WHEREAS, pursuant to State CEQA Guidelines section 15063, an Initial Study was prepared for the Project, which analyzed whether the Project may cause a significant effect on the environment; and
WHEREAS, the City determined that a Mitigated Negative Declaration (“MND”) should be prepared to analyze the Project’s potential environmental effects; and WHEREAS, on March 30, 2022, as required by CEQA, the City prepared and circulated for 30 days the Initial Study/MND for the Project and made the Initial Study/MND available to the public and all interested agencies and individuals; and WHEREAS, the Notice of Intent to adopt a MND was publicly noticed in the Sentinel Weekly, a local newspaper of general circulation, and made available to the public on March 30, 2022, for a 30-day comment period, which closed on April 29, 2022; and WHEREAS, the City Council, at its regularly scheduled public meeting on July 6, 2022, reviewed and considered the MND, the Initial Study, and the Mitigation Monitoring and Reporting Program, and adopted the MND and the Mitigation Monitoring and Reporting Program; and
WHEREAS, all findings and conclusions made by the City Council pursuant to 2 this Resolution are based upon the oral and written evidence before it as a whole; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CORONA, CALIFORNIA, AS FOLLOWS:
SECTION 1. Compliance with the California Environmental Quality Act. As the decision-making body for the Project, the City Council has reviewed and considered the information contained in the MND, Initial Study, and administrative record, which is on file with the City and available for review at the office of the City Clerk, City of Corona City Hall, 400 South Vicentia Avenue, Corona, California 92882. The City Council finds the MND and Initial Study have been completed in compliance with CEQA and the State CEQA Guidelines.
SECTION 2. Findings on Environmental Impacts. In the City’s role as the lead agency under CEQA, the City Council finds the MND and Initial Study contain a complete and accurate reporting of the environmental impacts associated with the Project. The City Council further finds the documents have been completed in compliance with CEQA, the State CEQA Guidelines, and the City’s local CEQA Guidelines. The City Council further finds that all environmental impacts of the Project are either insignificant or can be mitigated to a level of insignificance pursuant to the mitigation measures outlined in the MND, Initial Study, and Mitigation Monitoring and Reporting Program. The City Council further finds there is no substantial evidence in the record supporting a fair argument that the Project may result in significant environmental impacts. The City Council finds the MND contains a complete, objective, and accurate reporting of the environmental impacts associated with the Project and reflects the independent judgment of the City Council.
SECTION 3. Adoption of Mitigated Negative Declaration. The City Council hereby approves and adopts the MND prepared for the Project.
SECTION 4. Adoption of the Mitigation Monitoring and Reporting Program.
The City hereby approves and adopts the Mitigation Monitoring and Reporting Program prepared for the Project and included in the MND.
SECTION 5. Notice of Determination. The City Council directs staff to file a notice of determination with the Riverside County Clerk and the Governor’s Office of Planning and Research within five (5) working days of Project approval.
SECTION 6. Custodian of Records. The documents and materials that constitute the record of proceedings on which these findings are based are located at the office of the City Clerk, City of Corona City Hall, 400 South Vicentia Avenue, Corona, California 92882.
SECTION 7. Execution of Resolution. The City’s Mayor shall sign this Resolution and the City Clerk shall attest and certify to the passage and adoption thereof. 3 PASSED, APPROVED AND ADOPTED this 6th day of July, 2022. ____________________________________
