I. PUBLIC HEARINGS AND MEETINGS:

1. Approve Tentative Tract Map 2024-1002, Subdivide an approximately 7-acre parcel and create 28 single family residential parcels in an R-1-8 zoning designation and adopt a CEQA Section 15183 exemption
This item was moved from the regular agenda to public hearing.

Councilwoman Hargens removed herself due to conflict of interest.

Presented by Planner II, Christina Meeds. Tract Map 2024-1002 proposes to subdivide approximately 7 acres and create 28 single family residential parcels. The zoning designation for the proposed parcels is R-1-8 indicating lot sizes between 8,000 and 10,000 square feet.

Assessor's Parcel Number (APN) 071-020-018 is located on the east side of Toomes between Colusa Street and North Street, it is approximately 180 feet north of the Colusa Street and Toomes Avenue intersection and approximately 1,000 feet south of the Woodson Elementary School. The proposed map shows two entries into the subdivision: one primary access from Toomes Avenue and the second access on the north side of the subdivision connecting Lincoln Avenue to North Street.

On October 15, 2024, The Planning Commission recommend approval of tentative map 2024- 1002, in a 4-0 vote.

Opened public hearing: 5:48 pm
Bud Williams had a few questions regarding the project. His top concerns were the storm sewer drainage system, PG&E easements, and final engineering plans. City Engineer, Robin Kampmann, clarified that the correct drainage system will be installed as part of the conditions.

The easements will be up to PG&E and the developer for the underground utility lines. The homes that are sold will be made aware of the easement. She also clarified that final engineering plans will be brought back to council to review a final map.

Another Corning resident had a concern as to why Lincoln Street will not be cutting through to North Street from Colusa Street. Robin clarified that the city would need a right of way from the current owners of the homes in order to make the street wide enough to be up to code. Mayor Snow said the city does not anticipate working on that street since there will be two access points for this new subdivision. He also clarified that Toomes Ave is fully capable of handling traffic with this project.

Closed public hearing: 6:01pm
Councilor Demo moved to adopt the seven findings as presented in the staff report and approve tentative tract map 2024-1002 and subject to the 37 conditions as presented in the staff report and modify to remove gas from the current language for the underground utilities condition; Councilor Valerio seconded the motion.

Presented by Mayor, Robert Snow. Following the Fifteenth Annual Tucker Mesker Classic Memorial Softball Tournament (2024) City Staff and City Council received a letter from a member of the public suggesting consideration of a name change. City Council member Valerio sponsored the idea leading to this item coming to Council for consideration. Valerio feels that the Tucker Mesker tournament brings a lot of business to Corning with this tournament and they should have some recognition.

5. Informational presentation and provide direction on as related to cannabis retail within the city
Presented by City Attorney, Collin Bogener. In recent months, at two City Council Meetings, staff and legal counsel has presented information regarding Senate Bill (SB) 1186 which precludes cities from imposing regulations that have the effect of prohibiting medical cannabis delivery within the City. At the most recent public meeting discussion, staff received a consensus from the City Council to bring back information regarding a store front ordinance for the City of Corning.

Mayor Snow clarified this is an item that will eventually need to be adopted and allow storefronts to sell in Corning. He stated his personal opinion doesn't matter this will be a CA law since marijuana is legal to a certain extent in our state and eventually the city will have to come up with some type of ordinance. City Council can wait until we get to that point, or they can start now on developing a guideline for cannabis retail within the city.

Councilwoman Hargens said she would be open for a medical marijuana store, but not for recreational use.

Councilwoman Lomeli felt like it's necessary to allow a storefront since the City does allow for cannabis delivery and that tax revenue should be staying in Corning instead of the store delivering from out of town. Extending it 1,000 feet from schools and moving it down to the south end of town is acceptable.

Councilman Valerio said he is open as well to a medical marijuana store as long as it was placed in the area south of town by the truck stops.

John Leach asked what the tax revenue would look like for Corning. Mayor Snow didn't have an exact amount since it is hard to tell since Corning doesn't have a current establishment. He also asked for clarification on the current allowed plants to be grown within city limits.

