ORDINANCE #717.

ORDINANCE NO. 717

AN ORDINANCE OF THE CITY OF CORNING REGULATING THE CONSTRUCTION

OF UNINHABITATED, DETACHED STRUCTURES IN THE

CITY OF CORNING RECITALS
WHEREAS, Chapter 17.50 of the Corning Municipal Code sets forth the regulations within the City of Corning for detached, uninhabited structures, including height and setback requirements; and
WHEREAS, the City seeks to amend Chapters 17.50 to provide further clarity as to the application of the structures referenced in the requirements to ensure clear regulatory authority for the City and the ability of a homeowner to utilize most of their residential property.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CORNING DOES ORDAIN AS FOLLOWS:

Section 1. Section 17.50.040 of Chapter 17.50 of Title 17 is hereby repealed and replaced as follows:

17.50.040 - Detached structure.

A detached structure, including but not limited to a garage, shed, shop, gazebo, shade structure and/or other uninhabited improvement is permitted on a property, subject to the following provisions:

1. Side and rear setbacks for the detached structure shall be no less than 3-feet.

2. Any overhang for the detached structure shall be no more than 2-feet.

3. The detached structure must not exceed one story in height with a maximum height of 15-feet.

4. The detached structure may not occupy more than fifty percent of the rear yard area.

5. Each property is permitted only one detached structure, unless otherwise allowed by the Planning Department.

6. All detached structures must be at least eight feet from primary residence or any accessory dwelling unit.

7. Windows and doors on the detached structure shall not be oriented in a manner that allows direct visibility into the neighboring property
Section 2. Section 17.50.045 of Chapter 17.50 of Title 17 is hereby enacted as follows:

17.50.45- Cargo containers
There shall be no cargo containers, portable storage containers, semi-trailers, or any other container that is designed to be moved by semi-truck, train or vessel in any zoning district. This section does not apply to any temporary use during moving or construction when an encroachment permit has been issued by the city. For purposes of this section, temporary is defined as any use that occurs for 30-days or less.

Section 4. Severability.

If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of this Ordinance, or its application to any person or circumstance. The City Council of the City of Corning hereby declares that it would have adopted each section, subsection subdivision paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more other sections, subsections subdivisions paragraphs, sentences, clauses or phrases hereof be declared invalid or unenforceable.

Section 5. CEQA. The City of Corning finds that this Ordinance is not a “project” according to the definition set forth in the California Environmental Quality Act (“CEQA”), and, pursuant to CEQA Guidelines sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15061(b)(3) (there is no possibility the activity in question may have a significant effect on the environment), the adoption of this ordinance is therefore not subject to the provisions requiring environmental review.

Resolution No. 02-24-2026-01
Affirming the City’s
Commitment to Fair Treatment
and Condemning Caste-Based
Discrimination.

February 24, 2026
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: BRANT MESKER, CITY MANAGER

BACKGROUND
The City of Corning has long upheld the principles of justice, equality, and impartial treatment for all individuals regardless of background, heritage, or social standing. Across the United States, awareness has increased regarding caste-based discrimination—a form of social stratification that may result in unjust treatment based on birth, lineage, or inherited social status.

While caste-based discrimination may not always be visible, it can occur within communities nationwide. The proposed resolution formally denounces caste-based discrimination and reaffirms the City’s commitment to ensuring that all municipal policies, services, and institutions remain free from bias or exclusion based on caste or inherited status.

At the request of a council member, this Resolution has been agendized. Adoption of this resolution places the City on record as supporting continued state and national efforts to prevent and address caste-based discrimination through legislation, education, and public awareness.

DISCUSSION
This resolution is declaratory in nature and reinforces the City’s existing commitment to nondiscrimination and equal protection principles. The City currently operates under federal and state civil rights laws, including protections against discrimination based on race, religion, ancestry, national origin, and other protected characteristics.

By adopting this resolution, the City Council:
• Denounces all forms of caste-based discrimination within the City of Corning; • Affirms the City’s commitment to equitable treatment in City policies, programs, and services; and
• Expresses support for broader legislative and public awareness efforts aimed at preventing caste-based discrimination.

The resolution does not create new regulatory requirements but serves as a policy statement reinforcing the City’s values and commitment to inclusivity and fairness.

RECOMMENDATION
Mayor and Council:

Adopt Resolution No. 02-24-2026-01 affirming the city’s commitment to fair treatment and condemning caste-cased discrimination.

RESOLUTION NO. 02-24-2026-01
