Economic Development
• Economic Development is actions taken by staff representing an urban neighborhood or rural community to improve the economic situation of our citizens (disposable income and assets) and our local business (profitability and growth).
• This is accomplished by enhancing the community's quality of life through appearance, safety, networks, gathering places and by the sense that Corcoran is moving with positive momentum.
• This is accomplished through all the department and the citizens of Corcoran working together for a common goal that is the betterment of this great community.
• Economic development is hard work and involves leaders and citizens that have an idea and the fortitude to bring it to light. It requires simple vision of what this community is and what this community can be.

CITY ADMINISTRATION -

STAFF REPORT
March 24, 2026
ITEM #5-A
FROM: Valerie Bega, Transit and Grants Manager
SUBJECT: Unmet Transit Needs Public Hearing
Summary:

The state requires public transportation agencies to hold annual public hearings to receive comments on unmet transit needs before Transportation Development Act (TDA) funds are allocated. Once allocated, the city receives these funds as Local Transportation Funds (LTF) and can then be used for Transit Operations, Capital Projects, and Streets and Roads.

Recommendation:

Hold a public hearing to receive comments on Corcoran's unmet transit needs, consider adopting Resolution No. 4130 to make findings related to unmet transit needs.

Budget impact:

Once the City adopts a resolution making the necessary findings, LTF funds can be allocated to the City. Once the amount of these funds is determined, the City will plan to budget these funds through the City Council adopted annual budget process.

Background:

The City is required to conduct a public hearing, as mandated by State Law, to allow the public an opportunity to provide input on whether there are transit needs in the community that are reasonable to meet and that are not currently being met by our existing transit service. At the conclusion of the public hearing on March 24, 2026, the Council will then be requested to adopt a resolution that aligns with one of the following findings.

1. There are no unmet transit needs.

2. There are no unmet transit needs that are reasonable to meet.

3. There are unmet transit needs, including needs that are reasonable to meet.

PUBLIC WORKS DEPARTMENT

STAFF REPORT
March 24, 2026
ITEM # 5-C
FROM: Joseph Faulkner, Public Works Director
SUBJECT: Ordinance No. 650 Adopting Cross-Creek Control Requirements And Plan Summary:

Recent State Law changes have mandated that the City's Cross-Connection Control Plan and associated regulations to be updated to comply with new State Water Board standards and the State's Cross- Connection Control Policy Handbook.

Recommendation:

Consider taking action on the following:

1. Adoption of Resolution No. 4132 for introduction and waiver of the first reading of Ordinance No. 650.

2. Hold a public hearing to consider Ordinance No. 650 as the first reading to update the City's Cross- Connection Control regulations within the Corcoran Municipal Code, and City's updated Cross- Connection Control Plan.

3. Set April 14, 2026, for Ordinance No. 650 as the second reading and to consider adoption.

Budget impact:

None with this action.

Background:

Agencies with a public water system are required to ensure that their water distribution system will not be subject to backflow under normal operating conditions. The State Water Board recently adopt updated standards for backflow protection and cross-connection control requirements through the adoption of the Cross-Connection Control Policy Handbook (CCCH), which became effective July 1, 2024. The CCCPH and its standards apply to all California water systems, and failure to comply may result in the issuance of compliance, enforcement, or other corrective actions.

The City of Corcoran has operated a cross-connection control program based on the requirements of Title 17 of the California Code of Regulations. However, the State Water Board now requires that the City adopt a Cross-Connection Control Plan (CCCP) that meets the requirements in CCCPH, ensure ongoing compliance through site inspections, testing of backflow prevention assemblies, and have enforceable regulations. The purpose of this Ordinance is to update the City's Cross-Connection Control Corcoran Public Works Department

The Public Works Department has developed a Cross-Connection Control Plan and coordinated with the City Manager and City Attorney to draft Ordinance No. 650 that will establish the necessary regulations as part of the City's Municipal Code. This ordinance will also define the legal authority to implement corrective actions related to the installation, inspection, field testing, and/or maintenance of backflow devices tied to the City's water system.

ORDINANCE NO. 650
AN ORDINANCE OF THE CITY OF CORCORAN AMENDING ARTICLE 8, CHAPTER 1, SECTION 24 UPDATING THE CITY'S CROSS-CONNECTION CONTROL

PROGRAM TO PROTECT THE PUBLIC WATER SYSTEM
The City Council of the City of Corcoran does ordain as follows:

Section 1. PURPOSE. The purpose of this Ordinance is to update the City's Cross- Connection Control Program regulations to ensure compliance with applicable and updated state regulations, as well as guidelines in the State Water Resources Control Board's Cross-Connection Control Policy Handbook. These state mandated requirements are intended to protect the City's municipal water system from risk of backflow and potential contamination from service connections. The City is required to adopt and implement a Cross-Connection Control Plan (CCCP) as part of the program, and this ordinance integrates by reference the City's plan and its enforcement.

Section 2. CODE REPEAL. Section 8-1-24 of Chapter 1 of Title 8 of the Corcoran Municipal Code is hereby repealed.

