COMMUNITY DEVELOPMENT DEPARTMENT
SECOND PUBLIC HEARING: STAFF REPORT
January 13, 2026
ITEM # 5-A
FROM: Kevin J. Tromborg, Community Development Director SUBJECT: Second Public Hearing and approval of Ordinance 649 and Resolution 4124 pertaining to Land Use Designation Change (LUDC) 25-02.

Recommendation: (Voice Vote) Staff is recommending approval of Ordinance 649 and Resolution 4124 regarding LUDC 25-02 for address 1311 6 ½ Avenue. The owner is requesting his property's LUD that is currently R-10, be changed to R1-6.

Discussion: The owner of the property, Mr. Jose Salinas, develops moderate-income Single- Family housing on infill lots here in Corcoran. His intention is to split the lot into three (3) lots which under its current designation (R-10 Minimum 10,000 Sq. FT. lots) would only allow for two lots. With a designation change to R1-6 (Minimum 6,000 Sq. Ft. lots) would allow three (3) lots.

AN ORDINANCE OF THE CITY OF CORCORAN
APPROVING A ZONE CHANGE FROM R-1-10
RESIDENTIAL TO R-1-6 RESIDENTIAL FOR
APN 034- 151-017-000 (Land-Use Designation Change 25-02).

THE CITY COUNCIL OF THE CITY OF CORCORAN DOES ORDAIN AS FOLLOWS:

Section 1. PURPOSE: This zoning ordinance is intended to further allow real property within the City of Corcoran ("City") to be put to its highest and best use, while continuing to preserve, protect and promote the public health, safety, peace, comfort, convenience, prosperity and general welfare within the City of Corcoran through reasonable zoning.

Section 2. FINDINGS: The real property identified by Assessor Parcel Number ("APN") 034-151-017-000, located at 1311 6 1/2 Avenue in Corcoran, California ("Subject Parcel") is surrounded by real property in single-family residential use and is adjacent primarily to real property currently zoned R-1-6. Rezoning the Subject Parcel will allow for construction of more housing units and is therefore in the public interest because it would assist in mitigating the housing shortage crisis which is of statewide concern. The proposed zoning change is consistent with the General Plan and any applicable specific plan, and will not be detrimental to health, safety, convenience or welfare of the public within the City. Each and all of the findings within Planning Commission Resolution No. 2025-04, adopted at a duly noticed public hearing held on October 20, 2025, are hereby approved and incorporated into this ordinance by this reference, as if fully set forth herein verbatim. The City Council's public hearing for this ordinance was duly noticed and held on December 9, 2025.

Section 3. ZONE CHANGE: The zoning designation of the Subject Parcel of real property identified by Kings County Assessor Parcel Number 034-151-017-000 is hereby approved to change from R-1-10 Residential to R-1-6 Residential. The City Manager

or his/ her appointee is ordered to cause the official zoning map of the City of Corcoran be revised and updated to reflect the such approved change, and to take or to cause to be taken, all steps reasonably necessary, proper and/or convenient and/or incidental thereto, including incurring any reasonably necessary expenses to implement this ordinance.

Recommendation: (Voice Vote) Consider approval of Resolution No. 4125, Objecting to the tax sale of 527 Dairy Avenue Corcoran Ca. 93212 APN: 030-261-013 Discussion: 527 Dairy Avenue has been abandoned by the owners of the property, (Jerry W.

McFarland and Amber L. McFarland. The structure that was on the property caught fire twice and the city after all the required notices to the owners were forced to board up and secure the property and eventually tear down the posted sub-standard structure. On April 23, 2021, the city won a judgement in court in the amount of $ 33,175.17. Since then, the city has continued to keep the property clen of weeds and debris. The property is now in tax default and resolution 4125 will serve as a letter of exception that will be submitted to Kings County Finance department based of the filed judgement and the monies owed to the City.

CITY ADMINISTRATION

STAFF REPORT
November 12, 2025
ITEM # 6-C
FROM: Greg Gatzka, City Manager
SUBJECT: Declaration of Exempt Surplus Land on Whitley and Pickerell Properties Summary:

Several City owned properties proposed to be developed as the Lakeview Terrace Affordable Housing development qualify as Exempt from the State's Surplus Lands Act.

