceed fifteen minutes, before items scheduled on the agenda are considered, unless an increase or decrease of time is ordered by the Mayor. If public comment of longer than fifteen minutes is to be conducted, it will be taken following conclusion of the consideration of scheduled items.

4.72 Public Comment on Agenda Items. The agenda for every regular or special City Council meeting shall include the opportunity for members of the public to address the City Council before or during the Council’s consideration of any item on the agenda, including items on the Consent Calendar.

Persons addressing the Council shall be limited to three minutes, unless an increase or decrease of time is ordered by the Mayor. The Mayor may allow extra time for the applicant, appellant, or other person or entity directly involved in the decision.

4.8 Adoption of Consent Calendar. Adoption of the Consent Calendar may be made by one motion of the City Council, provided that any Councilmember, individual or organization in attendance may request removal of an item from the Consent Calendar for separate consideration. If a request for removal of an item from the Consent Calendar has been timely received, the Mayor may defer action on the particular item and place the same on the regular agenda for consideration in any order s/he they deems appropriate.

4.9 Voting.

4.91 Roll Call Vote. Any Councilmember may request a roll call vote to be taken and recorded on any motion. Whenever a roll call vote of the City Council is in order, the City Clerk shall call the roll as follows:

4.911 Maker of the motion.

4.912 Seconder of the motion.

4.913 The balance of the City Council in alphabetical order except that the Mayor is called last, unless the Mayor is the maker or seconder of the motion.

4.92 Silence Constitutes Affirmative Vote. In all voting, unless a member of the City Council states s/he they is are not voting, s/he their silence shall be recorded as an affirmative vote.

4.93 Ex Parte Communications. Whenever the City Council is sitting in a quasi-judicial capacity to weigh facts and evidence on a permit application, appeal, or other quasi-judicial matter, each Councilmember shall, once the agenda item is called, disclose for the record any ex parte communications or site visits and information received outside of the meeting, so that all Councilmembers, parties and opponents have the same information received by the Councilmember, and an opportunity to consider and/or respond to such information.

5. AGENDA

5.1 Preparation. The City Manager shall prepare an agenda for each City Council meeting, except for Closed Session per Section 3.4, and shall submit the draft agenda to the City Attorney for legal review. If after the regular agenda is prepared the City Manager determines that additional items should be placed thereon, a supplemental or revised agenda shall be posted in accordance with the provisions of Government Code Sections 54954.2 or 54956 as appropriate. The agenda shall contain a brief general description of each item of business to be transacted or discussed at the meeting. While not required by law, in the interest of transparency, City staff shall endeavor to include the monetary amount and source of funds of consultant, construction, employee, and similar contracts in applicable agenda descriptions; however failure to do so shall not invalidate or affect the adequacy of the agenda description or notice to the public.

5.11 Notice/Posting. At least seventy-two (72) hours before a regular meeting of the City Council an agenda shall be posted and mailed as required by law. The agenda shall specify the time and location of the regular meeting and shall be posted in a location that is freely accessible to members of the public, including on the City website, pursuant to Government Code Section 54954.2.

5.12 Non-Agenda Items. No action or discussion shall be undertaken on any item not appearing on the posted agenda, except as expressly permitted pursuant to Government Code Section 54954.2.

Councilmembers or staff may briefly respond to statements made or questions posed by persons speaking during the public comment period. In addition, on his/her their own initiative or in response to questions posed by the public, a Councilmember or staff may ask a question for clarification, make a brief announcement, or make a brief report on his or her activities.

Furthermore, the City Council or an individual Councilmember with the concurrence of the Council majority may provide a reference to staff or to other resources for factual information, request staff to report back to the City Council at a subsequent meeting concerning any matter, or take action to direct staff to place a matter of business on a future agenda. Finally, the City Council may take action on items of business not appearing on the posted agenda under any of the following Page 10 of 17 POLICY & PROCEDURE NO. 2
conditions:

5.121 Upon a determination by a majority vote of the City Council that an emergency situation exists as defined in Government Code Section 54956.5.

5.122 Upon a determination by a two-thirds (2/3) vote of the Councilmembers present at the meeting, or if less than two-thirds (2/3) of the members are present, a unanimous vote of those members present, that there is a need to take immediate action and that the need to take action came to the attention of the City subsequent to the agenda being posted. For a five person City Council, the 2/3 requirement means four of five, or three of four, Councilmembers.

5.123 The item was posted in accordance with this Policy & Procedure for a prior meeting of the City Council occurring not more than five (5) calendar days prior to the date action is taken on the item, and at the prior meeting the item was continued to the meeting at which action is being taken.

5.13 Special Meetings. As required by Government Code Section 54956, a written notice of each special meeting shall be delivered to each member of the City Council, and to each local newspaper, radio, or television station that has a written request for notice on file with the City. The notice shall be delivered and posted in a location freely accessible to the public at least 24 hours before the time of the special meeting, and shall state the time and place of the special meeting and all items of business to be transacted or discussed. Only matters described in the agenda may be considered at the meeting.

5.2 Consent Calendar. Items which are not expected to require public discussion may be grouped together and listed under the Consent Calendar. Typically, these will consist of routine and non-controversial items.

5.3 Ordinances. Upon the item being called, the City Clerk or City Attorney shall read the title of the ordinance in full. Thereafter, any member of the City Council may move to waive further reading of the ordinance and either introduce or adopt the ordinance pursuant to State law.

5.4 Public Hearings and Consideration Items. Legal publication, posting, and mailing will be carried out pursuant to law.

5.5 Continuances.

5.51 The City Council may, in its discretion, continue any item of business to a subsequent meeting.

5.52 Items that are not continued to a date certain or are continued for further hearing or action for a period longer than thirty (30) days from the City Council meeting shall be renoticed at the applicant/appellant's expense.

5.6 Urgency Ordinances. The City Council may adopt an urgency ordinance as provided by State law. Non- planning urgencies are governed by Government Code Section 36937(b). Planning urgencies are governed by Government Code Section 65858. Urgency ordinances not requiring a public hearing may be placed on an agenda for City Council action in accordance with the provisions of Government Code Section 54954.2.

