RECOMMENDATION:
In a form approved by the City Attorney, authorize the City Manager to award contracts or amend Task Orders to (1) California Waters Development, Inc, dba California Waters in an amount of $3,631,052 for the construction of the Aquatic Deck Replacement and Pool Plaster Project; (2) The Barrie Company in an amount not-to-exceed $220,000 for construction observation services; (3) Michael Baker International in an amount not-to-exceed $20,120 for construction administration support; (4) Kleinfelder in an amount not-to-exceed $29,531 for quality assurance testing. In addition, (1) approve a project contingency of $550,000; (2) appropriate an additional $2,838,049 from the Facilites Replacement Fund (436); and (3) authorize the City Manager to execute change orders in excess of 10% of the contract, but within the project contingency.
BACKGROUND:
In 2006, the Coronado Aquatics Center pool and pool deck were constructed as part of the Glorietta Bay Masterplan. Upon completion, the pool deck was sealed. However, the protective sealant was too slippery and subsequently removed by acid wash. By 2009, deterioration of the concrete pool deck was observed. From 2009 to 2013, the City contracted with three separate engineering firms to investigate the cause of the deterioration. The engineers were unable to determine if the scaling and spalling were due to inadequate design requirements or improper installation. As a result of the deterioration, there is exposed aggregate within the pools’ splash zones and heavily used areas such as near the diving boards and near the staff office door. The pool plaster is approximately 18 years old and has greatly exceeded its 10-year life expectancy. Several pool tiles are missing or chipped, the tile grout is stained and crumbling, the Competition Pool’s bulkhead is in disrepair, and due to improper drainage, water ponds next to the bayside stem wall.
The Fiscal Year (FY) 2016-17 Capital Improvement Program published in June of 2016, identified two separate maintenance projects for the aquatic center: the Aquatic Center Deck Rehabilitation project budgeted at $1,000,000 and the Pool Plaster and Grouting project budgeted at $300,000. The projects were planned for initiation in FY 2018-19 but no funds were appropriated.
In the FY 2019-20 CIP, the two maintenance projects were combined into a single project pending future funding with a budget set at $1,335,000.
In the FY 2019-20 CIP the Pool Heater Replacement and Installation project was prioritized over the Pool Deck, Plaster, and Grouting project.
In the FY 2022-23 CIP, the Aquatic Deck Replacement and Pool Plaster Project was formally adopted and a budget of $1,800,000 was appropriated from the Facilities Replacement Fund.
In early 2023 a field meeting between Public Services and Engineering staff and Recreation and Golf Services staff was held at the project site to discuss and define the scope of the project. The agreed upon scope includes replacement of the pool plaster and required repairs to the pool floors and walls, replacement of the pool tile and grout, replacement of gutter grating, repair of the concrete gutters, partial replacement of the pool deck and associated drainage, water proofing of the gutters and surge tanks, and refinishing existing grabrails and handrails. Also included were four additive alternates, expanding the extent of deck replacement to replace the entire pool deck, replacing existing turf, replacing rather than repairing the existing Competition Pool bulkhead, and refinishing the existing Recreation Pool water feature.
Between February and April of 2023, task orders were issued to two of the City’s on-call consultants, Michael Baker International (MBI) and Kleinfelder, Inc. The nature of the design work required MBI to subcontract with a firm with a specialty in aquatics, Aquatic Design Group (ADG). MBI performed the site survey, ADG provided the project’s construction drawings and technical specifications, and Kleinfelder performed geotechnical field investigations, laboratory testing, analysis, and report preparation to satisfy the information requested by ADG’s engineer.
ANALYSIS:
On December 29, 2023, four bids were received in response to the Request for Bids (RFB) published on November 20, 2023 in accordance with the California Municipal Code 8.07 and Public Contract Code 20160 full and open bidding procedures. Two contractors (U.S.
Construction, LLC, and Mission Pools) were deemed non-responsive. The City notified both bidders of the nonresponsive determination and no communications have been received in response to the notifications. Two contractors, California Waters and California Commercial Pools, were deemed responsive. The City received two protests for the initial apparent low bidder, U.S.A. Construction, LLC. Protest concerns were consistent with the City’s findings regarding the contractor’s responsiveness to the RFB requirements. Staff reviewed the bid package, insurance, bonding, and references beginning with the lowest eligible bidder.
The bids results are as follows:
BIDDER BID
California Waters - Base Bid $2,723,181
Alternate No. 1: Complete Removal and Replacement of Pool Deck $502,362 Alternate No. 2: Complete Removal and Replacement of Turf Area $54,872 Alternate No. 3: Complete Removal and Replacement of Floating Bulkhead $341,915 Alternate No. 4: Refinish Activity Pool Interactive Water Feature $8,722 Basis of Bid Determination (Base Bid+1+2+3+4) $3,631,052 California Commercial Pools, Inc. - Base Bid $3,013,000 Alternate No. 1: Complete Removal and Replacement of Pool Deck $430,000 Alternate No. 2: Complete Removal and Replacement of Turf Area $42,000 Alternate No. 3: Complete Removal and Replacement of Floating Bulkhead $225,000 Alternate No. 4: Refinish Activity Pool Interactive Water Feature $18,000 Basis of Bid Determination (Base 1+2+3+4) $3,728,000
California Waters meets the City’s bid requirements. In accordance with the Standard Specifications for Public Works Construction, California Waters is the lowest responsible and responsive bidder. Public contracting law requires the City award the contract to the lowest responsible and responsive bidder, in this case, California Waters.
FISCAL IMPACT:
This project is included in the FY 2022-23 Capital Improvement Program (41070000 – 98987 – AQDPP) with an allocation of $250,000 for design and $1,550,000 for construction, with a total budget of $1,800,000. To date, $178,855 for design and $8,491 for newspaper advertisement and building permit fees have been expended. An additional appropriation of $2,838,049 will be required to complete the Aquatic Deck Replacement and Pool Plaster Project. The project was funded from the Facilities Replacement Fund 436 (41070000). The Fund 436 balance is currently $11,075,089 and with the requested appropriation, $8,237,040 would remain in the fund.
