SUBJECT:
Agreements for Public Improvement and Survey Monumentation for Tract Map 33505 located on the west side of Jameson Road and south of Lowry Ranch Road, and release of the existing securities posted by the previous owner of Tract Map 33505. (Applicant: JD Builders Group, LLC) EXECUTIVE SUMMARY:
JD Builders Group, LLC is the current owner of 10 vacant residential lots associated with Tract Map 33505 and is required to post securities and enter into an agreement with the City for the construction of future public improvements and survey monumentation. Additionally, the request will release the same securities posted by the previous property owner, which are being replaced with new securities posted by the applicant.
RECOMMENDED ACTION:
That the City Council:
a. Authorize the Mayor to execute Public Improvement and Survey Monumentation Agreements between the City and JD Builders Group, LLC, a California limited liability company. b. Authorize the Mayor to release the existing Public Improvement and Survey Monumentation securities and accept the replacement securities posted by JD Builders Group, LLC.
BACKGROUND & HISTORY:
Tract Map 33505 is a single-phase subdivision of 10.1 acres, approved by the City Council on February 7, 2007, for the development of 10 single-family residential lots. The project is located on the west side of Jameson Road and south of Lowry Ranch Road as shown on Exhibit 1.
The original developers of the project site, David C. and Catherine D. Hall, and Ann J. Dunham, recorded the tract map and posted cash securities for the Faithfull Performance and Labor and Material in the amount of $135,000 and $67,500, respectively. the amount of $4,095 for the Survey Monumentation.
On January 25, 2013, the original owners sold the project to Carole A. Follman, as trustee under the declaration of Trust of Robert J. Follman and Carole A. Follman, dated August 14, 1979.
JD Builders Group, LLC recently purchased the property form Carole A. Follman. The new owner entered into an assignment agreement with the previous owner that will assign the rights of the previously posted securities to the current owner. The City Attorney’s Office has reviewed the assignment agreement, which allows the City to release the previously posted securities to the current owner.
ANALYSIS:
JD Builders Group, LLC posted new securities for the public improvements and survey monumentation for Tract Map 33505. The new securities will replace the existing securities posted by the previous owners, which are shown in the following tables.

FINANCIAL IMPACT:
All applicable fees have been paid by the developer.
ENVIRONMENTAL ANALYSIS:
The posting of the securities for public improvement and survey monumentation is not considered a project under the California Environmental Quality Act. Therefore, no environmental analysis is required.
