The rate increase proposed is 2.06% and includes a decrease of 0.38% for fuel. The rate increase is based upon the methodology described in Section 3.4 of the Refuse Collection Agreement. The increase for residential customers with 96-gallon service will be from $29.30 to $29.90 per month, an increase of $0.60. Should residents have excess capacity, they may choose to downsize their current 96-gallon cart to a 64-gallon cart at $27.53 per month, for a monthly savings of $2.37. The Senior Citizen rate for the smaller 32-gallon roller cart will rise from $14.64 to $14.94 per month, an increase of $0.30 per month. The cost of commercial service is based on service level and would also increase by 2.06% (same as the residential rate). Rates are detailed in the Agreement (attached). If approved, the new rates will become effective April 1, 2025.
The annual CP increase, and Fuel Cost adjustments are specifically addressed within the Agreement (copy of applicable section attached as Exhibit "A"). As a result of the Agreement approved by the City Council on December 22, 2020, Staff scheduled the matter for Council consideration and sent out notices of the hearing to all utility customers.
Commercial rates vary by service need (size/frequency of service).
BACKGROUND:
The Refuse Collection Agreement between the City of Corning and Corning Disposal provides for an annual rate increase equal to the Consumer Price Index for the 12-month period ending on the prior September 30th. The Consumer Price Index (CPI) indicates that inflation for this period is 2.44%, and a fuel cost adjustment of -0.38%, for a total rate increase as previously mentioned of 2.06% (Exhibits C & D). The last rate increase was approved by the City Council on March 26, 2023 and effective on April 1, 2024.
NOTICE:
Notices (Exhibit "B) of this hearing were sent to all utility customers on February 5, 2025, in accordance with Proposition 218, the "Right to Vote on Taxes Act". As of March 21, 2025 there were no protests received
RECOMMENDATION:
MAYOR AND COUNCIL, HAVING CONDUCTED THE PUBLIC HEARING AND RECEIVED ALL PROTESTS; APPROVE THE PROPOSED DISPOSAL SERVICE RATE INCREASE OF 2.06%, AS SHOWN ON THE RATE SCHEDULE ATTACHED AS EXHIBIT "C" TO BECOME EFFECTIVE APRIL 1, 2025.
EXHIBIT "A"
3.4 Annual CPI Rate Adjustment.
Commencing on April 1, 2021 and on April 1 annually thereafter, the rates set forth on Exhibit C shall, subject to CITY Council review to confirm calculations, be adjusted by a percentage equal to the percent change in the average Consumer Price Index for All Urban Consumers, U.S. city average, All Items ("CPI"), as published by the Bureau of Labor Statistics, for the 12-month period ending the previous September 30. Not later than November 30 of each year, CONTRACTOR shall notify the CITY of its intent to increase the rate and provide the rate computations and a proposed new schedule. The CITY Manager shall promptly schedule the request for a rate adjustment on the next CITY Council agenda at which action could be taken in accordance with all applicable laws and regulations.
3.5 Fuel Cost Adjustment.
In addition to the CPI and other rate adjustments provided by this Section, the rates in Schedule C may be further adjusted for changes in fuel costs associated with performance of the services hereunder in the manner provided below:
(a) Not later than November 30 of each year, CONTRACTOR shall notify the CITY of any intent to seek a fuel cost adjustment. CITY may also by such date each year notify CONTRACTOR of its intent to seek a fuel cost adjustment. CONTRACTOR, on its own initiative or at the request of the CITY, shall then submit to CITY a written proposal for a fuel cost rate adjustment, including a report detailing the calculations in accordance with the formula agreed to below. Within thirty (30) days after CONTRACTOR provides the CITY with such proposal and report, the CITY shall notify the CONTRACTOR in writing as to whether the CITY accepts such information as complete or specifying any respect in which the CITY deems such information incomplete or deficient. CITY and CONTRACTOR shall attempt in good faith to review such information and complete all its deliberations in connection therewith within ninety (90) days from the date of submittal of the proposal and report to the CITY. The effective date for any such increase, if approved, shall be April 1. (b) The fuel cost adjustment shall be calculated by the following formula:
(1 + ((Fuel Cost Change - CPI Change) x Fuel Percentage]) x Old Rate = New Rate The terms used in the preceding formula shall have the following meanings:
"Fuel Cost Change" means, for No. 2 diesel fuel, the average price for California No 2-diesel fuel for the twelve (12) month period immediately preceding the submission of a proposal and report by the CONTRACTOR divided by such average price for the immediately preceding 12-month period average price for the calendar year preceding the most recent calendar year.
The price used to compute the Fuel Cost Change shall be the price reported by the United States Department of Energy, Energy Information Administration. In the event that price is no longer reported, the parties will designate a new methodology for determining the price based on comparable data. The parties will meet to determine this designation as soon as practically possible. For fuels other than No. 2 diesel, the CONTRACTOR shall calculate the change in fuel cost using the same time periods and a reasonably comparable fuel price index.
"CPI Change" means the average CPI (defined in Section 3.4) for the most recently completed calendar year divided by such average price for the calendar year preceding the most recent calendar year.
