REQUEST FOR CITY COUNCIL ACTION
DATE: 06/01/2022
TO: Honorable Mayor and City Council Members
FROM: Public Works Department
SUBJECT:
Release of lien recorded against the properties, identified in Document No. 2001-574936 and Document No. 2013-0453391 in connection with Lien Agreements to secure the construction of public improvements.
EXECUTIVE SUMMARY:
Property owners, Betzalel and Anat Louk, entered into various lien agreements to secure the construction of certain public improvements associated with the development of their properties.
They have recently completed real estate transactions and are now requesting the release of liens on the completed public improvements. The property owner has satisfied the requirements of the lien agreements by completing the construction of the public improvements; therefore, staff recommends that the City Council consider the release of the liens.
RECOMMENDED ACTION:
That the City Council:
a. Authorize the City Manager to execute a Release of Public Improvement Lien related to Lien Agreements to Secure Construction of Public Improvements recorded in Document No. 2001- 574936 and Document No. 2013-0453391.
b. Direct the City Clerk to record said Release of Public Improvement Liens at the Office of the County Recorder of Riverside County.
BACKGROUND & HISTORY:
On November 07, 2001, May 20, 2009, and June 25, 2013, Betzalel and Anat Louk entered into Lien Agreements with the City associated with Document Nos. 2001-574936, 2009-0276789, and 2013- 0453391, respectively, to secure the construction of certain public improvements, such as curb, gutter, sidewalk, driveway reconstruction, and other appurtenances associated with the development City of Corona Page 1 of 2 Printed on 5/26/2022

gutter, sidewalk, driveway reconstruction, and other appurtenances associated with the development of their properties. The liens serve as a mechanism for the property owner to defer public improvements, that were a condition of development, to a future time until the obligations had been met.
The properties are located on the northwest corner of Lester Avenue and Golden Harvest.
ANALYSIS:
On October 21, 2020, the City Council accepted the public improvements for the property owner as the improvements have been completed. However, the staff report only released the Lien Agreement associated with Document No. 2009-0276789. Two other associated Lien Agreements, now included in this staff report, should have been included in the Release of Lien request to finalize the release.
All three liens are still identified in the Preliminary Title Reports on the properties. Betzalel and Anat Louk are requesting the release of Lien Agreements associated with this staff report and to continue processing the Release of Lien that was already approved by the City Council on October 21, 2020.
City staff recommends that the lien against the subject properties be released by authorizing the City Manager to execute the attached Release of Public Improvement Lien and directing the City Clerk to record it in the official records of the County of Riverside.
FINANCIAL IMPACT:
There is no fiscal impact on City resources as the property owner has already paid for the release of the Lien Agreement.
ENVIRONMENTAL ANALYSIS:
This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the commonsense exemption that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action merely releases the current liens associated with the properties. Since there is no possibility that adopting this action will have a significant effect on the environment, no environmental analysis is required.