5.7 Written Staff Reports. Staff reports and/or resolutions shall be prepared if directed by the City Manager or otherwise required by law. In advance of the meeting, copies of the final versions of any such staff report or resolution shall be made available to the City Council, the news media, and persons who have requested advance copies thereof.

5.71 Benched Documents. Any public records provided to the City Council subsequent to the posting of the agenda, and changes to the staff report, resolutions, contracts, and other City materials, shall Page 11 of 17 POLICY & PROCEDURE NO. 2
be made available upon request as provided in Government Code Section 54957.5.

5.72 Plans. Plans provided by an applicant, appellant, and/or his/her their/its representative to City staff or to the City Council in connection with an agenda item may be reduced in size and published together with or as part of such agenda item; reduced-sized plans use for such purpose shall become a public record subject to disclosure under the Public Records Act.

6. AGENDA DISTRIBUTION

6.1 Agendas which have been copied and distributed to the City Council will be made available to the public at the same time and at City Council meetings.

6.2 Agendas of regular and special meetings will be provided to all individuals who subscribe to an annual mailing service.

6.3 Individuals or organizations whom the City believes may be affected by an agenda item may, as a courtesy, be mailed an agenda to advise when the item is scheduled to be considered by the City Council.

6.4 The agenda shall be posted in the display case located near the Parkside Drive entrance to the Civic Center and on the City’s website not less than seventy-two (72) hours in advance of each regular meeting and not less than twenty-four (24) hours prior to each special meeting of the City Council. A log shall be maintained of the time and date each agenda is posted.

7. MINUTES

7.1 Official Record. The official minutes of the City Council shall be kept by the City Clerk. The City Clerk shall be required to make a record only of such business as was actually voted upon by the City Council and shall not be required to record any remarks of any member of the City Council or of any other person, except at the special request of a member of the City Council during that meeting. The City Clerk shall enter into the minutes a brief summary of the reasons for dissent from or protest against any action of the Council if any member of the City Council so requests it during that meeting. Names of persons addressing the City Council, the title of the subject matter to which their remarks related, and whether they spoke in support of or in opposition to such matter shall be entered in the minutes.

7.2 Recordings. As an aid to the preparation of minutes, the City Clerk shall arrange to have recordings made of all regular and special City Council meetings, except for workshops and closed sessions. The City Clerk is not required to have recordings made for meetings when no recording is needed to assist in the preparation of minutes. The recordings may be destroyed after the City Council approval of minutes in accordance with the Records Retention Schedule, unless the City Attorney requests retention of a particular recording.

7.3 Approval of Minutes. The City Clerk shall attach a copy of the minutes to the agenda for the meeting at which the minutes are proposed to be approved. The City Council may request minor clarification and corrections as necessary. The minutes may be approved without reading.

8. ORGANIZATION OF CITY COUNCIL
The City Council shall annually reorganize, choosing from amongst its members who should serve as Mayor and Vice Mayor for the coming year.

8.1 Term of Mayor. The appointment of the Mayor is for a one-year term.

8.2 Term of Vice Mayor. The appointment of Vice Mayor is for a one-year term.

8.3 Seating. Council seating at the dais will be per the attached diagram, or as established by the Mayor.

Report in Brief
On May 12, 2026, City Council (Council) held a budget workshop on the City of Concord’s (City) proposed Two-Year Capital Improvement Program Capital Budget for Fiscal Years (FY) 2027 and 2028 (Capital Budget) and Five-Year Capital Improvement Plan FYs 2027-2031 (CIP). The Capital Budget outlines major expenditures and investments related to City infrastructure, facilities, parks, and information technology.

After receiving the presentation and public comment, Council asked questions and provided comments to City staff (Staff), with the understanding that Staff would return for a public hearing at the June 9, 2026, Council meeting for adoption of the Capital Budget and CIP.

At the budget workshop, the Council requested follow up on appropriating the approximate $22,000 raised by Councilmember Obringer for the Don Fernando Pacheco Adobe Restoration project. One other change was made to the proposed Capital Budget since the May 12 Council meeting which is summarized in the body of

this report. Council is being asked to consider the information provided in this report and adopt the Two-Year Capital Budget and Five-Year Capital Improvement Plan.

Recommended Action
Adopt a Resolution adopting the City of Concord’s Two-Year Capital Improvement Program Capital Budget for Fiscal Years (FY) 2027 and 2028 and Five-Year Capital Improvement Plan FYs 2027-2031 (Attachment 1).

Background
On March 25, 2026, the Parks, Recreation, and Open Space Commission received an update of current Parks and Recreation facilities projects, and projects recommended by staff for funding in the Capital Budget or inclusion in the CIP. On April 1, 2026, the Measure V Committee received an overview of proposed use of Measure V Funds in the Two-Year Capital Budget and was in support of the staff recommended plan. On April 15, 2026, the Planning Commission reviewed and found that the Two-Year Capital Budget is in conformance with the City’s General Plan. Lastly, On May 12, 2026, Council held a public workshop on the proposed Capital Budget and Five-Year CIP. At the meeting, Council reviewed the proposed Capital Budget, allowed for public testimony, and asked questions of Staff. After asking clarifying questions of staff and listening to public comment, Council concurred with the proposed Capital Budget and Five-Year CIP as presented.

