SERVICES AGREEMENT AND ISSUE/AMEND TASK ORDERS WITH MIKHAIL OGAWA ENGINEERING INC. FOR AN INTIAL THREE YEAR TERM FOR ASNEEDED STORM WATER AND WASTEWATER ENGINEERING SERVICES, TASK ORDERS TOTALING $1,231,313 FOR STORM WATER AND

WASTEWATER PROGRAM SUPPORT SERVICES
Recommendation: Authorize the City Manager to execute a professional services agreement and issue/amend task orders with Mikhail Ogawa Engineering, Inc. (MOE) for an initial three year term, task orders for storm water and wastewater management support services for the remainder of Fiscal Year (FY) 23/24 and FY 24/25 totaling $1,231,313 and authorize the City Manager to execute future renewal options and issue/amend task orders for years four and five.

PROVIDE AUTHORITY TO THE CITY MANAGER TO EXERCISE RENEWAL OPTIONS FOR SINGLE YEARS THROUGH JUNE 30, 2029; AND APPROVE A CONTRACT SUM OF UP TO $60,000 PER YEAR
Recommendation: Authorize the City Manager to execute a contract to CentralSquare Technologies, LLC for licensing, support, and maintenance of the City’s Finance Plus and TRAKiT enterprise systems for an initial period through June 30, 2025; provide authority to the City Manager to exercise renewal options for single years through June 30, 2029; and approve a contract sum of up to $60,000 per year.

REPLACEMENT PROJECT, INCLUDING ASSOCIATED TREE REMOVALS Recommendation: Formally vacate all of the Project Approvals dated July 18 and August 15, 2023, relating to the Lawn Bowling Green Turf Replacement Project, including associated tree removals.

10a. COUNCIL REPORTS ON INTERAGENCY COMMITTEE AND BOARD ASSIGNMENTS.

Mayor Bailey announced that the disaster declaration for the San Diego area had been approved by President Biden and that information will be forthcoming after review from City staff.

Councilmember Duncan reported on his activities relating to the Chamber of Commerce Board of Directors and updates on the trans-border sewage issue.

Councilmember Tanaka reported that a Winn Room Subcommittee meeting is scheduled for March 20 at 4:00 p.m.

Councilmember Downey reported on her attendance at the USS John L. Canley commissioning ceremony.

Councilmember Donovan reported on his activities relating to the California League of Cities.
10b. REVIEW OF REGULATIONS REGARDING FIRES ON THE PUBLIC BEACH
Kelli Maples, Management Analyst, presented this item utilizing a PowerPoint presentation.

Councilmember Downey asked about the security patrols on the beach. Ms. Maples replied that the service patrols the fire rings on the north beach and that there are no active patrols of the central and south beaches.

Councilmember Tanaka asked if the proposed options affect the fire pits and activities in from of the Hotel del Coronado. City Attorney Johanna Canlas clarified that the beach in front of the Hotel del Coronado is a private beach that is not subject to the City’s policies but must be in compliance with Coastal Act provisions. Councilmember Tanaka noted that one of the complaints received was related to beach fire activities at the Hotel del Coronado and asked if the Hotel del Coronado was in compliance with the Coastal Act, and if not, could the City deliberate on that matter. City Attorney Canlas advised that certain areas of the beach in front of the Hotel del Coronado, while mostly private, is under multiple jurisdictions, and as such, depending on where the beach fire activities occur, the City may or may not be able to enforce restrictions.

Councilmember Duncan asked what restrictions, if any, were in effect on the state beaches located in Coronado. Ms. Maples replied that the state beaches allowed for wood-burning or charcoal fires in state-provided fire rings only.

Mayor Bailey asked what the volume of the complaints regarding beach fires was between May and September. Police Captain Dusting Külling replied that the Police Department receives reports from the security service daily, mostly regarding alcohol or glass bottles and burning materials. Captain Külling noted that the police department would intervene if called, but that the hired security personnel do most of the enforcement.

Councilmember Duncan asked for the scope of work of the security contractor performed and their location on the beach. Captain Külling replied that the contractor begins their shift near the entrance to the fire pits to inspect what materials are being burnt, and then begins a walking patrol once the fire pits are filled up.

Sharon Lapid provided comments regarding the impact of smoke on residents of the Shores.

Amy Steward provided comments regarding the environmental impact of fires, dumped refuse materials, and requested that the fires be limited to north beach.

Tricia Trowbridge provided comments regarding the impact of smoke on residents of the Shores and requested that the fires be limited to north beach.

Terry Zack provided comments regarding the environmental impact of wood-burning fires.

