I. PUBLIC HEARINGS AND MEETINGS:
1. Proposed disposal services rate increase.
Presented by City Manager, Brant. The proposed refuse rate increase is 12.89%, raising the standard 96-gallon residential service from $29.90 to $33.74 per month. Customers can reduce Item: G-2
costs by downsizing to a 64-gallon cart at $31.08. The senior 32-gallon rate will increase from $14.94 to $18.28, with adjusted percentages below the standard rate over the next two years.
Commercial rates will increase by 8.58% and vary based on service level.
The increase follows the methodology outlined in the Refuse Collection Agreement, which also includes annual CPI adjustments. If approved, the new rates will take effect April 1, 2026.
Notices were sent to all utility customers on February 6, 2026, in compliance with Proposition 218, and any protests received have been documented. There was a total of 8 protests of which 5 were complete, two had missing information, and one was rejected due to not being an address within the city limits. With the new rate a new service provider for street sweeping is included.
Opened the public hearing at 5:36pm.
A community member voiced his concern of this rate increase due to many people he knows that are on fixed income. He stated it’s already hard to make ends meet and with this increase many people will be affected.
Another member of the community mentioned that the Waste Management pick up calendar’s are wrong and that they should send out a corrected one since it is causing confusion.
Closed Public Hearing at 5:38pm
Councilor Demo moved to approve the proposed disposal service rate increase of 12.89%, as shown on the rate schedule attached as exhibit “C” to become effective April 1, 2026; Councilor Valerio seconded the motion.

Absent: None
Abstain/Opposed: None
Result: Motion was approved by a 5-0 vote
J. REGULAR AGENDA:
1. Approve agreement with J&J Pumps for the City of Corning Blackburn Well Repair Project.
Presented by Public Works Director, Eli Stanley. The Blackburn Well, a key high-producing groundwater source, is currently out of service due to pump failure. After diagnostic work by J&J Pump, the issue was identified as a failed 11CLC bowl requiring replacement, along with new bearings and pump reinstallation. Because the well is critical for meeting peak summer demand, timely repairs are essential to avoid added strain on other wells. J&J Pump, already familiar with the site, is ready to proceed upon approval, helping minimize delays and costs. The repair will be funded through the Water – Well Repair budget.
Councilor Hargens moved to approve agreement and authorize the City Manager to sign the contract with J&J Pump for the Blackburn well repair project at a cost not to exceed $34,257.96; Councilor Valerio seconded the motion.
Ayes: Snow, Valerio, Demo, Hargens, Lomeli

TO: PLANNING COMMISSION OF THE CITY OF CORNING
FROM: CHRISTINA MEEDS, PLANNER II
SUMMARY:
This application is for a 2-year extension to tract map 24-1001. The subdivider may apply for map extensions, at 2-year intervals, for a total of 6 years from the initial approval date. The map was approved on March 19, 2024, making the life of the map viable until March 19, 2030.
This Planning Application seeks to create fourteen (14) parcels for single-family residential use in an R-1 Zoning District
The Tentative Tract Map was adopted by the Corning City Council on September 11, 2007, along with a Mitigated Negative Declaration and was allowed to expire on September 11, 2016. Mr. Singh reached back out to the City in August of 2023 to start discussions regarding the Tentative Tract Map and what it would take to renew it. Mr. Singh hired a new engineering firm to duplicate the map and submitted it to the City. The 14 new residential lots under Tentative Tract Map 24-1001 will be known as “Shaan Estates”. It will be a mirror image of North Alex Lane just to the East of the property. A new map requires an addendum to the previously adopted Mitigated Negative Declaration which staff has completed.
The Planning Commission, in a regularly scheduled meeting on March 17, 2026, recommended that the City Council approve a two year extension.

ITEM NO: J-2
APPROVAL OF FIRE REPEATER
PURCHASE AGREEMENT AND
MEMORANDUM OF UNDERSTANDING
WITH CORNING UNION ELEMENTARY
SCHOOL DISTRICT
APRIL 14, 2026
TO: HONORABLE MAJOR AND COUCILMEMBERS
FROM: BRANT MESKER, CITY MANAGER
TOM TOMLINSON, FIRE CHIEF
SUMMARY:
Reliable radio communications are critical for emergency response operations.
The City’s current fire communication system has identified coverage gaps that may impact response effectiveness and firefighter safety.
To address this need, staff has worked with Silke Communications Solutions to develop a project that includes the purchase and installation of a new radio repeater system to improve wireless communication coverage.
In conjunction with this project, the Fire Chief has coordinated with the Corning Union Elementary School District (CUESD) to utilize an existing telecommunications tower located at 821 Hoag Street for placement of the repeater equipment.
Staff is requesting authorization to utilize Section 3.1.082(A)(6) of the City’s Purchasing Policy, which allows the City to forgo formal bidding when the City’s needs will be better met by negotiating prices from a single vendor or by following other procedures designed to expeditiously acquire necessary equipment at a reasonable price. In this instance, working with a vendor already familiar with the equipment and coordinating with the School District supports operational efficiency, cost savings, and timely implementation.
BACKGROUND:
As part of the adopted Fiscal Year 2025/2026 Fire Department Fixed Asset/Capital Improvement Budget, $22,000 was approved for the purchase and installation of a new radio repeater. The repeater will enhance communication reliability and operational efficiency for emergency response services.
RECOMMENDATION:
Mayor and Council:
• Authorize staff to utilize Section 3.1.082(A)(6) of the City’s Purchasing Policy to waive the formal bidding process and negotiate directly with Silke Communications.
• Approve the agreement with Silke Communications Solutions for the purchase and installation of a fire repeater system in an amount not to exceed $21,580.26; and
• Approve the Memorandum of Understanding (MOU) with the Corning Union Elementary School District for use of its telecommunications facility and tower to install and operate the repeater equipment; and • Authorize the City Manager to execute all necessary documents related to both agreements; and
AGREEMENT