Section 3. CODE ADOPTED. Section 8-1-24 is hereby added into Chapter 1 of Title 8 of the Corcoran Municipal Code to read in its entirety as follows:
8-1-24: CROSS-CONNECTION CONTROL PROGRAM:

A. Purpose: This section enacts regulations to implement and enforce the City's Cross- Connection Control Program pursuant to California's Health and Safety Code (CHSC, section 116275 (h)) and the State Water Resources Control Board's Cross-Connection Control Policy Handbook (CCCPH) that became effective July 1, 2024. These regulations are mandatory for all California public water systems and serve to protect the City's public water system's drinking water distribution system from risk of backflow and contamination. The City's Cross-Connection Control Plan (CCCP), as may be updated and/or amended by the City Council from time to time, is hereby incorporated herein by this reference, and contains minimum standards and necessary requirements, which must be satisfied, when a parcel is actively connected to the City's public drinking water distribution system, in compliance with all applicable and updated federal and State regulations. Together, this section and the CCCP form the City's Cross-Connection Control Program. Failure to comply with the CCCP is subject enforcement by the City administratively and/or through the courts, and may result in disconnection from the City's public drinking water distribution system and loss of water system capacity rights.

B. Responsibility: The City's Cross-Connection Control Program is required to be implemented and enforced by a qualified and City designated Cross-Connection Control Coordinator as defined by the CCCP. The City's coordinator ensures that appropriate backflow assembly devices meet CCCP standards and are installed by the water user connection were required and at the user's expense. It is the water user's responsibility to comply with the City's CCCP requirements.

C. General Requirements:

1. Unprotected cross-connections with the public water supply are prohibited.

2. Where backflow protection is deemed necessary on any water supply line entering a water user's premises, all such lines connected to the City's water mains must have an approved backflow prevention assembly (BPA) installed. The specific type of BPA required shall be in accordance with the CCCP.

3. Cross-connections of any type that may permit backflow from any source or system other than the City's potable water system are prohibited. No connection that poses a potential or actual backflow hazard shall be permitted unless backflow protection measures are in full compliance with the CCCP.

4. Additional provisions and procedures governing cross-connection control and backflow prevention are set forth in the CCCP. The Cross-Connection Control Program Coordinator or his/her designee may update the CCCP from time to time as necessary to ensure continued protection of the City's potable water supply.

5. All customer systems and premises shall be readily accessible for inspection at all reasonable times to authorized City representatives to enable the City to ascertain the existence of cross-connections or other structural or sanitary hazards, including violations of the cross-connections rules and regulations in these regulations and the CCCP. The City shall seek customer consent before conducting inspections. If the customer denies the City access for inspection, the City shall obtain a warrant. City representatives may enter customer premises without consent or a warrant to take corrective actions or to address cross-connection hazards that pose an immediate risk to the City's public health via the system's water distribution system.

Any newly installed, relocated, or repairs of a BPA must be tested and certified prior to the continuation of water service. Testers observing a backflow incident or unprotected cross-connection must notify the City within one business day. The City may immediately discontinue water service pending investigation and remediation.

At a minimum, all BPAs must be tested annually, as directed by the CCCP, or at a higher frequency, as determined by the City through the CCCP rules and regulations.

The City shall review all applications for new water service to determine whether backflow protection is required. Upon request, applicants must submit plans and specifications for review of potential cross-connection hazards. If backflow prevention is deemed necessary, installation of an approved backflow prevention assembly shall be a condition precedent to the provision of water service. Refer to the CCP for detailed

9. The serial numbers for BPAs must always be clear and legible. Covering or rendering the serial number unreadable is not permitted and may result in enforcing replacement of said BPA.

D. Enforcement:

Enforcement Provisions:

Upon the occurrence of any condition set forth in sub-section D-3, the City may issue a Non-Compliance notice to the user. All BPAs must be installed, replaced, or repaired within 30 days of notification of the failure by the City. The City may allow extensions of up to 90 days upon the customer's request and based on the severity of the problem.
b. If non-compliance continues beyond the specified timeframe, a $250 citation may be issued and applied to the user's account. If unresolved after 30 days, a second $500 citation may be applied. After another 30 days, a third $1,000 citation may be issued. Continued non-compliance may result in recurring $1,000 citations every 30 days until resolved.

C. If the City determines that a BPA is severely damaged, malfunctioning, allowing backflow, or otherwise presents a threat to the public water system, the City may immediately discontinue water service without prior notice. Service will remain suspended until the user resolves the issue to the City's satisfaction. Restoration of service is at the City's discretion and will only occur after the BPA has been repaired or replaced and successfully passes a certified backflow test. d. I. BACKGROUND
A. OBJECTIVE
The primary objective of the Cross-Connection Control Plan (CCCP) is to bring the City of Corcoran into compliance with the Cross-Connection Control Policy Handbook (CCCH) developed by the State Water Resources Control Board. The plan is intended to protect public health within the Corcoran community by establishing standards that ensure the City's drinking water distribution system is safeguarded against the backflow of liquids, gases, or other substances into the water main.

