REQUEST FOR CITY COUNCIL AND

CORONA UTILITY AUTHORITY ACTION
DATE: 06/15/2022
TO: Honorable Mayor and City Council Members
Honorable President and Board Members
FROM: Utilities Department
SUBJECT:

Resolution Designating Certain Equipment and Products as “Sole Source” Products for Construction of Potable Water, Water Reclamation, and Reclaimed Water Facilities.

EXECUTIVE SUMMARY:

In 2013, the City Council adopted Resolution No. 2013-057 designating certain equipment and products as “sole source” products for construction of potable water, water reclamation, and reclaimed water facilities, and providing authority to the General Manager and City Attorney to update the list as needed. Due to the citywide reorganization, the Department of Water and Power was renamed to the Utilities Department, and the General Manager was renamed to the Director of Utilities. It is necessary to approve and adopt a resolution referencing the new title and updating the list of “sole source” products.

RECOMMENDED ACTION:

That the:
a. City Council adopt Resolution No. 2022-046, designating certain equipment and products as “sole source” products for construction of potable water, water reclamation, and reclaimed water facilities.
b. Corona Utility Authority (CUA) review, ratify, and to the extent necessary, direct that the City Council take the above action.

BACKGROUND & HISTORY:

On June 19, 2013, the City Council adopted Resolution No 2013-057 designating certain equipment and products as “sole source” products for construction of potable water, water reclamation, and City of Corona Page 1 of 3 Printed on 6/9/2022

and products as “sole source” products for construction of potable water, water reclamation, and reclaimed water facilities. The sole source list is also considered an exclusive standard specification list. As part of this Resolution, the Department of Water and Power General Manager was authorized to update the list as needed with the City Attorney’s approval. During summer 2021, the City completed a reorganization, and the Department of Water and Power was renamed the Utilities Department, including renaming the General Manager as the Director of Utilities. It is necessary to update the Resolution to reflect the new Department name and title.

Further, on December 8, 2021, the Director of Utilities and the City Attorney presented to the Committee of the Whole about the “sole source” list and the authorized exceptions to the “or equal” contracting requirement. The “or equal” contracting requirement states that the City cannot require a designated material, product, thing, or service by specific brand or trade unless an “equal” of said item or service is allowed. At that time, the Committee of the Whole confirmed the continued use and delegation to staff for maintenance of the sole source specification list.

ANALYSIS:

The Utilities Department is presenting Resolution No. 2022-046 for City Council consideration to update the General Manager’s title to Director of Utilities, and it also includes an updated list of sole source specifications for potable water, water reclamation, and reclaimed water facilities. This updated list was determined based on staff’s review of the City’s current facilities, general contracts, plans, and specifications, and their identification of items needed to match the City’s equipment and products in use on the potable water, water reclamation, and reclaimed water facilities. The Resolution authorizes the Director of Utilities to review and update the list from time-to-time, in accordance with applicable laws, with the concurrence of the City Attorney.

FINANCIAL IMPACT:

There is no financial impact associated with the recommended action. All materials will be procured in compliance with the City’s Purchasing Policy and Corona Municipal Code Chapter 3.08 ENVIRONMENTAL ANALYSIS:

This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the commonsense exemption that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action is for the approval of a sole source or exclusive standard specification list and there is no possibility that adoption of Resolution No. 2022-046 will have a significant effect on the environment. Therefore, no environmental analysis is required.