4. PAYMENTS:
The acceptance of the final payment by the Contractor shall constitute a waiver of all claims by him.
5. SUSPENSION OF WORK:

The sureties in executing such bonds shall be deemed to have expressly agreed to any such extension of time. The amount of time allowed in any Extension of Time shall be limited to the period of the delay-giving rise to the same as determined by the CITY.

G. Category A Delays
For the purpose of these Contract Documents, the term "Category A Delays" shall mean, and is limited to, delays caused directly by acts of God; acts of the public enemy; fire, riots, insurrections; epidemics; quarantine restrictions; strikes; lockouts; sit- downs; acts of a governmental agency; priorities or privileges established for the manufacture, assembly or allotment of materials necessary in the construction of the work by order, decree or otherwise of the United States or by any department, bureau, commission, committee, agent, or administrator of any legally constituted public authority; changes in the work ordered by the CITY insofar as they necessarily require additional time in which to substantially complete the work; the prevention by the CITY of the Contractor from commencing or prosecuting the work because of the acts of others, excepting the Contractor's subcontractors; or the prevention of the
Contractor from commencing or prosecuting the work because of a city-wide failure of public utility service.
Inclement weather shall not be a prima facie reason for the granting of an extension of time, and the Contractor shall make every effort to continue work under prevailing conditions. The CITY may, however, grant an extension of time if an unavoidable delay as a result of inclement weather in fact occurs, and such shall then be classified as a "Category A Delay".
The term "Category A Delay" shall specifically not include (i) any delay which could have been avoided by the exercise of care, prudence, foresight and diligence on the part of the Contractor; (ii) any delay in the prosecution of parts of the work, which may in itself be unavoidable but which does not necessarily prevent or delay the prosecution of other parts of the work, nor substantial completion of the whole work within the time specified; (iii) any reasonable delay resulting from time required by the CITY for review of plans submitted by the Contractor and for the making of surveys, measurements and inspection; and (iv) any delay arising from an interruption in the prosecution of the work on account of the reasonable interference from other contractors employed by the CITY which does not necessarily prevent the completion of the whole work within the time specified.
H. Category B Delays
For the purposes of these Contract Documents, the term "Category B Delays" shall mean delays caused directly by loss or damage to the project caused by the perils covered by the Builder's Risk insurance provided for by the Agreement or by any war declared by an enactment of the Congress of the United States of America.
VI LIQUIDATED DAMAGES
The provisions for Liquidated Damages appearing in the General Conditions, Article 12, are incorporated by reference as if fully set forth herein. Liquidated damages of $3,600.00 per day will be charged the Contractor for each day of delay beyond the substantial completion date.
VII NOTICE OF DELAY
The Contractor shall promptly notify the CITY in writing of any anticipated delay in the prosecution of the work, and, in any event, promptly upon the occurrence of a delay. Said notice shall constitute an application for an extension of contract time only if it is in compliance with the provisions of Article 12. Failure by the Contractor to make a timely request will result in a waiver of the right to such extension. Contractor shall take notice of General Conditions, Article 12, affecting the time period in which to claim an extension of the contract time for physical conditions and limitations set forth in the General Conditions, Article 12. The CITY may take steps to prevent the occurrence of continuance of the delay and/or may determine to what extent the completion of the work is delayed thereby.
VIII NO WAIVER OF RIGHTS
Neither the inspection by the CITY or its agents, nor any order or certificate for the payment of money, nor any payment for, nor acceptance of the whole or any part of the work by the CITY, nor any extensions of time, nor any position taken by the CITY or its agents shall operate as a waiver of any provision of this Contract, or of any power herein reserved to the CITY or any right to damage herein provided, nor shall any waiver of any breach of this Contract be held to be a waiver of any other or subsequent breach. All remedies provided in this Contract shall be taken and construed as cumulative, that is in addition to each and every other remedy herein provided; and the CITY shall have any and all equitable and legal remedies which it would in any case have.
IX AGREEMENT CONTROLS
In the event of a conflict between the Contract Documents, the conflict shall be resolved by giving precedence in the following order: (1) This Agreement Form; (2) the General Conditions and General Requirements; (3) the Supplementary Conditions; (4) the Notice to Contractors; (5) the Instructions to Bidders; (6) the Technical Specifications text; (7) the Drawings (Plans).

To effectively manage the project NorthStar anticipates regular meetings for the duration of the project with the City to review project progress and activities.
QUALITY ASSURANCE / QUALITY CONTROL
NorthStar’s approach to quality assurance and control program has been developed over the course of performing engineering consulting services for a variety of clients and complex projects over the past 40 years.
