ADOPTION OF “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CORONADO, CALIFORNIA, AUTHORIZING THE RECEIPT AND APPROPRIATION OF FISCAL YEAR 2023- 24 RIDE TO LIVE MOTORCYCLE EDUCATION GRANT FUNDS FROM THE CALIFORNIA OFFICE OF TRAFFIC SAFETY (OTS) IN THE AMOUNT OF $65,000” RECOMMENDATION:
Adopt “A Resolution of the City Council of the City of Coronado, California, Authorizing the Receipt and Appropriation of the Fiscal Year 2023-24 Ride to Live Motorcycle Education Grant Funds from the California Office of Traffic Safety (OTS) in the amount of $65,000.” BACKGROUND:
The Ride to Live motorcycle education program is designed to provide motorcycle training to reduce injuries and deaths due to motorcycle collisions. The training is free to the public and involves hands-on skills taught by Coronado Police Department Motor Officers. Financial support for this grant is distributed in the form of direct costs and personnel costs by the Office of Traffic Safety. The Coronado Police Department has participated in this program since 2020.
ANALYSIS:
The acceptance of this grant will allow the Coronado Police Department to purchase training supplies, travel costs, rent training sites and cover the cost of overtime for those teaching the class. Motorcycle collision injuries and deaths have been an issue for years. Possessing lifesaving skills is critical to reducing motorcycle collision-related deaths and injuries. Educating motorcycle riders on how to safely maneuver in dangerous situations will aim at lowering the number of motorcycle collisions each year.
FISCAL IMPACT:
The City of Coronado’s award of the Fiscal Year 2023-24 Ride to Live Motorcycle Education grant funds is $65,000. These funds will cover the cost of overtime for instructors, training supplies and travel, and site fees associated with the Police Department’s Ride to Live motorcycle education program. SECOND READING AND ADOPTION OF AN ORDINANCE TO AMEND THE CORONADO
MUNICIPAL CODE TO INCORPORATE EXPEDITED PERMITTING FOR THE INSTALLATION
OF ELECTRIC VEHICLE CHARGING STATIONS AND DETERMINATION THAT THE
PROPOSED ORDINANCE IS EXEMPT FROM ENVIRONMENTAL REVIEW PURSUANT TO CEQA SECTION 15061(B)(3)
RECOMMENDATION:
Conduct the second reading and adoption of “An Ordinance of the City Council of the City of Coronado, California, Adopting Municipal Code Amendment to Add a New Chapter 70.36 (Electric Vehicle Charging Stations) to the Coronado Municipal Code.” BACKGROUND:
Assembly Bill (AB) 1236, adopted by the State of California in 2015, mandates that local governments with a population of under 200,000 create an ordinance to establish a streamlined and accelerated permitting procedure for electric vehicle charging stations. AB 1236 was enacted with the goal of expanding the availability of charging infrastructure to promote the use of zeroemission vehicles.
In conjunction with AB 1236, AB 970, enacted in 2022, further improves the permit streamlining process by introducing specific, binding timelines for the review period. This additional legislation adds an element of efficiency and accountability to the permitting process for EVCS, aligning with California's goals of promoting cleaner energy sources and sustainable transportation practices.
An Implementation Plan for the City’s Climate Action Plan (CAP) was authorized by the City Council on June 6, 2023, outlining multiple initiatives aimed at reducing greenhouse gas emissions and fostering sustainability within the community. One of the primary objectives outlined in CAP Section 4.4.1, specifically item 1a dedicated to Electric Vehicles, is to foster the growth of EVCS. The creation of an ordinance aimed at expediting the permitting process for EVCS, in line with state mandates AB 1236 and AB 970, advances Coronado towards its goal of inspiring residents, businesses, and visitors to reduce greenhouse gas emissions through increased electric vehicle adoption.
ANALYSIS:
The proposed amendments to Coronado's Municipal Code would be in alignment with California's AB 1236 and AB 970 as outlined below:
ASSEMBLY BILL 1236
In accordance with AB 1236, cities and counties are required to adopt an ordinance and checklist that include several key elements:
1. Streamlined Ordinance: Create a clear and well-defined set of rules and regulations tailored to the needs of EVCS permits.
2. Permitting Checklist: A concise permitting checklist is required to facilitate efficient processing.
City of Coronado Page 46
This checklist will outline all the necessary requirements that applicants must fulfill, providing a clear framework for the evaluation of applications.
3. Administrative Approval: To expedite decision-making, permits will be subjected to administrative approval by the building official, ensuring a streamlined decision-making process.
4. Electronic Signatures: Electronic signatures on application documents will now be accepted for permit processing.
5. Homeowner Association Exemption: Permits will not require approval from a Homeowner Association.
6. Deficiency Notice: If an application is found to be incomplete, a single comprehensive deficiency notice will be issued. Consolidating any deficiencies into one notification, allowing applicants to address all outstanding requirements at once.
