1 RESOLUTION NO. 2022-101
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CORONA, CALIFORNIA, ORDERING THE SUMMARY
VACATION OF 0.13 ACRES OF EXCESS CITY RIGHT-OFWAY ADJACENT TO 2785 PALISADES DRIVE.
WHEREAS, the City of Corona (“City”) has excess 0.13-acres of right-of-way property on Palisades Drive (“Excess ROW”), which is located immediately west of certain real property owned by Allsize Storage Corona, Inc. (“Allsize”) and identified as 2785 Palisades Drive, Corona (Assessor Parcel Number 101-170-045) and immediately south of certain real property owned by ASC 1.46 Acres, LLC (“ASC”) and designated as Assessor Parcel Number 101-170-044; and
WHEREAS, the City is planning to construct a new 24” sewer line, known as the Wardlow Road Sewer Relocation Project, which will run under the 91 freeway and through the Allsize property; and
WHEREAS, construction of the new 24” sewer line will require temporary construction easements on the Allsize property and the ASC property, which led to the City negotiating a purchase and sale agreement with Allsize and ASC that calls for the City’s conveyance of the Excess ROW to ASC in exchange for Allsize and ASC granting the temporary construction easements needed for the Wardlow Road Sewer Relocation Project; and WHEREAS, Palisades Drive is developed to its full-width configuration, and road widening improvements are not needed as the road enables adequate traffic circulation of pedestrians vehicles, emergency service vehicles, and City maintenance vehicles connecting to the Corona road network, and thus, the Excess ROW is considered excess right-of-way that is not needed for street or highway purposes; and
WHEREAS, these summary vacation proceedings are being conducted pursuant to the requirements of Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, which authorizes the City Council to summarily vacate excess right-of-way of a street or highway that is not required for street or highway purposes; and WHEREAS, pursuant to Section 8313 of the California Streets and Highways Code, the Planning and Housing Commission of the City of Corona, at its meeting on March 21, 2022, adopted Resolution 2586, which determined that the summary vacation of the Excess ROW is consistent with the City’s General Plan Circulation Element because Palisades Drive is constructed to its ultimate right-of-way width for a city collector street which provides a safe roadway design and sufficient capacity, and furthers the intent of Circulation Element Policy CE
1.3 which is to provide for safe roadway conditions by adhering to nationally recognized improvement standards and uniform construction and maintenance practices CA\JR\16000.65504\10265395.1

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CORONA, CALIFORNIA, AS FOLLOWS:
SECTION 1. Incorporation of Recitals. The above Recitals are true and correct and are incorporated herein by reference.
SECTION 2. Findings. The City Council finds that: (i) the Excess ROW is considered excess right-of-way because Palisades Drive is developed to its full-width configuration and the road provides adequate traffic circulation and connectivity to the Corona road network; and (ii) there are public utility facilities in use within the Excess ROW, but they will not be affected by the vacation of the Excess ROW because the grant deed conveying the Excess ROW to ASC reserves a public utility easement over the Excess ROW for all existing public utility facilities.
SECTION 3. Vacation of the Existing Right-of-Way. The City Council hereby summarily vacates the Excess ROW in accordance with Section 8334(a) of the California Streets and Highways Code.
SECTION 4. Effective Date. This Resolution shall be effective immediately.
SECTION 5. Recordation. The City Clerk shall cause a certified copy of this Resolution to be submitted to the escrow holder pursuant to the terms and conditions of the purchase and sale agreement between the City, Allsize, and ASC. The escrow holder will record this Resolution in the Riverside County Recorder’s Office. From and after the date this Resolution is recorded, the Excess ROW shall no longer constitute a street, highway, or public right-of-way.
PASSED, APPROVED AND ADOPTED this 6
th day of July 2022.
