WHEREAS, pursuant to Government Code Section 54221(f)(1)(G), the Subject Property meets the definition of “exempt surplus land” based upon the findings set forth herein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CORONA, CALIFORNIA, AS FOLLOWS:
SECTION 1. Findings. The City Council hereby finds and determines that the above stated recitals are true and correct.
SECTION 2. Exempt Surplus Property Declaration and Findings. The City Council hereby finds and declares that the Subject Property is no longer necessary for the City’s use and is exempt surplus land pursuant to Government Code Section 54221(f)(1)(G) based on the evidence in the record and the following findings:
(A) The Subject Property and the Surplus Parcels are collectively more than one (1) acre and less than ten (10) acres in size. (B) The Subject Property, in combination with the Surplus Parcels, is intended to be developed with retail and restaurant uses and mixed-use residential of not less than three hundred (300) residential units, twenty-five percent (25%) of which would be restricted to lower income households at an affordable sales price for forty-five (45) years pursuant to a covenant or restriction recorded against the Subject Property and the Surplus Parcels at the time of sale.
(C) The development of the Subject Property and the Surplus Parcels will be subject to an open, competitive solicitation process, with all entities identified in Government Code Section 54222(a) invited to participate. (D) The Subject Property: (i) is not located within a coastal zone; (ii) is not adjacent to a historical unit of the State Parks System; (iii) is not listed on, or determined by the State Office of Historic Preservation to be eligible for, the National Register of Historic Places; and (iv) is not located within the Lake Tahoe region as defined in Government Code Section 66905.5.
SECTION 3. CEQA. The declaration of the Subject Property as exempt surplus land is exempt from environmental review under the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15061(b)(3), which states that a project is exempt from CEQA if the activity is covered by the common sense exemption that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This resolution simply declares that the Subject Property is exempt surplus land and there is no possibility that this action will have a significant effect on the environment. Therefore, no environmental analysis is required.