B. WHAT IS A CROSS-CONNECTION?
3 A cross-connection is any actual or potential connection between a potable water supply and a non-potable source through which contamination could occur. It includes any structural arrangement that links a public water system to a source containing liquids, gases, or other substances not derived from an approved water supply. Bypass arrangements, jumper connections, removable sections, improperly installed devices, and other temporary or permanent configurations through which backflow may occur are considered cross-connections.

Backflow is the undesirable reversal of flow of water or other substances into a public water system's distribution system or water supply. The existence of a cross-connection creates a point in the distribution system where contaminants or pollutants may enter through backflow.

Backflow occurs when pressure in a non-potable source exceeds the pressure in the potable water distribution system. This condition may result from backsiphonage or backpressure.

Backsiphonage occurs when negative pressure in the distribution system draws non-potable substances into the drinking water supply. Backpressure occurs when pressure from a non- potable source exceeds the pressure within the potable water distribution system.

Backsiphonage may result from circumstances such as water main breaks, system flushing, pump failures, or high emergency firefighting demand. Backpressure may occur when heating, cooling, waste disposal, or industrial processes connected to potable supplies generate pressures greater than those in the distribution system. In either case, the normal direction of water flow, from the distribution system to the customer, is reversed, allowing non-potable substances from industrial, commercial, or residential premises to enter the distribution system through a cross-connection.

Cross-connections are not limited to industrial or commercial facilities. Submerged inlets may exist in common plumbing fixtures and, in some cases, are necessary for proper operation. Older bathtubs and sinks may have supply inlets below flood-level rims, although modern sanitary design has largely minimized or eliminated this risk in newer fixtures. Submerged inlets can be created in numerous ways and may be difficult to detect.

C. PURPOSE OF A CROSS-CONNECTION CONTROL PLAN
4 The purpose of the CCCP is to prevent backflow into a public water system's distribution system and protect customers from contamination or pollution caused by potential hazards. The CCCP provides foundational educational information on backflow prevention to increase awareness within the City of Corcoran regarding the importance of backflow protection and cross- connection control, supporting the implementation of a comprehensive and effective cross- connection control program. The CCCP also establishes procedures and documentation to:

1. Describe how the City of Corcoran water system will achieve and maintain compliance with the Cross-Connection Control Policy Handbook, as defined in California's Health and Safety Code (CHSC, section 116275 (h)).

2. Describe the process, personnel, and timeframes for completing initial and ongoing hazard assessments, as well as the steps required to ensure that the distribution system is protected from backflow from identified hazards

3. Describe the legal authority to implement corrective actions in the event a water user fails to comply in a timely manner with the City of Corcoran Cross-Connection Control Plan

4. Describe the process and timeframe for ensuring each backflow prevention assembly is inspected and field tested, and air gaps are inspected, at a frequency no less required than the City of Corcoran Cross-Connection Control Plan

5. Describe the process and timeframe for ensuring each non-testable backflow preventer that is under City of Corcoran administration is installed and maintained according to the California Plumbing Code

6. Describe the process used to ensure that individuals performing field testing and inspection of backflow prevention assemblies are properly qualified, including verification of the individual's:
a. Certification as a backflow prevention assembly tester b. Field test kit or gage equipment accuracy verification, and c. Backflow prevention assembly test result reports

7. Describe the procedures and timeframes of activities for responding to backflow incidents, including notification of customers, and reporting backflow incidents

8. Contain contact information for cross-connection control personnel including any cross- connection control program coordinator and specialist

9. Describe the tracking system that maintains current and relevant information, including:
5 a. Recordkeeping information
b. Location and type of backflow prevention assembly
c. The highest potential hazard from which a given backflow prevention assembly is protecting the public water system distribution system

10. Detail the corrective actions and timeframes of each that the City of Corcoran water system will implement when:
a. A cross-connection exists and the backflow prevention assembly installed is not appropriate
b. A backflow prevention assembly needs to be replaced or maintained

11. Describe the public outreach and education program needed to comply with the Cross- Connection Control Policy Handbook section 3.1.3(a)(9)

12. Contain the procedures for coordinating with local entities.

II. INTRODUCTION
A. HISTORY OF CROSS-CONNECTION CONTROL POLICY HANDBOOK
On October 6, 2017, Assembly Bill 1671 (AB 1671) was approved and filed with the Secretary of State (see Appendix A). AB 1671 amended California's SDWA through the establishment of CHSC sections 116407 and 116555.5. AB 1671 also amended section 116810 of the CHSC.

On October 2, 2019, Assembly Bill 1180 (AB 1180) was approved and filed with the Secretary of State. AB 1180 amended Section 116407 of the CHSC and added section 13521.2 to the Water Code. AB 1180 requires that the CCCPH include provisions for the use of a swivel or changeover device (swivel-ell).

AB 1671 and 1180 established the following:
• The State Water Board must adopt standards for backflow protection and cross- connection control by January 1, 2020.
6 • The State Water Board may establish standards for backflow protection and cross- connection control through the adoption of the CCCPH, with the CCCPH not being subject to the requirements of the CA Administrative Procedure Act.