Ethyanne Ochoa provided comments regarding the heal impact of beach fires near the Shores.

Yvonne Ochipinti provided comments regarding the impact of beach fires on quality of life.

Jan Yanda requested that the Council consider only allowing wood-burning or charcoal fires in City-provided fire rings or a prohibition of all wood-burning, charcoal, and propane fires.

Andrew Corley provided comments regarding the effects of beach fires on air quality and asked if the City could discuss beach fire activities in front of the Hotel del Coronado at a future meeting.

Councilmember Tanaka asked if any residents from the Shores have contacted the Hotel del Coronado regarding beach fires. Mr. Corley replied that he was unaware of any such efforts but would work with residents to do so.

Discussion ensued regarding the narrow shoreline of south beach compared to north beach, benefits of allowing beach fires, the possibility of adding more fire rings to north beach, smokeless fire pits, clarity and enforcement of the policy.

10c. REPORT ON THE FREE SUMMER SHUTTLE PROGRAM
Richard Grunow, Director of Community Development, Redevelopment Services and Housing, presented this item utilizing a PowerPoint presentation.

Councilmember Donovan asked why the ridership data for September was much lower than other months. Mr. Grunow responded that the shuttle service only runs for the first few days of September.

Brad Gerbel provided comments regarding the time that it took for the report to be generated, lack of passenger counts on bus ridership, the high cost to rider ratio of the program, and noted that the City did not pursue grants to assist with funding the service.

Councilmember Tanaka commented on the pre-Covid ridership counts and reimagining the vehicle wraps to be more enticing and encourage ridership. Councilmember Tanaka further proposed that the shuttle service run from July 1 through September 2 from 9 a.m. to 8 p.m. and cited his support to see the program run for another year.

Mayor Bailey asked if the City had approached the Old Town Trolley Tour company to inquire if their vehicles could be used instead of a bus. Mr. Grunow replied that staff had not contemplated that option.

Councilmember Donovan asked if the City had a projected cost for the service in 2024.

Mr. Grunow estimated between $200,000 to $230,000 if the service duration was kept at the same level as previous years. Councilmember Donovan noted his support to continue the service for at least another year and supported a reduction in hours and service length.

Councilmember Downey stated her support for the service and noted that the Metropolitan Transit Service currently has nine electric buses, and they will be expanding their fleet of electric vehicles in the future and suggested the installation of automated counters to assist with gathering ridership data.

Discussion ensued regarding the cost per rider, increased cost of the service per year, information gathered from MTS compared to independent data gathering, service to the City of Coronado Page 12

Cays, and the possibility of data becoming skewed with the Circuit shuttle acting as a competing service.

A motion to receive the report and reduce the operation of the Free Summer Shuttle to run from July 1 through September 2 with operating hours from 9 a.m. to 8 p.m. was made by Councilmember Tanaka and seconded by Councilmember Duncan.

REVIEW THE RECOMMENDATIONS OF THE CULTURAL ARTS COMMISSION TO INSTALL

NONPROFIT ORGANIZATION BANNERS ON THE ORANGE AVENUE CORRIDOR STREET LIGHT POLES APRIL 1 THROUGH JUNE 15, 2024
RECOMMENDATION:

Approve the recommendations of the Cultural Arts Commission to install banners for the League of Wives Memorial Foundation and the Coronado Chamber of Commerce and Coronado Schools Foundation 2024 Art and Wine Festival from April 1 through June 15, 2024.

BACKGROUND:

The Orange Avenue Street Banner Program was initiated in 2016 and is funded through an annual Discover Coronado Community Enhancement Grant. Recently Discover Coronado approved a grant for $36,000 to fund the banner program through FY2025. Banners are displayed on the Orange Avenue corridor from First Street to Avenida de las Arenas. In 2018 the banner program introduced two of five series open to local nonprofit organizations seeking to display banners highlighting their organizations along Orange Avenue either from September through Thanksgiving or January through March. The 2018 National Citizen Satisfaction Survey polled Coronado residents and nearly 80 percent of respondents support the display of the banners on a year-round basis. At the December 2023 City Council meeting the nonprofit schedule was modified to invite the League of Wives Foundation to participate in the program in conjunction with the presentation and dedication of the public art piece commemorating the founding of the League of Wives.

The purpose of the program is to accentuate the City’s main thoroughfare, welcome citizens and visitors to Coronado’s main street, and to celebrate Coronado traditions including holidays, events and activities. The City limits and regulates banners to maintain safe and effective travel through the City and avoid over-commercialization. Goals of the program include adding color, excitement and a festive look to Orange Avenue, celebrating cultural and civic events and promoting Coronado traditions.

