PUBLIC WORKS DEPARTMENT -

CONSENT CALENDAR
April 14, 2026
ITEM # 2-C
FROM: Joseph Faulkner, Public Works Director
SUBJECT: Adoption of Ordinance No. 650 and Cross-Creek Control Plan Summary:

Recent State Law changes have mandated the City's Cross-Connection Control Plan and associated regulations to be updated to comply with new State Water Board standards and the State's Cross- Connection Control Policy Handbook.

Recommendation:

Consider approval of Ordinance No. 650 updating the City's Cross-Connection Control regulations within the Corcoran Municipal Code, and City's updated Cross-Connection Control Plan.

Budget impact:

None with this action.

Background:

Agencies with a public water system are required to ensure that their water distribution system will not be subject to backflow under normal operating conditions. The State Water Board recently adopt updated standards for backflow protection and cross-connection control requirements through the adoption of the Cross-Connection Control Policy Handbook (CCCPH), which became effective July 1, 2024. The CCCPH and its standards apply to all California water systems, and failure to comply may result in the issuance of compliance, enforcement, or other corrective actions.

The City of Corcoran has operated a cross-connection control program based on the requirements of Title 17 of the California Code of Regulations. However, the State Water Board now requires that the City adopt a Cross-Connection Control Plan (CCCP) that meets the requirements in CCCPH, ensure ongoing compliance through site inspections, testing of backflow prevention assemblies, and have enforceable regulations. The purpose of this Ordinance is to update the City's Cross-Connection Control Program to meet these updated state regulations, and guidelines in the State Water Resources Control Board's Cross-Connection Control Policy Handbook.

The Public Works Department has developed a Cross-Connection Control Plan and coordinated with the City Manager and City Attorney to draft Ordinance No. 650 that will establish the necessary regulations as part of the City's Municipal Code. This ordinance will also define the legal authority to Corcoran Public Works Department

ORDINANCE NO. 650
AN ORDINANCE OF THE CITY OF CORCORAN AMENDING ARTICLE 8, CHAPTER 1, SECTION 24 UPDATING THE CITY'S CROSS-CONNECTION CONTROL

PROGRAM TO PROTECT THE PUBLIC WATER SYSTEM
The City Council of the City of Corcoran does ordain as follows:

Section 1. PURPOSE. The purpose of this Ordinance is to update the City's Cross- Connection Control Program regulations to ensure compliance with applicable and updated state regulations, as well as guidelines in the State Water Resources Control Board's Cross-Connection Control Policy Handbook. These state mandated requirements are intended to protect the City's municipal water system from risk of backflow and potential contamination from service connections. The City is required to adopt and implement a Cross-Connection Control Plan (CCCP) as part of the program, and this ordinance integrates by reference the City's plan and its enforcement.

Section 2. CODE REPEAL. Section 8-1-24 of Chapter 1 of Title 8 of the Corcoran Municipal Code is hereby repealed.

Section 3. CODE ADOPTED. Section 8-1-24 is hereby added into Chapter 1 of Title 8 of the Corcoran Municipal Code to read in its entirety as follows:
8-1-24: CROSS-CONNECTION CONTROL PROGRAM:

A. Purpose: This section enacts regulations to implement and enforce the City's Cross- Connection Control Program pursuant to California's Health and Safety Code (CHSC, section 116275 (h)) and the State Water Resources Control Board's Cross-Connection Control Policy Handbook (CCCH) that became effective July 1, 2024. These regulations are mandatory for all California public water systems and serve to protect the City's public water system's drinking water distribution system from risk of backflow and contamination. The City's Cross-Connection Control Plan (CCCP), as may be updated and/or amended by the City Council from time to time, is hereby incorporated herein by this reference, and contains minimum standards and necessary requirements, which must be satisfied, when a parcel is actively connected to the City's public drinking water distribution system, in compliance with all applicable and updated federal and State regulations. Together, this section and the CCCP form the City's Cross-Connection Control Program. Failure to comply with the CCCP is subject enforcement by the City administratively and/or through the courts, and may result in disconnection from the City's public drinking water distribution system and loss of water system capacity rights.

B. Responsibility: The City's Cross-Connection Control Program is required to be implemented and enforced by a qualified and City designated Cross-Connection Control Coordinator as defined by the CCCP. The City's coordinator ensures that appropriate backflow assembly devices meet CCCP standards and are installed by the water user connection were required and at the user's expense. It is the water user's responsibility to comply with the City's CCCP requirements.

