CONTRACT VARIANCE SUMMARY
Justification for Item(s) No. S-7 Design Engineer under-estimated the pavement excavations, as referred to in the attached RFI No.3. S7.1, S-7.3, and S-7.4 were increases in AC Pavement segments at Chase Dr/Gilbert Ave. and Smith Ave. necessary to allow a proper transition to the existing AC Pavement surface. Items: S-7.2, S-7.5, S-7.6, S-7.7, S-7.9, S-7.10, S-7.11, S-7.12, S-7.15 are various construction items that were not constructed or installed per the planned estimates and City changes. Items: S-7.8/7.8.1, S-7.13/7-13.1, and S-7.14/7.14.1 are overages that were compensated to contractor with payment to their Invoice No. 3, and thus are credited on this Balancing Contract Change Order No. 6. Item S-7.16 was necessary to relocate a street light due to an objection from the resident at 2852 Thacker Dr (the light would block his view from his 2nd-floor window). Item S-7.17 is a claim by the subcontractor for the cancellation of a short load of concrete (PCC) and the cost to revise the bolt circle for the streetlight foundation of streetlights. For S-7.17's justification, refer to(Response to Ferreira’s CCO #2).

Sidewalk Gap Closure at Chase Drive and Smith Avenue – Project No. ST-2022-14 TO: City of Corona – Attn: Gerardo Sanabria, Associate Engineer RE: RFI #3 – Excavation Quantities, submitted by Copp Contracting, Inc., dated June 26, 2026 SUBJECT: Unclassified Excavation – 135 CY Overage, Slot Patch, Chase Drive RFI:

The actual excavation quantities on this project resulted in a 135 CY overage. May we please request the slot patch on Chase Dr. be reevaluated? From our review, it seems the contract quantity may not include the cubic yards allowed for the depth of the 11-inch section.

RESPONSE:

Onward Engineering has reviewed Copp Contracting's RFI #3 regarding the Unclassified Excavation quantity for the Sidewalk Gap Closure project along Chase Drive and Smith Avenue, including the design plans and field conditions at the slot patch area.

Field conditions along combined with the full-depth AC pavement excavation required at the slot patch area, results in an Unclassified Excavation quantity beyond the 280 CY reflected in the bid documents. Based on this review, Onward Engineering confirms a total Unclassified Excavation quantity of 420 CY for this work, consistent with the 135 CY overage identified in Copp Contracting's RFI.

Per the Contract Special Provisions, payment for Unclassified Excavation (including sawcutting, excavation, and removal of existing driveways, sidewalk, and pavement) is made on a cubic yard basis at the Contract unit price, with no additional compensation allowed beyond that unit price. Because the quantity overages put as at more than 125%, a lower unit price for all quantities over 125% may apply at the City’s discretion.

Onward Engineering recommends the City process the confirmed additional quantity of 135 CY as a quantity adjustment at the applicable Contract unit price or negotiated price, subject to the City's review and approval, and upon the Contractor's submission of field-measured quantities/documentation supporting the actual excavation performed.
