SUMMARY:

The City Council is being asked to review the draft Water and Sewer Rate Study recommendations and provide direction on the proposed water and sewer rate schedules. The information will be presented by the City’s consultant, Alison Lechowicz, with the firm LT Municipal Consultants.

BACKGROUND:

The City of Corning provides water and sewer service to a population of about 8,000 people via approximately 2,400 active water connections and 2,100 active sewer connections. Water and sewer services are funded entirely through monthly rates paid by customers. Water and sewer rates were last adjusted July 1, 2025. Water rates were increased by 10% and sewer rates were increased by 5%. The City Council has the authority to approve rate changes when necessary to ensure the financial stability of the Water and Sewer Enterprise Funds. The rate change and rate study process is governed by Proposition 218, which was added to the California Constitution in 1996. All property-related fees including water and sewer service fees must meet Proposition 218’s requirements for calculating, documenting, and adopting fees. The proposed water and sewer rates will also be subject to a majority protest public hearing anticipated to be held in June 2026.

ANALYSIS:

The Council received an introductory presentation to the rate study on March 10, 2026. Based on direction from the Council at that meeting, LTMC revised the original financial plan and prepared two additional financial plan options for each utility. LTMC used projected operating costs and capital improvement plan projections to develop 5-year rate structures that would support the needs of each utility and maintain adequate debt coverage for existing debt obligations. Currently, the City may be out of compliance with the rate covenant requirement as part of the 2017 refunding bonds. All financial plan options include the minimum increases needed to meet debt service coverage requirements in the first year of the rate study period.

In addition to funding operating costs and debt service, the City would like to fund about $1.5M of water system capital projects over the next five years consisting of:
 Meter replacements ($125,000)
 Fire Hydrant replacements ($100,000)
 Well Maintenance ($412,700)
 Main Replacements ($735,000)
 Cross Connection Control Hazard Assessment ($125,000) Sewer system capital projects total $2.6 million and consist of:
 $835,000 of wastewater treatment plant upgrades: Oxidation Ditch Aerator, Gravity Thickener, rehab of sludge drying beds
 $1.4M of collection system improvements: pipelines and manholes ITEM: J-1

REQUEST FOR COUNCIL INPUT

AND CONSIDERATION ON THE

PROPOSED WATER AND

SEWER RATE STUDY
April 28, 2026
TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: BRANT MESKER, CITY MANAGER

ALISON LECHOWICZ, LT MUNICIPAL CONSULTANTS
 $355,000 of other projects: main extensions, CCTV, lift station repairs The rate study also proposes rate structure adjustments to better comply with Proposition 218 requirements and recent court rulings.

Currently, water customers are charged a base fee by meter size that includes the first 4,000 gallons of usage, with additional usage billed at a volume rate per 1,000 gallons. It is proposed that water meter fees no longer include any usage, and all water consumption instead be billed at the volume rate. This change benefits low water users who consume less than 4,000 gallons each month. It is also proposed that the 5/8” meter size, 3/4” meter size, and 1” meter size be combined into one category as the 1” meter size is the standard for new residential construction in California.

Sewer customers are currently charged flat monthly fees based on land use type. Many rate categories have either no customers or very few. It is proposed that the sewer rate structure be simplified by grouping customers into categories based on typical usage and wastewater strength.

Residential customers would be classified as single-family, multifamily, or mobile home, where multifamily and mobile home customers would be charged at a lower rate than single family customers due to lower average sewer flow. Commercial customers would be categorized as low, medium, or high strength users based on business type and typical flow and pollutant characteristics. Under the proposed rates, residential sewer customers would continue to pay a fixed monthly fee. Commercial sewer customers would pay a base fee that includes the first 5,000 gallons of usage, with an excessive flow charge applied to usage above 5,000 gallons.

A summary of rate plan options are as follows:

Option 1:
• No CIP or CIP is grant funded. Increases to meet debt service coverage in 1st year of rate study period, followed by inflationary increases.