The program is administered by the Coronado Cultural Arts Commission and the City Manager’s Office. A Banner Committee, comprised of representatives from the Cultural Arts Commission, Coronado MainStreet and Discover Coronado review and recommend to the Cultural Arts Commission all banner designs and updates to the program. In turn, the Cultural Arts Commission presents recommendations to the City Council for final decisions regarding the banner program.

ANALYSIS:

The Cultural Arts Commission identified local non-profit organizations who are having significant events this spring. The Coronado Chamber of Commerce and the Coronado Schools Foundation are hosting the Third Annual Coronado Art & Wine Festival on Saturday, May 11, 2024. This community street festival celebrates local artists and local businesses through artists booths, wine tasting, live music, and an array of science, technology, engineering and mathematics (STEM) activities for kids.

The League of Wives Foundation has been working diligently to complete their fundraising efforts and gift of public art to the City of Coronado. The presentation and dedication of this artwork is tentatively scheduled for June 2024. The banners will highlight Coronado as the birthplace of the League of Wives as well as the notable addition of the statute to Coronado’s public art collection.

The Cultural Arts Commission considered the recommendations at a special meeting on February 20, 2024 and unanimously recommended the attached designs for display from April 1 through June 15, 2024. Installation will include three designs for each nonprofit on 15 poles for this series.

FISCAL IMPACT:

The Banners on Orange Avenue are funded entirely by a grant from Discover Coronado. This includes banner production and installation. Applicants are responsible for providing camera ready art at their expense. The cost to produce and install a new series of 60 banners on 30 poles is approximately $6,000.

ALTERNATIVE:

The City Council could choose to not accept the Cultural Arts Commission recommendation and provide different direction to staff.

RESOLUTION TO EXTEND A LOCAL EMERGENCY DECLARATION DUE TO THE

DISCOVERY OF CAULERPA PROLIFERA IN THE CORONADO CAYS
RECOMMENDATION:

Adopt the Resolution to extend a local emergency declaration due to the discovery of Caulerpa prolifera.

BACKGROUND:

On September 21, 2023, an approximately 24 square meter patch of Caulerpa prolifera was discovered growing underneath and adjacent to boat docks along the eastern edge of Antigua Village within the Unified Port of San Diego’s (Port) jurisdictional waters of the Coronado Cays during pre-construction underwater surveys associated with the Antigua Village Dock Replacement project. Surveys conducted subsequent to the initial discovery have revealed approximately 0.25-acres of additional Caulerpa prolifera infestations on the north side of Antiqua Village and within City of Coronado jurisdictional waters.

Caulerpa prolifera can expand aggressively if left untreated and displace native habitats including the 1,900 acres of eelgrass habitat in South San Diego Bay. Any impacts to eelgrass could threaten numerous other species including 70 different fish species and 60-80 federally listed green sea turtles that rely on eelgrass as foraging and resting habitat.

The threat to sensitive marine habitats and species posed by Caulerpa prolifera prompted the City of Coronado and the Port to declare local emergencies in November 2023. The emergency declarations also satisfied conditions necessary to access state and federal grant funding to complete additional underwater surveys and initiate eradication efforts. Pursuant to state law, the City’s local emergency declaration will expire on March 16, 2024 unless extended by the City Council.

ANALYSIS:

City staff has continued to work with partner agencies and stakeholders as part of the Southern California Caulerpa Action Team (SCCAT) to identify funding opportunities and to develop an eradication plan. Since the November 2023 City Council emergency declaration, a total of $850,000 in grant funding has been secured, including a $500,000 allocation from the State Water Resources Control Board (SWRCB) Cleanup and Abatement Account and $350,000 from the U.S. Fish and Wildlife Invasive Species Grant Program. While these grant awards are significant and will allow additional surveys and initiation of eradication efforts, it is anticipated that the total project cost will exceed $1.2 million and could escalate if additional areas of infestation are identified.

Extending the local emergency declaration would allow the City and partner agencies to continue to pursue other sources of grant funding while also recognizing that the Caulerpa infestation in City waters remains a threat until it is successfully treated and eradicated.