If standards for backflow protection and cross-connection control are established via the CCCH, the State Water Board must:
• Consult with state and local agencies and persons, identified by the State Water Board, as having expertise on backflow protection and cross-connection control. • Hold at least two public hearings before adoption of the CCCPH. • Post the CCCPH on the State Water Board website.
• Upon the effective date of the CCCPH, the previous cross-connection control standards become inoperative, and are repealed 90 days later, unless the State Water Board determines not to repeal a specific existing regulation. • A PWS must implement a cross-connection control program that complies with the standards adopted by the State Water Board.
• Use of a swivel-ell must be consistent with any notification and backflow protection provisions contained in the CCCPH.

The development of the CCCPH included consultation with stakeholders, including state and local agencies, on an array of subjects related to cross-connection control, consistent with the statutory mandate, as well as consideration of input from other stakeholders and the public in a February 20, 2020, workshop.

Prior to adoption of the CCCPH, in accordance with the statutory mandate, the State Water Board held two public hearings - one on April 27, 2021, and the other on December 5, 2022. A Board Workshop was held on October 18, 2023.

Pursuant to sections 116407 and 116555.5 of the CHSC, the State Water Board chose to adopt standards for backflow protection and cross-connection control through the adoption of this CCCPH, which became effective July 1, 2024.
7 Aside from the mandates of AB 1671 related to the State Water Board's need and authority to develop and adopt an enforceable CCCPH, there are long-standing statutory mandates in California's SDWA concerning backflow protection and cross-connection control, some of which are summarized below.
• The State Water Board is required to adopt regulations for the control of cross- connections that it determines to be necessary for ensuring PWSs "distribute a reliable and adequate supply of pure, wholesome, potable, and healthy water." (CHSC section 116375, subd. (c).)
• Any person who owns a PWS is required to ensure that the distribution system will not be subject to backflow under normal operating conditions. (CHSC section 116555, subd. (a)(2).)
Prior to AB 1671 and the adoption of this CCCPH, California's regulations pertaining to cross- connection control were set forth in regulations in CCR Title 17.4, which were adopted in 1987 with minor revisions in 2000. Although still protective to public health, the CCR Title 17 cross- connection regulations required updating as both the drinking water and cross-connection control industries had evolved. This CCCPH updates those regulations, which as previously noted are no longer operative following the adoption of the CCCPH.

The State Water Board may update its standards for backflow protection and cross-connection control through revisions of the CCCPH. Prior to adopting substantive revisions to the CCCPH, the State Water Board will consult with state and local agencies and people identified as having expertise on the subject by the State Water Board, and the State Water Board will hold at least one public hearing to consider public comments.

D. OPERATING RULES OR ORDINANCES
In accordance with the State CCCPH, Section 3.1.3 (a)(1), Section 3.1.4(b)(1) and Section 3.1.4 (b)(3), the City of Corcoran must have operating rules, ordinance(s), by-laws, or a resolution to implement the cross-connection control program. The City must have legal authority to implement corrective actions in the event a water user fails to comply in a timely manner with the City's given provisions regarding the installation, inspection, field testing, and/or maintenance of BPAs as required by the CCCPH. Such corrective actions must include the City's ability to perform at least one of the following:
• Deny or discontinue water service to a water user;
• Install, inspect, field test, and/or maintain a BPA at a water user's premises, or • Otherwise address in a timely manner a failure to comply with the City's Cross- Connection Control Plan.

The City's backflow and cross-connection control requirements are established through its Cross-Connection Control Program (Ordinance #:), which incorporates the City's CCCP. 15 Ill. HAZARD ASSESSMENTS AND REQUIRED PROTECTION
In accordance with the State CCCPH, Section 3.1.3 (a)(3) - Hazard Assessments, Section 3.1.4 (b)(2), and Section 3.2.1, the City of Corcoran must survey its service area and conduct hazard assessments per Article 2 of the State CCCPH that identifies actual or potential cross-connection hazards, degree of hazard, and any backflow protection needed.

