PUBLIC FACILITIES MAINTENANCE DISTRICT NO. 18-01
PROCEDURES FOR THE COMPLETION, RETURN AND TABULATION OF
ASSESSMENT BALLOTS
I. Completion of Ballots
1. Who may complete a ballot?
An assessment ballot may be completed by the owner of the parcel to be assessed. As used in these procedures, the term "owner" includes the owner's authorized representative. If the owner of the parcel is a partnership, joint tenancy or tenancy in common, a ballot may be completed by any of the general partners, joint tenants or tenants in common. Except as set forth below, only one ballot may be completed for each parcel.
2. Ownership apportioned assessment ballots.
If a parcel has multiple owners of record, any owner of record may request an apportioned ownership assessment ballot no later than ten (10) days before the date of the scheduled public hearing. If proportion of ownership interests is not shown on the last equalized secured property tax roll, such request must include evidence, satisfactory to the City, of the record owner's proportional interest in the parcel. The City will provide an apportioned ballot to the record owners at their address as shown on the most recent assessment roll. Each request for any form of ballot to be mailed to another location must be made in writing and must include evidence, satisfactory to the City, of the identity of the person requesting the ballot. Each apportioned ballot will be marked to show the date on which the ballot was provided, to identify it as an ownership apportioned ballot and to indicate the owner's proportional interest in the parcel. The City will keep a record of each apportioned ballot provided to an owner.
3. Duplicate ballots.
If an assessment ballot is lost, withdrawn, destroyed or never received, the City will mail or otherwise provide a duplicate ballot to the owner upon receipt of a request in writing delivered to the City Clerk. The duplicate ballot will be marked to show the date on which the ballot was mailed or provided and to identify it as a duplicate ballot or a duplicate apportioned ballot.
4. Marking and signing the ballot.
To complete an assessment ballot, the owner of the parcel must: (1) mark the appropriate box supporting or opposing the formation of an assessment district and the proposed
assessment; and (2) sign, under penalty of perjury, the statement on the ballot certifying that the person completing the ballot is the owner of the parcel or the owner's authorized representative. Only one box may be stamped or marked on each ballot. Ballots must be completed in blue or black ink and the ballot containing the original signature must be timely returned to the City in a sealed envelope indicating the Assessor's Parcel Number (APN), street address or record owner's name on the exterior of the return envelope.
5. Only assessment ballots provided by the City will be accepted.
The City will only accept ballots mailed or otherwise which were provided to owners by the City. No facsimile, mechanically duplicated or other ballot form will be accepted.
II. Return of Ballots
1. Who may return ballots?
An assessment ballot may be returned by the owner of the parcel or by anyone authorized by the owner to return the ballot.
2. Where to return ballots.
Ballots may be mailed to the address indicated on the ballot. Ballots may also be delivered in person to the City Clerk at the Corcoran City Hall, 832 Whitley Avenue, Corcoran 93212 (before 5 P.M. on the date scheduled for the public hearing on the proposed annexation and/or assessment), or delivered to the City Clerk at the public hearing on the proposed assessment.
3. When to return ballots.
All returned ballots must be actually received by the City Clerk before the City Council closes the public input portion of the public hearing on the proposed assessment. The public input portion of the public hearing may be continued from time to time. The City Clerk will endorse on each ballot the date of its receipt. The City Clerk will collect mailed ballots at 3:30 P.M. on the date scheduled for the public hearing on the proposed assessment. To ensure that mailed ballots are actually received by the City Clerk before the conclusion of the public input portion of the public hearing, mailed ballots must be actually received by the City before 3:30 P.M. on the hearing date. Mailed ballots received after 3:30 P.M. on the hearing date will only be counted if the ballots are actually received by the City Clerk before the conclusion of the public input portion of the public hearing. The City makes no representation whether the public input portion of the public hearing will be concluded on the date scheduled for commencement of the public hearing, or continued to a later date.
4. Withdrawal of assessment ballots.
After returning an assessment ballot to the City, the person who signed it may withdraw the ballot by submitting a written statement to the City Clerk, directing the City Clerk to withdraw the ballot, before the close of the public input portion of the public hearing on
the proposed assessment. When ballot shares for the assessment are tabulated, the City Clerk will segregate withdrawn ballots from all other returned ballots. The City Clerk will retain all withdrawn ballots and will indicate on the face of such withdrawn ballots that they were withdrawn. When a ballot has been withdrawn, the person withdrawing the ballot may request a duplicate ballot.
5. Changes to assessment ballots.
To change a ballot which has been submitted, the person who has signed it must: (1) request the ballot be withdrawn; (2) request a duplicate ballot; and (3) return the duplicate ballot fully completed by the deadline set by these procedures. Each of these steps must be completed in the manner prescribed in these procedures.
III. Tabulation of Ballot Shares
1. Which assessment ballots will be counted?
Only ballots which are received by the City Clerk in compliance with these procedures will be counted.