Steve Kimbrough- He thinks the cannabis delivery should be allowed to continue, but not a brick and mortar in the town because he thinks you will create a nuisance.

Mr. Garrett wants clarification on how much revenue the city will get since it seems like the tax revenue is an incentive to allow store fronts. Councilwoman Lomeli clarified that the purpose of promoting sales tax is because that money should stay in our city instead of other cities receiving the sales tax for an item that could be purchased in Corning.

Mayor Snow directed staff to amend the current ordinance to comply with SB 1186 but otherwise stay the same; Councilor Hargens seconded the motion.

Ayes: Snow, Demo, Valerio, and Hargens

Absent: None
Abstain/Opposed: Lomeli
Result: Motion was approved by a 4-1 vote

6. Authorize filling the Police Detective Position and budget allocation Presented by City Manager, Brant Mesker. In the past years this position was not budgeted for, but once the police department was fully staffed it would be an item that would be brought to council to allocate funds for this position. Police Chief, Craig Bassett added that the Detective position has been recognized on the position allocation list but has not been funded in the Fiscal Year Budget. The Detective position has been vacant since September 2011. During the Fiscal Year 2024/25 budget it was recognized by staff and City Council that this detective position was unfunded and that should the Police Department become staffed allowing the hiring of a

THE CITY OF CORNING IS AN EQUAL OPPORTUNITY PROVIDER AND EMPLOYER Item No. : G-2
Detective that an agenda item would come before the City Council to appropriate funds to hire the Detective Position. The Police Department is now fully staffed and has the interest of hiring a Detective. During the time that Corning Police Department has been without a Detective, the City has had to rely on the Tehama County Sheriff's Department and The Tehama County District Attorney to investigate major crimes. The annual budget increase for the Detective Position is $159,197.67 per year.

Councilor Demo moved to authorize budget allocation to fund the detective position and further authorize the Corning Police Department to fill the position; Councilor Valerio seconded the motion.

Ayes: Snow, Demo, Hargens, Lomeli, and Valerio

Absent: None
Abstain/Opposed: None
Result: Motion was approved by a 5-0 vote

7. Approve budget adjustment in the net general fund in the amount of $54,462 Presented by City Manager, Brant Mesker. The City is requesting the approval of a budget adjustment that has a net general fund impact in the amount of $54,462. A recent review of accounts and expenditures revealed that street expenses, salary, and benefits are outpacing the Gas Tax Revenue Budget. Staff and CPA recommend moving the salary expenses to General Fund expenses in the amount of $54,462. It should be noted that upon approval of the budget adjustment, the $54,462 that would be recognized as a General Fund expense will be recognized as part of the City's required General Fund Maintenance of Effort (MOE) for roads which is a required City MOE.

Councilor Hargens moved to approve the budget adjustment and authorize the CPA to make the necessary budget; Councilor Valerio seconded the motion.

ADOPT RESOLUTION NO. 11-12-2024-05
APPROVING NO PARKING • ON THE

NORTH SIDE OF BLACKBURN AVE
November 12, 2024
TO: HONORABLE MAYOR AND COUNCIL
FROM: BRANT MESKER, CITY MANAGER AN

RUBI ORDAZ, CITY CLERK RO
SUMMARY:

Corning High School is currently in the process of constructing a new student parking lot to improve parking availability for students. However, it has been noted that many students are parking on the north side of Blackburn Avenue, creating a significant safety concern, particularly during busy loading and unloading times. The school district has requested the City to not allow parking on the north side of Blackburn Avenue Monday through Friday from 7:30am to 3:30pm.

SAFETY CONCERNS:

During peak times, students frequently cross Blackburn Avenue to access their parked vehicles. This behavior increases the risk of accidents involving both students and passing vehicles. Traffic congestion in this area further exacerbates the situation, making it essential to find a solution that prioritizes safety. This action aims to:

1. Enhance Safety: By eliminating parking in this area, the risk of students crossing the street will be significantly reduced, thereby improving safety for all roadway users.