CORONADO, CALIFORNIA, EXTENDING A DECLARATION OF

A LOCAL EMERGENCY DUE TO THE DISCOVERY OF

CAULERPA PROLIFERA IN THE CORONADO CAYS AND

DETERMINING THAT THE PROJECT IS CATEGORICALLY

EXEMPT UNDER CALIFORNIA ENVIRONMENTAL QUALITY
ACT GUIDELINES SECTION 15307
WHEREAS, the California Emergency Services Act, including but not limited to Government Code section 8630 and Coronado Municipal Code Chapter 2.50, empowers the City Council to proclaim the existence or threat of a local emergency; and WHEREAS, on Thursday, September 21, 2023, an approximately 24-square-meter patch of Caulerpa prolifera was discovered growing underneath and adjacent to boat docks along the eastern edge of Antigua Village within Unified Port of San Diego jurisdictional waters in the Coronado Cays, and subsequent surveys have revealed additional infestations within City of Coronado jurisdictional waters; and
WHEREAS, while Caulerpa prolifera is not harmful to humans, it is highly invasive with the ability to rapidly expand and harm native habits and sensitive native species; and WHEREAS, South San Diego Bay is home to 1,900 acres of eelgrass which could be overgrown and displaced by Caulerpa and impact the Bay’s 70 fish species and 60-80 threatened green sea turtles which reside in or forage on eelgrass; and WHEREAS, since the discovery, staff has been working diligently with the Southern California Caulerpa Action Team (SCCAT) consisting of state and federal agencies to develop and implement an immediate response plan to prevent further infestation of this algae; and WHEREAS, on October 9, 2023, the infestation of Caulerpa prolifera found in the Coronado Cays within Port jurisdiction, was treated by the placement of a benthic barrier to prevent the spread of the algae; and
WHEREAS, additional Caulerpa prolifera surveys were conducted from October 6 through October 25, 2023, which identified additional Caulerpa prolifera infestations within City jurisdictional waters in the Coronado Cays; and

WHEREAS, significant funding will be required to determine the extent of the Caulerpa prolifera infestation in San Diego Bay and for the eradication of the Caulerpa prolifera found to date; and
WHEREAS, the State Water Resources Control Board (SWRCB) Cleanup and Abatement Account has up to $500,000 in funds to support the eradication efforts and the additional surveys that are required to determine the extent of the algae infestation; and WHEREAS, City staff has been informed that a local emergency declaration is required in order to secure funding through the SWRCB Cleanup and Abatement Account; and WHEREAS, The Coronado City Council adopted a Resolution to Declare a Local Emergency on November 21, 2023 and subsequently extended the declaration for another 60 days on January 16, 2024.

WHEREAS, The Emergency Declaration is set to expire on March 16, 2024 unless further extended by the City Council; and
WHEREAS, The Caulerpa prolifera infestation in City waters will continue to pose a threat to sensitive marine habitats and species until eradication efforts have been successfully completed; and
WHEREAS, based on the facts recited hereinabove and detailed in the corresponding agenda report, the existing and threatened conditions to cause extreme peril to the safety of property within the City’s jurisdiction caused by Caulerpa prolifera; the existing and threatened conditions are, or are likely to be, beyond the control of the services, personnel, equipment, and facilities of the City, and may require the supplemental efforts and available resources of other local government entities, the state and/or federal government, and/or disaster relief organizations to help alleviate the damage, loss, hardship, or suffering caused thereby.

NOW, THEREFORE, BE IT RESOLVED that a local emergency now exists based on the discovery of invasive Caulerpa prolifera algae in Coronado Cays waterways; and BE IT FURTHER RESOLVED that the City Council of the City of Coronado hereby determines that this activity is categorically exempt from environmental review pursuant to Section 15307 of the California Environmental Quality Act Guidelines, Class 7 because the project consists of actions taken by regulatory agencies as authorized by state law or local ordinance to assure the maintenance, restoration, or enhancement of a natural resource where the regulatory process involves procedures for protection of the environment; and City of Coronado Page 58

BE IT FURTHER RESOLVED that during the existence of said local emergency the powers, functions, and duties of the emergency organization of this City shall be those prescribed by state law, ordinances, and resolutions of this City, and approved plans of the City of Coronado in order to mitigate the effects of this local emergency, including the receipt, processing, and coordination of all inquiries and requirements necessary to obtain available state and federal assistance.

AUTHORIZE THE CITY MANAGER TO EXECUTE A ONE-YEAR LICENSE AGREEMENT

BETWEEN THE UNITED STATES NAVY AND THE CITY OF CORONADO FOR THE USE OF

BAYFRONT PROPERTY AND SUBMERGED LAND IN FRONT OF THE CLUBROOM AND

BOATHOUSE
RECOMMENDATION:

Authorize the City Manager to Execute a License Agreement Between the United States Navy and the City of Coronado for a portion of the Glorietta Bay front and find the project exempt pursuant to CEQA section 15304.

BACKGROUND:

The City has maintained a standing agreement with the U.S. Navy for the use of the area in front of the Coronado Boathouse and Clubroom. The current license agreement expires on March 31, 2024.

