MEMO
TO: Corcoran City Council
FROM: Joseph Faulkner, Public Works Director
DATE: August 22, 2024, MEETING DATE: August 27, 2024
SUBJECT: Corcoran Local Roadway Safety Plan
Recommendation:

Consider approval of the Corcoran Local Roadway Safety Plan.

Background:

In 2019, the city received state funding through the Systemic Safety Analysis Report Program (SSARP) to develop a Local Roadway Safety Plan (LRSP). This plan involved collecting local collision data to identify accident hotspots and areas of concern throughout the city. The data was then analyzed to determine effective countermeasures and prioritize roadway safety improvements.

To apply for grant funds from the Highway Safety Improvement Program (HSIP), an agency must have an approved LRSP. HSIP is a federal program designed to reduce traffic fatalities and serious injuries on public roads. It typically announces funding opportunities every two years and is currently in its 12th cycle. The city has previously secured HSIP funding for pedestrian crossing enhancements and guardrail upgrades.

Discussion:

To qualify for future grant funding through the Highway Safety Improvement Program, the city must have an approved LRSP. It is strongly recommended that the LRSP be formally approved by the Corcoran City Council.

Budget Impact:

There is no fiscal impact approving the Corcoran Local Roadway Safety Plan.

ITEM #: 2-F
MEMO
TO: Corcoran City Council
FROM: Marlene Spain, City Clerk
DATE: August 23, 2024 MEETING DATE: August 27, 2024
SUBJECT: Consider City Council appointments in lieu of an election to be held on November 5, 2024.

RECOMMENDATION: (Roll Call Vote)
That the City Council adopt Resolution No. 4066 providing for the appointment of nominees to the public offices of this City which were to be elected on Tuesday, November 5, 2024.

DISCUSSION:

The Office of the City Clerk hereby certifies that as of the close of the nomination period at 5:00 P.M. on August 9, 2024, County staff received nomination papers of two candidates which were certified. The two nominees consist of the following two City Council seat incumbents: Jeanette Zamora-Bragg and Patricia Nolen.

Election Code § 10229 sets the course of action available for the governing body to take:

1. Appoint to the public office(s) the person(s) nominated

2. Appoint to the public office any eligible voter, if no one was nominated.

3. Hold an election, if either no one or only one person has been nominated.

Because the number of nominees equals the number of public offices up for election, only course of action No. 1 above is appropriate. The attached proposed resolution form reflects the recommended action to be taken, in light of the number of nominees matching the number of Council seats up for election in November, namely the appointment of the nominees, in lieu of incurring the expense of an unnecessary election.

FISCAL IMPACT:

A savings to the City of approximately $6,000.00 to $8,000.00 if no election is held.

PUBLIC HEARING
ITEM 5-A

MEMORANDUM
TO: Corcoran City Council
FROM: Kevin J. Tromborg: Community Development Director Planner, Building Official,
SUBJECT: Presentation of the draft 6 Cycle, 2024-2032 Housing Element and Fair Housing Analysis and authorization to submit the Draft Sith cycle Housing Element and Fair Housing Analysis to the California Department of Housing and Community Development (HCD).

DATE: August 21, 2024 MEETING DATE: August 27, 2024
RECOMMENDATION: Staff recommends conducting a Public Hearing to receive public comments. Following Council review and comments, approval and authorization of the 6* Cycle Draft Element and Fair Housing Analysis submittal to the State of California, Housing and Community Development (HCD) for final review.

DISCUSSION
The Housing Element is a State mandated element of the City's General Plan containing analysis, policies, and programs with the objective to preserve, improve, and develop housing for all economic segments of the community.

The current update covers the period 2024-2032 (Sixth Cycle).

The Draft Housing Element has been prepared in accordance with State Housing Element Law and Guidelines of the State Department of Housing and Community Development Department (HCD). Upon approval of the Draft staff will send the Draft to HCD for review, which review could take up to 90 days. HCD may approve the Draft or submit comments requiring revisions to the Draft. A review of the revised Draft would take 60 days for review. Upon obtaining the letter of statutory compliance from HCD, the Final Housing Element will be placed before the Planning Commission and the City Council for Adoption. Once adopted, a copy of the Housing Element will be submitted to HCD for Certification.

A PowerPoint presentation will be made at the meeting showing relevant Tables and Figures in City Offices: 832 Whitley Avenue * Corcoran, CA 93212 * Phone 559/992-2151 support of the presentation by city staff and/or consultant.

FAIR HOUSING ANALYSIS
California State Law AB 686 created new requirements for all housing elements revised on or after January 1, 2021 to contain an Affirmatively Furthering Fair Housing (AFFH) analysis.