Analysis
The recommended Capital Budget is approximately $59.0 million and is primarily funded with a combination of Measure V, Gas Tax (including SB 1), Measure J (Local + 28a), Enterprise funds (Storm Water, Sewer, Golf Course), General Plan Reimbursement, and Information Technology funds (including PEG) and includes an expectation of future financing for approximately $7 million to fund critical improvements to the Police Department headquarters and Emergency Operations Center. PW-27-016 Emergency Operations Center/Police Department Roofing and Mechanical Systems Replacement
Seven critical projects which support the City’s Emergency Operations Center (EOC) and the overall Police Department were approved for funding in prior capital budgets to repair the aging Police Department building on Galindo Street. The seven partially funded projects have been consolidated as one new proposed project and additional funding is recommended to fully fund the project, so it can be designed and built over the next two-year Capital Budget cycle. The seven elements (listed below) of this newly combined project can be reviewed in the CIP Budget Sheets (Exhibit A to the Resolution):

Thanks to fundraising by Councilmember Obringer with support from the Concord Historical Society, a total of $22,040 in proceeds is available, originating from the following events: $10,648 from the Mayor’s Cup Golf Classic, and $11,392 from a Bowling for the Adobe Tournament.
• 2744 Ongoing Storm Drain Maintenance Lining Repair
As recommended to Council during the Budget Workshop, $500,000 of Measure V funds will be transferred from this project to the EOC/PD Roof and HVAC project. However, staff wants to ensure that funds are available for unexpected repair needs and recommends appropriating $200,000 from the Stormwater Fund to be allocated to Project 2744.

Measure V Conformity
On April 1, 2026, the Measure V Committee reviewed and recommended to City Council support for the Measure V funding allocations to projects listed in the proposed Capital Budget.

General Plan Conformity
On April 15, 2026, the Planning Commission reviewed and found that the proposed Capital Budget is in conformance with the City’s General Plan.

Financial Impact
The Two-Year Capital Budget for Fiscal Years 2027 and 2028, which includes the Sewer Enterprise, Measure V Revenue, SB1, grants, Enterprise funds, General Plan Reimbursement, and Measure J (Local + 28a), totals approximately $59.0 million. The approximate breakdown of the funding sources for the Capital Budget is illustrated in the Two-Year Capital Budget Funding Chart (Attachment 3), and summarized, as follows: Measure V (25%), Sewer Operating (18%), Measure J (15%), SB1 (13%), grants (7%), Stormwater Management (3%), General Plan Reimbursement (2%), other sources of funding, such as Enterprise Funds, building maintenance fund, maintenance district funds (4%), and borrowing (12%). The borrowing is the $7 million loan necessary to fund the full EOC/Police Department Roof and HVAC Systems replacement costs, which Council is anticipated to consider in 2027.

Environmental Determination
Pursuant to the California Environmental Quality Act (CEQA) of 1970, Public Resources Code Section 21000, et. seq., as amended and implementing State CEQA Guidelines, Title 14, Chapter 3 of the California Code of Regulations (collectively “CEQA”), this activity does not constitute a “project” within the meaning of within the meaning of Public Resources Code Section 21065, CEQA Guidelines Sections 15060(c)(2) and/or 15378, because there is no potential that it will result in either a direct or reasonably foreseeable indirect physical change in the environment. Even if the activity does comprise a project for CEQA analysis, it falls within the “common sense” CEQA exemption set forth in CEQA Guidelines Section 15061(b)(3), excluding projects where

“it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment” and/or is statutorily exempt pursuant to CEQA Guidelines Section 15273 since the activity involves only government funding/fiscal activities. Accordingly, no further environmental review is warranted. This determination reflects the City’s independent judgment and analysis.

This is the fifth public meeting on the proposed Capital Budget. The first was before the Parks, Recreation, and Open Space Commission, the second was before the Measure V Committee, the third was before the Planning Commission, and the fourth was a workshop before City Council. A Public Hearing notice and the City Council Agenda was posted.

WHEREAS, on April 1, 2026, the Measure V Committee reviewed and recommended to City Council support for the Measure V funding allocations to projects listed in the proposed Two-Year Capital Improvement Program Capital Budget for Fiscal Years 2027 and 2028; and WHEREAS, on April 15, 2026, the City of Concord Planning Commission determined and reported to the City Council for purposes of Government Code Sections 65401 and 65402 that the proposed public projects, street vacations and right-of-way acquisitions listed in the proposed Two- Year Capital Improvement Program Capital Budget Fiscal Years 2027 and 2028 are consistent with the General Plan; and
WHEREAS, the City Manager has recommended the Two-Year Capital Budget; and WHEREAS, at the May 12, 2026, City Council workshop, the City Manager presented the Two-Year Capital Budget and the Five-Year Capital Improvement Plan for Fiscal Years 2027-2031 and received comment and direction from Council regarding the proposed budget recommendations and strategy; and
WHEREAS, the City Council, after giving all public notices required by state Law and the Concord Municipal Code, held a duly noticed public hearing on June 9, 2026, on the Two-Year Capital Budget, considered testimony and information received at the public hearing, the written reports from City staff dated May 12, 2026 and June 9, 2026, the Planning Commission General Plan consistency determination, the Measure V Committee support of Measure V funding allocations, as well as other documents contained in the record of proceedings relating to the Two-Year Capital Budget and the Five-Year Capital Improvement Plan for Fiscal Years 2027-2031, which are maintained at the offices of the City of Concord City Clerk’s Office, 1950 Parkside Drive, Concord, Attachment 1

CA and declared their intent to approve and adopt the Two-Year Capital Budget; and WHEREAS, attached hereto as Exhibit A are the Capital Improvement Plan (CIP) Budget Sheets which provide detailed project information, however, also attached hereto as Exhibit B is the Fiscal Years 2027 and 2028 Capital Budget Project Funding Recommendation Summary document, which serves as the source for all budget allocations and appropriations as identified in the Two-Year Capital Budget; and
WHEREAS, the expenditures provided in said Two-Year Capital Budget, together with any revisions to it, are within the expenditure limitations imposed by Article XIII B of the California Constitution; and
WHEREAS, Policy & Procedure No. 129, Budget and Fiscal Policies, which provides the concepts and processes that help protect City resources and long-term fiscal health, was amended in June 2015 to reflect the implementation of a biennial budgeting process for the Capital Budget; and WHEREAS, on June 10, 2025, the City Council adopted Resolution No. 25-34 authorizing the City Manager to redistribute budgeted appropriations between similar Capital Projects. The maximum fund transfer shall be $220,000 per project. Funds may be transferred from projects in different Capital Budgets as long as they are between similar Projects. The City Manager may transfer up to $220,000 of unappropriated capital reserves to approved Capital Projects. The City Manager may transfer remaining budgets on closed projects allocated from the contributing source fund (ie.