ANALYSIS:

The license agreement with the U.S. Navy grants the City use of approximately 1.7 acres of beach and water area in front of the Clubroom and Boathouse for public recreation. This area supports numerous recreational operations at the Clubroom and Boathouse, including beach access for events at the venue, instructional programs such as kayaking, stand-up paddle boarding, rowing and fitness classes. Without the license, the City would not longer have access to the area. The license is for a one-year term and expires March 31, 2025.

FISCAL IMPACT:

The City spends approximately $2,500 per year on the maintenance of the Glorietta Bay beach and water area. The U.S. Navy previously used the City’s annual maintenance expenditures to offset the fees assessed for processing the license agreement; however, new regulations from the Navy require an offsetting fee of $4,800 per license which will be charged to the NonDepartmental Permits and Fees account 10012201-80290. Sufficient funding is budgeted annually within the Public Services budget for maintenance activities.

ALTERNATIVE:

The City Council could decide not to authorize the City Manager to execute the license agreement.

1. USE OF AND ACCESS BY LICENSEE. The Licensor grants to the Licensee the right to use the premises or facilities described in block 4 and Exhibit “A” (“Premises”), together with the necessary rights of ingress and egress authorized by the Installation Commanding Officer. Any parking that accompanies the use of, and any routes of access to and from, the Premises are subject to change at the sole discretion of the Installation Commanding Officer.

2. TERM. This License shall be effective for the period stated in block 3 and is revocable at any time without notice at the option and discretion of the Licensor or its authorized representative.

3. USE OF PREMISES. The use of the Premises shall be limited to the purposes specified in block 5, and no other.

6. PROTECTION AND MAINTENANCE OF PREMISES. The Licensee, at its own cost and expense, shall protect, maintain, and keep the Premises under its control in good order. Licensee is responsible for repairing any damage to the Premises caused by Licensee, or its agents, employees, contractors, guests or invitees.

7. IMPROVEMENTS AND RESTORATION. No additions to, or alterations of, the Premises shall be made without the prior consent of the Licensor. Upon revocation or surrender of this License, to the extent directed by the Licensor, the Licensee shall remove all alterations, additions, betterments and improvements made, or installed, and restore the Premises to the same or as good condition as existed on the date of entry under this License, reasonable wear and tear excepted.

8. INDEMNIFICATION.
a. The Licensee releases the Licensor and its employees from liability for death or injury to persons at the Premises. b. The Licensee, to the extent allowed by law, agrees to release and hold the Licensor and its employees harmless from, and to indemnify and defend them against, loss or damage to property caused by or arising from its use of the Premises, regardless of any contributory fault of the Licensor. c. The Licensee shall indemnify and save harmless the Licensor, its officers, agents, servants and employees from, and defend it and them against, all liability under the Federal Tort Claims Act (28 U.S.C. §§ 2671 and 2680) or otherwise, for death or injury to all persons, or loss or damage to the property of all persons resulting from its use of the Premises.

d. The Licensee agrees that the Licensor, its officers, agents and employees shall be released from all liability on all suits, claims, actions or demands in any way related to or arising under the Licensee’s use of the property. This release includes, but is not limited to, all environmental suits, claims, and enforcement actions, whether arising during the Licensee’s construction on or use of the property, or after such use has ended.

 The insurer must be authorized to write insurance in the state where the Premises is located.  Proceeds of policies shall be made payable to “Treasurer of the United States”.  Each policy of insurance covering bodily injuries and third party property damage shall contain an endorsement waiving the insurer’s right of subrogation against the United States of America.  No cancellation, reduction in amount, or material change in coverage shall be effective until at least sixty (60) days after receipt by the Licensor of written notice.
 Notwithstanding the foregoing, any cancellation of insurance coverage based on nonpayment of the premium shall be effective only upon thirty (30) days’ written notice to the Licensor.  The Licensee shall provide proof of insurance to the Licensor throughout the term of this License.

The Licensee will not be allowed entry on the Premises until it first delivers a certificate or certificates of required insurance to the Licensor.

