CITY COUNCIL STAFF REPORT
June 4, 2024 {{section.number}}b
INTRODUCTION AND FIRST READING OF ORDINANCE 2024-05 AMENDING THE

CORONADO MUNICIPAL CODE REGARDING CONFLICT OF INTEREST
RECOMMENDATION:

Introduce and conduct the first reading of Ordinance 2024-05 “An Ordinance of the City Council of the City of Coronado, California, Amending Chapter 1.20, Section 1.20.060 (A-J), Section

1.20.070 (A-P), and Section 1.20.080 (A-B) of Title 1 of the Coronado Municipal Code regarding Conflict of Interest.”
BACKGROUND:

Enacted in 1974, the Political Reform Act (PRA) establishes ethical standards for state and local government officials, emphasizing that those in positions of public trust must act ethically and not out of personal economic interest. It compels public officials to disclose any economic interests that could be impacted by their official decisions. According to Government Code Section 87100, no local government official may make, participate in making, or use their position to influence a government decision if they know or should know they have a financial interest in the outcome.

The City’s Conflict of Interest Code identifies which public officials this applies to and, in alignment with the PRA, requires these officials to disclose certain financial interests on Form 700 if those interests could be materially affected by their decisions in their official capacities.

The Political Reform Act mandates that the City adopt a conflict of interest code and review it for amendments no later than October 1 of each even-numbered year. The proposed changes reflect title and organizational changes and clarifying language. These changes ensure that the Conflict of Interest Code remains current and reflective of the latest organizational structure.

ANALYSIS:

This amendment aims to revise Section 1.20.060 (A-J), which pertains to Department Positions, and Section 1.20.070 (A-P), which relates to Boards, Commissions, and Committees and Section

1.80.080 (A-B), which relates to consultants. The modifications to Section 1.20.060 are intended to update the titles of positions and their departmental assignments as aligned with the Fiscal Year 2024-25 adopted budget. The adjustments in Sections 1.20.070 and 1.20.080 are meant to clarify when the section should be updated.

The complete Conflict of Interest Code is attached with these amendments. Revisions and additions are highlighted in red type, while deletions are indicated with a line through the text.

FISCAL IMPACT:

The addition of filers has no fiscal impact to the City.

ALTERNATIVE:

The City Council may decline any or all of the proposed amendments.

CALIFORNIA ENVIRONMENTAL QUALITY ACT:

Not Applicable.

PUBLIC NOTICE:

In lieu of publication of the ordinance in its entirety, the City Clerk will publish a summary of the ordinance a minimum of five days prior to adoption, and again within 15 days after adoption of the ordinance.
