REQUEST FOR CITY COUNCIL ACTION
SUBJECT:

IMPROVEMENT AGREEMENTS AND SURVEY MONUMENTATION AGREEMENT FOR PARCEL MAP 36667 LOCATED AT THE SOUTHERLY TERMINUS OF RIVERBEND CIRCLE (APPLICANT: MELVIN AOU, POPPYBEND LLC) EXECUTIVE SUMMARY:

This staff report asks the City Council to approve the agreements and security for the public improvements, landscape improvements, and survey monumentation for Parcel Map 36667 (PM 36667). The applicant is ready to record PM 36667 at the county recorder office and is required to post security on the required public improvements and the survey monumentation and enter into a public improvement agreement with the city before the recordation of the parcel map. The recordation of the parcel map will establish four parcels for the construction of single-family homes.

RECOMMENDED ACTION:

That the City Council authorize the City Manager, or his designee, to execute the Landscape Improvements, Public Improvements, and Survey Monumentation agreements between the City and Poppyseed, LLC, a California limited liability company.

BACKGROUND & HISTORY:

The project site is located at the terminus of Riverbend Circle, east of Fullerton Avenue and south of Taber Street. The zoning of the project site is Medium Density Residential (MDR) of the Corona Vista Specific Plan (SP90-5).

PM 36667 subdivides 1.60 acres into four parcels for the development of four singlefamily residential homes and two letter lots for the street and improvements associated with the subdivision.

PM 36667 was approved by the Planning and Housing on November 13, 2018, and subsequently approved by the City Council on December 10, 2018.

ANALYSIS:

The applicant is proposing to record PM 36667. To guarantee the construction of the public and private infrastructure improvements associated with the development, the developer is entering into improvement agreements with the City and has posted sufficient securities for the street, storm drain, sewer, water, reclaimed water, and landscaping facilities.

According to the requirements of the Subdivision Map Act, the developer will also enter into an agreement for the survey monumentation and post sufficient securities to guarantee the placement of all survey monuments and improvements required by PM 36667.

The following securities have been posted for the map:

FINANCIAL IMPACT:

All applicable fees have been paid by the developer, including the payment of Development Impact Fees that are due before the recordation of the map.

ENVIRONMENTAL ANALYSIS:

The project qualifies as a Class 15 Categorical Exemption under CEQA Section 15315 (Minor Land Division). The subject property is designated MDR on the Corona Vista Specific Plan land use map which permits the proposed project. The subdivision will result in four lots which conform to the MDR standards and the City's General Plan designation of MDR in terms of use and density. No variances are associated with the subdivision. All services and access are available and designed per local standards. The property has not been involved in another subdivision within the previous two years, and the average slope of the property is less than 20 percent. Therefore, the project qualifies as an exemption under the referenced CEQA section.
