REQUEST FOR CITY COUNCIL ACTION
DATE: 07/06/2022
TO: Honorable Mayor and City Council Members
FROM: Planning and Development Department
SUBJECT:
Extension of time for Parcel Map 36667 generally located east of Fullerton Avenue and south of Taber Street in the Medium Density Residential designation of the Corona Vista Specific Plan.
EXECUTIVE SUMMARY:
Parcel Map 36667 (PM 36667) subdivides 1.60 acres into 4 single family residential lots. The zoning of the project site is Medium Density Residential (MDR) of the Corona Vista Specific Plan, which allows single family residential development. PM 36667 was originally approved by the City Council on December 10, 2018. The parcel map was granted an automatic 18-month extension of time pursuant to Assembly Bill 1561, which extended PM 36667 to June 6, 2022. Pursuant to the Subdivision Map Act, PM 36667 is eligible for a discretionary extension of time by the City Council not exceeding a period of six years. This discretionary extension of time would extend PM 36667 for three years until to June 6, 2025.
RECOMMENDED ACTION:
That the City Council approve a three-year extension of time for Parcel Map 36667, expiring on June 6, 2025.
BACKGROUND & HISTORY:
The project site is 1.60 acres located at the terminus of Riverbend Circle, which is east of Fullerton Avenue and south of Taber Street. The zoning of the project site is Medium Density Residential (MDR) of the Corona Vista Specific Plan (SP90-5). The General Plan and South Corona Community Facilitates Plan (CFP) also designates the property MDR. The General Plan density range is 6 to 15 dwelling units per acre whereas the South Corona CFP limits the density to 7.88 dwelling units per acre. PM 36667 creates four parcels over the 1.60 acres resulting in a density of 2.67 dwelling units per acre. The parcel sizes range from 10,621 square feet to 27,498 square feet.
PM 36667 was originally approved by the City Council on December 10, 2018.

ANALYSIS:
The initial term of PM 36667 was 24 months from the date of its initial approval, with an expiration date of December 10, 2020. PM 36667 was eligible for an automatic 18-month extension per Assembly Bill No. 1561, which extended the parcel map to June 6, 2022. The applicant submitted an extension of time request to the City prior to the expiration date. Pursuant to the Subdivision Map Act, the request grants an automatic extension of 60 days or until the extension is approved, conditionally approved, or denied by the City’s legislative body, which is the City Council. The owner is eligible to have the parcel map extended by the City Council for a period of no more than six years. The applicant is requesting a discretionary three-year extension of time, which will extend PM 36667 to June 6, 2025.
The applicant is currently in the plan check process with the City to have PM 36667 recorded. The applicant is concurrently in plan check with Tentative Tract Map 36634, which is across Fullerton Street from the project site. Both maps are being reviewed together and the applicant intends to have both maps recorded at the same time. The additional time will allow the applicant to finish the current process with the City without having to start over the process of applying for a new map. If for some unforeseen reason PM 36667 is not recorded by June 6, 2025, the applicant can apply for one additional three-year extension of time.
FINANCIAL IMPACT:
All applicable fees have been paid by the developer.
ENVIRONMENTAL ANALYSIS:
The parcel map at the time of its initial approval qualified as a Class 15 Categorical Exemption under Section 15315 (Minor Land Division) of the California Environmental Quality Act (CEQA). The extension of time does not change the scope of the project from its initial approval. This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act, which states that a project is exempt from CEQA if the activity is covered by the commonsense exemption that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.
This action is to extend the time of a previously approved parcel map, which was already determined to be categorically exempt from CEQA.