"Fuel Percentage" means the CONTRACTOR's total cost for diesel fuel (or such other fuel as is employed by CONTRACTOR incurred during the most recent calendar year divided by CONTRACTOR's total operating revenue for such calendar year, in both cases calculated for CONTRACTOR's operations district that includes the CITY. "Old Rate" means each of the rates on Exhibit C, as they may have been previously adjusted or amended.
"New Rate" means the new rate calculated pursuant to the preceding formula that will replace the Old Rate.
This rate adjustment for fuel costs shall be in addition to, and not in lieu of, any other rate increase to which CONTRACTOR may be entitled under this Agreement. Under no circumstances may an adjustment for fuel costs reduce a rate below the base rates as specified in Exhibit C, as increased for changes pursuant to this Section 3. Adjustments for fuel costs shall only be made to increase or reduce (but not below zero) prior adjustments for fuel costs. In addition to the preceding limitations on fuel cost adjustments, the percentage increase or decrease in the New Rate from the Old Rate in any single adjustment for fuel costs shall not exceed 2%.

March 25, 2025
TO: HONORABLE MAJOR AND COUCILMEMBERS
FROM: BRANT MESKER, CITY MANAGER
ELIJAH STANLEY, PUBLIC WORKS DIRECTOR
SUMMARY:
Staff received a request from Lisa Lomeli for City Council to approve a waiver of the special event permit fee for the use of Clark Park for the annual Corning Community Egg Hunt.
The event is scheduled to take place on April 19, 2025. This is a community-based event that benefits local children by providing a safe family friendly, and inclusive event to hunt for Easter eggs at no cost.
The City of Corning received a donation request in the amount of $500 to support the Corning Community Easter Egg Hunt to be held at Clark Park on April 19, 2025. To support such an event, the City Council must declare a community benefit, otherwise, the donation would be considered a gift of public funds. This will be the fourth (4) year the event will be held, and the event is being heavily advertised within the community. Past events have proven to have a large attendance. Event organizers anticipate up to, if not more than 1,500 youth in the community to attend.
If the City Council approves this donation, the organizers of the event would be required to provide receipts up to $500 for reimbursement for plastic easter eggs and candy.
BACKGROUND:
Staff requests Council approval to waive the special event permit fee normally charged ($235) for the Corning Community Easter Egg Hunt.
The City has made this donation in past years to support this event and has also waived City fees for the event.
FINANCIAL:
There are adequate funds within Community Events Materials and Supplies budget line item # 001-6150-3190 to support this request. Typically, this line item is used to support Food Truck Tuesday event costs.

APPROVE MUNICIPAL AIRPORT
GROUND LEASE TRANSFER TO
RACHELLE LIMA FOR HANGARS #3
AND #10
MARCH 25, 2025
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
CITY OF CORNING
FROM: BRANT MESKER, CITY MANAGERMA
ELIJAH STANLEY, PUBLIC WORKS DIRECTOR
SUMMARY:
Staff requests to transfer the lease of Airport Hangars #3 and #10 to Rachelle Lima. The current leaseholder, her husband Rueben Lima, passed away, and this transfer is necessary for the maintenance of insurance and to potentially facilitate the sale of the hangars.
BACKGROUND:
Hangars #3 and #10 are currently under the lease of Ruben Lima, who has passed away.
Rachelle Lima, as the surviving spouse, seeks to transfer the leasehold to her name to ensure continuity of insurance coverage and to retain the option to sell the hangars at a later date.
Given the circumstances, it is recommended that the lease for Hangars #3 and #10 be transterred to Rachelle Lima. This will allow her to maintain the necessary insurance coverage and provide the flexibility to sell the hangars should she choose to do so in the future. The transfer should be processed in accordance with the standard procedures outlined in the lease agreement.
RECOMMENDATION:
MAYOR AND COUNCIL APPROVE THE CORNING MUNICIPAL AIRPORT GROUND LEASE TRANSFER TO RACHELLE LIMA FOR HANGARS #3 AND #10
ITEM NO.: J-4
APPROVE THE AGREEMENT WITH TELSTAR
INSTRUMENTS FOR THE WWTP CHLORINE
ANALYZER PROJECT IN THE AMOUNT OF
$107,594.00 AND AUTHORIZE THE CITY
MANAGER TO EXECUTE THE CONTRACT.
March 25, 2025
TO: HONORABLE MAYOR AND COUNCILMEMBERS
FROM: BRANT MESKER, CITY MANAGER
ELIJAH STANLEY, PUBLIC WORKS DIRECTOR
Background:
The Wastewater Treatment Plant (WWTP) is required to monitor and report effluent chlorine levels as stipulated by the Central Valley Regional Water Quality Control Board and under the National Pollutant Discharge Elimination System (NPDES) Permit. Accurate and continuous chlorine monitoring ensures compliance with regulatory standards, protecting water quality and avoiding potential fines or enforcement actions.
Currently, the WWTP requires updated chlorine analyzers to enhance monitoring capabilities. The installation of two new chlorine analyzers will provide accurate, real-time data essential for plant operations and compliance.
