BACKGROUND
CUP2021-0003 is an application to establish a liquor store within an existing multi-tenant commercial building located at 490 N. The Specific Plan permits liquor stores within the CR designation by a conditional use permit.

The applicant is Ryan Morrissey, and the proposed business on the project site is Happiest Ours Wine and Spirits. The proposed liquor store is located within the Metro at Main mixed-use center, which was constructed between 2014 through 2017. The Metro at Main mixed-use center was approved under Precise Plan 12-005 (PP12-005). The center is developed with 293 apartments and 77,256 square feet of commercial space.

The applicant submitted the CUP application to the city on November 30, 2021. The application was reviewed by city staff at the Project and Environmental Review Committee meeting on December 22, 2021. The Committee deemed the application complete, and the application was subsequently scheduled for the February 7, 2022 Planning and Housing Commission meeting.

PROJECT DESCRIPTION
Site Plan
As shown on Exhibit 3, the subject site is situated near the northerly border of the mixed-use center.

It is surrounded to the west, south and east by other commercial tenants that are within the same center. The businesses consist of eating establishments, retail and general services. Also located to the south are apartment units, which are part of the mixed-use development. Located to the north on the other side of Rincon Street is an apartment complex and an auto repair and service business.

To the west of the mixed-use center is an industrial development.

Floor Plan
Exhibit 5 depicts the proposed liquor store’s floor plan, which consists of product display cases near the front of the store along with a wall of refrigerator for product storage on one side and a built-in wine and spirit storage on the opposite wall. The interior layout provides a 94 square-foot tasting area with two tables, eight chairs, and a mobile bar where product demonstrations and tasting will take place.

Operation
The store intends to sell artisanal wine, distilled spirits, and beer from local, regional, and national producers. The store will also sell cocktail recipes, garnishes, mixers, glassware, barware, and other accompaniments that are used for cocktails. Instructional tastings and demonstrations will also be offered at the store. The store intends to operate under two license types from the Department of Alcohol Beverage Control:
· Type 21, which allows for sale of beer, wine and distilled spirits for off-site consumption, and · Type 86, which allows for instructional tasting for beer, wine, and distilled spirits at off-sale licensed establishment. This license has a set limit on the quantity and number of tastings that may be offered to consumers.

The applicant’s proposed operating hours are 9:00 AM to 11:00 PM daily. The applicant submitted a letter and a business summary (Exhibits 6 and 7) to provide an overview of the business operation.

Access and Parking
The mixed-use center has three points of vehicle access from the surrounding streets. One driveway is located on Rincon Street, near the subject building. A second driveway is located near Main Street, and a third driveway is located on Harrison Street. The driveways are shared among the residential City of Corona Page 2 of 5 Printed on 2/2/2022
powered by Legistar™
File #: 22-0111
and commercial tenants within the center.

The center currently has 876 parking spaces on-site, which are also shared among the residential and commercial tenants. The center’s compliance with the municipal code’s parking requirements was originally reviewed through the original precise plan process (PP12-005). The proposed liquor store use will not change or impact the center’s compliance with the parking codes, as this CUP application does not involve any expansion to the building or removal of any parking spaces.

ENVIRONMENTAL ANALYSIS
Per Section 15301 of the State Guidelines for Implementing the California Environmental Quality Act (CEQA) and Section 3.21 of the City’s Local CEQA Guidelines, a Notice of Exemption has been prepared for the project because the project qualifies as a Class 1 (Existing Facilities) categorical exemption. The project consists of establishing a liquor store within an existing commercial building, no expansion to the existing commercial building is proposed with this project. Approval of this project will only establish the right to operate a liquor store within an existing commercial building.

The Notice of Exemption is attached as Exhibit 8.

FISCAL IMPACT
The applicant has paid the applicable application processing fees for the project.

PUBLIC NOTICE AND COMMENTS
A 10-day public notice was mailed to all property owners within a 500-foot radius of the project site, as well as advertised in the Sentinel Weekly News and posted at the project site. As of the preparation of this report, staff has not received any inquiries regarding the proposed liquor store operation (CUP2021-0003).

STAFF ANALYSIS
CUP2021-0003 will allow for the establishment of a liquor store within an existing multi-tenant commercial building within the Metro at Main mixed-use center. The site’s zoning of Commercial Retail allows the use with the approval of a conditional use permit. The use will be contained entirely within the building and will not impact the center’s required parking or access. While there are residential uses within the project site and to the north of the project site, the area also includes commercial uses that are intended to serve the public. Therefore, the site is appropriate for the proposed use and is compatible with other commercial land uses in the area.

Per the North Main Street Specific Plan, the intent of the Commercial Retail designation is to attract a mix of general uses that service both residents and businesses nearby. The applicant’s proposed use contributes to this goal, as the store will not only offer the sale of liquor to the immediate community, but it will also offer an educational component through tastings and demonstrations.

Therefore, the Planning Division recommends approval of CUP2021-0003, based on the findings listed below and staff’s recommended conditions of approval attached as Exhibit 4.

FINDINGS OF APPROVAL FOR CUP2021-0003

1. A preliminary exemption assessment has been conducted by the City of Corona and it has shown that this project does not require further environmental assessment because the City of Corona Page 3 of 5 Printed on 2/2/2022

3.21 of the City’s Local CEQA Guidelines. The project consists of establishing and operating a liquor store within an existing commercial building. The liquor store will be contained entirely within the existing commercial building, no expansion is proposed to the commercial building. Therefore, there is no possibility that the project will have a significant effect on the environment.

2. All the conditions necessary for granting a Conditional Use Permit as set forth in Section

17.92.110 of the Corona Municipal Code do exist in reference to CUP2021-0003 for the following reasons:
a. The proposed liquor store will not cause any detrimental impact to the public health, safety, convenience of general welfare because the project site is a fully developed mixed-use development with adequate vehicular access from the surrounding roadways.
b. The proposed use will not be detrimental to other existing and permitted uses in the general area because the proposed operation will be conducted entirely within an existing commercial building which complied with all applicable development standards that existed at the time the mixed-use center was developed. Furthermore, the proposed use will be required to demonstrate compliance with applicable building and fire codes that are applicable to the proposed use through the city’s plan check process, and the business is required to comply with the state’s regulation regarding the sale of alcohol beverages and shall first obtain a permit from the Department of Alcohol Beverage Control prior to operation.

3. The proposal is consistent with the General Plan for the following reasons:
a. The proposed project contributes to the achievement of General Plan Goal LU-1, Policies 1.1 and 1.2 which encourage having a comprehensive range of uses in the City that provide services to meet the diverse needs of Corona’s residents, create a selfsustaining community and minimize the need for residents to travel to surrounding communities for retail goods and services.
b. The proposed project is consistent with General Plan Goal LU-11, Policies 11.1 and 11.7 as the conditional use permit review process is a mechanism to regulate the location and number of alcohol sales, adult business, game arcade, and other “communitysensitive” uses based on the proximity to other such uses, residence, schools, parks, and religious facilities, consistent with State statutory requirements.

4. The proposal is consistent with the CR (Commercial Retail) designation of the North Main Street Specific Plan (SP99-01) for the following reason:
a. The proposed project complies with the CR designation of the North Main Street City of Corona Page 4 of 5 Printed on 2/2/2022