Option 2:
• Rate funds $1.5M water CIP and $2.6M sewer CIP
• Consistent or lower increases in later years of rate study period • Water option 2 reflects lower rate increases of 11% in years 2-4 of the rate study period, compared to the 13% increases presented at the March 10 City Council meeting. While the revised option continues to fund the CIP, the ending reserve balance in year 5 falls slightly short of the target by about $2,300. The first year rate increase remains at 15%, which is the minimum needed to meet debt service coverage requirements. • Sewer option 2 proposes the same rate increases as previously presented during March 10 City Council meeting.

Option 3:
• Rate funds $1.5M water CIP and $2.6M sewer CIP
• Phases in higher % increases in later years of the rate study period.

RECOMMENDATION:

Staff respectfully recommend that the City Council move forward with one of the following options:

1. The City Council can direct staff to move forward by selecting a rate plan option and formalizing new rates as proposed. The rate consultant will draft a rate study report describing the rates as proposed and begin the Proposition 218 public notification process.

2. The City Council can direct staff to make changes to the rate plan options as proposed. The rate consultant will return on May 12 with revised results for the City Council to review and formalize the revised rates into a draft rate study report. Please note this may delay rate implementation beyond the anticipated July 1, 2026 proposed date.

3. The City Council can elect not to move forward with new rates on the Water or Sewer System. This would require adjustments of either operational costs or capital costs to keep the system operating with the required net income to support debt service obligations.

AUTHORIZE THE CITY MANAGER TO

SIGN A CONTRACT WITH BUREAU
VERITAS NORTH AMERICA FOR ONCALL BUILDING RELATED

SERVICES THROUGH NOVEMBER
30, 2027
April 28, 2026
TO: HONORABLE MAYOR AND COUNCILMEMBERS
FROM: BENJAMIN MIERZWAK, BUILDING OFFICIAL

BRANT MESKER, CITY MANAGER

RUBI ORDAZ, CITY CLERK
SUMMARY:

The City has historically relied on qualified consultants to provide building-related services on an as-needed basis to supplement in-house capacity and maintain service levels.

This approach will be formalized by establishing individual contracts with multiple consultants, each operating under their own agreement for on-call support.

This contract is specifically with Bureau Veritas North America (Attachment 1), a firm with expertise in building plan review and related services. Maintaining separate contracts allows the City to build a pool of pre-qualified professionals who can be engaged as demand fluctuates. This structure provides flexibility in assigning work, supports competitive selection based on project needs, and ensures accountability at the consultant level.

It also enables the City to deliver accurate, consistent, and timely plan review services, while supporting other building-related functions when necessary.

FINANCIAL:

The financial impact of this agreement is structured to be on an as-needed basis, with no fixed or ongoing cost to the City unless services are utilized. This allows the City to manage expenditures in direct proportion to workload demands, avoiding the financial burden of maintaining additional full-time staffing during periods of fluctuating permit activity.

Costs associated with consultant plan review services are fully offset through the City’s adopted fee schedule. In accordance with the Book of Fees, outside plan review services are billed at 120% of the standard building plan review fee. This structure is intended to recover the full cost of consultant services, including administrative overhead, thereby minimizing any financial impact to the General Fund.

RECOMMENDATION:

MAYOR AND CITY COUNCIL:
• AUTHORIZE THE CITY MANAGER TO SIGN A CONTRACT WITH BUREAU

VERITAS NORTH AMERICA FOR ON-CALL BUILDING RELATED SERVICES THROUGH NOVEMBER 30, 2027.