A. HAZARD ASSESSMENTS
1) To evaluate the potential for backflow into the City of Corcoran's water distribution system, the City must conduct an initial hazard assessment of the user premises within its service area. The hazard assessment must consider:
a. The existence of cross-connections.
b. the type and use of materials handled and present, or likely to be, on the user premises.
c. the degree of piping system complexity and accessibility. d. access to auxiliary water supplies, pumping systems, or pressure systems. e. distribution system conditions that increase the likelihood of a backflow event (e.g., hydraulic gradient differences impacted by main breaks and high-demand situations, multiple service connections that may result in flow-through conditions, etc.). f. user premises accessibility.
g. any previous backflow incidents on the user premises; and h. the requirements and information provided in the CCCPH and the City's CCCP. 2) Each hazard assessment must identify the degree of hazard to the City of Corcoran's distribution system as either a high hazard cross-connection, a low hazard cross-connection, or having no hazard.
3) The hazard assessment must determine whether an existing BPA, if any, provides adequate protection based on the degree of hazard.
4) Hazard assessments completed prior to the adoption of the CCCPH may be considered as an initial hazard assessment provided that such hazard assessments and associated backflow 16 protection provide protection consistent with the CCCPH and the City describes their review of these assessments in the Cross-Connection Control Plan required in CCCPH section 3.1.4. 5) Subsequent to the initial hazard assessment described in subsection (a), the City must perform a hazard assessment under the following criteria:
a. if a user premises changes account holder, excluding single-family residences. b. if a user premises is new or re-connected to the City of Corcoran's water distribution system.
c. if evidence exists of changes in the activities or materials on a user's premises. d. if backflow from a user's premises occurs.
e. periodically, as identified in the City's Cross-Connection Control Plan required pursuant to CCCPH section 3.1.4.
f. if the State Water Board requests a hazard assessment of a user's premises; and g. if the City concludes an existing hazard assessment may no longer accurately represent the degree of hazard.
6) A cross-connection control specialist must review or conduct each initial and follow-up hazard assessment pursuant to this section and make a written finding that, in the specialist's judgment based on cross-connection control principles, the City's hazard assessment properly identified all hazards at the time of the assessment, the appropriate degree of hazards, and the corresponding backflow protection.

B. HAZARD ASSESSMENT SYSTEM
The City of Corcoran has created a structured system to comply with Article 2 of the CCCPH regarding hazard assessments. To assess each connection of the City's water distribution system for potential of cross connection, the City will undertake hazard assessments in three phases.

Each phase will be gathered and stored using the City of Corcoran's organizational Geographic Information System (GIS) as well as the City's backflow tracking system, Backflow Solutions, Inc. (BSI). The phases are:
• Phase 1 - All services with existing BPAs immediately downstream of the meter connection.
17 • Phase 2 - All non-residential connections without BPAs at the meter connection • Phase 3 - All residential connections without BPAs at the meter connection

1. PHASE 1 - ALL SERVICES WITH EXISTING BPAS
For all service connections with existing backflow protection assemblies, the City of Corcoran will enter each connection into its GIS and BSI systems, documenting the assembly type, manufacturer, serial number, location, and associated hazard classification. Each connection will have a dedicated data record and report to support accurate tracking and hazard assessment. The City's CCCS will review the records and reports to confirm that the appropriate type of BPA is installed at each meter connection.

The City currently maintains 301 existing backflow assemblies and has completed an initial review of all applicable service connections, including collection of the required data.

2. PHASE 2 - ALL NON-RESIDENTIAL SERVICES WITHOUT BPAS
For Phase 2 of the hazard assessment survey, the City of Corcoran will conduct a field inventory of all known non-residential service connections and document the location of each BPA along with any identified cross-connection hazards. If an unprotected non-residential connection is identified, the City will issue a self-reporting letter—by email and/or direct mail-to the owner of record requesting information about onsite conditions that may require installation of an approved BPA at the meter connection. The completed letter must be returned within 30 days of issuance.
• If the City's CCCS determines the self-reporting letter is acceptable and reliable, the process will proceed. If the letter is incomplete, not returned, or its validity is in question, an on-site inspection will be scheduled between the CCCS and the property owner within 90 days of notice.
• If the CCCS determines, based on the self-reporting letter, that an approved BPA is not required, the determination and supporting justification will be documented in GIS and BSI by the City of Corcoran. The non-residential customer will be notified of the decision.
18 • If the CCCS determines, based on cross-connection control principles, that an approved BPA is required, the requirement and justification will be documented in GIS and BSI.

The CCCS will notify the non-residential customer that an approved BPA must be installed at the meter connection within a specified timeframe or the account may be subject to citation and/or discontinuation of service.

The City of Corcoran has completed an initial review of all non-residential service connections, including those with and without a BPA. Phase 2 of the hazard assessments is estimated to be completed within one year following completion of Phase 1.

3. PHASE 3 - ALL RESIDENTIAL SERVICES WITHOUT BPAS
For all residential connections without a BPA, the City will assess the sites by conducting office-based analyses, reviewing information on:
• The City's organizational Geographic Information System (GIS) • Websites using Google Maps, Google Earth, and/or other aerial photography software
• The City's meter route software map
• Springbrook's database.

These sites will be reviewed for private water wells, any auxiliary water supplies, sewer and/or stormwater lift stations, septic tanks, and graywater systems. • If the City's CCCS determines, based on office-based analysis, that an approved BPA is not required, the determination and supporting justification will be documented in GIS and BSI.

If the City's CCCS determines, based on office-based analysis, that an approved BPA may be required, the residential customer will be notified by mail or phone and an on-site hazard assessment will be scheduled. If the CCCS determines, based on both the office analysis and the on-site assessment, that a BPA is required, the customer will be notified that an approved BPA must be installed at the meter connection within a specified timeframe or may be subject to citation and/or discontinuation of service.
19 It is estimated that Phase 3 of the hazard assessments can be completed within one year after the completion of Phase 2.

IV. BACKFLOW PREVENTION
In accordance with the State CCCPH, Sections 3.1.3(a)(4) and 3.2.2, the State Water Resources Control Board requires that all actual and potential cross-connections be eliminated where feasible or controlled through the installation of approved BPAs or AGs in compliance with Article 3 of the State CCCPH and the following sections..