2. Encourage Use of New Parking Facilities: Designating this area as no parking will promote the utilization of the new student parking lot, ensuring students have a designated and safer space to park their vehicles.

3. Reduce Traffic Congestion: A no parking zone will help alleviate congestion along Blackburn Avenue, leading to smoother traffic flow during peak times.

RECOMMENDATION:

Mayor and Council:

1. Adopt Resolution No. 11-12-2024-05 approving a no parking zone on the north side of Blackburn Avenue between Marguerite Avenue and First Street; and

2. Authorize Public Works to install appropriate signage ATTACHMENTS:

AVENUE BETWEEN MARGUERITE AVENUE AND FIRST STREET
MONDAY-FRIDAY FROM 7:30AM TO 3:30PM
WHEREAS, the Corning High School is in the process of constructing a new student parking lot to better accommodate student parking needs; and
WHEREAS, it has been observed that students are currently parking on the north side of Blackburn Avenue, which poses significant safety concerns during loading and unloading times as students frequently cross the street to access their vehicles; and WHEREAS, the safety of students and all roadway users is a priority for the City Council; and WHEREAS, designating a no parking zone on the north side of Blackburn Avenue will encourage students to utilize the new parking lot, thereby reducing traffic congestion and enhancing safety in the area
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Corning hereby authorizes the implementation of a no parking zone on the north side of Blackburn Avenue between Marguerite Avenue and First Street Monday through Friday from 7:30am to 3:30pm.

RE: Parking on Blackburn Ave
Dear Corning City Council,
As you may be aware, Corning Union High School (CUHS) is currently building a student parking lot where the JV softball field used to be. The new lot will exit onto North St. and is expected to be completed no later than November of this year.

The District is hopeful that this lot will allow for increased safety for students who drive to school and have typically parked on Blackburn Ave north of CUHS. During loading and unloading times, students cross to and from their cars creating a significant safety concern.

In order to require students to park in the new lot, the District is requesting that the City make the north side of Blackburn Ave in front of CUHS closed to parking from 7:30am-3:30pm, Monday through Friday. In order to minimize the impact this would have on city time and resources, school staff would assist in communicating the change and enforcing compliance with students. As a last resort, school staff would utilize the School Resource Police Officer to enforce the parking regulation.

If you have any questions regarding this request, please feel free to contact me at [email protected] or (530)824-8001 ext 105. I would also be happy to attend a Council meeting to discuss the issue further if that is helpful.

Thank you in advance for your consideration on this matter.

Sincerely,
migues Bang

ADOPT RESOLUTION 11-12-2024-06
ACCEPTING THE 2024/25

CALIFORNIA CITIZEN'S OPTIONS

FOR PUBLIC SAFETY GRANT
November 12, 2024
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: BRANT MESKER, CITY MANAGER fu

CRAIG BASSETT, POLICE CHIEF
SUMMARY:

The City of Corning is to be awarded $100,000 as part of the California Citizens' Option for Public Safety Front-Line Law Enforcement Allocation Program. The funds are restricted to front-line law enforcement and may not be used to supplant services already budgeted.

BACKGROUND:

State law establishes in each County Treasury a Supplemental Law Enforcement Services Fund that receives an annual allocation from the State. These funds cannot be transferred to the City until the Supplemental Law Enforcement Oversight Committee certifies receipt of an approved expenditure plan, by Resolution, from the City Council.

The City Council, at a public hearing, must appropriate the anticipated monies exclusively to fund front-line law enforcement services in accordance with a written request submitted by the Chief of Police.

The most recent State Budget funded another year of the California Citizens' Option for Public Safety (COPS) Program. The City of Corning will receive $100,000 of the total program allotment, which must be expended by June 30, 2025.

Staff proposes that the 2024 COPS funds be expended during the 2024/2025 fiscal year to fund a police officer position. Excluding overtime, the current estimated salary and benefits for a police officer position is expected to exceed $100,000. The balance of funds needed to fund the position will come from the General Fund.