Under State law, affirmatively further fair housing means "taking meaningful actions, in addition to combatting discrimination, to facilitate deliberate actions to explicitly address, combat, and relieve disparities resulting from past patterns of segregation to foster more inclusive communities free from barriers that restrict access to opportunity based on protected characteristics".

The Housing Element analysis must include a Fair Housing Analysis. The city's consultant has prepared the Housing Element and a Fair Housing Analysis addressing the following mandated topics:

1. Outreach

2. Assessment of Fair Housing
a. Key Data and Background Information
b. Fair Housing Enforcement and Outreach Capacity
c. Integration and Segregation Patterns and Trends
d. Racially or Ethnically Concentrated Areas of Poverty

FAIR HOUSING ANALYSIS - FINDINGS

1. Diversity: Diversity captures the racial and ethnic diversity of a geographic area.

A majority of the population-69.3%—identifies as Hispanic or Latino. This exceeds Kings County's share of Hispanic or Latino population (54.9%). Of the non-Hispanic population, 15.3% of Corcoran's population is White and 11.7% is Black. American Indian/Alaska Native, Asian, Native Hawaiian/Pacific Islander, and other racial cohorts represent only small percentages of the city's population.

2. GINI Index: The GINI index is a measure of the extent to which the distribution of income among families/households within a community deviate from a perfect equal distribution. The scale is from 0 to 1, with O representing perfect equality and 1 representing the highest possible level of inequality. The Gini coefficient for California is

0.49 while Kings County has a Gini index is 0.41. The City of Corcoran's index value of

0.46 shows that the City has similar levels of inequality as the state and county.

3. Dissimilarity Index: Dissimilarity suggests that racial or ethnic groups are more unevenly distributed (for example, they tend to live in different neighborhoods). While a central portion of Corcoran contains high segregation and poverty, the majority of the City Offices: 832 Whitley Avenue * Corcoran, CA 93212 * Phone 559/992-2151
county has low segregation.

4. Racially or Ethnically Concentrated area of Poverty (R/ECAP): The racial/ethnic concentration threshold must have a non-White population of 50 percent or more within a metropolitan or a micropolitan area. Outside of these areas, where the non-White populations are likely to be much smaller, the threshold is set at 20 percent. Kings County and its cities are classified as suburban with a population not exceeding 1 million in a Statistical Metropolitan Area less than 2 million. A neighborhood (Census tract) can also be a R/ECAP if it has a poverty rate that exceeds 40 percent or more or is three or more times the average tract poverty rate for the metropolitan/micropolitan area, whichever threshold is lower.

Most of the City of Corcoran is identified as Low-Medium Segregation. Census tract

14.01, which is located centrally, is identified as High POC Segregation. There is also a small part of the southern city limits of Corcoran that falls into the large Census tract

16.01 that is also identified High POC Segregation. Census tract 9801 lacks sufficient data. As the City aims to integrate further, it is important to take displacement risk into account which discussed in a section below.

5. Racially Concentrated Areas of Affluence (RCAA): RCAA exists when the population has a median household income of $125,000 and that is 80 percent or more, White. There are no Racially Concentrated Areas of Affluence (RCAAs) in the City of Corcoran.

6. Disparities in Access to Opportunities: The City of Corcoran presents a complex socio- economic landscape, as evidenced by its mixed resource distribution in the TCAC and HCD Opportunity map. The city is characterized by areas that are High Segregation & Poverty, Low Resource, and Moderate Resource. Corcoran faces significant challenges in bridging spatial economic disparities. These disparities necessitate nuanced policy interventions aimed at promoting equitable development.

7. Disproportionate Housing Needs: Housing tenure (owner vs. renter) influences several aspects of the local housing market. Residential mobility is influenced by tenure, with ownership housing evidencing a lower turnover rate than rental housing. The vacancy rate also indicates the match between the demand and supply of housing. Table 1 details housing tenure and vacancies in Kings County and incorporated communities according to the Census ACS 2016-2020 estimates. Vacancy rates of 5% to 6% for rental housing and 1.5% to 2.0% for ownership housing are generally considered to be optimum. A higher vacancy rate may indicate an excess supply of units, a softer market, and result in lower housing prices. A lower vacancy rate may indicate a shortage of housing and high competition for available housing, which generally leads to higher housing prices and diminished affordability.

City Offices: 832 Whitley Avenue Corcoran, CA 93212 * Phone 559/992-2151
In Corcoran, 91.5% of the housing units are occupied, which is slightly lower than Kings County's 94.20%. The proportion of owner-occupied units in Corcoran is 42.6%, with an average household size of 3.24, indicating a preference for ownership but at a rate lower than Kings County's 50.50% ownership rate. The average household size in Kings County for owner-occupied units is 3.12, slightly smaller than in Corcoran. This suggests that rental housing in Corcoran tends to accommodate larger households. The breakdown of these vacancies is varied, with Corcoran having a higher proportion of units for rent and a notable number of units sold but not occupied. This data illustrates how Corcoran's housing market differs from the broader Kings County area, with a higher vacancy rate, a lower rate of homeownership, and larger average household sizes for both owner- occupied and renter-occupied units.

