REQUEST FOR CITY COUNCIL ACTION
DATE: 04/06/2022
TO: Honorable Mayor and City Council Members
FROM: Public Works Department
SUBJECT:
Release of lien recorded against the property located at 1157 E. Chase Drive, identified as Riverside County Assessor's Parcel Numbers 120-112-009, in connection with a Lien Agreement to secure the construction of public improvements.
EXECUTIVE SUMMARY:
The current property owner at 1157 E. Chase Drive is in the process of selling his home and requests the City to release a lien, which has been recorded against the property since 1984. The lien was a mechanism for the property owner, at that time, to defer public improvements, which were a condition of development that would carry on to future property owners until the obligations have been met. Recently, the City was awarded a grant that includes public improvements in this area of the community, including at the property, which will be used to offset the property owner's obligations for the public improvements. The City Council will consider releasing the lien with payment of the remaining lien obligation.
RECOMMENDED ACTION:
That the City Council:
a. Authorize the City Manager to execute a Release of Public Improvement Lien related to a Lien Agreement to Secure Construction of Public Improvements recorded against 1157 E. Chase Drive, identified as Riverside County Assessor's Parcel Number 120-112-009. b. Direct the City Clerk to record said Release of Public Improvement Lien at the Office of the County Recorder of Riverside County.
BACKGROUND & HISTORY:
On April 10, 1984, George B. Thacker and Joan Carol Thacker entered into a Lien Agreement with the City to secure the construction of certain public improvements, such as curb, gutter, sidewalk, driveway reconstruction, and other appurtenances associated with the development of 1157 E. driveway reconstruction, and other appurtenances associated with the development of 1157 E. Chase Drive. The project is located on the northwest corner of E. Chase Drive Thacker Drive, as shown on Exhibit "1." On the date that the Lien Agreement was executed, the cost of constructing the public improvements and performing inspection services was estimated at approximately $19,200.
ANALYSIS:
Through subsequent private transactions, the subject property is now owned by Mr. Wesley Jones, who is in the process of selling the property and has requested that the City accept a cash payment equal to the estimated cost of constructing the public improvement and release the lien from title on the property.
Concurrently, the City was recently awarded a grant for the Chase Sidewalk Gap Improvement project that will fund most of the public improvements in this area. The improvements will include constructing curb, gutter, sidewalk, driveway reconstruction, and other appurtenances along the entire frontage of the property. The estimated cost of the public improvements, after applying for the credit from the grant, is $12,364. The cash payment of the fair share amount, including administrative fees, was provided to the City on March 17, 2022.
City staff recommends that the lien against the subject property be released by authorizing the City Manager to execute the attached Release of Public Improvement Lien and directing the City Clerk to record it in the official records of the County of Riverside.
FINANCIAL IMPACT:
There is no fiscal impact on City resources as the property owner has paid the necessary fee to process the lien removal.
ENVIRONMENTAL ANALYSIS:
This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action merely releases the current lien associated with the property. Since there is no possibility that adopting this action will have a significant effect on the environment, no environmental analysis is required.