Enterprise/Gas Tax/Developer Funds) back to the source fund(s).

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CONCORD DOES RESOLVE AS FOLLOWS:

Section 1. The foregoing recitals are true and correct.

Section 2. CEQA
Pursuant to the California Environmental Quality Act (CEQA) of 1970, Public Resources Code Section 21000, et. seq., as amended and implementing State CEQA Guidelines, Title 14, Chapter 3 of the California Code of Regulations (collectively “CEQA”), this activity does not constitute a “project” within the meaning of within the meaning of Public Resources Code Section 21065, CEQA Guidelines Sections 15060(c)(2) and/or 15378, because there is no potential that it will

Section 4. The City Council accepts the Planning Commission’s April 15, 2026, determination that the Two-Year Capital Budget complies with the goals and objectives of the General Plan.

Section 5. The City Council hereby adopts the Two-Year Capital Budget for Fiscal Years 2027 and 2028 and Five-Year Capital Improvement Plan FY 2027-2031 as modified during the public hearings. A copy of the Two-Year Capital Budget and the Five-Year Capital Improvement Plan for Fiscal Years 2027-2031 as modified during the public hearings are on file with the City Clerk.

Section 6. This resolution shall become effective immediately upon its passage and adoption. //

2495 Citywide Street Assessment Program
This on-going project will maintain the City’s Pavement Management Program (PMP) certification. Metropolitan Transportation Commission (MTC) requires the City to have the PMP certified to be eligible to receive regional discretionary funds. This project will continue on an ongoing basis to inspect arterials and collectors every two years and residential zones every five years.

Project funds from this project may be used for matching funds for pavement study grants such as MTC’s Pavement Technical Assistance Program (P-TAP) program, PMP software subscription: StreetSaver, and fund other street/pavement related studies such as the Five- Year Pavement Expenditure Plan.

Interpretive signage explaining the benefits provided by green infrastructure and associated landscaping. Extension of public sidewalk along Solano Wy to improve pedestrian mobility, the existing pathway connecting the two routes is pedestrian focused and improving the connections at each end of the connecting path will ease the maneuvering and encourage use of the park by cyclists. The park is located close to multiple trail connections, so wayfinding and informational signs are proposed, as well as a water station for cyclists.

Report in Brief
The City of Concord (City) is navigating a period of structural imbalance, one for which the City Council anticipated and prepared. Ongoing expenditures continue to exceed ongoing revenues, requiring the City to draw on its Fiscal Stability Fund to close the gap, while maintaining its operating budget reserve of 30%. The City Council established the Fiscal Stability Fund in 2023 to provide a planned, transparent bridge that maintains services levels and programs for residents while the City moves through this period of slow revenue growth.

Through the third quarter of Fiscal Year (FY) 2025-26, careful fiscal management has produced a projected year-end deficit of $2.26 million, which is $140,000 better than

anticipated at budget adoption. This improvement reflects disciplined monitoring of operating costs and stronger than expected performance in franchise fees and parking fine revenues.

For FY 2026-27, three specific cost pressures widen the structural gap and increase the planned draw on the Fiscal Stability Fund:
• Newly negotiated contracts with the Police Officers Association and Police Management Association add $614,290 in ongoing annual costs not previously contemplated in the adopted budget.
• The November 2026 general election adds $144,000, driven by higher per-voter costs and a citywide election for Treasurer requiring a citywide vote. • Adjustments related to the City’s Successor Agency. General Fund receipts will be reduced by approximately $895,000 and expenditures will be increased by $32,000.

Proposed adjustments to the FY 2026-27 budget include a net revenue decrease of $17,091 and a net expenditure increase of $1,023,640. Together, these adjustments produce a net negative budget impact of $1,040,731 for FY 2026-27. The Fiscal Stability Fund is projected to end FY 2026-27 with approximately $2.4 million. The City will maintain its 30% reserve policy target through FY 2026-27.

Staff recommends adopting the resolutions described in the Recommended Action section to amend the budget, establish the Annual Appropriations Limit, and adopt the updated Investment Policy.

Background
The City operates on a biennial budget cycle, a framework the City Council adopted to encourage longer range planning and reduce the administrative burden of annual budget adoption. The current two-year budget was adopted on June 10, 2025, covering FYs 2025-26 and 2026-27. A mid-year review was presented to City Council on February 10, 2026, with minor adjustments approved at that time. This Mid-Cycle Update evaluates performance through the third quarter of FY 2025-26 and recommends adjustments for the second year of the budget cycle, FY 2026-27.

The City’s budget framework is governed by the Fiscal Sustainability Ordinance (Concord Municipal Code Chapter 3.20), which establishes standards for the use of one-time versus ongoing revenues and guides how reserves may be applied. All recommendations in this report comply with those requirements.

Further, City Council established five Tier 1 priorities and one Tier 2 priority1 through FY 2026-27 as follows:

• Welcoming the New City Manager: Council and the organization will provide effective support and onboarding to the new City Manager, enabling a successful first year in the role.
• Economic Development Strategic Plan: Implement Year 1 Economic Development Strategic Plan activities, which include: exploring/adopting a Property & Business Improvement District for the downtown; creating an economic advisory group that will meet at least twice a year to advise staff on how City efforts can support improvements in the local economy; proactively seek the location or expansion of target industries in the City; and coordinate efforts to market Concord with the private sector to establish a “brand” using events, Visit Concord, and enhanced appearance, safety, and other quality of life efforts.
• Unfunded Infrastructure Needs Funding: Continue to make progress identifying funding to address the annual infrastructure investment shortfall, currently estimated at $25 million annually.
• Implement Various Housing Element Mandates: To ensure continued compliance with the City’s state certified housing element, complete implementation of 4 major housing element policies already underway and begin implementation of 9 major additional housing element policies. • Concord Naval Weapons Station Development: Make significant progress on negotiations with the US Navy and Master Developer on the Economic Development Conveyance Memorandum of Agreement (MOA) and work with the 1 Tier 1 priorities are to be the focus of the organization for the year, beyond day-to-day regular. Tier 2 priorities reflect projects or programs Council has identified as important to accomplish during the fiscal year if staff resources allow for it and Tier 1 priorities are not impacted.