ASSEMBLY BILL 970
In accordance with Assembly Bill 970, the state of California has introduced specific binding timelines for the review period of EVCS depending on the project's size and parking requirements.
According to this legislation, the completeness of an application to install EVCS shall be determined by the reviewing city or county within five business days after submission. If no declaration of incompleteness or written notice highlighting deficiencies is provided within this timeframe, the application will be considered complete.
Furthermore, the bill requires an application to be deemed approved within 20 business days after the application is deemed complete. AB 970 also requires the following conditions to be met:
1. Approval by a relevant authority.
2. Determination by the building official that the installation poses no negative impact on public health or safety.
3. Does not require a use permit.
4. Absence of a permit denial by the building official.
5. Absence of an appeal to the planning commission of the respective city.
If all these conditions are met, the application will be considered approved. Furthermore, the bill stipulates that the City must decrease the required number of parking spaces by an amount sufficient to accommodate EVCS. Should the installation of the charging station and its associated equipment interfere with, reduce, eliminate, or affect the City's parking space requirements, modifications must be made to accommodate the EVCS.
AB 1236 highlights the urgency of reducing gas usage, while AB 970 emphasizes the transition to renewable electricity sources. These mandates not only prioritize environmental responsibility but also impose binding timelines on permit reviews. Given these compelling state-level directives Municipal Code Chapter 70.36 is a logical step forward.
The proposed ordinance will bring the City into compliance with AB 1236 and AB 970 and simplify the EVCS permit process by utilizing a concise permitting checklist, expediting decision-making City of Coronado Page 47
through binding timelines and administrative approval, accepting electronic signatures, eliminating the need for HOA approval, and consolidating multiple deficiency notices into one.
The draft ordinance with these components will ensure the City's compliance with California’s climate goals, contributing to reduced greenhouse gas emissions and fostering a more sustainable future for residents.
As such, staff recommends that the City Council introduce an Ordinance creating Coronado Municipal Code Chapter 70.36 for its first reading. By incorporating the above listed elements into the permitting process, the City of Coronado will comply with state law and have an efficient and streamlined system for handling EVCS permits which will encourage the expansion of electric vehicle infrastructure and support the City and state of California’s sustainable transportation initiatives.
FISCAL IMPACT:
None.
ALTERNATIVE:
The City Council may choose not to amend the Municipal Code.
CALIFORNIA ENVIRONMENTAL QUALITY ACT:
Adoption of the proposed ordinance is exempt from CEQA review pursuant to State CEQA Guidelines Section 15061(b)(3) because there is no possibility that this ordinance may have a significant effect upon the environment.
PUBLIC NOTICE:
In lieu of the full text ordinance being published within 15 days after passage, the City Clerk published and posted the summary of the proposed ordinance on September 27, 2023 and will publish and post a summary of the ordinance 15 days after adoption.

A Mills Act Agreement is a contract between the property owner and the City, wherein the property owner agrees to preserve, and when necessary, restore and rehabilitate a designated historic resource throughout the term of the annually renewable ten (10) year agreement. In exchange, the property owner receives a reduction in property taxes. The Mills Act Program was adopted by the City Council in 2000 by Resolution No. 7736.
At its October 4, 2011 meeting, the City Council adopted Resolution No. 8524 implementing a change to the Mills Act Program that sets the maximum savings that a property owner receives with a Mills Act Agreement to 50% of the current, non-Proposition 13, property tax for Mills Act applications received beginning January 1, 2012. In 2018, the City Council adopted Resolution No. 8968 removing the previous fiscal cap of $15,000 in the first year forgone property revenue, leaving the number of applications approved in each calendar year up to the discretion of the City Council.
ANALYSIS:
Estimates for first year reduced property tax income to the City are included in Attachment 1. It should be noted that the reduced property tax income estimates do not include any exclusions that may be written into the agreements. Exclusions recommended by staff generally include nonhistoric elements of the property such as additions after the period of significance of the designation and accessory buildings that do not contribute to the historic significance of the property. The process of reducing the Mills Act tax savings as a result of exclusions is not done by the City of Coronado; it is done after the Mills Act Agreement is recorded and taken over by the County Tax Assessor. When an exclusion is written into a Mills Act Agreement, the County Tax Assessor gives the property a blended Mills Act valuation, which results in a lower tax savings for the property owner and a lower fiscal impact to the City. Exclusions and lists of improvements associated with each property on the waiting list, as recommended by the HRC and staff, are included in Attachment 1.
Per City Council direction, Mills Act applications that have been reviewed by the Historic Resource Commission are prioritized, added to the waiting list, and scheduled for formal consideration by the City Council at a public hearing, as required by Section 84.10.100 of the Coronado Municipal City of Coronado Page 55
Code.1 Photographs of each of the properties are included as Attachment 3.
For Mills Act Agreements approved by the City Council, staff will draft Agreements tailored to each individual property per the recommendations indicated in Attachment 1, and with the appropriate calculations to comply with City Council Resolution No. 8524. The agreement will be signed and notarized by the City and property owner, recorded at the County Recorder’s Office by the end of the calendar year, and take effect in 2023.
