Please be aware, Government Code section 65585, subdivision (i) grants HCD authority to review any action or failure to act by a local government that it determines is inconsistent with an adopted housing element or housing element law. This includes failure to implement program actions included in the housing element. HCD may revoke housing element compliance if the local government's actions do not comply with state law.
For your information, pursuant to Assembly Bill 1398 (Chapter 358, Statutes of 2021), as the City did not adopt a compliant housing element within 120 days of the statutory deadline (January 31, 2024), all necessary rezoning must be completed no later than one year from the statutory deadline. Program 2.22 (Prior Identified Sites in the Sites Inventory) taking effect upon adoption of the housing element (as of May 14, 2026) is crucial to meeting this requirement.
Several federal, state, and regional funding programs consider housing element compliance as an eligibility or ranking criteria. For example, the Cal19Trans Senate Bill (SB) 1 Sustainable Communities grant, the Strategic Growth Council and HCD's Affordable Housing and Sustainable Communities program, and HCD's Permanent Local Housing Allocation consider housing element compliance and/or annual reporting requirements pursuant to Government Code section 65400. With a compliant housing element, the City now meets housing element requirements for these and other funding sources.
For your information, some general plan element updates are triggered by housing element adoption. HCD reminds the City to consider timing provisions and welcomes the opportunity to provide assistance. For information, please see the Technical Advisories issued by the Governor's Office of Land Use and Climate Innovation at:
https://www.lci.ca.gov/planning/general-plan/guidelines.html.
HCD appreciates the collaboration and diligence of you and Kevin Tromberg in preparing the housing element as part of the multi-jurisdictional housing element process. HCD wishes the City success in implementing its housing element and looks forward to following its progress through the General Plan annual progress reports pursuant to Government Code section 65400. If HCD can provide assistance in implementing the housing element, please contact Colleen Harjo, of our staff, at [email protected].
Sincerely,
RaY

STAFF REPORT

ITEM # 6-D
FROM: Greg Gatzka, City Manager
SUBJECT: City Solar Energy Project Completed
Summary:
In 2022, the City entered into a construction agreement and established financing for eight energy savings site improvements. On May 12, 2026, the entire project was completed and facilities turned over to the City.
Recommendation:
Informational Item Only
Budget impact:
None with this action. However, the City's eight separate solar sites are now operational and the City will financially benefit from the guaranteed energy savings per the maintenance agreement with Opterra Energy Services (previously Engie).
Background:
The entered into a construction agreement with Engie Energy Services on March 22, 2022. The eight different sites include City Hall Parking Lot Solar and building energy efficiencies, Police Department Parking Lot Solar and electric vehicle energy charging stations, City Pool Parking Lot Solar and Variable Pump enhancement, Wastewater Treatment Plan Solar, Wastewater Ponds Solar, Water Well 2A Solar, Water Well 4A Solar, and Water Treatment Plan Solar and Battery Backup. City Hall and PD facilities were completed in late 2023. Wastewater facilities and City Pool were completed in early 2024. The last three sites related to Water service were delayed by almost two years due to PG&E, Caltrans and Highspeed Rail challenges and proximity to Waukena Avenue property boundary changes. These last three sites are now operational and the project closeout occurred on May 12, 2026. Engie was bought out and now Opterra Energy Services that fortunately maintained the same project management staff for the City's construction project throughout the entire construction process. The existing agreement with Engie is also wholly assumed by Opterra Energy Services, and on May 28, 2026 Opterra conducted their construction closeout with the City Manager and Public Works Director to turn over the facilities to the City.
All facilities will now transition to the agreement maintenance provisions with Opterra guaranteed energy savings benefits to the City.