ATTACHMENTS:

Attachment 1- Contract for services with Bureau Veritas North America

APPROVE AGREEMENT WITH BEN’S
TRUCKING & EQUIPMENT, INC. FOR THE

EMERGENCY RESPONSE SERVICES FOR

THE CITY PLAZA AND RECREATION

CENTER PROJECT
APRIL 28, 2026
TO: CITY COUNCIL OF THE CITY OF CORNING
FROM: BRANT MESKER, CITY MANAGER

ELIJAH STANLEY, PUBLIC WORKS DIRECTOR
BACKGROUND:

During site demolition at the City Plaza project site, tanks containing an unknown substance were discovered. At this time, the size of the tanks and the quantity and nature of the material contained within them are unknown.

Staff notified the Tehama County Environmental Health Department upon discovery and coordinated with the County to determine next steps for remediation. Testing of the tank contents is required to identify appropriate handling, removal, and disposal procedures. Based on the test results, the County will provide further direction regarding disposal requirements and any necessary soil remediation.

SUMMARY:

To ensure compliance with environmental regulations and to avoid delays to the City Plaza and Recreation Center projects, staff has engaged an approved environmental contractor to perform the required services.

The scope of work includes sampling and testing the tank contents, removal and proper disposal of the tanks, and soil remediation if required by the Tehama County Environmental Health Department. Because both the size of the tanks and the quantity and nature of the material inside are currently unknown, the agreement is structured on a time and materials basis.

Approval of this agreement will allow the City to respond promptly to regulatory requirements and maintain the project schedule. Delays in authorizing this work could result in construction interruptions and potential additional costs.

RECOMMENDATION:

MAYOR AND COUNCIL:
• PROJECT SITE UPDATE TO COUNCIL

APPROVE AGREEMENT WITH MID
PACIFIC ENGINEERING, INC. FOR THE

SPECIAL INSPECTION SERVICES FOR

THE CITY PLAZA AND RECREATION

CENTER PROJECT IN THE AMOUNT OF
$50,708.38
APRIL 28, 2026
TO: CITY COUNCIL OF THE CITY OF CORNING
FROM: BRANT MESKER, CITY MANAGER

ELIJAH STANLEY, PUBLIC WORKS DIRECTOR
SUMMARY:

Staff solicited proposals from multiple special inspection firms for the City Plaza Project. In accordance with the California Uniform Public Construction Cost Accounting Act, the City is authorized to obtain informal quotes for public works projects under $60,000. The City received three quotes, which are summarized below.

Company Bid Amount
Mid Pacific Engineering, Inc. $50,708.38
MT Hall & Associates $52,665.00
NV5 $77,930.80
Following a comprehensive review, staff determined that Mid Pacific Engineering, Inc. submitted the lowest responsive quote. Attached for Council’s review is the proposed agreement with Mid Pacific Engineering, Inc.

BACKGROUND:

At the March 4, 2026, City Council meeting, Council authorized staff to award the City Plaza and Recreation Center construction contract to Ginno Construction in the amount of $9,772,000.

As part of construction, the project is subject to required special inspections for applicable structural and life-safety components in accordance with the California Building Code.

Special inspections provide independent verification that key structural and life-safety components are constructed in accordance with approved plans and applicable building codes.

Because elements such as concrete placement, reinforcing steel, welding, and soil compaction cannot be fully verified after installation, these inspections ensure compliance is confirmed during construction. This process provides an additional level of quality assurance, supports regulatory requirements, and helps protect public safety and the City’s investment in the project.

FINANCIAL IMPACT:

The City Plaza Project is primarily funded through Proposition 68 Grant funds, Community Development Block Grant (CDBG) funds, and City Park Land Development Funds. The recommended contract for special inspection services will be allocated within the grant funding.

RECOMMENDATION:

MAYOR AND COUNCIL:
• APPROVE THE AGREEMENT AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE AGREEMENT WITH MID PACIFIC ENGINEERING, INC. FOR

SPECIAL INSPECTION SERVICES FOR THE CITY PLAZA AND
RECREATION CENTER PROJECT IN THE AMOUNT OF $50,708.38.