A. BACKFLOW PREVENTION REQUIREMENTS

1. The City must ensure its distribution system is protected from backflow associated with identified hazards through the proper installation, continued operation, and field testing of approved BPAs. When a DC is required or referenced in the CCCPH, a DDA or DCDA-I assembly may be substituted, where appropriate. When an RP is required or referenced in the CCCPH, an RPDA or RPDA-Il assembly may be substituted, where appropriate.

2. The BPA installed must provide a level of protection commensurate with the degree of hazard present at the user premises, as specified in this chapter and determined by the results of the hazard assessment conducted pursuant to CCCPH Section 3.2.1.

3. Unless specified otherwise in this Chapter, the City must, at all times, protect its distribution system from high hazard cross-connections through premises containment, through the use of AGs or RPs.
a. Following State Water Board review and approval, the City may implement an alternate method of premises containment in lieu of a required AG provided that the proposed alternative would not increase the level of risk to protection of public health.
b. Following State Water Board review and approval, the City may accept internal protection in lieu of containment when premises containment is not feasible. 20 4. Except as otherwise allowed or prohibited in statute or in CCR Title 22, Division 4, Chapter 3, a swivel-ell may be used instead of an AG for premises containment protection when temporarily substituting tertiary recycled water use areas with potable water from a PWS if all the following criteria are met:
a. the swivel-ell is approved by the State Water Board. b. the City has a cross-connection control program, required pursuant to CCCPH section

3.1.3, and the use and operation of the swivel-ell is described in the Cross-Connection Control Plan required pursuant to CCCPH section 3.1.4.
c. the design and construction-related requirements of the swivel-ell adheres to the criteria in CCCPH Appendix C.
d. at least every 12 months, inspections are performed and documented to confirm ongoing compliance with the design and construction-related requirements in CCCPH Appendix C.
e. the RP used in conjunction with the swivel-ell is field tested and found to be functioning properly.
f. immediately upon each switchover to potable water use, a visual inspection of the RP must be completed within 72 hours of each switchover to potable water use, a field test must be completed, and at least every 12 weeks the use site is supplied with potable water; and
g. there is a legally binding agreement between the City and the entity supplying the recycled water, signed by those with relevant legal authority, that includes the following requirements:
i. The State Water Board will be notified within 24 hours of all switchovers to or from potable water, will be given an estimate of the timeframe until the next switchover, and will be provided with the results of the field testing required in paragraph (5) of the CCCPH.
ii. a trained representative of the City be present to supervise each switchover; and
iii. within seven days of each switchover, if requested by the State Water Board, the City will submit a written report describing compliance with this subsection, as well as potable and recycled water usage information. 21 5. Except as noted below, the City must ensure its distribution system is protected with no less than DC protection for a user premises with a fire protection system within ten years of adoption of the CCCPH.
a. A high hazard cross-connection fire protection system, including but not limited to fire protection systems that may utilize chemical addition (e.g., wetting agents, foam, anti-freeze, corrosion inhibitor, etc.) or an auxiliary water supply, must have no less than RP protection.
b. For existing fire protection systems that do not meet Section 3.2.2 (e)(3) or cannot install DC protection within ten years of adoption of the CCCPH, the City may propose in the cross-connection control plan submitted for CCCPH Section 3.1.4:
i. an alternative date; or
ii. an alternative method of backflow protection that provides at least the same level of protection to public health.
c. A BPA is not necessary for a low hazard fire protection system on a residential user premises if the following criteria are satisfied:
i. the user premises has only one service connection to the City; ii. a single service line onto the user premises exists that subsequently splits on the property for domestic flow and fire protection system flow, such that the fire protection system may be isolated from the rest of the user premises. iii. a single, water industry standard, water meter is provided to measure combined domestic flow and fire protection system flow. iv. the fire protection system is constructed of piping materials certified as meeting NSF/ANSI Standard 61; and
v. the fire protection system's piping is looped within the structure and is connected to one or more routinely used fixtures (such as a water closet) to prevent stagnant water.

6. The State Water Board and the City of Corcoran may, at their discretion, require a water user to designate a user supervisor when the user premises has a multi-piping system that conveys various types of fluids and where changes in the piping system are frequently made. If a user supervisor is designated the following is required:
22 a. The user supervisor is responsible for the avoidance of cross-connections during the installation, operation and maintenance of the water user's pipelines and equipment.

The user supervisor must be trained on the fluids used and backflow protection for the premise, and must inform the City of changes in piping, and maintain current contact information on file with the City; and
b. B. RESPONSE
The City's CCCP was developed in consultation with their Cross-Connection Control Specialist because the City's water system has more than 1,000 service connections.

The City's designated CCCS, or their designee, can be notified within one hour, per the State CCCPH, for a public water system with 3,000 or more service connections.