10. DAMAGE TO THE PREMISES.
a. In the event of damage, including damage by contamination, to any Government property by the Licensee, its officers, agents, servants, employees, or invitees, the Licensee, at the election of the Licensor, shall promptly repair, replace, or make monetary compensation for the repair or replacement of that property to the satisfaction of the Licensor. That obligation includes any damage discovered from the physical condition and environmental condition inspections notwithstanding the expiration or earlier termination or revocation of this License. b. In the event that any item or part of the Premises shall require repair, rebuilding or replacement (collectively, “repair”) resulting from loss or damage, the risk of which is assumed under this License, the Licensee shall promptly give notice to the Licensor and, to the extent of its liability as provided in this paragraph, shall either compensate the Licensor for any loss or damage within thirty (30) days of receipt of a statement, or repair the lost or damaged item or items of the Premises, as the Licensor may elect. If the cost of repair exceeds the liability of the Licensee for any loss or damage, the Licensee shall effect the repair if required to do so by the Licensor, and the excess of cost shall be reimbursed to the Licensee by the Licensor within thirty (30) days of receipt of a statement provided that appropriations are available for that purpose. In the event the Licensee shall have effected any repair that the Licensee is required to effect, the Licensor shall direct payment to the Licensee of so much of the proceeds of any Attachment 1

insurance carried by the Licensee and made available to the Licensor on account of loss of or damage to any item or part of the Premises that may be necessary to enable the Licensee to effect the repair. In the event the Licensee shall not have been required to effect the repair, and the insurance proceeds allocable to the loss or damage that has created the need for the repair have been paid to the Licensee, the Licensee shall promptly refund to the Licensor the amount of the proceeds.

11. OFFICIALS NOT TO BENEFIT. No member of, or Delegate to Congress, or Resident Commissioner shall be admitted to any share or part of this License or to any benefit that may arise from it; but this provision shall not be construed to extend to this License if made with a corporation for its general benefit.

12. COVENANT AGAINST CONTINGENT FEES. The Licensee warrants that it has not employed any person to solicit or obtain this License upon any agreement for a commission, percentage, brokerage or contingent fee. Breach of this warranty shall give the Licensor the right to annul this License or in its discretion to recover from the Licensee the amount of that commission, percentage, brokerage or contingent fee in addition to the consideration for this license. This warranty shall not apply to commissions payable by the Licensee upon contracts or sales obtained or made through bona fide established commercial or selling agencies maintained by the Licensee for the purpose of acquiring business.

13. NON-DISCRIMINATION. In connection with the performance of work under this License, the Licensee agrees not to discriminate against any employee or applicant for employment because of race, religion, color, or national origin. Non-discrimination shall include, but not be limited to, the following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The Licensee agrees to post in conspicuous places available for employees and applicants for employment, notices to be provided by the Licensor setting forth the provisions of the nondiscrimination clause. The Licensee further agrees to insert the foregoing provision in all subcontracts for work under this License, except subcontracts for standard commercial supplies or raw materials.

14. APPLICABLE RULES AND REGULATIONS.
a. All activities authorized under this License shall be subject to rules and regulations regarding supervision or otherwise, that may, from time to time, be prescribed by the local representative of the Licensor. b. Upon request, the Licensee shall submit to the Licensor evidence of compliance with local, state, and Federal environmental laws and regulations.

15. FEDERAL FUNDS. This License does not obligate the Licensor to expend any appropriated funds. Nothing in this License is intended or should be interpreted to require any obligation or expenditure of funds in violation of the AntiDeficiency Act (31 U.S.C. § 1341).

16. STORAGE OF TOXIC OR HAZARDOUS CHEMICALS. Storage, treatment, or disposal of toxic or hazardous materials on the Premises is prohibited except as authorized by the Licensor in accordance with 10 U.S.C. § 2692.

Any hazardous materials that the Licensor authorizes the storage, treatment, or disposal of in connection with the use of the Premises shall be identified on a Hazardous Materials List and made a part of this License. Any such approved storage, treatment, or disposal of toxic or hazardous material by Licensee on the Premises shall be strictly limited to that material required or generated in connection with the authorized and compatible use of the Premises and shall be conducted in a manner consistent with the best interest of national defense as determined by the Secretary of the Navy and applicable law and regulations. As and to the extent caused by or attributable to the Licensee, Licensee shall have continued financial and environmental responsibility or liability for any and all direct or indirect consequences of the storage, treatment, or disposal of toxic or hazardous material within the Premises. Licensee will manage, control and dispose of its hazardous waste and hazardous materials in accordance with Federal, state, and local laws. In addition, Licensee shall implement the environmental requirements of applicable facility plans including but not limited to Spill Plans, Emergency Response Plans, and Hazardous Waste Management Plans. Licensor approves the storage, treatment, or disposal of toxic or hazardous materials, the Licensee shall obtain insurance or post a bond in an amount sufficient to cover possible cleanup costs.

17. ENVIRONMENTAL CONDITION OF PREMISES. Exhibit “C”, Environmental Condition of Property, sets forth the existing environmental condition of the Premises as represented by a baseline survey conducted by the Licensor.

