REQUEST FOR CITY COUNCIL ACTION
DATE: 07/06/2022
TO: Honorable Mayor and City Council Members
FROM: Public Works Department
SUBJECT:
Acceptance of grant deeds from the Riverside County Transportation Commission for the State Route 91 expansion project.
EXECUTIVE SUMMARY:
City Council consideration to accept grant deeds from Riverside County Transportation Commission for the State Route 91 expansion project for real property and easements associated with the project improvements. Acceptance of these grant deeds will give the City full control of the future actions associated with the real property and easements.
RECOMMENDED ACTION:
That the City Council:
a. Accept the grant deeds for 17 parcels of real property in the City of Corona associated with the State Route 91 expansion project from the Riverside County Transportation Commission, a Public Agency of the State of California.
b. Authorize the City Attorney to execute the Certificates of Acceptance. c. Authorize the City Manager, or his designee, to approve and accept future grants and deeds associated with the State Route 91 expansion project from the Riverside County Transportation Commission, a Public Agency of the State of California, and authorize the City Attorney to execute the Certificates of Acceptance.
BACKGROUND & HISTORY:
On October 5, 2011, the City Council approved a Cooperative Agreement between the City and the Riverside County Transportation Commission (RCTC) for the construction of improvements and upgrades of existing utilities and local streets within the scope of the State Route 91 expansion project (Project). project (Project). The Project extended the existing toll lanes from Orange County to Interstate 15, widened the 91 freeway, and replaced or modified all of the interchanges along SR-91 within the City of Corona. The Project also included improvements and upgrades of existing utilities and local streets within the scope of the project. The Agreement included requirements for aesthetic and landscaping treatments, technical provisions for construction of City facilities, provisions for traffic control and traffic management, a requirement for replacement of the Main Street Bridge, and provisions to construct betterments beyond those required for the project to be paid by the City.
Construction of the Project is complete, including utility and public right-of-way improvements and upgrades to City facilities that have been constructed in conformance to City standards. As part of the project close-out, RCTC is seeking to grant to the City real property and easements associated with the project improvements.
ANALYSIS:
The grant deeds have been reviewed by City staff and are ready for acceptance by the City. There are 17 deeds ready for transfer now, as shown on Exhibit 1, and more than 20 pending for transfer at a future date, as listed on Exhibit 2. Additional deeds related to the Project may be forthcoming from RCTC. Most of the deeds grant right-of-way for City streets along the SR-91 freeway; however, some of the deeds may transfer specific easement rights for City facilities such as sewer and storm drain. Completing the transfer to the City ultimately gives the City full control of future actions associated with the real property and easements.
FINANCIAL IMPACT:
Once the properties are incorporated as part of City facilities, they will be included as regular maintenance of the streets, right-of-way, or property easements. The costs associated with maintaining these facilities will be included as part of the annual budget process.
ENVIRONMENTAL ANALYSIS:
This action is exempt pursuant to Section 15061(b)(3) of the Guidelines for the California Environmental Quality Act (CEQA), which states that a project is exempt from CEQA if the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This action merely approves the acceptance of grant deeds, and there is no possibility that approving this action will have a significant effect on the environment. Therefore, no environmental analysis is required.