VIII. USER SUPERVISORS
In accordance with the State CCCPH, Section 3.2.2 (3)(f), the State Water Board and the City may, at their discretion, require a water user to designate a user supervisor when the user premises has a multi-piping system that conveys various types of fluids and where changes in the piping system are frequently made. If a user supervisor is designated the following is required:

1. The user supervisor is responsible for the avoidance of cross-connections during the installation, operation, and maintenance of the water user's pipelines and equipment. The user supervisor must be trained on the fluids used and backflow protection for the premise and must inform the City of changes in piping and maintain current contact information on file with the City.

2. The CCCP must include the training and qualification requirements for user supervisors if required by the State Water Board or City, identify the entity that will provide the user 31 supervisor training, and frequency of any necessary recurring training. The training must adequately address the hazards and concerns typically found Since the City does not provide service to any unique user premises as defined in the State CCCPH, Section 3.2.2 (3)(f), there are no user supervisors identified or designated within the City.

IX. BACKFLOW PREVENTION ASSEMBLY TESTING AND

REPORTING
In accordance with the State CCCPH, Section 3.1.3(a)(6), the City of Corcoran must ensure that each BPA required by the CCCP to protect the City's domestic water distribution system is field tested. The City will develop and implement procedures to ensure all BPAs and AGs are field tested, inspected, and maintained in accordance with Section 3.3.3 of the State CCCPH.

All BPAs installed within the City must comply with the CCCP and must be field tested following installation, repair, depressurization for wintering, or permanent relocation. All required field testing must be performed by a certified backflow prevention assembly tester.

1. BPAs must be field tested at least annually. The State CCCPH does not preclude the City, the State Wate Board, or a local health agency from requiring more frequent field testing for premises with high hazard cross-connection or BPA at increased risk of testing failure.

2. Air gap separations must be visually inspected at least annually by the City's staff.

3. The City must receive passing field tests before providing continuous service to a water user with a newly installed BPA.

4. BPAs that fail the field test must be repaired or replaced. Refer to Section IX.B for additional information.

Backflow prevention assembly testers must notify the City within one day if a backflow incident or an unprotected cross-connection is observed at a BPA or upstream of the user premises during field testing. The City will investigate the report and may discontinue service if a backflow incident is confirmed. Water service will not be restored until the City receives documentation of 32 a passing BPA field test from a certified tester and verifies that the assembly is properly protecting the distribution system.

A. BACKFLOW TESTING NOTIFICATION PROCESS
For each BPA in the City's water distribution system, an annual notice will be emailed and/or mailed to the owner, informing them that the BPA must be tested in accordance with the CCCP.

This letter may be mailed by the City or their backflow tracking system, BSI.

Upon receipt, the owner will have approximately 90 days until their annual test due date. The actual due date, which is based on either the last successful test date or the new BPA installation date, will be listed on the notice. The owner must have the BPA tested by a certified backflow assembly tester and the test results must be submitted to the City via the City's backflow tracking system, BSI.

The City uses web-based backflow management software, BSI Online Inc., to track devices, record test results, generate letters and notices, and track history of the BPAs in their service area. Certified backflow testers are required to create an account and enter test data directly into BSI Online, Inc.

Each water user with a BPA installed on their service connection must comply with the following schedule to remain in compliance with the CCCP and to continue receiving water service from the City.
• First Notice (Backflow Due Notice / 90 Day Notice) - This is the first notice received by the BPA-owner for BPA testing. It is generated on June 1" of every calendar year for all existing BPAs and sent out immediately. Notices are sent via mail or email. This initial letter gives the BPA-owner 90 days to submit a passing BPA test. If a backflow is newly installed earlier in the calendar year, it will not receive a letter until the following calendar year.
• Non-Compliance - If a test becomes over 30 days past due, the City may issue one or multiple citations in accordance with the City's Ordinance. • Termination of Water Service - The City may elect to terminate water service in accordance with the City's Ordinance.
33 B. DAMAGED, LEAKING, MISSING, FAILED, OR IMPROPERLY INSTALLED

BACKFLOW PREVENTION ASSEMBLIES
If a backflow prevention assembly is missing, leaking, installed incorrectly, illegally modified, or tampered with, the City may implement the following actions:
• Contact property owner which includes BPA and notify them of the issue. Violations shall be resolved in accordance with the City's Ordinance. These violations are given 30 days to be resolved.
• Non-Compliance - If a BPA-owner fails to resolve the violation within 30 days, the City may issue one or multiple citations in accordance with the City's Ordinance. • Termination of Water Service - The City may elect to terminate water service in accordance with the City's Ordinance.

X. PUBLIC OUTREACH AND EDUCATION
In accordance with the State CCCPH, Section 3.1.3 (a)(9) and Section 3.1.4 (b)(12), the City must implement a cross-connection control public outreach and education program element that includes educating staff, customers, and the community about backflow protection and cross- connection control.

To achieve this, the City has included information on backflow and cross-connections on the City's website, www.cityofcorcoran.ca.gov. The City intends to distribute information on its social media platforms, as well as periodic water bill inserts, information pamphlet distribution, new customer documentation, emails, customer portal options, and additions to the City's annual Consumer Confidence Reports.