Master Developer and significantly advance the specific plan, infrastructure planning, and environmental permits.

Tier II
• Concord Library: Working with a Mayor-appointed ad-hoc committee, evaluate the feasibility of expanding, relocating, or replacing the City’s library. The assessment will include, at a minimum, costs to build and operate, potential locations (including the Concord Naval Weapons Station and other sites), funding opportunities (including grants), project timelines, and required steps.

The City Council agreed that any additions to or re-prioritization of these items would require deferring or demoting existing priorities. This is a discipline that reflects the resource constraints the City is managing.

Part II: FY 2025-26 Third Quarter General Fund Analysis Revenues
At the close of the third quarter, March 31, 2026, the City received $88.86 million of budgeted revenues for this fiscal year. The year‑over‑year growth rate for total revenues has moderated, declining from 2.32% at mid‑year to 0.94% in the third quarter. Property tax collections remain consistent with the mid-year report; however, the pace of sales tax growth has softened. This deceleration is partially offset by higher growth rates in franchise fees and transient occupancy tax. Despite the reduced overall growth trajectory, total revenues are still tracking slightly above budget.

General Fund Revenues

1. Successor Agency Administrative Revenue: $250,000 decrease (ongoing) Staff recommends reducing General Fund revenue by $250,000 to reflect the anticipated phase-out of administrative charges associated with Successor Agency indirect costs. These revenues were included in the adopted budget but are now expected to be lower as the Successor Agency winds down operations and is projected to close in FY 2026-27. This adjustment aligns the budget with updated revenue expectations.

2. Redevelopment Property Tax Trust Fund (RPTTF): $645,000 decrease (ongoing)
Staff recommends reducing Redevelopment Property Tax Trust Fund (RPTTF) revenue by $645,000 in FY 2026-27 to reflect updated projections provided by the City’s property tax consultant. RPTTF revenues represent residual property tax distributions from former redevelopment project areas after enforceable obligations are paid and are expected to decline over time as successor agency activities wind down. This adjustment aligns the budget with the most current distribution estimates.

3. Parking Fine Revenue: $100,000 increase (ongoing)
In February, Council approved a mid-year budget adjustment to support the addition of two part-time Parking Services positions, offset by a corresponding increase in parking fine revenue. Through the third quarter, parking fine revenue has exceeded budget, reflecting the effectiveness of the Parking Services program. Based on this performance, staff recommends increasing ongoing parking fine revenue by $100,000 in the next fiscal year to continue supporting the program.

4. Franchise Fee: $595,559 increase (ongoing)
Staff recommends aligning the ongoing budget of all the revenue accounts in this category (franchise fees for cable, waste disposal, electrical, gas, and oil pipeline) with forecasted year-end actuals. This adjustment partially offsets the Successor Agency revenue loss.

5. Cardenas Settlement: $182,350 increase (one-time)
In 2019, Cardenas Markets, LLC agreed as part of a settlement with the Monument Business Owners Coalition (MBOC) to pay the City $150,000 to support establishment of a Business Improvement District (BID) in the Monument neighborhood. The City was not a party to the settlement but received the funds.

Efforts to establish a BID and, later, an independent nonprofit did not advance.

The funds have sat unspent for seven years, accumulating $32,350 in interest for a current total of $182,350. Recent conversations with MBOC have identified a new use with broad support: park improvements at Meadow Homes Park and

Cambridge Park. Parks serve as economic development assets — they attract visitors, support nearby businesses, and provide community amenities — making this an appropriate use of funds originally intended to support the Monument area’s economic vitality. Staff recommends appropriating these funds as a one- time revenue in the Other Revenues Category and as a one-time expense in the Public Works Department. This is a one-time item with no ongoing budget impact.

General Fund Expenditures

6. Additional Cost of New Police Officers Association (POA) and Police Management Association (PMA) Contracts: $614,290 increase (ongoing) Staff estimates the additional cost of the POA and PMA negotiated contracts, which are anticipated to be approved by Council at the same meeting that this mid-cycle budget report is presented, to be $614,290 ongoing.

7. Part-Time Police Parking Services Positions: $51,000 increase (ongoing) Based on the success of the program approved by Council at mid-year, staff recommends continuing funding for two part-time Community Specialist positions in Parking Services. These positions improve responsiveness to parking enforcement and abandoned vehicle complaints by expanding coverage during peak periods, evenings, weekends, and special events, while reducing the need for sworn officers to respond to lower-level parking-related calls. The positions are supported by revenue generated through parking enforcement activity and have contributed to parking fine revenues exceeding budget through the third quarter, demonstrating the effectiveness of the program.

8. November 3, 2026, General Election: $144,000 increase (one-time) Staff recommends appropriating an additional $144,000 from the General Fund to support the November 3, 2026, General Election. The City’s current election budget of $180,000 is not sufficient due to increases in the estimated cost per registered voter and the need to reflect the citywide vote for the City treasurer position. The cost per registered voter has increased from the prior range of $2.50-$4.00 to an updated range of $3.00-$4.50. Based on updated estimates provided by the Contra Costa County Elections Division and approximately 72,039 registered voters, total election costs are now projected to range between $216,117 and $324,176. This adjustment aligns the budget with current cost estimates.

9. Reallocate Internal Service Charges from the Successor Agency to the General Fund: $32,000 increase (ongoing)
Staff recommends reallocating $32,000 in internal service charges from the Successor Agency administrative fund to the General Fund. Internal service charges support citywide shared services such as administrative and information

technology functions. As the Successor Agency is expected to close in FY 2026- 27, these costs will no longer be recoverable from the Successor Agency.

Reallocating the charges to the General Fund aligns the budget with the anticipated closure and ensures continued funding for these shared services.

