REQUEST FOR CITY COUNCIL ACTION
SUBJECT:
EXTENSION OF TIME OF TENTATIVE TRACT MAP 37691 LOCATED ON THE SOUTHWEST SIDE OF FOOTHILL PARKWAY AT CHASE DRIVE (APN 275-050-014, 275-050-017, AND 275-080-041), IN THE GENERAL COMMERCIAL AND MULTIPLE FAMILY RESIDENTIAL ZONES (APPLICANT: JK BUILDING BLOCKS, LLC) EXECUTIVE SUMMARY:
This staff report asks the City Council to approve a three-year time extension for Tentative Tract Map 37691 (TTM 37691). Pursuant to the Subdivision Map Act and the Corona Municipal Code Section 16.12.066, TTM 37691 is eligible for a discretionary extension of time by the City Council, not exceeding six years. This is the second request for a discretionary extension of time and, if granted, would extend TTM 37691 until August 4, 2029.
RECOMMENDED ACTION:
That the City Council approve a three-year extension for Tentative Tract Map 37691, expiring on August 4, 2029, which includes the addition of Public Works Condition No. 67, Fire Department Condition No. 8, Fire Department Condition No. 9, and the revision of Fire Department Condition No. 2.
BACKGROUND & HISTORY:
TTM 37691 consists of 17.02 acres, subdivided into two lots for future development located on the southwest side of Foothill Parkway at Chase Drive. The zoning of the property is C-3, General Commercial, and R-3, Multiple Family Residential. The tentative tract map was approved with Precise Plan 2020-0005 (PP2020-0005) and Conditional Use Permit 2020-0001 (CUP2020-0001) for the construction of 25,715 square feet of commercial/ retail and food space, and 78 residential condominiums.
TTM 37691 was originally approved by City Council on August 4, 2021. The initial term was 24 months from the date of its initial approval. At the August 16, 2023 meeting, the City Council approved the first discretionary time extension of three years for TTM 37691, which extended the tract map to August 4, 2026.
ANALYSIS:
The applicant submitted a time extension request to the City on July 27, 2026. , The Subdivision Map Act grants an automatic extension of 60 days or until the extension is approved, conditionally approved, or denied by the City’s legislative body, the City Council. As detailed in the provided letter (Exhibit 3), the applicant is pursuing an alternative development they believe better matches what the current market will support. The applicant is requesting an extension of their current entitlement so that it remains an option for development, while the new development undergoes its review and approval process. The applicant’s request for a three-year extension will extend TTM 37691 to August 4, 2029. Additionally, the developer has also requested that Public Works Conditions of Approval No. 67, Fire Department Conditions of Approval No. 2, 8, and 9, all detailed below, be added to the previous conditions of approval(Exhibit 4).
Public Works Condition No. 67 (Added)
Additional trail amenities are to be provided to comply with the recently adopted Corona Trails Master Plan and Skyline Area Master Plan, adopted by City Council on February 21, 2024.
Public Works Condition No. 67:
Prior to map recordation, the applicant shall construct or guarantee the construction of trail amenities for Trail No. 34 as described in the Corona Trails Master Plan, Skyline Area Master Plan, and as approved by the Community Services Director. Said improvements shall include the following:
1. A trailhead at Foothill Parkway at the easterly entrance of Trail No. 34 that includes the following improvements: wayfinding signage, trash receptacles, bench seating, drinking fountain, bike repair station, and dog bag dispenser.
2. Trail wayfinding signage at each end of Trail No. 34.
Fire Department Condition No. 2 (Revised):
This revision clarifies the definition of “two points of access,” to comply with revisions made to Section 15.12.200 of the Corona Municipal Code per City Ordinance 3357, and the 2022 California Fire Code.
Fire Department Condition No. 2:
Show two (2) all weather surface access ways to be approved by the Fire Marshal and construct the access way(s) to accommodate 75,000 lbs. gross vehicle weight during all phases of construction. Two points of access shall be required for new development and when the existing development density is increased, unless otherwise approved by the fire code official and justified by the fire protection plan. A secondary access point shall not satisfy the requirements of this section if it directs traffic to or from the same point as the primary access point or otherwise results in a circular traffic flow.
Fire Department Condition No. 8 (Added):
Weed abatement maintenance in compliance with revisions made to Section 15.12.090 of the City of Corona Municipal Code per Ordinance 3357 and the 2022 California Fire Code.
Fire Department Condition No. 8:
Groves and weed abatement shall be maintained so as not to pose a fire hazard until the time of development.
Fire Department Condition No. 9 (Added):
Fuel Modification and/or Fuel Protection Plan required to comply with Chapter 15.25 of the Corona Municipal Code adopted by City Council November 19, 2025, including the revisions made to Section 15.12.090 of the City of Corona Municipal Code per Ordinance 3357, and the 2022 California Fire Code.
Fire Department Condition No. 9:
Prior to issuance of a grading permit, the applicant is required to submit a fuel modification plan and/or Fire Protection Plan to the Fire Department for review and approval.
FINANCIAL IMPACT:
All applicable fees have been paid by the developer.
ENVIRONMENTAL ANALYSIS:
A Mitigated Negative Declaration for TTM 37691 was approved on August 4, 2021, because the initial study identified that the project’s potentially significant effects to the environment are capable of being mitigated to less than significant, pursuant to section 15070 of the State Guidelines for Implementing the California Environmental Quality Act (CEQA) and Section 6.02 of the City’s Local CEQA Guidelines. The extension of time does not change the scope of the project from its initial approval. Therefore, this request does not require further environmental analysis under CEQA.
