Subject: TTM 37691 - Request for Extension of Time
Honorable Chair and Members of the Counsel:
JK Building Blocks, LLC, the current owner of the property subject to Tentative Tract Map No. 37691 (“TTM 37691”), respectfully requests a three-year extension of time for the map. The map was previously extended in 2023 under the prior ownership, and currently expires August 3, 2026. This request for Extension of Time is filed prior to that expiration.
As staff is aware, the current ownership is concurrently pursuing a revised project for the site of approximately 31, quality, single family homes. The extension request for TTM 37691 is not an alternative to the work of a revised project, but rather a practical “belt and suspenders” approach should the City Counsel and Planning not agree to a revised project. The owners believe the extension of the existing TTM 37691 will allow all parties the time necessary to design and approve the optimum project for the site.
The revised project has been filed and a review initiated through the DPR process. The DPR process when completed, will be followed by submission for a new TTM that will require approval and will replace TTM 37691. The ownership cannot responsibly allow the site to become unentitled while that process runs. Extending TTM 37691 preserves the City's existing approval as a functioning baseline during the transition. If the revised project is approved, the ownership will proceed with the new TTM.
If the revised project cannot be approved on mutually agreeable terms, the City and owner will retain TTM 37691, an approved project on the site. The current owners believe that rather than a vacant, unentitled parcel the community benefits from keeping an active TTM on the parcel.
Since the 2023 extension, the current ownership has continued to fund and advance the site rather than hold the entitlement passively. The current owners believe the approved TTM 37691 remains a sound project as approved – yet the owners believe that a 31 home quality development is better matched to what the current market will support. The underlying market conditions have changed since TTM 37691 was approved. Construction costs, interest costs, and mortgage rates are all at recent highs. The new owners have taken time to study both the prior plan and the best options for the new proposed project.
Request
Granting the extension request preserves optionality for the site. It maintains a fully entitled, fully reviewed project on the site while the revised application completes the City's process.
JK Building Blocks LLC therefore respectfully requests a three-year extension of Tentative Tract Map No. 37691. We appreciate the City's continued partnership and are happy to provide any additional information the Counsel may find useful.