RECOMMENDATION:

TO: HONORABLE MAYOR AND COUNCIL MEMBERS

CRAIG BASSETT, POLICE CHIEF
SUMMARY:

The City of Corning Police Department has been notified by the Tehama County Auditor-Controller that there is an unencumbered overage in the COPS fund in the amount of $47,453.00. These funds are restricted to front-line law enforcement and may not be used to supplant services already budgeted.

The Corning Police Department has requested, and received approval from, the Tehama County Auditor-Controller and the Tehama County Chief Administrator on October 22, 2024, that these funds (approximately $47,238.00) can be spent on several projects or items that relate to better serving the community. See attached list.

RE: Tehama County Supplemental Law Enforcement Oversight Committee 2023/24 Citizens' Option for Public Safety (COPS) Unencumbered Overage Fund Proposed Expenditures
Dear Mr. Hydrick:

In the email dated September 23, 2024, we were informed that there is an unencumbered overage in the COPS fund for the City of Corning in the amount of $47,453.00. We would like the Oversight Committee to consider that $47,453.00, minus the $215 administrative fee, of these monies be encumbered toward the purchase of the following:
(1) Voice Logger for Dispatch
(2) K-9 Program
(3) ADA Compliant door for Dispatch
(4) Camera at Northside Park
(5) Electric Gate for PD staff safety (this is partially funded by CIP but electric gates put cost over what was budgeted)
(6) Pop-Up canopy, tablecloth, and backdrop with new patch/emblem for Community Events. (7) LPR for South Ave/99
If permitted, these funds will be expended during the 24/25 fiscal year, with any remainder to be held in the COPS fund in trust.

Thank you for your consideration of this request.

Respectfully.

APPROVE CONTRACT AND
PURCHASE OF A K9 AND HANDLER

TRAINING CONTRACT FROM MEYER'S
POLICE K-9 TRAINING, LLC.

NOVEMBER 12, 2024
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: BRANT MESKER, CITY MANAGER 2

CRAIG BASSETT, CHIEF OF POLICE
SUMMARY:

On October 8, 2024, the City Council unanimously approved resuming the Corning Police Department's K9 program after it was paused due to low staffing and the sale of former K9, Blaze, to the Tehama County Sheriff's Office after his handler accepted a position with the agency.

Since the approval, Officer Dannette Ross was selected to fill the K9 Handler role. On November 1st, Officer Ross, Administrative Secretary Smith, and Sergeant Squier visited Meyer's Police K9 Training Facility to view their available dogs. A dog was selected for purchase, along with an initial five-week Basic K9 Handler School. The total cost of the K9 is $17,696.25, and the training course is $5,500.00 for a total of $23, 196.25.

Ongoing training is necessary for the handler and K9. Staff requests approval of the ongoing training with Meyer's Police K9 Training at a cost of $4,200 per year.

FINANCIAL:

1. Upon execution of the proposed purchase order with Meyer's Police K9 Training, LLC., the K9 is to be purchased utilizing the amount of $8,000.00 that was earmarked from the purchase of Blaze, $9,696.25 from funds raised by the community, and $5,500.00 from the Cal Cops Grant overage.

2. The ongoing monthly maintenance training fees are $4,200 per year, which will be paid for utilizing funds from a community K-9/PAL/Cadets bank account and/or community fundraisers for the remainder of the fiscal year. The cost for the first year would not be a cost to the City. Once the new fiscal year begins, the Police Department will make appropriate budget requests in order to budget accordingly as they had in previous years.

RECOMMENDATION:

MAYOR AND COUNCIL APPROVE THE:
• CITY MANAGER TO SIGN THE PURCHASE ORDER WITH MEYER'S POLICE K- 9 TRAINING, LLC. FOR THE PURCHASE OF A K9 AND HANDLER TRAINING IN THE AMOUNT OF $23,196.25, AND MAKE THE NECESSARY BUDGET APPROPRIATIONS;
• CITY MANAGER TO SIGN THE AGREEMENT WITH MEYER'S POLICE K-9 TRAINING, LLC. FOR TRAINING SERVICES IN THE AMOUNT OF $4,200 PER
