AMENDING THE SCHEDULE OF FEES

AND CHARGES FOR CITY SERVICES

AND AUTHORIZE AUTOMATIC ANNUAL

UPDATES
July 9, 2024
TO: CITY COUNCIL OF THE CITY OF CORNING
FROM: BRANT MESKER, CITY MANAGER
BACKGROUND:

At the July 13, 2021 City Council meeting, the City Council approved an agreement with Revenue Cost Specialists to provide a Comprehensive User and Development Impact Fee Study. In July 2022, the Comprehensive User Fee Study was completed and on November 22, 2022, it was presented to the City Council. Council adopted the new fees on July 9, 2024. As discussed during that presentation, staff recommended that the Council consider implementing an annual Consumer Price Index (CPI) adjustment so that future increases would be incremental rather than significant.

Periodic review and evaluation of fees is necessary to ensure that fees fairly reflect the actual cost of providing services, and to prevent the General Fund from subsidizing personal choice services that should be cost-recovery based.

Exhibit A of the Resolution provides the updated proposed fee schedule.

SUMMARY:

The June 2025 Consumer Price Index for All Urban Consumers (CPI-U) for the West region reflects an increase of 2.7%. Staff is therefore recommending that the City Council adopt a Resolution updating all user fees and charges by 2. 7%.

Staff further recommends that going forward, the City Council authorize an automatic annual update of fees each year based on the 12-month percentage change in CPI-U in June for the West region with a cap of 5%. This year's fees would be effective immediately upon approval of the Resolution. Beginning in 2026, the annual CPI-U adjustment would be effective September 1 of each year.

Imposing fees on new development and personal choice services that benefit an individual rather than the community at large recognizes that current residents and businesses in Corning should not be responsible for the cost of expanding infrastructure or services that provide personal and/or financial benefit. General Fund dollars should not subsidize or fully subsidize a service that benefits an individual, because doing so prevents those same funds from supporting community services such as Police, Fire, Parks, and Streets.

RESOLUTION NO. 09-09-2025-01

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CORNING,

CALIFORNIA, AMENDING THE SCHEDULE OF FEES AND CHARGES FOR CITY

SERVICES BASED ON THE CONSUMER PRICE INDEX (CPI-U) AND

ESTABLISHING ANNUAL ADJUSTMENTS
WHEREAS, the City of Coming has conducted an analysis of certain services, the costs reasonably borne of providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and, WHEREAS, the City wishes to comply with both the letter and the spirit of Article XIIIB of the California Constitution and limit the growth of taxes; and, WHEREAS, the City has a policy of recovering thefull costs reasonably borne of providing special services of a voluntary and limited nature, such that general taxes are not diverted from general services of a broad nature and thereby utilized to subsidize unfairly and inequitably such special services; and,
WHEREAS, pursuant to Government Code Section 66016 the various fees to be charged for services must be adopted by the City Council by Ordinance or Resolution, after providing notice and holding a public hearing; and,
WHEREAS, Government Code Section 66018 applies to the adoption or increase of fees to which a specific statutory notice requirement does not apply; and, WHEREAS, on September 9, 2025, the City Council conducted a legally noticed public hearing on the proposed amendment to the schedule of fees and charges for city services, and considered public testimony both oral and written and materials in the staff report and accompanying documents and exhibits; and,
WHEREAS, pursuant to Government Code Sections 66016 and 66019, the data required to be madeavailable to the public prior to increasing theamount of the fees by this Resolution was made available for public review at least 10 days prior to the date of this meeting; and, WHEREAS, the Consumer Price Index for All Urban Consumers (CPI-U) for the West Region, based on the 12-month percentage change in CPI-U in June, increased by 2.7%, and staff has applied that increase to the City's fee schedule; and,
WHEREAS, it is the intent of the City Council to provide for automatic annual adjustments to fees based on the 12-month percentage change in CPI-U in June for the West Region, effective September 1st of each year beginning in 2026 with a cap of 5%, unless otherwise directed by Council; and,
WHEREAS, additions to the schedule of fees and charges to be paid by those requesting such special services need to be adopted so that the City might carry into effect its policies; and, WHEREAS, the City Council finds that the user fees detailed in Exhibit A, attached hereto, are consistent with the City of Coming General Plan; and,
WHEREAS, pursuant to California Government Code Section 66016, a general explanation of the hereinafter contained schedule of fees and charges has been published as required; and, WHEREAS, all requirements of California Government Code Section 66016 are hereby found to have been complied with.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CORNING, CALIFORNIA, RESOLVES AS FOLLOWS:

Section 1. Fee Schedule Adoption. The fees as set forth in Exhibit "A," attached hereto and incorporated herein by reference, are hereby adjusted by 2. 7% in accordance with the 12-month percentage change in CPI-U in June for the West Region, and shall be applied by the various City departments and collected by the City Finance Department.

Section 2. Separate Fee for Each Process. All fees set forth by this Resolution are for each identified process; additional fees shall be required for each additional process orservice that is requested orrequired. Where fees are indicated on a per unit of measurement basis, the fee is for each identified unit or portion thereof within the indicated ranges of such units.

Section 3. Automatic Annual Adjustments. Beginning in 2026, the Schedule of Fees and Charges shall be automatically adjusted each year based on the 12-month percentage change in CPI-U in June for the West Region. These annual adjustments shall take effect on September 1st of each year, unless otherwise modified by Council action.

Section 4. CEQA. The adoption of this Resolution is not subject to CEQA review pursuant to CEQA Guideline 15378(b)(4), which provides that the creation of government funding mechanisms or other government fiscal activities that do not involve any commitment to any specific project are not projects subject to CEQA review.

Section 5. Interpretations. This Resolution may be interpreted by several City department heads in consultation with the City Manager and, should there be a conflict between two fees then the lower in dollar amount of the two shall be applied.

Section 6. Constitutionality. If any portion of this Resolution is declared invalid or unconstitutional then it is the intention of the City Council to have passed the entire Resolution and all its component parts, and all other sections of this Resolution shall remain in full force and effect.

Section 7. Repeal of Conflicts. All resolutions and other actions of the City Council in conflict with the contents of this Resolution are hereby repealed.

Section 8. Effective Date. This Resolution, and Exhibit "A" attached hereto, shall go into full force and effect immediately upon approval.