C. General Requirements:

1. Unprotected cross-connections with the public water supply are prohibited.

Where backflow protection is deemed necessary on any water supply line entering a water user's premises, all such lines connected to the City's water mains must have an approved backflow prevention assembly (BPA) installed. The specific type of BPA required shall be in accordance with the CCCP.

3. Cross-connections of any type that may permit backflow from any source or system other than the City's potable water system are prohibited. No connection that poses a potential or actual backflow hazard shall be permitted unless backflow protection measures are in full compliance with the CCCP.

4. Additional provisions and procedures governing cross-connection control and backflow prevention are set forth in the CCCP. The Cross-Connection Control Program Coordinator or his/her designee may update the CCCP from time to time as necessary to ensure continued protection of the City's potable water supply.

5. All customer systems and premises shall be readily accessible for inspection at all reasonable times to authorized City representatives to enable the City to ascertain the existence of cross-connections or other structural or sanitary hazards, including violations of the cross-connections rules and regulations in these regulations and the CCCP. The City shall seek customer consent before conducting inspections. If the customer denies the City access for inspection, the City shall obtain a warrant. City representatives may enter customer premises without consent or a warrant to take corrective actions or to address cross-connection hazards that pose an immediate risk to the City's public health via the system's water distribution system.

6. Any newly installed, relocated, or repairs of a BPA must be tested and certified prior to the continuation of water service. Testers observing a backflow incident or unprotected cross-connection must notify the City within one business day. The City may immediately discontinue water service pending investigation and remediation.

7. At a minimum, all BPAs must be tested annually, as directed by the CCCP, or at a higher frequency, as determined by the City through the CCCP rules and regulations.

The City shall review all applications for new water service to determine whether backflow protection is required. Upon request, applicants must submit plans and specifications for review of potential cross-connection hazards. If backflow prevention is deemed necessary, installation of an approved backflow prevention assembly shall be a condition precedent to the provision of water service. Refer to the CCCP for detailed

9. The serial numbers for BPAs must always be clear and legible. Covering or rendering the serial number unreadable is not permitted and may result in enforcing replacement of said BPA.

D. Enforcement:

General:
a. Failure to comply with any requirement under this Ordinance, including but not limited to overdue backflow testing or failure to install, repair, or replace a BPA, may result in citation(s) and/or potential suspension or termination of water service.

Enforcement Provisions:

Upon the occurrence of any condition set forth in sub-section D-3, the City may issue a Non-Compliance notice to the user. All BPAs must be installed, replaced, or repaired within 30 days of notification of the failure by the City. The City may allow extensions of up to 90 days upon the customer's request and based on the severity of the problem.
b. If non-compliance continues beyond the specified timeframe, a $250 citation may be issued and applied to the user's account. If unresolved after 30 days, a second $500 citation may be applied. After another 30 days, a third $1,000 citation may be issued. Continued non-compliance may result in recurring $1,000 citations every 30 days until resolved.

If the City determines that a BPA is severely damaged, malfunctioning, allowing backflow, or otherwise presents a threat to the public water system, the City may immediately discontinue water service without prior notice. Service will remain suspended until the user resolves the issue to the City's satisfaction. Restoration of service is at the City's discretion and will only occur after the BPA has been repaired or replaced and successfully passes a certified backflow test. d. The City reserves the right to suspend or terminate water service at its sole discretion.

If any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions. The City Council hereby declares that it would have adopted each section, subsection, paragraph, sentence, clause, and phrase of this Ordinance irrespective of the invalidity of any part thereof.

In addition to the foregoing general exemptions, the City Council further finds that the ordinance is categorically exempt from review under CEQA under the Class 8 categorical exemption [regulatory activity to assure the protection of the environment]. The City Manager is hereby directed to ensure that a Notice of Exemption is filed pursuant to CEQA Guidelines section 15062 [14 C.C.R. § 15062].

Section 6. NO LIABILITY. The provisions of this ordinance shall not in any way be construed as imposing any duty of care, liability or responsibility for damage to person or property upon the City of Corcoran, or any official, employee or agent thereof.

Section 7. PENDING ACTIONS. Nothing in this ordinance or in the codes hereby adopted shall be construed to affect any suit or proceeding pending or impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance or code repealed by this ordinance, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance.

Section 8. CONSTRUCTION. WIRE FRAUD ALERT
This Notice is not intended to provide legal or professional advice.