10.Cardenas Settlement: $182,350 increase (one-time)
This expenditure reflects the spending of the revenue being acknowledged in item 5 above. These funds will be appropriated to the Public Works budget and used to make the following improvements:
• In Meadow Homes Park: Upgrade the asphalt trail, install bollard and chain perimeter fencing to protect the park turf, and repair the concrete sidewalk. • In Cambridge Park: replace the poured in place under playground surface.

Part IV: Impact on Fiscal Stability Fund
The Fiscal Stability Fund (Fund 138) was established in April 2023 with $10.5 million in one-time General Fund residuals from FY 2021-22 and increased by an additional $2.1 million in February 2024 using FY 2022-23 residuals. The fund was proactively created by the City Council as a supplemental reserve to provide temporary financial support to the General Fund during periods of structural imbalance while preserving the City’s reserve policy targets. This was sound fiscal planning. The City Council saw a structural imbalance coming, one driven by expenditure pressures growing faster than revenues, and chose to set money aside during better years to manage the transition responsibly.

After Council approved using $2.6 million to close out FY 2024-25 on February 10, 2026, an estimated balance of $8.6 million remains available. The adopted budgets for the current and next fiscal years (FYs 2025-26 and 2026-27) were structurally imbalanced and even after introducing cost cutting included an estimated use of reserves of $2.4 million and $2.9 million, respectively.

The updated projection for FY 2025–26 reduces the planned use of reserves by $0.14 million, while the FY 2026–27 mid‑cycle adjustments increase reserve use by $1.04 million. In aggregate, these adjustments yield a forecasted ending reserve balance of $2.4 million at the close of FY 2026–27.

11.Golf Course Fund (700) Golf Course Maintenance Contract: $197,000 (ongoing)
On December 2, 2025, Council approved a new golf course maintenance agreement. In February, Council approved a mid-year budget adjustment of $197,000 in FY 2025-26 to support implementation of the agreement. Staff recommends increasing the Golf Course contracts budget by $197,000 in FY 2026-27 to align the ongoing budget with the previously approved agreement and reflect the full-year cost of maintenance services. The increased costs will be fully supported by revenues generated at Diablo Creek Golf Course and will not result in any impact to the General Fund. operating costs will continue to be absorbed within the Golf Course enterprise fund.

Part VI: The City’s Annual Appropriation Limit
In November 1979, the voters of the State of California approved Proposition 4, which created limits on the amount of revenue that can be spent by most entities of government, including local governments. The method of calculating these limits was modified with the passage of Proposition 111 in June 1990. The City is in compliance with these requirements, and the City’s applicable proposed Municipal Budget appropriation subject to the limit (approximately $109.9 million) remains well below the $271.3 million appropriation allowed the City of Concord for FY 2026-27. A resolution setting the limit is required; Attachment 2 fulfills this requirement.

Part VII: Measure V Oversight Committee Findings
The Measure V Oversight Committee reviewed the FY 2024-25 Annual Comprehensive Financial Statement (ACFR), which includes the annual audit and the proposed FYs 2026-27 and 2027-28 capital budget.

After completing its review, the Committee found that:
• The FY 2024-25 Annual Audit reflects that Measure funds were collected and appropriately spent.
• The City’s proposed use of Measure V revenues in the Biennial Capital Improvement Budget for FYs 2026-27 and 2027-28 addresses the City’s infrastructure needs.

The Committee encourages Council to continue analyzing spending priorities to ensure that they meet the most pressing needs and concerns of all Concord residents.

A copy of the Measure V Oversight Committee report to the City Council is attached (Attachment 3).

Part VIII: FY 2026-27 Investment Policy
Pursuant to Policy & Procedure 184 Investment Policy Section 18, the City’s Investment Policy shall be adopted annually by the City Council as recommended by California Government Code Section 53646. The attached policy was updated in coordination with the City’s investment advisor, Chandler Asset Management, to reflect current State law and to incorporate minor clarifying edits. The changes are reflected in the attached Investment Policy.

Part IX: City Council Compensation
In June 2025, the City Council deferred consideration of City Council compensation until completion of the City’s 2026 labor negotiations. As of the date of this report, labor negotiations remain ongoing. For Council to adopt a compensation change that would be effective after the November general election, Council must hold a first and second reading of a Council compensation ordinance no later than the end of this coming October.

WHEREAS, Article XIII B of the California Constitution (Proposition 4) established appropriation limits for cities; and
WHEREAS, Government Code Section 7910 (a portion of the Legislation implementing Proposition 4) requires cities to annually adopt a resolution establishing their appropriation limit; and WHEREAS, the Director of Finance has made, or caused to be made, calculations in accordance with the provisions of Article XIII B and the implementing legislation to determine the appropriation limit for Fiscal Year 2026-27; and
WHEREAS, the City Council has determined that the growth factors of (1) the percentage change in Per Capita Personal Income and (2) the percentage change in the County’s population will be used to establish the FY 2026-27 appropriation limit; and WHEREAS, selecting these growth factors will result in a new limit for FY 2026-27 of $271,263,712; and

Section 3. Finds and determines that the total appropriation limit of Article XIII B, Proposition 111, and implementing State Legislation amounts to $271,263,712 for Fiscal Year 2026-

27. The Council further finds and determines that the annual adjustment factors to be applied to the limit calculation are the percentage change of Per Capita Personal Income and the County of Contra Costa’s annual population growth.

SUBJECT: Measure V Oversight Committee’s Review of the FY 2024-25 Annual Comprehensive Financial Report and Evaluation and Report on the City’s Proposed Use of Measure V Revenues in the Proposed Biennial Capital Budget for FY 2026-27 and FY 2027-28
The Measure V Oversight Committee (Committee) convened on April 1, 2026, to hear a presentation from staff on the City’s preliminary Biennial Fiscal Year (FY) 2026-27 and FY 2027-28 Capital Budget. The purpose of the Capital Budget presentation was to obtain an understanding of how Measure V revenue is proposed for use in the Capital Budget in order to advise the Council. Measure V was passed to: protect core services, maintain the City’s reserves, address the City’s infrastructure needs, and address areas of community priority.