AGREEMENT
THIS AGREEMENT IS MADE AND ENTERED INTO as of this 29 day of April 2026, by and between the City of Corning, a Municipal Corporation, hereinafter referred to as “City” and Mid Pacific Engineering, INC., hereinafter referred to as “Consultant”. It is hereby agreed by and between the parties that Consultant shall perform the special inspection services for the City of Corning Plaza and Recreation Center Project, as hereinafter more particularly described hereafter.

1. CONSULTANT’S OBLIGATION:
a. Consultant shall perform the special inspection services for the City of Corning Plaza and Recreation Center project. All services shall be completed safely, in a professional and workmanlike manner, using approved materials and methods. The project location and services are further described in Exhibit A attached hereto and incorporated by this reference. The City reserves unto itself the right to reject any or all performance hereunder and to require follow-up services to the City’s satisfaction and without further compensation.
b. Consultant shall, during the term of this Contract, maintain a valid City of Corning Business License.

2. COMPENSATION / TERM
For those services as outlined in Special Inspection – Scope of Work a. hereto the City shall pay to Consultant a not-to-exceed amount of $50,708.38 unless terminated under Section 3.
b. City will pay Consultant, upon completion of the project. However, should performance not be satisfactory as determined by the Public Works Director, as hereinafter specified, the City may retain and use such funds as the Public Works Director deems appropriate for purposes of ensuring proper performance and/or hiring other general engineering companies to complete the contract to the City’s satisfaction.

3. TERMINATION:

Should consultant fail to perform satisfactorily as herein set forth, City reserves to itself the right to cancel any remaining portion of said contract upon thirty days written notice to Consultant, by notice in writing provided to Consultant at his usual place of business. Should Consultant breach any of the terms and conditions of this contract, or violate any laws, especially those relative to negligent behavior that puts the public at risk, the City reserves unto itself the right to direct Consultant to immediately cease performance and then terminate this contract thereafter, upon thirty days written notice, and pay consultant such amounts as he may then be entitled to on a pro-rata basis (pro-rated according to amount of work satisfactorily completed).

4. PAYMENTS:

The acceptance of the final payment by the Consultant shall constitute a waiver of all claims by him.

5. SUSPENSION OF WORK:

The Public Works Director shall have authority to suspend the work wholly or in part for such period as he may deem necessary to investigate complaints regarding improper or unsafe use of equipment.

6. AUTHORITY OF DIRECTOR OF PUBLIC WORKS:

The Public Works Director shall be the City’s representative in deciding any and all questions that may arise as to the quality or acceptability of the work performed, all questions that arise as to the acceptable fulfillment of the contract on the part of the Consultant, and all questions as to claims and compensation. The City Manager also is authorized to act as the City’s representative at any time with respect to this agreement. Consultant is an independent consultant; therefore the City will not be supervising the work performed or directing Consultant how to do his work but will be expecting the Consultant to perform all work agreed upon in a safe and professional manner according to the terms of this agreement.

7. LAWS TO BE OBSERVED:

The Consultant shall keep himself fully informed of all State, Federal and Municipal Ordinances and/or regulations of the City of Corning which in any manner affect those engaged in or employed in the work, or the materials used in the work, or which in any way affect the conduct of the work and of all such orders and decrees of bodies or tribunals having any jurisdiction or authority over the same. Consultant must comply with all provisions of the Immigration Reform and Control Act and of the California Labor Code which includes the requirements of the prevailing wage laws and the obligation to register with the Department of Industrial Relations.

8. PREVAILING WAGE:

Pursuant to Section 1770 et seq. of the Labor Code the Consultant for the work will be required to pay, at least, the general prevailing wage rates as determined by the Director of the Department of Industrial Relations of the State of California. Questions pertaining to the general prevailing wage rates should be directed to the Division of Labor Statistics and Research, P.O. Box 603, San Francisco, CA 94101. A failure to pay the required prevailing wage may result in a penalty through forfeiture as set forth in Labor Code section 1775.