Discussion:
The proposed project includes the furnishing and installation of two chlorine analyzers:
1. Chlorine Contact Chamber Analyzer: This analyzer will measure chlorine dosing levels at the chlorine contact chamber, ensuring appropriate disinfection levels are maintained during the treatment process.
2. Final Discharge Point Analyzer: This analyzer will measure the final chlorine residual at the discharge point, confirming that effluent leaving the plant meets the regulatory chlorine residual requirements.
Both analyzers will be integrated with the SCADA auto dialer system, enabling real-time data logging and generating alarms sent directly to plant operators. This integration enhances operational efficiency by allowing for immediate response to any discrepancies in chlorine level, preventing permit violations.
This procurement qualifies as a sole source exception to the bidding requirement under the Corning Municipal Code section 3.12.082.A.2 and Public Contract Code section 3400(c). Staff recommends Council waive the bidding requirement as Telstar Instruments is the sole provider capable of furnishing and installing the analyzers with the necessary specifications and seamless SCADA integration required for WWTP operations.
Financial Impact:
As part of the mid-year budget review process, staff allocated an additional $53,000 to support the project. The total project cost is $107,594.00, which remains within the approved budget.
WWTP Chlorine Analyzer Project
380-9264-5200 $110,000
RECOMMENDATION:
MAYOR AND COUNCIL:
• APPROVE THE AGREEMENT WITH TELSTAR INSTRUMENTS FOR THE WWTP CHLORINE ANALYZER PROJECT IN THE AMOUNT OF $107,594.00; AND • WAIVE THE BIDDING REQUIREMENT PER CORNING MUNICIPAL CODE SECTION
3.12.082.A.2 AND PUBLIC CONTRACT CODE SECTION 3400(C); AND » AUTHORIZE THE CITY MANAGER TO EXECUTE THE CONTRACT

Dear Mitch,
Regulators have asked the City of Corning to install continuous monitoring and control for chlorine residual for the disinfection system at the wastewater treatment plant. Telstar has extensive experience with installing, calibrating and troubleshooting water quality analyzer systems such as the ones required by the regulators. Telstar has proposed DeNora MicroChem analyzers for this project. Telstar is an exclusive authorized service provider for DeNora chemical feed and analyzer equipment. Our certified instrument technicians are experts in installing and servicing this equipment. Telstar's team includes SCADA/PLC programmers, electricians, and mechanical/civil staff who can complete all aspects of the project in-house, without relying on other outside contractors and consultants.
Telstar recently worked with the City staff to upgrade the disinfection systems at the wastewater treatment plant from gaseous chlorine to liquid sodium hypochlorite and sodium bisulfite. Since we installed and commissioned them, Telstar is intimately familiar with the City's new chlorination and dichlorination systems including all aspects of the operation and programming for the systems. We can hit the ground running for installation of this new continuous monitoring and control system, integrating it into the recently installed disinfection systems.
Please call me should you have any questions about Telstar's unique qualifications for completing this project successfully.
Sincerely,
John Gardiner

BACKGROUND
On January 19, 2024, Staff entered into Agreement No. 460015659 with the State of California Department of Water Resources (DWR) to fund the Well and System Expansion Project. This project is part of the Small Community Drought Relief Program (SCRP), which was authorized by the Legislature through the Budget Act of 2021 (Stats. 2021, ch. 69, §112) and its Trailer Bill, Assembly Bill 148 (Stats. 2021, ch. 115, §97).
The SCRP program provides grants and direct expenditures for interim or immediate relief in response to drought conditions. Its primary goal is to address immediate impacts on human health and safety and on fish and wildlife resources while providing water to persons or communities that lose or are threatened with the loss or contamination of water supplies.
The City applied for and received funding through this Small Community Drought Relief Program to implement critical water infrastructure improvements. The new well project is essential to enhance water reliability and ensure long-term sustainability for the community.
DISCUSSION
As part of the project, an easement agreement with the Healthcare District is necessary to access and construct the new well on a portion of Parcel 3 and Parcel 4 of Parcel Map No. 07-
20. The easement will allow the City to install, operate, and maintain the new well and associated infrastructure, which is a critical component of the overall system expansion.
The easement agreement includes Exhibit A, which provides the legal description of the City Well and Access Easement for the City of Corning. This document defines the precise boundaries and access rights necessary for the construction and long-term maintenance of the new well.
Due to the complexity of the project and the need for thorough coordination with the engineer and designer, Staff has filed an extension request with the DWR. This extension, if approved, will extend the project completion date to December 2026. The additional time is necessary to complete the design phase, finalize the estimate, and carry out the construction activities, which include:
• Installation of one new well.
• Installation of one new backup generator.
• Installation of approximately 5,280 feet of new pipeline.
The easement agreement with the Corning Healthcare District is essential to keep the project on track and comply with the conditions of the DWR funding agreement.
FISCAL IMPACT
The well project is funded through Funding Agreement No. 460015659 with the State of California Department of Water Resources under the Small Community Drought Relief Program. [633-7390-742 CORP Well Pro 82,000,000)