The Committee reconvened on May 4, 2026, to review the FY 2024-25 Annual Comprehensive Financial Report (ACFR), which includes the annual audit. At this same meeting, the Committee also received an overview of the Measure V one-time residual funds as outlined in the Mid-Year Operating Budget update presented to the City Council on February 10, 2026.

The Committee has made the following findings with regard to its charge in oversight of the tax:

1. Has the Committee reviewed the FY 2024-25 Annual Audit and confirmed that the Measure V tax was collected and spent?
On May 4, 2026, the Committee reviewed the FY 2024-25 Annual Comprehensive Financial Report (ACFR) and determined that the presentation of the Measure V Transactions and Use Tax in the financial statements (pages xvii, 9, 13, 26-27, 32, 34, and 121) reflect the collection of the tax appropriately.

The Committee finds that usage of Measure V tax revenues and interest earned ($33.5 million) was identified clearly in the annual audit. Further, the Committee finds that $32.3 million of Measure V revenue went to maintain General Fund operations for City services, which allowed the City to avoid cuts to essential City Attachment 3

Services and infrastructure maintenance, and the remaining $0.6 million was used to support the Coordinated Outreach Referral Engagement (CORE) program (Council Priority) and building maintenance.

2. Does the City’s proposed Biennial Capital Budget for FY 2026-27 and 2027- 28 address the City’s infrastructure needs?
On April 1, 2026, the Committee reviewed the Proposed FY 2026-27 and FY 2027-28 Biennial Capital Budget and concluded that the presentation on the use of Measure V revenue to fund capital projects addresses the City’s infrastructure needs. Specifically, the revenues are being allocated to support existing infrastructure and address areas of community and Council priority. Safe and usable infrastructure is a City Council priority.

The City borrowed $114 million to accelerate infrastructure projects, leveraging Measure V funds. As of May 2026, the city has fully spent the $114 million on critical infrastructure projects for roadways, facilities, and transportation.

The Proposed FY 2026-27 and FY 2027-28 Biennial Capital Budget is approximately $55 million over two years, of which Measure V funds 20% or $12 million. This $12 million includes $7 million for pavement maintenance projects, $1.2 million for sidewalk maintenance projects, $2.1 million for parks and facilities, and $0.4 million for Transportation. The proposed capital projects do not create new, ongoing expenditures. The Biennial Capital Budget addresses the infrastructure needs and infrastructure improvements.

Committee Summary and Recommendation
Measure V has proven to be a vital revenue source allowing the City to protect essential services, address critical infrastructure backlogs, and focus efforts toward areas of community priority.

The Committee encourages Council to continue analyzing spending priorities to ensure that they meet the most pressing needs and concerns of all Concord residents.

INVESTMENT POLICY

1. PURPOSE
To establish the policy for this investment policy is to provide guidelines for the investment of public funds in a manner that ensures the safety of principal, provides adequate liquidity to meet operating requirements, and achieves a reasonable return. The policy also aims to promote transparency, accountability, and compliance with all applicable state and local laws and regulations.

2. POLICY
It is the policy of the City of Concord (“City”) to invest public funds in a manner which provides for safety of principal while providing sufficient liquidity to cover the City’s short- and long-term needs.

All investment activity will conform to the California Government Code, Sections 53600 through 53686. This policy is written to incorporate industry best practices and recommendations from sources such as the Government Finance Officers Association (GFOA), California Municipal Treasurers Association (CMTA), California Debt and Investment Advisory Commission (CDIAC) and the Association of Public Treasurers (APT).

The Treasurer will annually render to the City Council a statement of investment policy.

3. SCOPE
This investment policy applies to all financial assets of the City as accounted for in the City of Concord’s Annual Comprehensive Financial Report. Policy statements included in this document focus on the City’s pooled funds but will also apply to all other funds under the Treasurer’s control unless specifically exempted by statute or ordinance. This policy includes, but is not limited to, the following funds:
a. General Fund
b. Agency Fund
c. Enterprise Funds
d. Capital Project Funds
e. Debt Service Funds
f. Internal Service Funds
g. Special Revenue Funds
h. Any new funds created by the City Council
This policy specifically exempts any bond proceed funds in the possession of a trustee or fiscal agent.

These bond proceeds shall be invested in accordance with the requirements and restrictions outlined in the bond documents. Also exempt are pension or other post-employment benefit funds held in a trust.

2 Except for cash in certain restricted and special funds, the City will consolidate cash and reserve balances from all funds to maximize investment earnings and to increase efficiencies with regard to investment pricing, safekeeping and administration. Investment income will be allocated to the various funds based on their respective participation and in accordance with generally accepted accounting principles.

4. PRUDENCE
All persons authorized to make investment decisions for the City of Concord are trustees and therefore fiduciaries subject to the prudent investor standard.

The standard of prudence to be used by City of Concord fiduciaries is the “Prudent Investor” Standard found in the California Government Code, Section 53600.3 and shall be applied in the context of managing the overall portfolio, and is defined as:

Prudent Investment Standard: Acting with care, skill, prudence and diligence under circumstances then prevailing, which persons of prudence, discretion and intelligence exercise in the professional management of their business affairs, not for speculation, but for investment considering the probable safety of their capital as well as the probable income to be derived.

The Treasurer and other investment employees, acting within the intent and scope of the Investment Policy and other written procedures, and exercising due diligence, shall be relieved of personal responsibility for an individual security’s credit risk or market price changes, provided deviations from expectations are reported in a timely manner and appropriate action is taken to control adverse developments.

5. OBJECTIVE
The objective of the investment portfolio is to meet the City’s short- and long-term cash flow needs.

To achieve this objective, the portfolio will be structured to provide, in priority order, safety of principal, liquidity and return on investment.

5.1 Preservation of Capital (Safety)
Safety of principal is the foremost objective of the City of Concord. All investments of the City shall be undertaken in a manner that ensures the preservation of capital in the overall portfolio. Each investment transaction shall seek to ensure that capital losses are avoided, whether from issuer or broker/dealer default. The City shall seek to preserve principal by mitigating the two types of risk: Credit risk and market risk.