9. LABOR DISCRIMINATION:

No discrimination shall be made in the employment of persons in this project because of race, religious creed, color, national origin, ancestry, physical handicap, medical condition, marital status or sex of such persons. Violation of this section shall subject Consultant to penalties referenced in Section 1735 of the Labor Code.

10. RESPONSIBILITY FOR DAMAGES:

Neither the City of Corning, the City Council, nor the City Staff, shall be responsible or accountable in any manner for any loss or damage that may happen during the work or any part thereof; or for any materials or equipment used in performing the work; or for injury or damage to any person or persons, either workers or the public; or for damage to adjoining property from any cause whatsoever.

11. LIABILITY INSURANCE:

The Consultant shall secure and maintain in full force and effect, during the term of this agreement and for one year thereafter, a valid comprehensive public liability and property damage insurance policy listing the City as additional insured in the following amounts:
a. $2,000,000.00 for death or injury to any person arising out of any incident or accident; b. $50,000.00 for property damage arising out of any one incident or accident.

12. WORKMAN’S COMPENSATION INSURANCE:

Consultant at all times shall keep fully insured, at his own expense, all persons employed by him in connection with this Agreement as required by Workman’s Compensation and Insurance (California Labor Code Section 3200 et seq.), and shall hold the City free and harmless from all liabilities that may arise by reason of the injuries to any of the employees of the Consultant who are injured while performing at work any labor necessary to carry out the provisions of this agreement.

13. CERTIFICATION OF INSURANCE AND CANCELLATION THEREOF:

The Consultant shall keep on file with the City a Certificate of Insurance duly executed by the Consultant’s insurance carrier or carriers, which shall serve as evidence of the continued existence of said insurance policies. The Consultant’s insurance carriers shall be required to give the City thirty (30) days written notice prior to the cancellation of the Consultant’s Insurance.

14. INDEMNITY, DEFENSE AND HOLD HARMLESS:

The Consultant shall indemnify, defend and save harmless the City of Corning, the City Council, and the City Staff from any suits, claims, liability, loss, damages, fines, penalties, settlements or actions brought by any person or entity for, or on account of, any injuries or damage arising from, or related to in any way, the work performed, or not performed, as set forth in this contract no matter how removed. The City may retain so much of the money due the Consultant as shall be considered necessary until disposition has been made of such suits or claims for damages as aforesaid.

Any defense obligation arising from this contract requires retention of qualified legal counsel of no less than five years of experience in the area of contract litigation.

15. ACCIDENTS:

The Consultant shall provide at the site of the project such equipment and medical facilities as are necessary to supply first aid service to anyone who may be injured in connection with the work.

The Consultant must promptly report in writing to the city all accidents whatsoever arising out of, or in connection with the performance of the work, whether on or adjacent to the job site, which caused death, personal injury, or property damages, giving full details and statements of witnesses. In addition, if death or serious injuries or serious damages are caused, the accident shall be reported to the City immediately by telephone or messenger.

16. SAFETY:

In accordance with generally accepted practices, the Consultant will be solely and completely responsible for the conditions of the job site(s), including safety of all persons and property during the performance of the work. This requirement will apply continuously and not be limited to normal working hours.

17. CONSULTANT AGREEMENT:

Consultant agrees to perform the services between the hours of 7:00 a.m., and 6:00 p.m., on any day.

18. NON-EMPLOYEE STATUS:

Consultant agrees and affirms that nothing in this agreement causes or creates an employer/employee relationship between City and Consultant.

Materials Engineering and Testing and Special Inspection Services Proposal

CORNING PLAZA AND RECREATIONAL FACILITY
1101 Solano Street
Corning, California
MPE Proposal No. 26-0294
As requested, Mid Pacific Engineering, Inc. (MPE) is pleased to submit this proposal to provide materials engineering and testing, and special inspection services for the proposed Corning Plaza and Recreational Facility project located in Corning, California. To assist in the preparation of this proposal we have reviewed the Geotechnical Investigation prepared for the project by Geocon (Geocon No. E9381-04-01, dated October 31, 2023), the provided project plans and the Testing and Inspection Form prepared by ZFA Structural Engineers.

