REQUEST FOR CITY COUNCIL ACTION
DATE: 07/06/2022
TO: Honorable Mayor and City Council Members
FROM: Planning and Development Department
SUBJECT:
Extension of time for Tentative Tract Map 36634 generally located west of Fullerton Avenue at Taber Street in the Medium Density Residential designation of the Corona Vista Specific Plan.
EXECUTIVE SUMMARY:
Tentative Tract Map 36634 (TTM 36634) created a residential subdivision on 2.32 acres for condominium purposes. The zoning of the project site is Medium Density Residential (MDR) of the Corona Vista Specific Plan, which allows detached residential condominiums. TTM 36634 was originally approved by the City Council on December 10, 2018. The tentative tract map was granted an automatic 18-month extension of time pursuant to Assembly Bill 1561, which extended TTM 36634 to June 6, 2022. Pursuant to the Subdivision Map Act, TTM 36634 is eligible for a discretionary extension of time by the City Council not exceeding a period of six years. This discretionary extension of time would extend TTM 36634 for three years to June 6, 2025.
RECOMMENDED ACTION:
That the City Council approve a three-year extension for Tentative Tract Map 36634, expiring on June 6, 2025.
BACKGROUND & HISTORY:
The project site is 2.32 acres located on the east side of Hudson Avenue at Poppyseed Lane, generally west of Fullerton Avenue at Taber Street. The zoning of the property is Medium Density Residential (MDR) of the Corona Vista Specific Plan (SP90-5). The General Plan and South Corona Community Facilitates Plan (CFP) also designates the property MDR. The General Plan density range is 6 to 15 dwelling units per acre whereas the South Corona CFP limits the density to 7.88 dwelling units per acre. TTM 36634 accommodates 11 single family condominium residential units resulting in a density of 4.74 dwelling units per acre. The project also includes 10,050 square feet of common recreation space.
TTM 36634 was originally approved by the City Council on December 10, 2018.

ANALYSIS:
The initial term of TTM 36634 was 24 months from the date of its initial approval, with an expiration date of December 10, 2020. TTM 36634 was eligible for an automatic 18-month extension per Assembly Bill No. 1561, which extended the parcel map to June 6, 2022. The applicant submitted an extension of time request to the City prior to the expiration date. Pursuant to the Subdivision Map Act, the request grants an automatic extension of 60 days or until the extension is approved, conditionally approved, or denied by the City’s legislative body, which is the City Council. The owner is eligible to have the tentative tract map extended by the City Council for a period of no more than six years. The applicant is requesting a discretionary three-year extension of time, which will extend TTM 36634 to June 6, 2025.
The applicant is currently in the plan check process with the City to have TTM 36634 recorded. The applicant is concurrently in plan check with PM 36667, which is across Fullerton Street from the project site. Both maps are being reviewed together and the applicant intends to have both maps recorded at the same time. The additional time will allow the applicant to finish the current process with the City without having to start the process over by applying for a new map. If for some unforeseen reason TTM 36634 is not recorded by June 6, 2025, the applicant can apply for one additional three-year extension of time.
FINANCIAL IMPACT:
All applicable fees have been paid by the developer.
ENVIRONMENTAL ANALYSIS:
The tentative tract map at the time of its initial approval had a Mitigated Negative Declaration approved because the initial study identified that the project’s potentially significant effects to the environment are capable of being mitigated to less than significant pursuant to Section 15070 of the State Guidelines for Implementing the California Environmental Quality Act (CEQA) and Section 6.02 of the City’s Local CEQA Guidelines. The extension of time does not change the scope of the project from its initial approval. This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act, which states that a project is exempt from CEQA if the activity is covered by the commonsense exemption that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action is to extend the time of a previously approved tentative tract map, and there is no possibility that approving this request will have a significant effect on the environment. Therefore, no further environmental analysis is required PREPARED BY: MARIA MIRANDA, SENIOR ENGINEER