8. Displacement: The southern regions of Corcoran are at lower risk of displacement while the northern and surrounding regions are risk of displacement. This refers to the likelihood of residents, particularly low-income renter households, being forced to move out of their neighborhoods due to various factors. This concept is often evaluated in the context of gentrification, rising housing costs, and changing neighborhood dynamics.

9. Site Inventory (Vacant Sites 6,000 Sq. Ft. or Greater): The RHNA sites in Corcoran are generally accommodated throughout the city and are not concentrated in areas with high racial or ethnic populations, persons with disabilities, female-headed households, or senior households. For these reasons, the city finds that the sites proposed to accommodate its RHNA allocation do not unduly burden existing areas of concentrated racial or ethnic homogeneity, poverty, or other characteristics. Moreover, the sites affirmatively further fair housing by helping to stimulate investment in areas where additional opportunities are desired, and where new residential and/or mixed-use development can help to improve some of the opportunity level characteristics discussed earlier in this chapter.

10. Identification of Contributing Factors, Goals and Actions:

Based on the issues identified in the Fair Housing Analysis, the following are the top 5 issues to be addressed through the programs in the Housing Plan:

1. Maintaining and preserving the existing affordable housing stock;

2. Assisting in the provision of housing;

3. Removing governmental constraints, as necessary;

1. Providing adequate sites to achieve a variety and diversity of housing; and

5. Promoting equal housing opportunity.

The new Housing Element has proposed a list Housing Plan (Chapter VI of Housing Element), including policies and programs augmenting Fair Housing goals of the City.

I. HOUSING ELEMENT
2024-2032 REGIONAL HOUSING NEEDS ASESSMENT (RHNA) - 6t CYCLE The Housing Element includes an analysis of new Regional Housing Needs Assessment (RHNA) requirements under the 6'" Cycle as shown in Table 2 and 3 below:

RHNA is a state requirement, and the allocation of units are prepared, generally, by Council of Governments and subsequently approved by the State. Regulations for the construction of the housing units should be facilitated by each jurisdiction in each RHNA period. The units may be constructed by the private sector, non-profits, housing authorities, or by the jurisdiction (cities/counties) through grant monies. A certified Housing Element enables the jurisdictions to be eligible to seek various types of grants from the State and Federal governments. Jurisdictions must submit an annual progress report to HCD on the progress of the implementation of the Housing Element.

9. Site Inventory
The RHNA sites in Corcoran are generally accommodated
throughout the city and are not concentrated in areas with high racial or ethnic populations, persons with disabilities, female-headed households, or senior households. For these reasons, the city finds that the sites proposed to
accommodate its RHNA allocation do not unduly burden
existing areas of concentrated racial or ethnic homogeneity, poverty, or other characteristics.

STAFF REPORT
ITEM #: 6-A
MEMO
TO: Corcoran City Council
FROM: Joseph Faulkner, Public Works Director
DATE: August 22, 2024 MEETING DATE: August 27, 2024
SUBJECT: Safe Routes to School Project
Recommendation:

Consider awarding a contract to Seal Rite Paving for the Safe Routes to School Project- Active Transportation Program (ATP Cycle 5).

Background:

The Safe Routes to School Project is designed to improve pedestrian safety by building new sidewalks in critical areas around local schools. This initiative is part of our broader efforts to enhance student safety and encourage walking as a practical transportation option. This project is the first of two phases; the first phase will concentrate on the Letts Avenue school corridor and the installation of sidewalks along Sherman Avenue.

Discussion:

Staff has completed the analysis of the bids for the Safe Routes to School Project. The bids received are ranked below from lowest to highest total bid amount:

1. Witbro Inc., dba Seal Rite Paving & Grading - $2,289,141.00

2. JT2 Inc., dba Todd Companies - $2,970,060.00
After a thorough review of the bid packages and project cost estimates, staff recommends proceeding with Seal Rite Paving. To align with our $1,400,000 construction budget, we have revised the project scope to include only the base bid for Letts Avenue and Bid Additives 3 & 4 for Sherman Avenue. Additionally, we have adjusted the base rock requirement from 12 inches to 4 inches. We recommend that the Corcoran City Council award the project to Seal Rite Paving, contingent upon their agreement to proceed with the adjusted budget of $1,400,000.

Budget Impact:

This project is within the 24/25 budget and is paid entirely by grant funds.