Further, we have discussed the project with Mr. Bryan Ginno of Ginno Construction.

Based on our review of the Geotechnical Investigation, the project plans, the Testing and Inspection Form, our conversations with Mr. Ginno and our experience with similar projects, we estimate our fees to complete this project to be $50,708 as outlined in the attached budget estimate. The amount of time spent on this project by our representatives is dependent on the rate and quality of work performed by the subcontractors, as well as the number of requested site visits. We understand that this project falls under the California Prevailing Wage laws and requirements, therefore, actual billing will be based on the work performed and determined using the attached 2026.4 Preferred Fee Schedule. Work requested beyond the anticipated scope of services would be billed on a time and expense basis using the attached Fee Schedule.

To ensure that all parties fully understand the limitations of our role in your project, we emphasize that our representative will not act as supervisor of construction, nor will we direct construction operations. The various subcontractors should be informed that neither the presence of our representative nor the testing by our firm shall excuse them for defects discovered in their work. Job and site safety of the contractor's personnel will be the sole responsibility of the contractor.

AUTHORIZATION OF REPAIRS FOR
FIRE ENGINE 3 AND BUDGET

ADJUSTMENT
April 28, 2026
TO: HONORABLE MAYOR AND COUNCILMEMBERS
FROM: BRANT MESKER, CITY MANAGER

TOM TOMLINSON, FIRE CHIEF
SUMMARY:

Fire Engine 3 (Ladder Truck) recently experienced mechanical failure requiring immediate attention to ensure continued operational readiness and public safety response capability.

Upon inspection, it was determined that multiple components required repair and replacement.

The repairs to Fire Engine 3 included the following:
• Failure of the waterway system, which required repair; • Replacement of the braking system, including new brakes, discs, and rotors; • Rebuilding of the cylinder to restore proper functionality.

Due to the complexity of the repairs, the majority of the total cost is attributed to labor.

These repairs were necessary to return the apparatus to safe and reliable operating condition and to prevent further mechanical issues.

Staff is requesting to utilize Section 3.12.082(A)(6) of the City’s Purchasing Policy, allowing the repairs to not be formally bid. Due to the specialized nature of fire apparatus repair and the need to return Fire Engine 3 to service as quickly as possible, the City’s needs are best met by working directly with a qualified vendor familiar with the equipment.

This approach ensures timely repairs and reliable workmanship at a reasonable cost.

FISCAL IMPACT:

Sufficient funds are not currently available within the Fire Department Vehicle Maintenance budget (001-2300-6350) to fully cover these unanticipated repairs.

However, funds remain available in the Fire Department Painting/Repair budget (174- 2300-6353) from the completed fire station paint project.

Staff is recommending a budget transfer in the amount of $31,780 from Fire Department Painting/Repair budget (174-2300-6353) to Fire Department Vehicle Maintenance budget (001-2300-6350) to cover the cost of these repairs.

RECOMMENDATION:
• CITY COUNCIL DETERMINES THAT THIS PURCHASE IS EXEMPT FROM THE CITY’S PURCHASING POLICY PER SECTION 3.12.082 A-6 OF THE CORNING

MUNICIPAL CODE
• AUTHORIZE THE BUDGET TRANSFER IN THE AMOUNT OF $31,780 FROM FIRE DEPARTMENT PAINTING/REPAIR BUDGET (174-2300-6353) TO FIRE DEPARTMENT VEHICLE MAINTENANCE BUDGET (001-2300-6350)
• APPROVE THE PURCHASE ORDER AND PAYMENT IN THE AMOUNT OF $31,779.87 TO HI-TECH EVS, INC FOR NECESSARY REPAIRS.