Licensee is hereby made aware of the Land Use Controls contained in Exhibit “C” and shall comply with all restrictions set forth therein.
a. Kayak and boating equipment should be kept clean, tidy and properly stored in a storage facility and kept away from the Installation fence.
b. Active nests are protected year round by the Migratory Bird Treaty Act (MBTA). If the project requires tree removal or trimming that may contain active bird nests, the executing agent/contractor will avoid the nesting season and coordinate with the Naval Base Coronado (NBC) Biologist at (619) 545-3703 to ensure that work will not impact birds protected under the MBTA. MBTA Breeding Season occurs between 15 February and 15 September.
c. Avoid impacts to nesting birds in trees and on roof of the property in order to comply with the MBTA.

Licensee will ensure that work avoids impacting birds protected under the MBTA. To avoid impacts, all vegetation removal should be scheduled to occur outside of the general avian breeding season (16 September to 15 February). Prior to the start of maintenance activities, a survey will be performed to identify any bird nests in the vicinity of the project site. If active nests are found, Licensee must contact the NBC Biologist immediately at (619) 545-3703.
d. All trash generated use of property must be contained within covered, secured trash bins that are inaccessible to wildlife and emptied on a regular basis and prevented from overflowing. All exposed food waste or trash generated from food products (e.g.,wrappers, food containers) will be removed from the site on a daily basis to prevent attraction of predators (e.g., American crows [Corvus brachyrhynchos] or commonravens [Corvus corax] and mammalian scavengers such as rats [Rattus sp.], raccoons[Procyon lotor], and skunks [Mephitis mephitis]).

18. JOINT INSPECTION AND INVENTORY REPORT (NON-ENVIRONMENTAL). A Joint Inspection and Inventory Report (JIIR) has been conducted by representatives of the Licensor and the Licensee documenting the condition of the Premises. The report is attached to this License and made a part hereof as Exhibit “D”. The Premises shall be delivered to the Licensee on an "As Is, Where Is" basis, and, as such, Licensor makes no warranty relative to the Premises as to its usability generally or as to its fitness for any particular purpose. Any safety and/or health hazards identified and listed as such in the JIIR shall be corrected at the Licensee’s expense prior to use and occupancy of the relevant portion of the Premises. Such safety and/or health hazards shall be limited to those identified in the JIIR. In the event this License is terminated and the parties have not agreed to enter into a new License, or another agreement, Licensee shall return the Premises to the Licensor in the same condition in which it was received, reasonable wear and tear and Acts of God excepted. Licensee may, at its expense and with prior written approval of the Licensor: (a) replace any personal property with personal property of like kind and utility, (b) replace any personal property in a good and workmanlike manner, and (c) dispose of any worn out, obsolete or nonfunctioning personal property, in accordance with applicable laws and regulations. Licensor shall not unreasonably withhold or delay granting its approval to Licensee’s request for such actions.

19. ADMINISTRATIVE COSTS. At the termination or expiration of this License, at the Licensor’s discretion, Licensee shall be responsible for administrative costs associated with completing a final inspection of the premises and updating the Environmental Condition of Property.

20. NOTICES. Correspondence concerning this License shall be provided to both the Local Representative identified in Block 6a. and the Real Estate Contracting Officer identified in Block 10.

BETWEEN THE UNITED STATES NAVY AND THE CITY OF CORONADO FOR THE SAN

DIEGO BAY TIDELAND MARSH AREA
RECOMMENDATION:

Authorize the City Manager to Execute a License Agreement Between the United States Navy and the City of Coronado for the San Diego Bay Tideland Marsh area and find the project exempt pursuant to CEQA sections 15304 and 15308.

BACKGROUND:

The San Diego Bay Tideland Marsh area, also known as the South Bay Marine Biology Study Area, is an open space area of approximately 16.5 acres located on Silver Strand Boulevard, east of the Navy Radio Receiving Facility in Imperial Beach. The site has served as a San Diego Bay biological study area for over 20 years and provides public parking, wildlife viewing, and access to walking and biking trails. The County of San Diego previously leased the ecological preserve from the United States Navy.

On June 4, 2001, the City of Coronado and the County of San Diego entered into a Joint Exercise of Powers Agreement to facilitate a joint venture between the two agencies for improvements to the area. Under the agreement, the City of Coronado performed work to improve the overlook including stabilization of the bike path, resurfacing and restriping the parking lot, mitigation of weeds, and installing new landscaping, benches, signs and trashcans as well as the construction of a new viewing deck. Completed in 2003, the project resulted in significant improvements to that portion of the Silver Strand and the City determined that it would continue to maintain the area under a license agreement with the Navy. The Navy lease requires the removal of any improvements and restoring the property to its original condition if the City were to surrender the property back to the Navy.