CITY ADMINISTRATION

STAFF REPORT
ITEM #: 6-F
MEMO
TO: Corcoran City Council
FROM: Greg Gatzka, City Manager
DATE: August 22, 2024 MEETING DATE: August 27, 2024
SUBJECT: Corcoran Police Officers Association MOU
Summary:

The City has reached tentative agreement with the Corcoran Police Officers Association (COA) for a one year agreement for FY 2024-25.

Recommendation:

Consider approval of the Memorandum of Understanding (MOU) between the City and CPOA for a one year term, and authorize staff to sign and implement the agreement.

Budget impact:

The proposed one year MOU agreement with COA will increase the City's Police Department Budget for salaries and benefits by an estimated $265,000 for Fiscal Year 2024-25. This will require a follow up budget amendment from the Finance Department that will be presented at a later date to increase the Police Department's Budget for Salaries and Benefits expenditures and offset with Measure A revenue funds. The City can immediately begin providing these salary and benefit adjustments using the existing approved budget, but will need to amend the budget to cover the entire fiscal year.

Background:

The collective bargaining process for this proposed MOU between the City and CPOA began in February 2024, and took approximately six months of good faith negotiations to reach agreement.

The previous MOU expired on June 30, 2024, and the newly proposed MOU was not complete at the time of the Council's formal adoption of the City's Fiscal Year 2024-25 Budget. Therefore, a budget amendment was anticipated to occur once agreement was reached on the MOU. In general, the proposed MOU incorporates salary adjustments that range from 1% to 10.25% based upon classification, 5% increase in city contribution towards health coverage, a $2,500 deferred comp 1/1 match, education incentive, on-call weekly pay, and other minor MOU changes.

The proposed MOU agreement through June 30, 2025, between the City and COA is attached.

STAFF REPORT
ITEM #: 6-G
MEMO
TO: Corcoran City Council
FROM: Greg Gatzka, City Manager / Joe Faulkner, Public Works Director DATE: August 22, 2024 MEETING DATE: August 27, 2024
SUBJECT: Application for Pump Track Qualifier Event
Summary:

A request for the City of Corcoran to host a UCI Pump Track World Championships qualifier event was received.

Recommendation:

Consider taking action on the following:

1. Pre-authorize use of the City's Pump Track for a UCI Pump Track World Championship qualifier event; and

2. Direct staff to submit an application to Velosulutions for Corcoran to serve as a host city for a qualifier event; and

3. Authorize the Mayor to sign a letter of support on behalf of the City.

Budget impact:

None with this action. If the City is selected, staff will prepare a full proposal for the event and identify potential funding sources and sub-sponsors.

Background:

The City of Corcoran's Gateway Park is home to a professionally designed pump track branded as the "The Loop" and is currently one of the largest in the western united states. The pump track design team remains in contact with our City staff and is encouraging the City to consider serving as a host to the growing bicycle riding sport associated with pump tracks. On August 15, 2024, the City Manager and Public Works Director were notified and encouraged to have the City consider being a host city for a regional qualifier pump track event as part of the qualifying events for the UCI Pump Track World Championships to be held in September 2025 in Valais, Switzerland. If the city is selected and hosts a qualifier event, the top four riders will qualify for entry in the World Championships and have their travel and entry expenses for the trip covered.

The application deadline is August 31, 2024. If the City is selected, the event would have to be scheduled between February through August of 2025.

MEMO
TO: Corcoran City Council
FROM: Moses Diaz, City Attorney
DATE: August 22, 2024 MEETING DATE: August 27, 2024
SUBJECT: Council Review Of Layoff Appeal
Summary:

Council consideration of the Gary Cramer layoff appeal.

Recommendation:

Consider the Council's sub-committee recommendation and render a final decision on the layoff appeal.

Budget impact:

None.

Background:

As part of the City's Fiscal Year 2024-2025 Budget process, the City's job classification of Deputy Police Chief was permanently eliminated from the City's job classification system. This resulted in a layoff notice being issued to Gary Cramer on June 26, 2024, with his last day on the City's payroll on July 17, 2024. On July 12, 2024, Mr. Cramer requested an appeal of his layoff as allowed pursuant to the City's Personnel Manual Sec. 403, and was subsequently scheduled for City Manager Review under Section 1104(b). The City Manager's Review of this layoff appeal was then held on July 24, 2024, with the former employee and his representative. The City Manager's decision to uphold the layoff was issued on August 1, 2024. In response, on August 7, 2024, Mr. Cramer requested his layoff appeal proceed to City Council Review pursuant to Section 1104(c). On August 13, 2024, the Council established a sub-committee for fact-finding and is anticipated to report back to the Council at the August 27, 2024 meeting. If the Council decides their review process is complete, the Council may act to render a final decision.