FISCAL IMPACT:
General Fund:
If the Council approves Mills Act Agreements recommended by staff and the Historic Resource Commission, the estimated first-year reduction in property tax revenue to the City will be approximately $31,888 (Attachment 1). Properties for which no fiscal impact is expected in the first year is due to assessment under Proposition 13 rather than the Mills Act Restricted Value.
Should these properties change ownership and no longer see a greater benefit from Proposition 13 assessment, the City would see a fiscal impact as a result of assessment under the Mills Act Restricted Value.
Attachment 2 contains the Cumulative to Date Fiscal Impact Report of all recorded Mills Act Agreements since the program was implemented. This report shows that the fiscal impact to the City last year was $980,584, and to date the cumulative fiscal impact since the start of the program in 2001 is $7,195,172.
The City’s General Fund balance includes $500,000 committed to Historic Preservation for the purpose of mitigating impacts of reduction in property tax revenues to the City.
To the Successor Agency to the Community Development Agency of the City of Coronado (SA):
The estimated cumulative tax increment loss is approximately $127,552 ($31,888 x 4 years).
Although this would reduce the excess tax increment that can be used to early retire the 2018 Tax Allocation Refunding Bonds (TARBS), it is not expected to impact the originally projected early maturity timeline of 2027.
ALTERNATIVE:
The City Council may approve or deny any of the Mills Act applications.

PUBLIC NOTICE:
Section 84.10.100 of the Historic Preservation Ordinance requires that the City Council consider Mills Act Agreement applications at a noticed public hearing. A public notice was published in the Coronado Eagle & Journal on September 20, 2023, and was mailed to all property owners within 300 feet of the subject properties.
1 One additional application, 476 A Avenue, was recommended for approval by the HRC in 2022. That application is on hold for future Council consideration due to a Councilmember holding a property interest.

CITY COUNCIL STAFF REPORT
October 3, 2023 8b
PUBLIC HEARING: CONSIDER A RESOLUTION TO AUTHORIZE A GREEN ENERGY
INCENTIVE PROGRAM TO WAIVE PERMIT FEES FOR ROOFTOP SOLAR, ELECTRIC
VEHICLE CHARGING STATIONS, HOME BATTERY SYSTEMS, AND SOLAR WATER
HEATERS
RECOMMENDATION:
Adopt a resolution to authorize a Green Energy Incentive Program to waive City permit fees for rooftop solar, electric vehicle charging stations, home battery systems, and solar hot water heaters and find that the program is exempt from environmental review pursuant to CEQA section 15361(B)(3).
BACKGROUND:
On June 6, 2023, the City Council adopted a Climate Action Implementation plan. This comprehensive plan includes a range of projects, programs, and activities designed to effectively reduce greenhouse gas emissions in Coronado. One of the initiatives outlined in the plan is implementation of a Green Energy Incentive Program.
A Green Energy Incentive Program is designed to encourage the adoption and use of clean and sustainable energy sources. This program would incentivize property owners to install rooftop solar, electric vehicle charging stations, home battery systems, and solar hot water heaters by offering a free local permitting process, thereby reducing greenhouse gas emissions by reducing dependency on fossil fuel energy sources.
ANALYSIS:
The proposed Green Energy Incentive Program will be comprised of the following components:
1. Waive local permit fees for existing residential and commercial developments to promote the adoption of rooftop solar systems under 10 MHz, electric vehicle charging stations, home battery systems, and solar hot water heaters.
2. Promote the cost saving benefits of transitioning to solar energy through marketing and community outreach efforts.
By removing financial barriers, promoting the City’s free permitting program, and streamlining the permitting process, this program can help residents reduce their home energy costs while also helping the City meet its climate action goals.
Current Permit Fees
The following table shows the approximate fees charged by the City for rooftop solar, electric vehicle charging stations, home battery systems, and solar hot water heaters and the potential annual fiscal impact of offering fee waivers. Figures shown in the below table are approximate and were based on average permit activity over the past 30 months. Any required state permit fees would continue to be assessed.
City of Coronado Page 68
Project Type City Fees Annual # of Permits Annual Revenue Rooftop Solar $450 140 $63,000
EV Charging Station $400 15 $6,000
Home Battery System $375 14 $5,250
Solar Hot Water Heater $300 1 $300
FISCAL IMPACT:
The adoption of the Green Energy Incentive program may result in an annual revenue loss of approximately $74,500 depending on the number of permits issued each year.
ALTERNATIVE:
The City Council could authorize a fee reduction instead of a full fee waiver or decline to implement the program and continue to charge current fees.
CALIFORNIA ENVIRONMENTAL QUALITY ACT:
Adoption of the proposed program is exempt from CEQA review pursuant Section 15361(B)(3) because it can be seen with certainty that this program would not have a significant effect on the environment.