Recommendation:

1. Consider approving Resolution No. 4126 to declare certain real property comprised of Assessor's Parcel Numbers 034-170-002, 034-170-003, 034-170-004, and 034-170-020 totaling 17.70 Acres as Exempt Surplus Land Pursuant to California Government Code Section 54221(f(1)(A) and the Final Updated Surplus Land Act Guidelines Section 103(c)(2).

2. Authorize the City Manager to submit the appropriate documentation to the California Department of Housing and Community Development in connection with the Resolution and demonstrating the housing development meets the requirements of Government Code Section 37364.

Budget impact:

None with this action.

Background:

On September 13, 2022, the City adopted Resolution No. 3969 that declared the following City owned properties APNs 034-170-002, 034-170-003, 034-170-004, and 034-170-020 as Surplus Land. On August 14, 2023, the City issued Notices of Availability for these same City owned and designated Surplus Land properties located northeast of Whitley and Pickerell Avenues. On September 27, 2023, Self Help Enterprises (SHE) submitted to the City a notice of intent to purchase the above referenced properties for the purpose of building affordable housing. The State Surplus Lands Act then required the City to engage in 90 days good faith negotiations with the intended purchaser, which subsequently resulted in the City agreeing to enter into an Option to Purchase land with SHE. Over the past two years, SHE has been diligently working to secure the necessary funding for the project and purchase of the land. In order for the City to complete the Surplus Land Act process for State Law compliance to sell City owned property, the City must City Offices
832 Whitley * Corcoran, CA 93212 * Phone 559-992-2151 * www.cityofcorcoran.ca.gov submit a Notice of Disposition and await 30 days for a response from the State. As SHE is intending to complete the purchase in the first quarter of 2026, the City may use a more streamlined alternative process by declaring these properties as "Exempt Surplus Land" so long as the project qualifies under Article 8 Surplus Land, Government Code Section 54221(f)(1)(A) that defines "exempt surplus land" as Surplus land that is transferred pursuant to Section 37364. The project does meet the criteria of this government codes section as defined below but will need to adopt a resolution declaring the property exempt and submit the necessary supporting documents to the State verifying the project meets the critena:

Government Code Section 37364.
(a) The Legislature reaffirms its finding that the provision of housing for all Californians is a concern of vital statewide importance. The Legislature recognizes that real property of cities can be utilized, in accordance with a city's best interests, to provide housing affordable to persons and families of low or moderate income.

Therefore, notwithstanding any provision of a city's charter, or any other provision of law, whenever the legislative body of a city determines that any real property or interest therein owned or to be purchased by the city can be used to provide housing affordable to persons and families of low or moderate income, as defined by Section 50093 of the Health and Safety Code or as defined by the United States Department of Housing and Urban Development or its successors, and that this use is in the city's best interests, the city may sell, lease, exchange, quitclaim, convey, or otherwise dispose of the real property or interest therein at less than fair market value, or purchase an interest in the real property, to provide that affordable housing under whatever terms and conditions the city deems best suited to the provision of such housing.
(b) Not less than 80 percent of the area of any parcel of property disposed of pursuant to this section shall be used for development of housing. (c) Not less than 40 percent of the total number of those housing units developed on any parcel pursuant to this section shall be affordable to households whose incomes are equal to, or less than, 75 percent of the maximum income of lower income households, and at least half of which shall be affordable to very low income households.
(d) Dwelling units produced for persons and families of low or moderate income under this section shall be restricted by regulatory agreement to remain continually affordable to those persons and families for the longest feasible time, but not less than 30 years, pursuant to a method prescribed by the city. The regulatory agreement shall contain a provision making the covenants and conditions of the agreement binding upon successors in interest of the housing sponsor. The regulatory agreement shall be recorded in the office of the county recorder of the county in which the housing development is located. The regulatory agreement shall be recorded in the grantor-grantee index to the name of the property owner as grantor and to the name of the city as grantee.
(e) The provisions of this section shall apply to all cities, including charter cities. (f) The definitions of "persons and families of low and moderate income," "lower income households," and "very low income households" set forth in Sections 50079, 50093, and 50105 of the Health and Safety Code shall apply to this section.

Attached Resolution No. 4126 states the necessary findings and declares the subject APNs as exempt surplus land pursuant to Government Code 54221(f)(1)(A) and the Final Updated SLA Guidelines Section 103(c)(2).