5.1.1 Credit Risk
Credit risk is the risk of loss due to failure of the issuer to repay an obligation and shall be mitigated by investing in high quality credits, actively monitoring investments, and by diversifying the investment portfolio so that the failure of any one issuer would not unduly harm the City’s cash flow.

5.1.2 Market Risk
Market risk is the risk of market value fluctuations due to overall changes in the general level of interest rates and shall be mitigated by providing adequate liquidity for short-term cash needs, and by making longer-term investments only with funds that are not needed for current cash flow purposes.

The City further recognizes that certain types of securities, including variable rate securities, securities with principal paydowns prior to maturity, and securities with

3 embedded options, will affect the market risk profile of the portfolio differently in different interest rate environments. The City, therefore, adopts the following strategies to control and mitigate its exposure to market risk:
• The City will maintain a minimum of six months of budgeted operating expenditures in short-term investments to provide sufficient liquidity for expected disbursements.
• The maximum stated final maturity of individual securities in the portfolio will be five (5) years from the date of trade settlement, except as otherwise stated in this policy.

5.2 Liquidity
The City’s investment portfolio will be structured to provide sufficient liquidity to meet the operating requirements of the City of Concord.

5.3 Return on Investment
State law requires that the objective of return on investment be subordinate to the objectives of safety and liquidity. Therefore, investment employees shall seek to achieve a return on the funds under their control throughout all economic cycles, taking into consideration the City of Concord’s investment risk constraints and cash flow requirements. In evaluating the performance of the City’s portfolio in complying with this Policy, it is expected that the City shall establish an appropriate performance benchmark and compare the total return of its portfolio to the total return of the benchmark.

6. DELEGATION OF AUTHORITY
Pursuant to California Government Code Section 53601 the City Council as the legislative body of the City of Concord has primary responsibility for the investment of surplus monies or monies held in sinking funds, in the City treasury. As authorized under California Government Code Section 53607 the City Council hereby delegates its authority to invest or reinvest the funds of the City, and to sell or exchange securities so purchased, to the City Treasurer who shall assume full responsibility for all such transactions until such time as this delegation of authority may be revoked by the City Council.

Within the Finance Department, the responsibility of day-to-day treasury activities and investment of City funds is delegated by the City Treasurer to the Director of Finance. The Director of Finance may then delegate the authority to conduct investment transactions and to manage the operation of the investment portfolio to other specifically authorized staff members. The City Treasurer shall establish investment policy guidelines in writing within which the Director of Finance or designee shall operate day-to-day investment activities. Delegation of Authority will not remove or abridge the Treasurer’s investment responsibility.

The Treasurer may also delegate investment decision making and execution authority to an investment advisor, who is registered under the Investment Advisers Act of 1940, to assist in the management of the City’s investment portfolio in a manner consistent with the City’s objectives. The advisor shall follow the Investment Policy and such other written instructions as are provided.

7. ETHICS AND CONFLICT OF INTEREST
In accordance with California Government Code, Sections 1090 et seq. and 87100 et seq., and the City of Concord’s Conflict of Interest Code, public officials of the City will refrain from any activity that could conflict with the proper execution of the investment program, or which could impair their

4 ability to make impartial investment decisions. In addition, these same employees are prohibited from undertaking personal investment transactions with any individual with whom City business is conducted.

Employees and investment officials shall annually submit a Statement of Economic Interest, also known as the Form 700. The Form 700 provides necessary information to the public about an official’s personal financial interests to ensure that officials are making decisions in the best interest of the public and not enhancing their personal finances. Additional guidance on disclosing potential conflicts of interest is available on the California Fair Political Practices Commission website.

8. AUTHORIZED FINANCIAL DEALERS AND INSTITUTIONS
The City of Concord shall transact business only with commercial banks, savings and loans, and investment securities dealers. The dealers must be primary dealers regularly reporting to the Federal Reserve Bank of New York or regional dealers that qualify under the Securities and Exchange Commission Rule 15C3-1 (uniform net capital rule). Selection of financial institutions and broker/dealers authorized to do business with the City shall be at the sole discretion of the City Treasurer. The Treasurer will maintain a list of financial institutions authorized to transact with the City.

All financial institutions and broker/dealers who desire to become qualified bidders for investment transactions must supply the Treasurer with audited financial statements from the three most recent years, at least three references from other California Local agencies, a completed broker/dealer questionnaire and a statement certifying that the institution has reviewed the California Government Code, Section 53600 et seq. and the City’s Investment Policy. The Treasurer shall determine if the Financial Institutions are adequately capitalized, make markets in securities appropriate to the City’s needs and are recommended by other local agency portfolio managers.

The Treasurer will conduct an annual review of the financial condition of all qualified institutions.

Additionally, their current financial statements are required to be on file.

If the City has an investment advisor, the investment advisor may use its own list of authorized broker/dealers to conduct transactions on behalf of the City. The advisor shall make available its list of authorized broker/dealers to City staff upon request.

9. AUTHORIZED INVESTMENTS
The City is authorized by California Government Code Section 53600 et seq. to invest in the types of securities listed below. Within the investments permitted by the Code, the City seeks to further restrict eligible investments to the guidelines listed below. In the event a discrepancy is found between this policy and Code, the more restrictive parameters will take precedence. Percentage holding limits and minimum credit requirements listed in this section apply at the time the security is purchased.

Where this section specifies a percentage limitation for a particular security type, that percentage is applicable only on the date of purchase. Credit criteria listed in this section refers to the credit rating at the time the security is purchased. If an investment’s credit rating falls below the minimum rating required at the time of purchase, the Treasurer will perform a timely review and decide whether to sell or hold the investment. A security purchased in accordance with this Policy shall not have a forward settlement date exceeding 45 days from the time of investment. At the time of the investment’s maturity or liquidation, such funds shall be reinvested only as provided in the current policy.