Ballots received by the City Clerk after the close of the public input portion of the public hearing on the proposed assessment will not be counted. Ballots which do not contain the original signature of the record owner will not be counted. Ballots with no box marked, or with more than one box marked, will not be counted. Ballots withdrawn in accordance with these procedures will not be counted. Each of these is an invalid ballot.
The City will keep a record of each apportioned or duplicate ballot mailed or otherwise provided to an owner and will verify, prior to counting any duplicate ballot, that only one ballot has been returned for the parcel (or for each owner in the case of apportioned ballots).
The following rules apply if more than one valid ballot for a parcel or owner is returned to the City. If a non-duplicate ballot is returned, the City will count the non-duplicate ballot and disregard each duplicate ballot. If only duplicate ballots have been returned, the City will count the duplicate ballot which was issued first by the City and disregard subsequently issued duplicate ballots. If an owner returns both a non-apportioned ballot and an apportioned ballot, the City will count the apportioned ballot and disregard the non-apportioned ballot.
2. When and where ballots will be tabulated?
The tabulation of ballots will be performed, in view of those present, at the public hearing tollowing the close of the public input portion of the public hearing. The public hearing may be continued from time to time for the purpose of tabulating ballots. Ballots will not be unsealed until the tabulation begins.
3. How ballots will be tabulated?
Ballot shares may be counted by hand, by computer, by any other tabulating device, or any combination thereof. Ballots shares will be tabulated by adding the ballots shares received in opposition to the assessment and adding the ballot shares received in favor of the assessment. Ballot shares assigned to each parcel shall be weighted according to the proportional financial obligation of the entire parcel in relation to the total assessment on all parcels within the City; provided, however, that ballot shares assigned to parcels with multiple owners of record shall, upon request, be apportioned to the owners thereof in their proportion of ownership. If one or more apportioned ballots are received for a parcel and a non-apportioned ballot is returned for the parcel, the non-apportioned ballot will be disregarded.
4. Who will tabulate ballots?
Ballot shares will be tabulated by the City Clerk or another impartial person designated by the City Council who does not have a vested interest in the outcome of the proposed assessment. The City Clerk or other designated person may be assisted by staff of and consultants to the City.
5. Results of tabulation.
The results of the tabulation will be announced following the completion of the tabulation and entered in the minutes of the City Council meeting. If ballot shares submitted in opposition to the proposed assessment exceed ballot shares submitted in favor of it (as tabulated above), the assessment will not be imposed.
IV. Resolution of Disputes
In the event of a dispute regarding whether the signer of a ballot is the record owner of the parcel to which the ballot applies, the City Clerk or other person designated by the City Council will make such determination from the last equalized assessment roll and any evidence of ownership submitted to the City before the conclusion of the public hearing. The City will be under no duty to obtain or consider any other evidence as to ownership of property and its determination of ownership will be final and conclusive.
In the event of a dispute regarding whether the signer of a ballot is an authorized representative of the owner of the parcel, the Clerk or other person designated by the City Council may rely on the statement on the ballot, signed under penalty of perjury, that the person completing the ballot is the owner's authorized representative and any evidence submitted to the City before the conclusion of the public hearing. The City has no duty to obtain or consider any other evidence as to whether the signer of the ballot is an authorized representative of the owner and its determination will be final and conclusive.
Any other dispute shall be resolved by the City Clerk or other person designated by the City Council.
V. Public Record
During and after the tabulation, assessment ballots shall be treated as disclosable public records and be equally available for inspection by the proponents and opponents of the proposed assessment.

CITY ADMINISTRATION
STAFF REPORT
ITEM #: 5-D
MEMO
TO: Corcoran City Council
FROM: Greg Gatzka, City Manager
DATE: April 20, 2023 MEETING DATE: April 25, 2023
SUBJECT: Update on Corcoran Homelessness Challenges
Summary:
The Council has requested updates on progress related to John Maroot Park clean up and ongoing homeless challenges.
Recommendation:
Receive an update from staff, and consider directing staff on follow up actions.
Budget impact:
None with this action. Authorizations for expenditures related to John Maroot Park clean up and implementation of the City's Anti-Encampment Ordinance have already been authorized.
Background:
The City of Corcoran, just like many other cities and communities throughout the San Joaquin Valley, is faced with a growing presence of homelessness and the associated challenges. The City Council has previously authorized funding for the clean-up of John Maroot Park, enacted an Anti-encampment ordinance that became effective on January 12, 2023, and authorized the contracted assistance of Kings Community Action Organization on February 14, 2023 to assist the City in providing housing navigation and other unsheltered services to homeless populations at John Maroot Park. During the month of March, significant rain and flooding occurred in and around the City that delayed some of the administrative processes needed to continue implementing the City ordinances and addressing the degradation of the park. In April 2023, the City experienced an increased surge of additional homeless in the community that were likely displaced from adjacent communities and their flooding as homeless encampments along the Tule River upstream and Cross Creek were displaced. This surge has accelerated the further degradation of John Maroot Park, including the significant increase of trash debris, unhealthy conditions, and safety issues with adjacent homeowners, businesses and churches.