The City is unaware of any agency willing to assume the lease and/or maintenance of the area.

The City entered into a formal license agreement for use and maintenance of the San Diego Bay Tideland Marsh area in 2009. The current license was executed April 1, 2023 and will expire on March 31, 2024.

ANALYSIS:

The license agreement requires the City to ensure the area is free from trash which could cause pollution to the adjacent natural habitats, wetlands, and waters of the San Diego Bay. City expenditures to maintain the overlook are minimal and there is a benefit to keeping the area clean and publicly accessible as the site is home to various native wildlife and plant species. The overlook also allows for access to the scenic biking and walking trails along the Silver Strand. The license agreement is for a one-year term and expires on March 31, 2025.

FISCAL IMPACT:

The City spends approximately $5,250 per year on the maintenance of the overlook area. The U.S. Navy previously used the City’s annual maintenance expenditures to offset the fees City of Coronado Page 73
assessed for processing the license agreement; however, new regulations from the Navy require an offsetting fee of $4,800 per license which will be charged to the Non-Departmental Permits and Fees account 10012201-80290. Sufficient funding is budgeted annually within the Public Services budget for maintenance activities.

ALTERNATIVE:

The City Council could decide not to authorize the City Manager to execute the license agreement.

The Licensee will not be allowed entry on the Premises until it first delivers a certificate or certificates of required insurance to the Licensor.

10. DAMAGE TO THE PREMISES.
a. In the event of damage, including damage by contamination, to any Government property by the Licensee, its officers, agents, servants, employees, or invitees, the Licensee, at the election of the Licensor, shall promptly repair, replace, or make monetary compensation for the repair or replacement of that property to the satisfaction of the Licensor. That obligation includes any damage discovered from the physical condition and environmental condition inspections notwithstanding the expiration or earlier termination or revocation of this License. b. In the event that any item or part of the Premises shall require repair, rebuilding or replacement (collectively, “repair”) resulting from loss or damage, the risk of which is assumed under this License, the Licensee shall promptly give notice to the Licensor and, to the extent of its liability as provided in this paragraph, shall either compensate the Licensor for any loss or damage within thirty (30) days of receipt of a statement, or repair the lost or damaged item or items of the Premises, as the Licensor may elect. If the cost of repair exceeds the liability of the Licensee for any loss or damage, the Licensee shall effect the repair if required to do so by the Licensor, and the excess of cost shall be reimbursed to the Licensee by the Licensor within thirty (30) days of receipt of a statement provided that appropriations are available for that purpose. Any hazardous materials that the Licensor authorizes the storage, treatment, or disposal of in connection with the use of the Premises shall be identified on a Hazardous Materials List and made a part of this License. Any such approved storage, treatment, or disposal of toxic or hazardous material by Licensee on the Premises shall be strictly limited to that material required or generated in connection with the authorized and compatible use of the Premises and shall be conducted in a manner consistent with the best interest of national defense as determined by the Secretary of the Navy and applicable law and regulations. As and to the extent caused by or attributable to the Licensee, Licensee shall have continued financial and environmental responsibility or liability for any and all direct or indirect consequences of the storage, treatment, or disposal of toxic or hazardous material within the Premises. Licensee will manage, control and dispose of its hazardous waste and hazardous materials in accordance with Federal, state, and local laws. Licensor approves the storage, treatment, or disposal of toxic or hazardous materials, the Licensee shall obtain insurance or post a bond in an amount sufficient to cover possible cleanup costs.

All trash generated through use of property must be contained within covered, secured trash bins that are inaccessible to wildlife, emptied on a regular basis, and prevented from overflowing. All exposed food waste or trash generated from food products (e.g., wrappers, food containers) will be removed from the site on a daily basis to prevent attraction of predators (e.g., American crows [Corvus brachyrhynchos] or common ravens [Corvus corax] and mammalian scavengers such as rats [Rattus sp.], raccoons[Procyon lotor], and skunks [Mephitis mephitis]). c. Migratory Bird Treaty Act (MBTA). Active nests are protected year round by the MBTA. Licensee will avoid the nesting season and coordinate with the Naval Base Coronado Biologist at (619) 545-3703 to ensure that work will not impact birds protected under MBTA. MBTA Breeding season occurs between 15 February and 15 September.
d. Botanical: Avoid and/or minimize potential direct and indirect effects to sensitive species and habitats and to avoid and/or minimize the potential introduction and spread of invasive non-native plants.

This action involves a renewal of a 1-Year succeeding lease between the Department of Navy and the City of Coronado for the operation and maintenance of an educational ecological preserve.