XI. LOCAL ENTITY COORDINATION
34 In accordance with the State CCCPH, Section 3.1.3 (a)(10) and Section 3.1.4 (b)(13), the City must coordinate with applicable local entities that are involved in either cross-connection control or public health protection to ensure hazard assessments can be performed, appropriate backflow protection is provided, and provide assistance in the investigation of backflow incidents. Local entities may include but are not limited to plumbing, permitting, or health officials, law enforcement, fire departments, maintenance, and public and private entities.

COMMUNITY DEVELOPMENT DEPARTMENT

STAFF REPORT
March 24, 2025
ITEM #6-D
FROM: Kevin J. Tromborg, Community Development Director SUBJECT: Direction regarding the sale or vacation and permanent transfer of a 10 Ft.

Easement owned by the City of Corcoran west of 1010 San Joaquín Avenue APN: 032-301-014-000.

Discussion:

The easement was installed to serve as a walkway between Bainum Avenue and San Joaquin Avenue in Tract 346 (South Park Manor) The walkway was either never finished or utilized. The adjacent parcels have used the easement over time for their personal use. One of the property owners would like to make an addition to his home. The addition would encroach into the 5 Ft. setback that is required by code. The sale or vacation and permanent transfer of the 10 Ft. would allow him the space required for his project. The four property owners of the parcels adjacent the walkway have come to an agreement that the owner of 1010 San Joaquin Avenue would pay for any cost associated with the sale or transfer of the easement and the relocation of fencing if required.

Attachment:

ITEM # 6-E
FROM: Greg Gatzka, City Manager
SUBJECT: Council Direction on Cesar Chavez Park
Summary:

Recent allegations and nationwide controversy regarding United Farm Workers (UFW) labor organizer Cesar Chavez have resulted in agencies and organizations across the United States to reconsider facilities and monuments named after this individual.

Recommendation:

Provide direction to staff on the naming and branding of the City's owned park located adjacent to Mark Twain Elementary School located at 1500 Oregon Avenue.

Budget impact:

None with this action.

Background:

UFW and other affiliated farm worker related groups have acknowledged receiving disturbing allegations involving Cesar Chavez and have taken action to remove mention and/or distance themselves with association to this individual. Nationwide news reports have led to many agencies and organizations taking action to either cover up public branding and naming of facilities and monuments. The Corcoran Mayor has coordinated with the City Manager to temporarily cover up the name and association of the City's owned park branded as Cesar Chavez Park, and place this agenda item on the Council agenda to receive further direction from the Corcoran City Council any further actions.

ITEM # 6-F
FROM: Greg Gatzka, City Manager
SUBJECT: Letter of Support - SB 1289 Hazardous Waste Disposal Standards Summary:

Senator Melissa Hurtado has introduced Senate Bill 1289 and Kings County is co-sponsoring this State legislation to address hazardous waste disposal in California. Kings County is requesting a letter of support from the City of Corcoran..

Recommendation:

Consider authorizing the Mayor to sign a letter of support for SB 1289.

Budget impact:

None with this action.

Background:

California currently has only two permitted hazardous waste disposal facilities, one of which is the Kettleman Hills Facility located in Kings County. The other facility is in Buttonwillow in Kern County. Despite the presence of these facilities and the strong environmental standards they operate under, the growing trend is for hazardous waste generated in California being shipped to out-of-state facilities that operate under weaker regulatory oversight and environmental protections.

Senator Melissa Hurtado has introduced Senate Bill 1289, which is being co-sponsored by Kings County, seeks to address this issue by requiring hazardous waste to be disposed of at a RCRA- compliant landfill. This will ensure that hazardous waste generated in California is managed at facilities that meet both federal and state environmental standards.

Kings County is requesting a letter of support from the City of Corcoran.

RE: Support for Senate Bill 1289 (Hazardous Waste Disposal Standards) Dear Senate Environmental Quality Committee:

On behalf of the City of Corcoran, we express our support for Senate Bill 1289 (SB 1289), legislation introduced to strengthen hazardous waste disposal standards in California.

California currently has only two permitted hazardous waste disposal facilities operating under rigorous state and federal environmental standards, Kettleman Hills Facility and Buttonwillow Facility. Despite the availability of these facilities, hazardous waste generated within California is increasingly being transported out-of-state, contributing to greater GHG and VMT, and delivered to facilities that may operate under weaker environmental oversight and regulatory protections.

SB 1289 aims to address this concern by requiring hazardous waste destined for land disposal to be disposed of at Resource Conservation and Recovery Act (RCRA) compliant landfills, ensuring waste generated in California is handled at facilities meeting strong environmental and safety standards.

This issue is particularly important for our region as the Kettleman Hills Facility in Kings County plays an essential role in California's hazardous waste management infrastructure while supporting local jobs, economic activity, and community investment in the surrounding area.

We appreciate the leadership of Kings County and Waste Management, who are co-sponsoring this legislation, and commend your efforts to address this important issue.

The City of Corcoran respectfully supports SB 1289 and encourages its passage.

Sincerely,
Sidonio "Sid" Palmerin, Mayor