If you have any questions, please consult with a lawyer.

All parties to a real estate transaction are targets for wire fraud and many have lost hundreds of thousands of dollars because they simply relied on the wire instructions received via email, without further verification. If funds are to be wired in conjunction with this real estate transaction, we strongly recommend verbal verification of wire instructions through a known, trusted phone number prior to sending funds.

In addition, the following non-exclusive self-protection strategies are recommended to minimize exposure to possible wire fraud.
• NEVER RELY on emails purporting to change wire instructions. Parties to a transaction rarely change wire instructions in the course of a transaction.
• ALWAYS VERIFY wire instructions, specifically the ABA routing number and account number, by calling the party who sent the instructions to you. DO NOT use the phone number provided in the email containing the instructions, use phone numbers you have called before or can otherwise verify. Obtain the number of relevant parties to the transaction as soon as an escrow account is opened. DO NOT send an email to verify as the email address may be incorrect or the email may be intercepted by the fraudster. • USE COMPLEX EMAIL PASSWORDS that employ a combination of mixed case, numbers, and symbols.

Make your passwords greater than eight (8) characters. Also, change your password often and do NOT reuse the same password for other online accounts.
• USE MULTI-FACTOR AUTHENTICATION for email accounts. Your email provider or IT staff may have specific instructions on how to implement this feature.

CITY ADMINISTRATION

STAFF REPORT
April 14, 2026
ITEM #6-A
FROM: Valerie Bega, Transit and Grants Manager
SUBJECT: Low Carbon Transit Operations Program (LCTOP)
Summary:

For Fiscal Year 2025-2026, LCTOP has implemented Cycle A and Cycle B funding. Cycle A funding totals S37,771. Staff prepared a resolution to apply funds towards two separate projects to support community based transit.

Recommendation:

Consider adopting Resolution No. 4133 for LCTOP funded projects, and authorize the City Manager and the Transit and Grants Manager to sign LCTOP documents on behalf of the City.

Budget impact:

For Fiscal Year 2025-2026, LCTOP has implemented Cycle A and Cycle B funding available to the City. The total funds available to the City is estimated to be $37,771.

Background:

In previous years, LCTOP funding was provided once per fiscal year. However, following the passage of SB 840 this program will now distribute two allocations annually for eligible projects.

For Fiscal Year 2025-2026, the City of Corcoran has been allocated $37,771 that consists of Cycle A at $19,909 and Cycle B at $24,459.

Two projects are proposed to be funded and include introducing a new service to the community by providing transportation for special community events, improving accesibility and mobility for residents. The second project institutes free fare days during community events, further reducing transportation barriers and encouraging public transit use.

The first project, estimated to cost $20,350, will support employee salaries, overtime, and fuel costs associated with delivering this expanded service. The second project establishes free fare days during community events and will cover the cost of residents utilizing transit services to attend these events. Once Cycle B funding is awarded, staff will return with further project details and recommendation on how to supplement the new service program or expand the free fare days initiative.

STAFF REPORT
April 14, 2026
ITEM #6-B
FROM: Greg Gatzka, City Manager
SUBJECT: Set Special Meeting Dates for Housing Element Adoption.

Summary:

The Housing Element formal submission is set for the week of May 4, 2026. One of requirements is to have both the Planning Commission and City Council approve the adoption of the Housing Element.

Recommendation:

Consider setting Special Council Meeting Date for May 19, 2026, at 5:30 p.m. for the timely consideration of the Housing Element adoption to meet State deadline.

Budget impact:

None with this action.

Background:

The City of Corcoran has partnered with Kings County and two other cities in Kings County to produce a Multi-Jurisdictional Housing Element as a regional approach to streamline the State Department of Housing and Community Development (HCD) review process and benefit from cost sharing on one document. A consultant was hired to perform this work on behalf of all local agencies, unfortunately the draft document has not met the requirements of HCD and is now two years past the original State deadline. Our City along with Kings County and the two other Cities have shifted to use our own staff resources to now address the document deficiencies and work closely with HCD to complete the Housing Element by the new compliance deadline. In order to meet this new deadline and meet the 20 day notice requirement, staff is recommending that the Council hold a special meeting on May 19, 2026, so the resolution can be submitted along with the other jurisdictions on May 26, 2026. A special meeting date for the Planning Commission is also being considered for May 11, 2026, for the Housing Element approval process.
